INTRODUCTION This document lists all Ontario entities which meet the definition of agency in the Establishment and Accountability Directive. The Directive was approved by Management Board of Cabinet in February 2000 and replaces the former Establishment and Scheduling Directive and the Administration of Agencies Directive. Agencies are assigned by Management Board of Cabinet to a class according to the primary function of the agency. The Establishment and Accountability Directive replaced the former approach to categorizing agencies into one of four Schedules with a system of seven classes of agencies (defined below). The following list of agencies by ministry identifies the former schedule (either I, II, III, or IV) of an agency if the agency had previously been assigned to a schedule. This fills an interim need for determining whether and how a classified agency is subject to any other Management Board of Cabinet directives which may refer to the former system of scheduling agencies. The letter U indicates that the agency was previously unscheduled. A number in brackets after an agency name indicates the number of such agencies. DEFINITION OF AN AGENCY means a provincial government organization (may be known as an agency, board, commission, corporation, etc.):. which is established by the government but is not part of a ministry, which is accountable to the government, to which the government appoints the majority of the appointees, and to which the government has assigned, delegated, etc. authority and responsibility, or which otherwise has statutory authority and responsibility to perform a public function or service CHARACTERISTICS OF AN AGENCY.. the agency is formally established by a statute, by a regulation under an enabling statute, or by an Order-in-Council; and the function performed or service provided by the agency is ongoing and not short-term; and there is a provincial interest in the function or service, most shown by the government s interest in: > the agency s fulfilment of its statutory obligations, > the agency s management of the resources it uses, and > the agency s standards of service; and the government has a direct interest in the agency; namely, the government: > appoints the majority of appointees to the agency; and > may provide 50 per cent or more of the operating funds of the agency, and / or > may give sole authority to the agency to engage in commercial activity and generate revenues, and / or > may own 50 per cent or more of the capital assets of the agency, and / or > may own directly or indirectly 50 per cent or more of the issued and outstanding shares with voting rights of the agency, and / or > may designate or constitute the agency as an agent of Her Majesty the Queen in Right of Ontario. 3

DEFINITIONS OF CLASSES OF AGENCIES Agencies are classified by Management Board of Cabinet according to the agency s primary function as follows: provides ongoing information and / or advice to assist in the development of policy and / or in the delivery of programs. makes independent decisions (including inspections, investigations, prosecutions, certifications, licensing, rate-setting, etc.) which limit or promote the conduct, practice, obligations, rights, responsibilities, etc of an individual, business or corporate body. makes independent quasi-judicial decisions, resolves disputes, etc on the obligations, rights, responsibilities, etc. of an individual, business or corporate body against existing policies, regulations, and statutes, and /or hears appeals against previous decisions. delivers goods or services to the public usually with no, or only minimal, fees. sells goods or services to the public in a commercial manner (including, but not necessarily, in competition with the private sector). solicits, manages, and distributes donations of money and / or other assets donated for a named organization in whose interests the Foundation has been established. In this Directive, Crown Foundation includes only a foundation established under the s Act or under the University Foundations Act. Trust administers funds and / or other assets for beneficiaries named under statute. 4
