National Foundation for Syndactyly Research, Support and Education, Inc. Corvette Charity Car Raffle Rules 1. CORVETTE CHARITY CAR RAFFLE RULES National Foundation for Syndactyly Research, Support and Education, Inc. (NFSUS) CORVETTE CHARITY CAR RAFFLE begins on July 31, 2017, and ends on July 30, 2018. The raffle is licensed through an application by the NFSUS. The raffle drawing is July 31, 2018, at approximately 2pm (CDT) at Schmitt Chevrolet, Inc., 127 Regency Park, O Fallon, IL, 62269. The Grand prize is, at the sole option of the winner, the choice of a certificate towards the purchase of a NEW Corvette (a $60,000 certificate toward the purchase of a NEW Corvette), or a certificate for $50,000 towards the purchase of any other Chevrolet purchased from Schmitt Chevrolet, Inc. A $40,000 Cash option will also be offered. The delivery of a selected vehicle will be from Schmitt Chevrolet, Inc. All net proceeds benefit NFSUS and Shriners Hospitals for Children. A maximum of 1000 tickets will be sold. Tickets may be purchased by mail from NFSUS P.O. Box 159, 42 West Main Street, Mascoutah, Illinois 62258, by internet on the foundations web site (www.nfsus.org), or in person at Schmitt Chevrolet, Inc. or Gateway Classic Cars of O Fallon, IL. Tickets may also be purchased from designated representatives of the aforementioned organizations sponsors at other promotional events. Name of the winner will be posted on the NFSUS website on or about August 1, 2018. 100% Refund if the Raffle is not sold out or held. Accounting and Audit of the Raffle is by Boyce Hund and Associates LLC. The raffle is void where prohibited by law. 2. RAFFLE ELIGIBILITY The raffle is open to all persons age 18 and over who have U.S. address. Participants may be required to sign an affidavit of eligibility. Officers of NFSUS are prohibited from participation in the raffle; however, their families may purchase tickets and have the same chance to win as all other entrants. Representatives of Schmitt Chevrolet, Inc. and Gateway Classic Cars may participate. An Officer of NFSUS will preside over the actual drawing. Grand prize winner need not be present to win. 3. DETAILS OF RAFFLE ENTRY AND PARTICIPATION Raffle tickets donation is one hundred ($100.00) dollars each. The ticket purchase price does not qualify as a charitable contribution. Personal checks for ticket purchases should be made out to National Foundation for Syndactyly 2018 Car Raffle. Internet and mailed entries and payment must be received by NFSUS no later than 6 PM (CDT) on Wednesday, July 26, 2018. All entries must include payment by personal check, bank check or credit card (Visa and MasterCard are accepted 1
for payment). For credit card purchases, the raffle ticket purchaser must provide their full name, billing address, telephone number of the cardholder, the credit card number, expiration date and security code per the requested information on the entry form. For any raffle ticket request and payment after 1000 tickets have been sold, the purchaser will be contacted and offered a ticket for the following year raffle. No other refunds will be made, except as provided below in the event of cancelation or as otherwise determined by NFSUS in its sole and absolute discretion. Subject to availability, purchasers may buy as many tickets as they wish. NFSUS reserves the right, in its sole and absolute discretion to disqualify: false entries, entries suspected of being false, illegible entries, defective entries, incomplete entries, physically altered entry forms, and entries that do not include valid or complete payment. NFSUS is not responsible for printing errors in any Raffle-related material or for lost, late, misdirected or non-delivered mail or corrupt internet messages, or any other failure to receive orders or deliver receipts prior to the drawing deadlines. All entries become the property of NFSUS and will not be returned. NFSUS reserves the right to withdraw this offer at any time. If for some reason the raffle is cancelled prior to the drawing, all ticket purchases will be refunded. 4. PRIZES The Grand prize winner, at the sole option of the winner, receives the choice of a certificate towards the purchase of a NEW Corvette* (* a $60,000 certificate toward the purchase of a NEW Corvette or a certificate for $50,000 towards any other Chevrolet from Schmitt Chevrolet, Inc., Inc. A Cash option will be offered if requested for $40,000. The election of prize choice must be submitted in writing to NFSUS no later than fifteen (15) days after the Grand Prize drawing. If the Grand Prize winner fails to notify NFSUS of the decision to select the vehicle within this time period, it will be deemed that the cash option was selected. Grand Prize winner elects to receive a vehicle, they must make a payment of tax, equivalent to the required tax withholding based on the fair market value of the vehicle, as required by the Internal Revenue Service. NFSUS will issue a W2G for the fair market value. NFSUS will pay $60,000, which is the estimated base MSRP cost of a NEW Corvette as determined by Schmitt Chevrolet, Inc., $50,000 if the option to choose another Chevrolet Car is selected, or $40,000 cash less IRS mandated withholding. The Grand Prize winner assumes any additional expense for the actual vehicle selected. The vehicle is untitled and provided as New Condition by the Dealership with acceptable delivery mileage and will be supplied with the manufacturer s warranty and other guarantees as provided by the manufacturer. All winners are subject to relevant federal, state and local taxes and other expenses. The Grand Prize winner is responsible for costs of title, tax, license and registration fees if it is the elected prize, as well as transport of the Vehicle and any costs involved in its transport and or storage. Any other fees, in connection with the Grand Prize, are the sole responsibility of the Grand Prize winner. Payment will be made in the form of a check payable to the name provided on the Entry Form. NFSUS will issue IRS Form W2G for any prizes of $600 or more. 2
5. NOTIFICATIONS Raffle ticket purchaser whose ticket number is drawn at the Prize Drawing will be deemed the winner of the prize for that particular selection. The winner will be notified by email, telephone and/or U.S. Mail using the information provided on the Entry Form. Additionally, the winner s name will be posted at http://nfsus.org. If the winner cannot be located or fails to respond to attempts to contact them within thirty (30) days after NFSUS s first attempt to contact them, such winners will be deemed to have forfeited their prize. Another winner will not be drawn. The prize may be forfeited if the winner: cannot be reached or cannot accept or receive the prize for any reason. Winner grants permission for the use of their name in a future raffle or similar promotions without compensation, unless prohibited by law. 6. RULES AND LIABILITIES The Raffle is subject to these Official Rules. These Official Rules shall not be changed by any oral statement made by any person acting on behalf of NFSUS. By participating, ticket purchasers agree to the following: 1) To be bound by these complete raffle rules and the decisions of NFSUS shall be final and binding. 2) To waive any right to claim ambiguity in the Raffle or these Official Rules, except where prohibited by law. 3) By Accepting the Grand prize, the winner agrees to release NFSUS, its officers and members, representatives and agents, and any person or entity associated with the production, collection of tickets, judging, or administration of the raffle from and against any claims, damages, disability, attorneys fees, and costs of litigation and settlement, as well as any liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from redemption, acceptance, possession, ownership, misuse or use of any prize or participation in any raffle-related activity or participation in this raffle. 4) Except where prohibited by law, the winner s purchase of a raffle ticket and acceptance of a prize constitutes permission for NFSUS to use the winner s name, photograph, likeness, statements, biographical information, voice, and city and state address for promotional or advertising purposes in connection with this Raffle on a worldwide basis, and in all forms of media, now and hereafter know, in perpetuity, without review, permission or further compensation. 7. TAXES Taxes, if any, are the sole responsibility of the winners. If the winner selects a certificate for the purchase of a vehicle as the prize, he or she will be required to provide cash to NFSUS in the amount of 25% of the fair market value of the certificate in order for NFSUS to properly withhold income taxes on the prize. Selected winners will receive an IRS Form W2G and the amount of the winnings 3
(at the Estimated Retail Value) will be reported to the IRS of any awarded prizes of $600 or more. Each ticket purchaser is advised to consult his or her own tax advisor(s) with respect to the tax liabilities that may arise from winning a prize in this raffle. The ticket purchase price does not qualify as a charitable contribution. 8. PRIVACY POLICY Raffle ticket purchasers information collected during a purchase will only be used to contact the winner of the raffle and internally for future raffles. No information will be sold or shared with any third-party websites or companies. 9. GENERAL RAFFLE INFORMATION NFSUS reserves the right to disqualify any entrant it finds to be tampering with the entry process or the operation of the raffle or violating these Official Rules, and reserves the right to cancel the raffle should it suspect fraud or for reasons out of the control of NFSUS. Disputes regarding these Official Rules and/or this raffle will be governed by the internal laws of the State of Illinois. Any claim(s) or controversy between any of the raffle participants and NFSUS arising out of or relating to the raffle and or the raffle rules and regulations will be settled by binding arbitration administered in St. Clair County, IL, by the American Arbitration Association under its Commercial Arbitration Rules. Any Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof. Caution should be taken for any attempt to deliberately damage or to undermine the legitimate operation of the Raffle. Any such attempts may be in violation of criminal and civil laws and will result in disqualification from participation in the Raffle. Should any attempt be made, NFSUS reserves the right to seek remedies and damages, including all fees, such as attorney fees and court costs, to the fullest extent of the law, including criminal prosecution. A raffle winner s sole and exclusive remedy for any claim against NFSUS arising out of the sale of raffle tickets or the conduct of the raffle will be limited to the return of the purchase price paid for the raffle ticket(s). In no event will NFSUS, its directors, officers, agents or representatives be liable to any party for any loss or injury to earnings, profits or goodwill, or for any incidental, special, punitive or consequential damages of any person or entity whether arising in contract, tort or otherwise, even if advised of the possibility of such damages.
