Lake Crystal Municipal Utilities Beat the Peak Competition Guidelines Lake Crystal Municipal Utilities (LCMU) is conducting the Beat the Peak Competition (the Competition ). LCMU s Beat the Peak Energy Competition aims to reduce the cost of electricity and return some of those savings in the form of cash prizes for those who scored the most competition points. GENERAL PROGRAM DESCRIPTION The Beat the Peak Energy Competition is a voluntary program. There is no cost to participate. LCMU customers can participate in the Beat the Peak Energy Competition as an individual and as part of a team. Either way your goal is the same: reduce your electric usage when LCMU alerts you to reduce and score points by promoting the program. Those who score the most points win cash prizes! ELIGIBILITY To be eligible for the competition, an individual or group must: Be a legal resident of Lake Crystal Be an LCMU (electric) customer Be at least eighteen (18) years of age at time of entry Agree to participate in the LCMU Load Management Program Agree to receive: email, texts, and voice alerts, from LCMU (CodeRED) If you are a non-profit organization, you can set up a team and recruit LCMU residential members to participate. The competition is not open to employees, officers, directors, agents, or representatives of the LCMU, or employees of Heartland Consumers Power District (LCMU s power provider). Limit one entry per household CONTEST PERIOD The competition will begin Monday, May 28, 2018 (Memorial Day) at midnight and end at 11:59 p.m. on Monday, September 3, 2018 (Labor Day). LCMU s computer system is used to govern all computer and time-related aspects of the competition, and among other things, is the time and data-keeping device for the competition.
COMPETITION Participants in the competition can compete as an individual and as part of a team. Individual Competition For the individual competition, LCMU will determine which individuals have scored the most points on a monthly basis (June through August). Scoring will be tracked by LCMU staff throughout the contest period. Scoring for the competition is as follows: o Sign up for Beat the Peak Competition 5 pts o Sign up for Load Management Program 10 pts (required to participate) o Sign up for CodeRED Text/Email/Voice alerts 10 pts (required to participate) o Like the City of Lake Crystal on Facebook 10 pts o Apply for CIP Rebate through LCMU 15 pts o Participant referral (on Beat the Peak Sign Up Form) 15 pts o Reply to one (1) Text/Email/Voice alert 15 pts o Reply to three (3) or more Text/Email/Voice alerts 20 pts o Share a City of Lake Crystal post on Facebook promoting the Beat the Peak Competition (Must tag City of Lake Crystal ) 15 pts/share (limit 1/post) o Post on Facebook promoting the Beat the Peak Competition (Must tag The City of Lake Crystal facebook page) 20 pts/post (limit 3/week) o Letter-to-the-Editor in the Lake Crystal Tribune promoting the Beat the Peak Competition 25 pts (limit 1/edition) Participants in the competition must commit to reducing energy usage during a Beat the Peak event. o Generally, there will be around 5-7 Beat the Peak event days per month. o Each event lasts about 4-5 hours and will likely occur between 4:30 p.m. and 9:30 p.m. o LCMU will notify all participants the day ahead and the day of a Beat the Peak event day. Notifications will include date and time for competition events. o The official notification of events will be by email ant text alerts through LCMU s CodeRED notification system. Team Competition Individuals, during the sign-up process, may choose to sponsor a Lake Crystal school, church or civic organization. The points each individual scores will be attributed to the team they sponsor.
At the end of the competition, the organization (team) with the most points attributed to them will receive a donation from LCMU. HOW TO ENTER Complete an LCMU Beat the Peak Sign Up Packet (available at City Hall, 100 E. Robinson St.), which includes: o Beat the Peak Competition Sign-up Form o Load Management Program Agreement o CodeRED Email/Text/Voice Alerts PRIZES FOR INDIVIDUALS AND TEAMS Individual Competition Each month (June, July, & August), the top three (3) competitors with the most points scored will receive a cash prize of the following: o 1 st place $100 o 2 nd place $50 o 3 rd place $25 *Winners can also take the prize as a credit on their LCMU utility bill. Individual prize winners will be announced by the 10 th business day of the following month (Jul. 16, Aug. 14 and Sep. 17). An individual may only win one prize. Team Competition The team (organization) prize will be based upon the total points scored by its sponsors. The winning team (organization) will receive a $500.00 donation from LCMU. The team prize winner will be announced in September. The cash prize will be paid by September 30, 2018. Load Management Program Referral Incentive An additional $25 can be received when you make a referral of an additional LCMU Electric Customer to the Load Management Program. The person who is referred is also eligible to receive a one-time $25 incentive. The person referred must be a new Load Management Program enrollee. The referral credits will be paid out as a bill credit in the month the load management switch is successfully installed.
WINNER SELECTION Upon notification, the selected entrant must respond by telephone, email, or social media to the contact information provided in the notification, and the selected entrant s response must be received within the five (5) days of the notification. If the selected entrant does not respond within five days, he/she will be disqualified and will not receive a prize that and another entrant may be selected by LCMU (only for that month). LCMU is not responsible for the failure for any reason whatsoever of a selected entrant to receive notification or for LCMU to receive a selected entrant s response. If, as a result of an error relating to the entry process, or any other aspect of the competition, there are more selected entrants than contemplated in these guidelines, at LCMU s sole discretion there will be a random draw from amongst all persons making purportedly valid claims to such prizes after the competition s closing date, to award the correct number of Prizes. Winners will be required to execute a legal release and declaration form that confirms each winner s: o Eligibility for the competition and compliance with competition rules; o Acceptance of the prize as offered; o Release of LCMU s employees, directors, officers, suppliers, agents, sponsors, administrators, licensees, representatives, advertising, media buying and promotional agencies (collectively, the Releasees ) from any and all liability for any loss, harm, damages, cost or expense arising out of participation in the competition, participation in any competition-related activity or the acceptance, use, or misuse of any prize, including but not limited to costs, injuries, losses related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light, or from any and all claims of third parties arising therefrom; and o Grant to LCMU of the unrestricted right, at LCMU s discretion, to produce, reproduce, publish, broadcast, communicate by telecommunication, exhibit, distribute, adapt and otherwise use or re-use the winner s name, photograph, likeness, voice and biography, in any and all media now known or hereafter devised, in connection with the competition and the promotion and exploitation thereof, without payment, compensation or liability to the winner or to their heirs, executors, administrators or assigns. o Winning contestants must complete the Release and Declaration at the time of claiming their prize and within the timeframes described above under Prizes, or the selected entrant will be disqualified and the prize forfeited, without any liability of LCMU whatsoever. Actual receipt by LCMU and not proof of delivery is required. INDEMNIFICATION BY ENTRANT
By entering the competition, entrants agree to release and hold the Releasees harmless from any and all liability for any injuries, loss or damage of any kind to the entrant or any other person, including personal injury, death, or property damage, resulting in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of any prize, participation in the competition, any breach of these guidelines, or in any prize-related activity. The entrant agrees to fully indemnify the Releasees from any and all claims by third parties relating to the competition, without limitation. NON LIABILITY OF RELEASEES The Releasees shall assume no liability resulting from any loss, damage, or claims caused by the awarded prize or the competition itself, any failure of any competition website during the contest period, any problems, human or technical error, printing errors, or prizing error, lost, delayed or garbled data or transmissions, omissions, interruptions, deletions, or any losses or delays, in any mail or courier service, mistaken addresses on mail or e-mail received or sent, typographical errors, technical issues, computer or telephone malfunctions, or technical malfunction of any computer on-line systems, servers, access providers, computer equipment, software, or failure of any e- mail; or the loss or non-recording of any entry or entry form or vote or release to be received on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof, any injury or damage to an entrant or voter, the incorrect or inaccurate capture for any reason of entry information or votes, entries or votes which fail to comply with the competition guidelines, loss or theft of computer or telephone data, damage to software or computer equipment, fraudulent calls, printing, production, distribution, administration, or winner selection errors, any injury or damage to an entrant's or another person s computer, other electronic devices, or software, related to or resulting from uploading or downloading any material in the competition, all of which may affect a person s ability to participate in the competition, or any other mistake or other matter whatsoever. Entry material/data that have been tampered with or altered may be void, as determined in LCMU s sole discretion. PRIVACY In the course of conducting this competition, LCMU will acquire certain personal information as submitted by persons seeking to enter the competition. By participating in the competition, entrants grant to LCMU the right to use his/her name, mailing address, telephone number, and e-mail address ( Personal Information ) for the purpose of administering the contest, including but not limited to contacting and announcing the
winners. INTELLECTUAL PROPERTY All intellectual property, including but not limited to trade-marks, trade names, logos, designs, promotional materials, web pages, source code, drawings, illustrations, slogans and representations are owned by the City of Lake Crystal/LCMU, prize product companies, and/or their affiliates. All rights are reserved. Unauthorized copying or use of any copyrighted material or intellectual property without the express written consent of its owner is strictly prohibited. TERMINATION LCMU reserves the right, in its sole discretion, to terminate the competition, in whole or in part, and/or modify, amend or suspend the competition, and/or the guidelines in any way, at any time, for any reason without prior notice. LAW These are the official competition guidelines or rules. The competition is subject to applicable federal, state and municipal laws and regulations. The rules are subject to change without notice in order to comply with any applicable federal, state and municipal laws or the policy of any other entity having jurisdiction over LCMU. All issues and questions concerning the construction, validity, interpretation and enforceability of the competition rules or the rights and obligations as between the entrant and LCMU in connection with the competition shall be governed by and construed in accordance with the laws of the City of Lake Crystal, including procedural provisions, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction s laws. Any attempt by any person to deliberately undermine the legitimate operation of the competition or any part or parts of the competition may be a violation of criminal and civil laws, and should such an attempt be made, LCMU reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.
