TERMS AND CONDITIONS CIMB-TESCO Spend and Win Tesco Voucher Campaign (1 January 2018 28 February 2018) The Campaign 1) The CIMB-TESCO Spend and Win Tesco Voucher Campaign ( Campaign ) is organised jointly by CIMB Bank Berhad (13491-P) ( CIMB Bank ) and Tesco Stores (Malaysia) Sdn Bhd (521419-K) ( Tesco ), and shall run from 1 January 2018 to 28 February 2018 both dates inclusive ( the Campaign Period ). 2) CIMB Bank reserves the right to change the duration and/or the commencement and/or expiry dates of the Campaign Period by giving fourteen (14) calendar days prior notice. Eligibility Criteria 3) This Campaign is open to all principal cardholders of CIMB Bank debit card, credit card and/or prepaid card issued in Malaysia except CIMB Platinum Business Card and CIMB Partners Credit Card ( Participating Card(s) ) and maintained in CIMB Bank s record ( Eligible Participant(s) ). Note: CIMB Partners Credit Card is issued under CIMB Bank s Strategic Card Alliance Program (SCAP) provided to CIMB Bank's merchant partner as value added benefits and services to increase, retain and strengthen business relationship. SCAP's privileges and card benefits are from the merchant partner to their agents, dealers or franchisee only. 4) The following categories of persons are not eligible to participate in this Campaign:- i. Permanent, contract and/or temporary staff or employees of *CIMB Group of Companies and their immediate family members (i.e. spouses, children, parents, brothers and sisters); and/or ii. Representatives and/or agents (including advertising and promotion agents) of CIMB Bank, VISA Worldwide Pte. Limited a company registered in Singapore, having its office at 30, Raffles Place, #10-00, Chevron House, Singapore 048622 ( VISA ) (including its respective subsidiaries and related companies) and Mastercard Worldwide, a company organized under the State of Delaware, having its office and principal place of business at 2000 Purchase Street, Purchase, New York, NY 10577-2509, United States of America ( Mastercard ) (including its respective subsidiaries and related companies). * CIMB Group of Companies means the groups of companies/legal entities of which CIMB Group Holdings Berhad, being the ultimate holding company of CIMB Bank has a controlling interest, directly or indirectly, either by itself or through its subsidiaries.
Campaign Mechanics 5) To participate in this Campaign, the Eligible Participant(s) must make a minimum spending of Ringgit Malaysia One Hundred and Eighty Eight (RM188.00) in a single receipt using their Participating Card(s) during the Campaign Period ( Minimum Retail Spend ) at any Tesco Stores in Penang ( Eligible Transaction ) 6) Subject to the Selection Process as stated in Clause 14 of these terms and conditions, Eligible Participant(s) who fulfilled the Minimum Retail Spend shall be entitled to one (1) RM20 Tesco cash voucher ( Cash Voucher ). If the Eligible Participant(s) performs Eligible Transaction that not only meets but also exceeds the Minimum Retail Spend, for example RM500 in the same single receipt, subject to the Selection Process as stated in Clause 14 of these terms and conditions, the Eligible Participant(s) will only be entitled to one (1) Cash Voucher. 7) Subject to the Selection Process as stated in Clause 14 of these terms and conditions, the Cash Voucher given out under this Campaign is limited and capped at ten thousand (10,000) Cash Vouchers and will be awarded on a first come first serve basis. For the avoidance of doubt, the Eligible Participant(s) will not be entitled to the Cash Voucher once the available ten thousand (10,000) Cash Vouchers are given out. 8) Subject to the Selection Process as stated in Clause 14 of these terms and conditions, the Eligible Participant(s) is entitled to receive more than one (1) Cash Voucher so long as the Minimum Retail Spend is met during the Campaign Period provided each Minimum Retail Spend for the Eligible Transaction is made in different receipts. 9) The Eligible Transaction must be performed at any Tesco stores in Penang. For avoidance of doubt, the following transactions are expressly excluded and shall not be treated as an Eligible Transaction: i) Transaction(s) made on CIMB Bank Platinum Business Card, CIMB Bank Partner Cards and CIMB Bank Fuel Tanker Card; ii) Transaction(s) for payments made towards mail order & telephone order (MOTO); iii) Transactions which are not posted, void, subsequently cancelled or refunded, disputed, unauthorised or fraudulent transactions 10) Any determination by CIMB Bank as to what constitutes an Eligible Transaction shall be conclusive and shall not be challenged in any manner whatsoever, save for manifest error. 11) Eligible Transaction is calculated based on the total consolidated (principal and supplementary/ies) Eligible Participant(s) spending. If the Eligible Participant(s) has multiple credit and debit card
and/or prepaid card accounts, the Eligible Transaction made on all the credit, debit and prepaid card accounts by the principal and supplementary credit, debit and/or prepaid cardholders shall be consolidated and not be viewed individually to meet the Minimum Retail Spend within the Campaign Period. 12) All Eligible Transactions will be automatically tracked by CIMB Bank for the purpose of meeting the Minimum Retail Spend of the Eligible Participant(s). The tracking of the Eligible Transaction(s) is based on the transaction dates and/or time (Malaysian Time) as captured by CIMB Bank s transaction records during the Campaign Period. 13) CIMB Bank shall not be held responsible or liable for any delay in the posting of the Eligible Transaction(s) to the Eligible Participant(s) Participating Cards account and/or error or omission in the posting of the Eligible Transaction(s) due to any reasons whatsoever and howsoever arising including but not limited to the delay on the part of the merchant unless the same is due to the gross negligence and/or willful default of CIMB Bank Cash Voucher Fulfillment Process 14) Subject to these terms and conditions, Eligible Participant(s) who fulfilled the Minimum Retail Spend on Eligible Transaction shall only be entitled to receive the Cash Voucher during the Campaign Period. After the end of the Campaign Period, the Eligible Participant(s) shall be selected based on first 10,000 Eligible Transactions that have met the Minimum Retail Spend, during the Campaign Period ( Selection Process ). 15) Eligible Participant(s) who has been selected pursuant to the Selection Process shall receive the Cash Voucher which will be mailed to the selected Eligible Participant(s) correspondence address maintained in CIMB Bank s record within 12 weeks after the end of the Campaign Period. 16) The Cash Voucher cannot be exchanged for a different prize or reward of similar cost or any other alternatives in any circumstances. At the time of the receipt of the Cash Voucher, the Eligible Participant(s) Participating Card(s) MUST be in good standing and MUST NOT be in breach of any of the terms and conditions governing the Participating Card(s), delinquent, and/or be invalid or cancelled, otherwise the Eligible Participant(s) will be disqualified from receiving the Cash Voucher. General Terms and Conditions 17) By participating in this Campaign, the Eligible Participant(s) is deemed to have read, understood and agreed to be bound by these Terms and Conditions and the decisions of CIMB Bank in relation to
every aspect of the Campaign including the entitlement to the Cash Voucher shall be final and conclusive provided always that the decision made is fairly and reasonably made. 18) By participating in the Campaign, the Eligible Participant(s) also consents to CIMB Bank processing and disclosing their personal data in accordance with the CIMB Group Privacy Notice which can be found at http://www.cimb.com/en/policy.html 19) CIMB Bank shall be entitled at its absolute discretion upon giving prior notice of fourteen (14) calendar days to substitute or replace the Cash Voucher offered under this Campaign with other items of similar or equivalent cost(s) and/or to extend, modify, shorten, discontinue, cancel, terminate or suspend this Campaign. No compensation in cash or any kind shall be given to the Eligible Participant(s) for any loss or damage suffered or incurred by the Eligible Participant(s) as a direct or an indirect result of such substitution or replacement of the Cash Voucher and/or extension, modification, shortening, discontinuation, cancellation, termination or suspension of this Campaign unless the same is due to CIMB Bank s wilful default or gross negligence. 20) Eligible Participant(s) who is entitled to the Cash Voucher under this Campaign agrees and authorises CIMB Bank to disclose his/her details (including but not limited to name, NRIC number, telephone number and address) to the distributor/agent who would then contact him/her regarding the delivery of the Cash Voucher. 21) It shall be the Eligible Participant(s) responsibility to ensure that the correspondence address and mobile telephone number provided and maintained in CIMB Bank s records are current and updated. CIMB Bank reserves the right to forfeit the Cash Voucher in the event the Eligible Participant(s) mobile number maintained in the CIMB Bank s record is invalid and/or not updated. 22) CIMB Bank reserves the right upon giving prior notice of twenty one (21) calendar days to vary (whether by addition, deletion, modification, amendment or otherwise howsoever) ( Amendment ) any of the terms and conditions herein. Notification to the Eligible Applicants in respect of the Amendment, cancellation, termination, suspension of this Campaign or any other notices to be given by CIMB Bank to the Eligible Applicant(s) under this Campaign shall be effected at CIMB Bank s absolute discretion through any one of the following means of communication, namely, by posting a notice regarding the Amendment at each of CIMB Bank s branches or via CIMB Bank s website or by any other means of notification which CIMB Bank may select and the Amendment shall be deemed as binding on the Eligible Applicant(s) as from the date of notification of the Amendment or from such other date as may be specified by CIMB Bank in the notification. Eligible Applicant(s) acknowledges and agrees to access CIMB Bank s website at regular intervals to view these Terms and Conditions and to ensure that he/she is kept up-to-date with any changes or variations to these terms and conditions.
23) No compensation in cash or any kind whatsoever shall be given to the Eligible Participant(s) arising from such variation, deletion, addition or alteration of these terms and conditions and/or the extension, modification, cancellation, suspension or termination of this Campaign. 24) The terms and conditions herein (as the same may be amended from time to time pursuant to Clause 22 shall be read in conjunction with the prevailing terms and conditions governing the Participating Card(s) and shall prevail over any inconsistent terms, conditions, provisions or representations contained in any other promotional materials and advertising in relation to this Campaign. 25) Decision of CIMB Bank and/or CIMB Bank s judges in relation to this Campaign shall, save for manifest error, be final, binding and conclusive. CIMB Bank reserves it absolute rights and discretion to disqualify and/or reject any Eligible Participant(s) that it determines or reasonably suspects to be tampering with the process or the operation of this Campaign, or to be acting in breach of the terms and conditions herein. 26) CIMB Bank shall not be liable to any Eligible Participant(s) or any party for any loss or damage of whatsoever nature suffered by the Eligible Participant(s) or any party save for any loss or damage caused directly by the willful default or gross negligence of CIMB Bank. For the avoidance of doubt, CIMB Bank shall in no event be liable for any loss of income, profits or goodwill, indirect, incidental, consequential, exemplary, punitive or special damages of any party including third party) howsoever arising whether in contract, tort, negligence or otherwise in connection with this Campaign. 27) By acceptance or receipt of the Cash Voucher, the Eligible Participant(s) agrees to hold harmless CIMB Bank and its affiliates and their respective directors, officers, employees and agents from and against any claim, action, proceeding, judgment, damage, loss, expense or liability suffered by CIMB Bank and its affiliates and their respective directors, officers, employees and agents in connection with such Eligible Participant(s) participation in this Campaign or receipt, redemption or use of the Cash Voucher, save for any claim, action, proceeding, judgment, damage, loss, expense or liability caused by the gross negligence or willful default of CIMB Bank. 28) CIMB Bank will not be responsible for any complaint or dispute whatsoever in connection with the use of the Cash Voucher. Any queries or complaints in relation to the use of the Voucher and/or purchase using the Voucher should be referred to Tesco. CIMB Bank is not an agent of Tesco and makes no representation as to the quality of the service provided and/or product(s) sold/supplied by Tesco. 29) CIMB Bank shall not be responsible for any tax implications that may arise from the Cash Voucher or the use thereof. Any tax filling obligation or any tax payment due to any authority as a result of receipt of the Cash Voucher remains the sole responsibility of the Eligible Participant(s). It is the responsibility of each Eligible Participant(s) who is entitled to the Cash Voucher to seek independent advice on the possible implications this may have on his/her own financial situation.
30) If there any inconsistency (ies), conflict(s), ambiguity (ies) or discrepancy (ies) between the Bahasa Malaysia and English version or other language version of these terms and conditions herein, the English version of these terms and conditions shall prevail.
