We help our clients resolve these disputes and positively improve the outcomes. Our work in this area involves assisting clients authorised by the Financial Conduct Authority (FCA) in dealing with customer complaints, defending any formal complaints to the Financial Ombudsman Service (FOS) or litigation in the courts, and any supervisory and enforcement action by the FCA itself. We also act for pension scheme trustees in disputes with members and others, and in dealings with the Pensions Regulator. We also assist businesses harmed by financial services the Interest Rate Swap mis-selling scandal being a good example. In addition to our legal expertise, we understand the industry in which our clients operate. We make a point of obtaining formal financial planning and other qualifications so we can better understand the advice they give and the decisions they make. Our team has worked with the regulator, so when it comes to regulatory matters we have invaluable practical experience of its approach to supervisory and enforcement matters. We also act for both claimants and defendants, giving us a deep understanding of the motivations and tactics in play on both sides, something which gives us the edge over other firms. Our aim is to secure the best possible outcomes for our clients with the minimum of fuss, using whatever method is most appropriate in the circumstances, be it the courts, the Financial Ombudsman Service (FOS), the Pensions Ombudsman, mediation or just a good old-fashioned round-the-table meeting. We are recognised for our robust yet commercial approach, in that we fight hard to protect our clients interests whilst always having in mind their bottom line. We can offer flexible fee arrangements including fixed fees in many areas. For litigation in particular we are accustomed to acting under a conditional fee arrangement (CFA) and can provide access to third party funding and after-the-event insurance with a view to removing any costs concerns.

Meet the team Paul Chapman, Managing Director t: 0345 209 1306 e: paul.chapman@clarkewillmott.com Paul is the managing director of the Litigation division and the firm s Compliance Officer for Financial Affairs. He has been a member of the firm s management board since 2010. He is also a partner in the Financial Services Litigation team specialising in professional negligence claims involving financial institutions. Paul has undertaken a wide variety of litigation matters during his twenty year career. This has included a claimant personal injury practice ranging from more straightforward claims to significant injury claims. He has acted for local authorities and insurers in the defence of claims ranging from accidents at work to tree roots claims, local authority search returns and footpath disputes. He has also acted for local authorities as claimants under the recovery of monies due under the National Assistance Act, actions against squatters and planning injunctions. For a period of four years, Paul acted for building societies in various actions against solicitors and surveyors arising out of negligent advice on property transactions. Also, he has undertaken a wide range of construction, commercial and property litigation disputes including dilapidations claims, Landlord and Tenant Act renewals, rent review appeals and professional negligence claims. Philippa Hann Dip PFS, Partner t: 0345 209 1450 e: philipa.hann@clarkewillmott.com Philippa specialises in investment product misselling claims and negligent investment advice. She has particular experience in running group actions on behalf of large numbers of claimants. Philippa holds the Certificate in Financial Planning and the Diploma in Regulated Financial Planning. Philippa is a member of Chartered Institute of Insurers (CII) and is regularly a guest speaker for both the CII and the Institute of Financial Planning (now Chartered Institute for Securities & Investment). She is also a regular contributor for BBC Radio Bristol. She speaks fluent French. Philippa is Clarke Willmott s PR Partner and works closely with our business development and marketing team on firm wide PR matters. Paul has acted in a variety of claims through occupational pension transfers, poor investment advice, mis-selling of bonds, etc. He has completed Financial Planning Certificates 1, 2 and 3 and is recommended in Legal 500.

Meet the team Stephen Searle, Partner t: 0345 209 1384 e: stephen.searle@clarkewillmott.com Stephen specialises in professional negligence disputes involving financial product mis-selling and investment mis-management, commercial disputes between financial services firms, regulatory disputes (for example claims by the FSA alleging unauthorised activity). Stephen also acts in pensions disputes (with particular expertise in ill-health retirement matters). He works with private clients, financial advisers, networks and pension trustees. Stephen trained with Clarke Willmott and now has over ten years experience following his qualification in March 2003. He has the Chartered Insurance Institute (CII) Certificate in Financial Planning and is studying for the higher level Diploma. Stephen is a member of the Chartered Insurance Institute, the Personal Finance Society Association of Pensions Lawyers. John Mackinnon, Associate t: 0345 209 1430 e: john.mackinnon@clarkewillmott.com John is an associate in the Financial Services Litigation team specialising in claims in relation to negligent investment advice. He has over ten years of litigation experience dealing with a wide variety of claims and acting for both claimants and defendants. Beachcroft LLP where he specialised in defending professional negligence claims on behalf of professionals and their insurers and handling disputes in relation to insurance coverage issues As well as representing clients at trial, John has extensive experience of settling claims via alternative dispute resolution methods. John is a member of the Chartered Insurance Institute and the Personal Finance Society. He is currently studying for the CII Diploma in Financial Planning. Laura Hazell Dip PFS, Associate t: 0345 209 1074 e: laura.hazell@clarkewillmott.com Laura specialises in claims and complaints relating to financial products and planning. Her expertise includes managing claims and complaints regarding negligent advice given in respect of investments, pensions and tax mitigation schemes, primarily for claimants. Laura is a member of the Personal Finance Society and Chartered Insurance Institute and holds the CII Diploma in Regulated Financial Planning. At the present time, Laura is managing several cases which relate to recommendations given to high net worth individuals to invest in film partnerships, and others concerning the alleged mis-selling of the AIG Premier Access Bond. Laura joined Clarke Willmott in 2009 after studying at the University of the West of England. John joined Clarke Willmott in 2014 from DAC

Meet the team Clare O Sullivan, Associate t: 0345 209 1346 e: clare.osullivan@clarkewillmott.com Clare advises on all aspects of financial services disputes but specialises in the mis-selling of interest rate protection products by banks. Clare has experience in advising on a number of products including: interest rate swaps; enhanced collars; callable and extendable swaps; cap and collars; and digital swaps. Prior to joining Clarke Willmott LLP, Clare worked in a niche financial services firm in South Wales that specialises in these claims. Clare brings with her a depth of financial services knowledge having spent three years in the Financial Services Authority s (now the Financial Conduct Authority) Enforcement Division. Clare is a member of the Chartered Insurance Institute and is currently studying towards a diploma in regulated financial planning. Tammanna Bolt, Solicitor t: 0345 209 1463 e: tammanna.bolt@clarkewillmott.com Tammanna acts mainly for clients who have been mis-sold financial products. She acts for them in court proceedings, complaints to the Financial Ombudsman Service and/or Financial Services Compensation Scheme. Tammanna joined Clarke Willmott as a paralegal in 2010.
