Club and Organizatin Cnduct Prcedures Purpse The purpse f the Student Cde f Cnduct ( Cde ) is t maintain the general welfare f the University cmmunity and supprt cmmunity safety and student grwth by helping students. The University strives t make the campus cmmunity a place f study, wrk, and residence where peple are treated with respect and civility. The University views the student cnduct prcess as a learning experience that can result in grwth and persnal understanding f ne's respnsibilities and privileges within bth the University cmmunity and the greater cmmunity. The UCCS Student Cde f Cnduct gverns bth individual and rganizatinal behavirs. This dcument serves as a supplement t the Student Cde f Cnduct and utlines the prcedures fr addressing any alleged vilatins invlving clubs and rganizatins, including fraternities and srrities. Jurisdictin All University f Clrad at Clrad Springs (UCCS) student clubs and rganizatins are required t uphld federal, state, and lcal gvernment laws, as well as University plicies and prcedures. Furthermre, fraternities and srrities are required t cmply with the Standards fr Natinal Fraternities and Srrities at UCCS. The Club and Organizatin Cnduct Prcess is facilitated by the Department f Student Life in cnjunctin with the Office f the Dean f Students. The apprpriate Student Life Directr (r designee) will versee the prcess. The Club and Organizatin Cnduct Prcedures apply t all registered and recgnized student clubs and rganizatins, including fraternities and srrities. Any student club r rganizatin can be held respnsible fr its actins f ne f mre f its members (active r inactive). There is nt a minimum number f grup members wh must be invlved in an incident befre disciplinary actin may be taken against the club r rganizatin. In sme instances, the cnduct f a single member may prvide sufficient grunds fr actin against the entire club r rganizatin. A student club r rganizatin may be subject t cnduct prceedings when it engages in a vilatin f law, University plicy, the Student Cde f Cnduct, r the Standards fr Natinal Fraternities and Srrities in ne r mre f the fllwing ways: 1. Members f the club r rganizatin act tgether t vilate the Cde f Cnduct; 2. One r mre members, alumni, r guests allegedly vilate the Cde f Cnduct at a club- r rganizatinspnsred, financed, r therwise supprted activity; 3. One r mre members f a club r rganizatin knew that an act cnstituting a vilatin was either ccurring r abut t ccur, and fails t prevent the actin, r fails t reprt it t apprpriate University fficial in a timely manner; 4. A vilatin ccurs n premises and/r transprtatin wned, perated, r rented exclusively by the student club r rganizatin; 5. A pattern f individual vilatins that negatively reflects upn, and cmprmises the status f, the University student club r rganizatin cmmunity has ccurred and/r cntinues t ccur withut adequate cntrl, respnse, r sanctin n the part f the student club r rganizatin, r its leaders; 6. The student club r rganizatin knwingly chse t prtect r cver up ne r mre individual ffenders wh are members, alumni, frmer members, r guests f the student rganizatin frm fficial actins, r members knwingly interfere with a University investigatin; 8. Members f the club r rganizatin vilate a plicy f a related natinal gvernance grup that designates the behavir as being n behalf f an rganizatin. 9. Individual member(s) and/r fficer(s) wh partake in actins that vilate the Cllective Respnsibility Prvisin fund in the UCCS Student Organizatin Agreement, signed at the cmmencement f each academic year. Referrals 1. Sexual Miscnduct and Prtected Class Discriminatin and Harassment: The UCCS Office f Institutinal Equity receives cmplaints f and investigates all allegatins f sexual miscnduct and prtected class discriminatin and harassment. 2. Academic Miscnduct: Cases invlving academic miscnduct are heard thrugh the individual cllege r schl in which the alleged miscnduct ccurred. Individual Miscnduct. Individual students wh may have engaged in miscnduct will be referred t the Office f the Dean f Students. While the prcesses are similar, individual and rganizatinal utcmes and sanctins may vary. Duties and Expectatins f Students All club and rganizatin members are expected t read and be familiar with the Student Cde f Cnduct and the Club and Organizatin Cnduct Prcedures and make a timely reprt f all incidents related t clubs and rganizatins t the Department f Student Life. It is the duty f all students invlved in clubs and rganizatins t participate hnestly and cnscientiusly. Students have a duty t cperate and discuss relevant infrmatin with a cnduct fficer ver the telephne r in persn, adhere t stated deadlines, attend scheduled meetings, participate in all prceedings, and cmplete all sanctins as assigned. Knwingly prviding false r misleading infrmatin during an inquiry r investigatin is a vilatin f the Cde. This prvisin des nt apply t reprts made r infrmatin prvided in gd faith, even if the facts alleged are nt later substantiated. Failure t meet these duties and expectatins may result in a decisin being made withut the benefit f the club r rganizatin members participatin, r it may result in individual students being charged with failing t cmply with the student cnduct prcess. Student Club and Organizatin Cnduct Prcess: 1. Cmplaint Received by Department f Student Life Upn receipt f an allegatin r reprt, the Student Life Directr (r designee) will review the infrmatin t decide whether the allegatins fall within the jurisdictin f this prcess, and render the fllwing preliminary dispsitin: Infrmatin is insufficient, and persnal interviews are cmpleted with ther individuals, including members f the club r rganizatin, wh might have pertinent infrmatin relating t the alleged miscnduct. Infrmatin is sufficient, but reslutin thrugh an infrmal prcess is mst apprpriate based n infrmatin available. Infrmatin is sufficient, and a Reslutin Meeting shuld ccur. Infrmatin is sufficient and behavir des nt cnstitute a plicy vilatin. If the allegatin des nt fall within in the jurisdictin f this prcess, apprpriate referrals will be made. 2. Organizatinal Ntificatin If it is determined that allegatin(s) fall within the jurisdictin f this prcess and there is sufficient infrmatin, the club r rganizatin will be ntified in the fllwing manner: An email ntice shall be sent t the registered fficers f the student club r rganizatin that is the subject f the reprt r cmplaint. If the fficers fail t respnd by the date specified in the email, ther student club r rganizatin members may be cntacted t reslve the matter. The email ntice t the club r rganizatin will include: A descriptin f the alleged miscnduct; The law, University plicy, prcesses, and prcedures, r Standard fr Natinal Fraternities and Srrities that are alleged t have been vilated; The deadline fr scheduling the meeting and the staff member that shuld be cntacted. If a club r rganizatin representative des nt schedule a cnference by the date specified in the email ntice, r if the club r rganizatin representative des nt attend the scheduled meeting, the utcme f the case will be decided in the representative s absence based n the infrmatin available. 3. Reslutin Meeting The purpse f the reslutin meeting is fr rganizatinal representatives t exchange infrmatin abut the alleged vilatin and give the club r rganizatin an pprtunity t respnd. N mre than tw (2) student representatives may attend the Reslutin Meeting withut prir authrizatin. The student club r rganizatin may be accmpanied t the Reslutin Meeting by an advisr. The student rganizatin must prvide the name f the advisr t the Directr (r designee), at least twenty-fur (24) hurs befre the Reslutin Meeting. At n time may the advisr advcate n behalf f the club r rganizatin r participate directly in the prceedings. They may nly cnsult with the students representing the club r rganizatin. Nn-students accused f miscnduct may nt serve as advisrs during the cnduct prcess, regardless f their affiliatin with the rganizatin. Updated and Apprved 3/12/2018 3 P a g e
4. Decisin After the Reslutin Meeting and cnsidering all relevant infrmatin and any mitigating circumstances, the Directr (r designee) will take ne f the fllwing actins using the prepnderance f the evidence standard, meaning that based n the infrmatin available it is mre likely than nt that the cnduct ccurred: It is determined the club r rganizatin did nt cmmit r is nt respnsible fr the alleged vilatin, the cmplaint will be dismissed. It is determined the club r rganizatin cmmitted the alleged vilatin, sanctins shall be impsed. Sanctins shall be impsed by the Office f the Dean f Students, in cnsultatin with the Directr (r designee) determining the finding. The utcme will be emailed t the registered fficers f the student rganizatin and advisr (if applicable). Other members may be cpied as apprpriate. The ntificatin will include the alleged vilatin, the findings and cnclusins, any sanctins the club r rganizatin must cmplete, and the timeline in which sanctins must be cmpleted. 5. Sanctins Sanctins may include, but are nt limited t: Letter f Ntice Infrmal reslutin ptin ntifying the club r rganizatin that the behavir may be cnsidered inapprpriate and infrming members f University plicies, prcesses, r prcedures. May be used t dcument an educatinal cnversatin. Written Warning - A written statement t the club rganizatin leadership that the behavir was inapprpriate and mre serius cnduct actin will be taken shuld similar infractins ccur in the future. Frmal Reprimand A letter f ntificatin placed in the club r rganizatin s file and sent t its natinal rganizatin (if applicable) warning any future vilatins will result in mre severe sanctins. Club r Organizatinal Prbatin Further prhibited cnduct is likely t result in club r rganizatinal suspensin r withdrawal f recgnitin. Student clubs and rganizatins n disciplinary prbatin are nt in gd standing with the University. The club r rganizatin s ability t represent the University thrugh fficial events, serve n University cmmittees r cuncils, access resurces and services, r travel utside f the lcal area may be impacted. Restitutin A club r rganizatin, whse actins cause damage t public r private prperty r injury t anther persn, may be required t prvide mnetary reimbursement fr restratin f r replacement f prperty r fr medical bills related t injuries. Each member f the club r rganizatin may be held financially respnsible thrugh grup billing. Service Requirement May require members f the club r rganizatin t participate in University r cmmunity service activities. Event Restrictins May limit time, place, and manr in which club r rganizatinal events can ccur in rder t prmte sund risk management plicies and practices. Educatinal Requirement May require educatinal prgramming hsted and/r attended by a percentage f the club r rganizatin membership. Suspensin f Registratin/Recgnitin Suspensin f recgnitin as a student club r rganizatin and the privileges inherent in that recgnitin indefinitely r fr a specific perid f time. Suspensin in Abeyance The club r rganizatin s recgnitin is suspended, but due t mitigating circumstances, the suspensin is deferred allwing the club r rganizatin t cntinue activities, thus prviding the club r rganizatin ne final pprtunity t prve it can perate respnsibly within the cmmunity. If the club r rganizatin has any further vilatins during this perid, the suspensin is immediately enacted and additinal sanctins may be placed. Withdrawal f Registratin/Recgnitin Withdrawal f University recgnitin as a student club r rganizatin. 6. Appeal Appeals are heard in accrdance with the Student Cde f Cnduct, Sectin X. Appeals, and must cmply with thse guidelines. An appeal des nt prvide a secnd hearing f the case. A respnding student club r rganizatin may nly appeal the utcme f the Reslutin Meeting if the sanctins are Organizatinal Prbatin, Suspensin f Registratin/Recgnitin, r Withdrawal f Registratin/Recgnitin. The appeal is the final step in the cnduct prcess. If a case is appealed, and unless the welfare f a persn r the cmmunity is threatened, all f the sanctins impsed in the case will nt g int effect until either the deadline fr filing an appeal passes and n appeal is filed r, if a timely appeal is filed, the appeal is decided, whichever cmes first. An appeal must be filed by the date specified in the decisin letter. It is the club r rganizatin s bligatin t prvide all materials that the club r rganizatin wishes t have cnsidered at the time f appeal submissin. Subsequent infrmatin and/r revisins t the appeal will nt be accepted. The Cnduct Appeals Bard will make the decisin as t whether these cnditins have been met. A student may file an appeal by delivering the appeal in persn t the Office f the Vice Chancellr fr Student Success. 7. Expedited Administrative Review and Temprary Suspensins Temprary Suspensin. If it is determined that there is substantial cncern fr the health, safety, r welfare f the members f the University cmmunity, a temprary suspensin may be issued. Ntice t cease all activities will be prvided t the club r rganizatin s president. During this time, the club r rganizatin may nt perate r cnduct any rganizatinal activities, unless expressly permitted in writing by the Executive Directr f Student Life. Operatin under Temprary Suspensin will result in lss f recgnitin. Expedited Administrative Review. If it is determined that a prmpt review is essential (e.g. end f the semester, there is substantial cncern fr the health, safety, r welfare f the members f the University cmmunity), the club r rganizatin s leadership t meet within 48 hurs. In these cases, ntice may be given by telephne r email. If the rganizatinal leadership fails t attend the cnference in the time specified, the utcme will decided in the club r rganizatin s absence.
