SECTION 2 ELIGIBILITY CRITERIA 1. The bidder should have existence in Mumbai/Navi Mumbai/Thane for minimum period of 5 years. (Enclose copy of Certificate of Incorporation/Registration Certificate of the firm.) 2. Enclose copy of PAN CARD of the firm. 3. Enclose Bidder's Information. Annexure A1. 4. The bidder must not be blacklisted/suspended or any service related dispute with any organisation/govt. Organisations/ Bank in India or out side India. Annexure A2. 5. The bidder should accept RFP Terms & Conditions Annexure A3. 6. The bidder must have experience of having executed similar contract for providing pathalogy services with various Hospitals (comparable large trusts) during last five years of collecting hospital samples for testing and reporting. Enclose copy of atleast 3 work orders and their completion certificates. Annexure A4. 7. The bidder should have Annual Business Turnover of minimum 50 lacs for the last two Financial years i.e. 2012 13 & 2013 14. Annexure A5. (Enclose copy of Audited Annual Accounts for the last two years). 8. The bidder should have submitted filed ITR for last two years i.e. A.Y. 2013 14 & A.Y. 2014 15. Annexure A5. SUBMISSION OF OFFER: SECTION 3 INSTRUCTIONS TO BIDDERS 1. The Quotation MUST BE ENCLOSED IN A SEALED COVER superscribing Tender number / due date & should reach the undersigned on or before due date mentioned in the tender notice. If the quotation cover is not sealed, it will be rejected. 2. Tender should be dropped in the tender box kept in the office of concerned Department. No tender is to be handed over to our staff personally unless otherwise specified. All communications are to be addressed to the undersigned only. In case due date happens to be holiday the tender will be accepted and opened on the next working day. 3. The bid can be submitted in person or through post/ courier (IIT Bombay shall not be responsible for any postal delays or any other reason for not submitting the bid in the specified time and resulting in disqualification / rejection of any bid) so as to reach on or before the due date and time. 4. The leaflets catalogue, etc. should be sent invariably so that a proper evaluation of the equipment offered is possible. COMMERCIAL BID : Quoting of Price (s) : Price quoted should be in Indian Rupees. Bidders are requested to quote for all items mentioned. Quantity : The quantity shown in the tender can be increased or decreased to any extent depending upon the actual requirement. BID OPENING PROCESS: The Technical Bid will be opened in the first instance in the presence of representatives of the bidders at IIT Bombay. Financial bids of only those bidders, whose bids are found technically qualified, by the Technical Evaluation Committee, will be opened in the presence of the vendor s representatives subsequently at a later date for further evaluation. One authorized representative of each of the bidder would be permitted to be present at the time of aforementioned opening of the bids. The authorized representative of bidders, present at the time of opening of the bids shall be required to sign an attendance register as a proof of having attended the commercial bid opening. The bidder's name, bid prices, discounts and other appropriate details will be announced at the time of opening of the commercial bids. CANCELLATION OF TENDER: 1. Not withstanding anything specified in this tender document, Purchaser / IIT Bombay in his sole discretion, unconditionally and without having to assigned any reasons, reserves the rights: a) To accept OR reject lowest tender or any other tender or all the tenders. b) To accept any tender in full or in part. c) To reject the tender offer not confirming to the tenders terms. d) To give purchase preference to Public Sector undertakings when applicable as per Govt. LATE BIDS : IIT Bombay will not be responsible: i) For delayed / late quotations submitted / sent by post / courier etc. ii) For submission / delivery of quotations at wrong places other than the mentioned in the tender. iii) Fax / E mail / Telegraphic / Telex tenders will not be considered. iv) Any bid inadvertently received by IIT Bombay after the deadline i.e. due date & time for submission of bids, will not be accepted and returned unopened to the BIDDER. VALIDITY OF THE OFFER : 180 Days from the date of opening of the Technical bid. TRANSFER AND SUBLETTING : The seller shall not sublet, transfer, assign or otherwise part with the acceptance to the tender or any part thereof, either directly or indirectly, without the prior written permission of the Purchaser. EVALUATION OF OFFER : 1. IIT Bombay evaluate technical and commercial acceptable offers on landed net Price basis. 2. Offer which deviates from the vital conditions (as illustrates below) of the tender shall be rejected: a) Non submission of complete offers. b) Receipt of offers after due date and time and or by email / fax (unless specified otherwise). c) Receipt of offers in open conditions. 3. In case any BIDDER is silent on any clauses mentioned in this tender documents, IIT Bombay shall construe that the BIDDER had accepted the clauses as per the invitation to tender no further claim will be entertained. 4. No revision in the terms and conditions quoted in the offer will be entertained after the last date and time fixed for receipt of tenders. 5. In case of two bid system the date and time of Price Bid opening shall be intimated to technically qualifying bidders only. DEADLINE FOR SUBMISSION OF BIDS : Bids must be received by IIT Bombay before the due date and time at the address specified in the tender document. In the event of the specified date for the submission of bids being declared as a holiday for IIT Bombay the bid closing deadline will stand extended to the next working day up to the same time. COST OF BIDDING : The Bidder shall bear all costs associated with the preparation and submission of its Bid and the Purchaser shall not be responsible or liable for those costs regardless of the conduct or outcome of the bidding process. AMENDMENT OF BIDDING DOCUMENTS : At any time prior to the deadline for submission of bids,iit Bombay may, for any reason, whether on its own initiative or in response to the clarification request by a prospective BIDDER may modify the bid document. All prospective BIDDER who have downloaded the bidding document may visit IIT Bombay, website for amendments / modifications which will be binding on them. MMD, IIT Bombay Page No.7 o f 17
SECTION 4 SCOPE OF WORK Successful bidder shall arrange to have its technician available at IIT Bombay Hospital by 08.00 am. Bidder's technician shall draw samples from IPD & OPD patients from 08.00 am to 09.30 am on daily basis except Saturdays, Sundays & Holidays. However in case of emergency, bidder shall also arrange to collect the samples drawn by IIT Bombay's technicians as per hospital requirement. The bidder should arrange for safe and proper transportation to its laboratory located in Mumbai/Navi Mumbai/Thane. It is mandatory that all tests are carried out at own laboratory. The collection of samples & delivery of the reports will be the responsibility of the bidder. In case of loss of or damage to any sample collected, it will be the bidder's responsibility to report the same to IIT Bombay Hospital without delay and the bidder will have to arrange for immediate collection of another sample. The bidder shall be required to forward the soft copy of the reports on same day of collection vide e mail and deliver the printed reports within 24 hours of collection in case of routine tests. For tests where 24 hours reporting is not possible, printed reports should be delivered within minimum time schedule. The bidder shall carry out tests as per the request of the IIT Bombay's Hospital Doctors. The tests shall be advised for the patients by IIT Bombay's hospital doctors proper recommendation. The results of any test should not be disclosed to any person/agency other than IIT Bombay Hospital's authorised doctors. Any disclosure will amount to breach the contract. The bidder shall carry out the test as per the re quest of IIT Bombay hospital doctors though a Credit Referral Note given by IIT Bombay Hospital office. MMD, IIT Bombay Page No.8 o f 17
SECTION 5 TERMS AND CONDITIONS AWARD OF CONTRACT : 1. Evaluation shall be carried out as per the tests and quantities under Section Commercial Bid. The list is only for the purpose of evaluation. The successful bidder required to provide the entire list of tests mentioned in commercial bid. 2. Only one technically qualified L1 bidder shall be selected for rate contract. 3. L1 supplier will be calculated on total approximate annual quantity multiplied by per unit test amount. 4. The Empaneled bidder will be abide by all the Terms & Conditions of the Tender Document. 5. The qualified bidders will be empaneled initially for the period of one year and maybe extended further for two years subject to annual revision, if their performance found satisfactory. 6. The services of the empaneled bidder's will be reviewed by committee during contract period and IITB reserve right to add or delete bidders in rate contract based on performance if necessary without intimation. 7. If more than one BIDDER happens to quote the same lowest price, IIT Bombay reserves the right to award the contract to more than one BIDDER or any BIDDER. 8. IIT B reserve right to award for all tests or part of it. EARNEST MONEY DEPOSIT & SECURITY DEPOSIT : While submitting bid, the BIDDER shall deposit an amount mentioned in tender document as Earnest Money, with the IIT Bombay through the following instruments: 1. Earnest Money Deposit (EMD) of Rs. 80,000/ (Rs. Eighty Thousand Only) in the form of Demand Draft in the favour of 'The Registrar, IIT Bombay' payable at Mumbai to be submitted in Technical Bid. Failing which, submitted bid will be Rejected. 2. The Earnest Money shall be valid upto a period of 180 days or the complete conclusion of the contractual obligations to the complete satisfaction of both the BIDDER and the BUYER, including warranty period, whichever is later. 3. No interest shall be payable by the BUYER to the BIDDER on Earnest Money for the period of its currency. 4. For successful bidder, EMD will be converted to security Deposit and will be retained with IIT Bombay till the expiry / termination of rate contract without interest. 5. Security deposit shall be released after successful completion of the contract subject to compliance and settlement of all outstanding dues. TERMS OF PAYMENT : The bills is to be submitted on monthly basis for payment to Chief Medical Officer, IIT Bombay Hospital. The bills must be supported by original Credit Referral Note issued by IIT Bombay Hospital Doctors. Payment within 30 days from the date of submission of bill completed in all respects MMD, IIT Bombay Page No.9 o f 17
as mentioned above. Payment shall be made by Cheque or such other mode / electronic fund transfer offered by the Bank. PENALTY : In the event of any breach of any of the terms & conditions of the contract or bidder neglects, delays or fails to perform the contract, IIT Bombay shall be levy and recovered penalty subject to maximum of 5% of total monthly bill. And also reserves rights to forfeit the security deposit. FORCE MAJEURE : Force Majeure will be accepted on adequate proof thereof.
