The Arbitrator will be assigned from the American Arbitration Association. Each party is responsible for their own file/answer fees, and the Arbitrators conclusion will be accepted as all-inclusive/final resolve. If AHG is not the prevailing party, the standard filing fee will be reimbursed. (2) If the arbitration process fails (meaning no decision or failure to conclude), then local small claims court is the only other alternative. (3) Reiteration of contract terms-- it is acknowlegded and accepted that the contractual limits or obligations contained herein represent the maximum allowable claim. (4) By entering into this contractual agreement, all parties agree they are irrevocably waving/giving up the right of single/private attorney action of any kind, trial by jury, and participation in any representative, consolidated or class action. 21. Contract Holder Obligations: The Contract Holder must review and acknowledge all terms and conditions of this contract before utilizing the contract or requesting service. At the first indication service may be required; it is the Contract Holder s obligation to contact AHG as described in section 8.1. When requesting service, it is the Contract Holder s obligation to select the trade type of the contractor. In the event the wrong trade type is requested, the Contract Holder is required to pay a second service fee to dispatch a second contractor. In addition, the Contract Holder is obligated to perform all manufacturer recommended preventative maintenance or necessary cleaning activities for coverage to apply. If the Contract Holder is notified of a need for maintenance, 10-days will be granted to complete the required service. If the maintenance is not completed as described, the item will be excluded from coverage for the remaining term of the contact. The Elite Coverage upgrade does not negate the maintenance requirement after being notified. It is also the Contract Holder s obligation to pay any deductible or processing fee to seek reimbursement or service in accordance with any prior service providers warranty, the Contract Holder s Homeowners Insurance or existing manufacturer warranties before this contract can be utilized. 22. Coverage Effective Dates: 22.1 All contracts are for the duration indicated on the OCL. However, coverage will not begin until AHG realizes payment in full. All contracts granted assume a 30-day no claim requirement, unless the Contract Holder provides documentation of continuous home warranty coverage, or if the home has had an inspection by a state certified home inspector within 45-days prior to the start date of this contract (see section 2.3). In the event service is required in the first 30-days of the contract, a complete copy of the inspection report or proof of continuous home warranty coverage must be submitted to AHG before the claim will be processed. 22.2 New construction contracts begin 365 days after the close of escrow and will continue for 3 years from the start date. Payment is due in full within 10 days of the close of escrow. All new construction contracts must be placed by calling 1-866-710-3700. 23. In this event, a prorated refund less any service costs incurred or unpaid fees will be given to the Contract Holder in the form of a business check within 45 days of AHG receiving a written cancellation notice that has been delivered via first class mail to AHG s CANCELLATION DEPARTMENT. All contracts canceled by the Contract Holder will be charged a 15% administrative handling fee based on full purchase price. 23.3 If the home is sold prior to expiration of this contract, please contact AHG to transfer ownership to the new owner. A $15.00 transfer fee is required for this transaction if the contract is not extended to a minimum of a one-year term. Contract Holders can transfer any remaining value of the contract to a new home if they purchase a minimum term of one year. No fees will be applied to this transaction. 23.4 This contract is renewable at AHG s discretion. At time of renewal, the Contract Holder will be notified of rates and terms required to continue coverage. 24. Sellers Coverage Terms: Aggregate limit of $1,000.00 or 180 days of Standard coverage will be provided during listing period if the home is listed in the MLS by a licensed Real Estate Agent and the home is owner occupied at contract origination. At AHG s discretion, the Seller will have the option to purchase contract if the home does not sell in 180 days. By initiating Sellers Coverage, both the Seller and the Listing Agent are agreeing to pay full price for the contract at close of escrow even if the contract has expired or to reimburse AHG for the cost of any repairs. All optional items are excluded during the listing coverage period. If the Seller would like additional coverage during the listing period, they can call AHG to request a quote for short-term coverage. Sellers Coverage is not eligible for renewal and it is not available if there has already been an accepted offer and does not apply to vacant, rental or investment properties. When escrow payment is received, a 1-year contract will be issued for the Buyer. The Buyer will have up to 14 days to upgrade or add additional coverage. 25.
