OFFICIAL CONTEST RULES (the Contest Rules ) The Shoppers Drug Mart /Pharmaprix Lady Speed Stick Contest (the Contest ) is sponsored by Shoppers Drug Mart Inc., and Colgate-Palmolive Canada Inc. (individually a Contest Sponsor and collectively, the Contest Sponsors ) 1. NO PURCHASE NECESSARY. Each Shoppers Drug Mart or Pharmaprix store in Canada will be herein referred to as a Participating Store. The Contest starts at each Participating Store s opening time on April 21, 2018 and closes at a Participating Store s closing time on May 18, 2018 (the Contest Period ). ELIGIBILITY: The Contest is open to legal residents of Canada who, at the time of entry, have reached the age of majority in their province/territory of residence and who are valid PC Optimum program members, in possession of a valid PC Optimum card. Entrants are responsible for ensuring their contact information with the PC Optimum program is up to date. There is no cost to obtain a PC Optimum card and being a member. Employees of Contest Sponsors, the Associate/Owners of Shoppers Drug Mart stores and the Associate/Owners of Pharmaprix stores, and each of their agents, representatives, affiliates, subsidiaries, franchisees, advertising and promotional agencies, fulfillment houses and members of their respective immediate families or those with whom they are domiciled, are not eligible to enter the Contest. In the Contest Rules, immediate family means mother, father, brothers, sisters, sons, daughters, legal or common-law spouse, regardless of where they reside. Groups, clubs, organizations, businesses and commercial and non-commercial entities cannot participate. All decisions of Contest Sponsors are final. 3. HOW TO ENTER: You may enter the Contest and qualify for a chance to win the Grand Prize (defined in rule 7) in one of two (2) ways: i. AUTOMATIC ENTRY WITH PURCHASE: Visit a Participating Store located in Canada (each store a licensed operator of Shoppers Drug Mart Inc. or its affiliates, (collectively Shoppers Drug Mart/Pharmaprix )) during the Contest Period and purchase any Lady Speed Stick product (the Participating Purchase ) (while supplies last). Next, present your valid PC Optimum Card, and once it is scanned you will receive one (1) automatic entry for each Participating Purchase (the Automatic Entry ) during the Contest Period. The sole determinant of time for the purposes of receipt of a valid Automatic Entry will be the computer server(s) of Contest Sponsor(s). ii. NO PURCHASE ENTRY: To enter the Contest and receive a no purchase entry (the No Purchase Entry ) without making a purchase, on a plain piece of paper, write by hand a minimum of 50 English or French word essay about Why I love shopping for Lady Speed Stick
at Shoppers Drug Mart / Pharmaprix stores and include your full name, PC Optimum Card number. Next, mail your no-purchase Entry to: Shoppers Drug Mart /Pharmaprix Lady Speed Stick Contest, c/o Shoppers Drug Mart, 243 Consumers Road, Toronto, Ontario, M2J 4W8 and you will receive one (1) No Purchase Entry into the Contest (subject to compliance with these Official Rules). All No Purchase Entries must be postmarked by May 18, 2018 (the Contest Closing Date ) and be received by Shoppers Drug Mart /Pharmaprix at the aforesaid address no later than 5:00:00 PM Eastern Daylight Time (EDT) on May 29, 2018 (the No Purchase Deadline ) in order to be eligible for entry into the random draw. Limit of one (1) essay per envelope with sufficient postage. You may enter as many No Purchase Entries as you would like during the Contest Period, but each essay must be unique and original to the entrant submitting the essay, handwritten, not photocopied or otherwise mechanically reproduced, and created for the purposes of the Contest. All essays must be appropriate for the Contest, in good taste, and in keeping with Contest Sponsors image, as determined by Contest Sponsors in their sole and absolute discretion, or may be judged void and disqualified. For example, mail-in essays must not be indecent, obscene, profane, hateful, discriminatory, tortuous, defamatory, slanderous, libelous or infringe any third party rights. An Automatic Entry or No Purchase Entry will herein be collectively referred to as an Entry or Entries. By entering this Contest, all entrants agree to comply with and be bound by the terms and conditions of the Contest Rules, and the decisions of the Contest Sponsors which are final and binding in all matters related to this Contest and the awarding of the Grand Prize. 4. CHANCES OF WINNING: The odds of winning the Grand Prize depend on the total number of eligible Entries received from all Participating Stores during the Contest Period and the number of eligible no purchase Entries postmarked by the Contest Closing Date and received by the No Purchase Deadline. 5. DRAW: One (1) Entry will be randomly selected from among all eligible Entries received from all Participating Stores together (see rule 3.i) with all those submitted eligible Entries by the no-purchase entry method (see rule 3.ii) during the Contest Period. No purchase Entries will be included in the draw if received by the No Purchase Deadline. The draw will occur at the Shoppers Drug Mart central office in Toronto, Ontario on Wednesday, May 30, 2018 ( Draw Date ) at approximately 2:00 PM ET. All Entries become the property of Contest Sponsors and none will be returned. No responsibility is assumed by the Contest Group (as defined below) for any inability of a potential entrant to successfully enter the Contest for any other reason. A representative from Shoppers Drug Mart or Pharmaprix, the Contest administrator, will notify the selected entrant by phone or by email at the phone number or email address provided within his/her profile for his/her PC Optimum Card account within ten (10) days of the Draw Date. If the selected entrant (a) cannot be reached by telephone and/or email within five (5) business days of notification; (b) fails to correctly answer the skill testing question (see rule 6); (c) fails to return the properly executed Release Form (defined in rule 6) within the specified time (see rule 6); or otherwise does not meet all of the Contest conditions as per the Contest Rules, the selected entrant will be disqualified and shall forfeit any rights to the Grand Prize without any liability to the Contest Group (defined in rule 6), and a second random draw will occur and the above process will be repeated until such time as there is one (1) confirmed prize winner, or no more eligible Entries, whichever comes first. The Contest Sponsors will not be responsible for failed attempts to contact a selected entrant.
6. To be confirmed a winner, the selected entrant must: (1) correctly answer, without assistance of any kind, whether mechanical or otherwise, a mathematical skill testing question to be administered by phone or email or within the Release Form (defined in 6(2)) and (2) sign and return within five (5) business days of its receipt a standard declaration/liability release and consent to publicity form ( Release Form ) confirming compliance with the Contest Rules, and releasing the Contest Sponsors, the Associate/Owners of Shoppers Drug Mart stores and the Associate/Owners of Pharmaprix stores, and each of their agents, representatives, affiliates, subsidiaries, franchisees, advertising and promotional agencies, fulfillment houses, and all of their respective shareholders, employees, parents, directors, officers, franchisees, successors, and assigns (collectively, the Contest Group ) from all liability with respect to the entrant s participation in this Contest and the awarding, use and/or misuse of the Grand Prize or for matters that inhibit, reduce or prevent enjoyment of the Grand Prize. The selected entrant may be required to show proof of identification as part of the confirmation process. In case of a dispute concerning the identity of the individual who submitted an Entry, the entrant will be deemed to be the account holder of the PC Optimum Card account under which the Entry was submitted, according to Shoppers Drug Mart Inc. s records. If for any reason the selected entrant s name does not match the account holder s name, the selected entrant will be disqualified and will forfeit all rights to the Grand Prize without liability to the Contest Sponsors. 7. GRAND PRIZE: There will be one (1) grand prize (the Grand Prize ) available to be won, consisting of the following: i. One (1) $10,000.00 (CDN) cheque made payable to the Grand Prize winner as his/her name appears on the Release Form (see rule 6). ii. One-hour life coach consultation (the Consultation ) with Reese Evans, the founder of Yes Supply. Consultation will be held in Toronto or via Skype depending on the winner s accessibility, at their own discretion. Transportation and accommodations are NOT included in the Grand Prize. The Consultation must be held by October 31, 2018. The Consultation has an approximate retail value of $1,200.00 (CDN). iii. One year VIP membership to The Collective (the VIP Membership ). More information on The Collective can be found here: https://inspire.yessupply.co/collective/. The VIP Membership has an approximate retail value of $240.00 (CDN). The total approximate retail value ( ARV ) of the Grand Prize is $11,440.00 (CDN). 8. General Conditions: The winner is solely responsible for all costs and other expenses not specified herein, including but not limited to transportation to/from the Consultation, accommodations, personal expenses, and any other costs not specifically stated herein as being included. The Contest Sponsors expressly disclaim any responsibility and the Grand Prize winner agrees to indemnify and hold harmless the Contest Sponsors from and against any and all claims, actions, demands and/or liability for injury, damage or loss whatsoever relating to or arising in connection with participation in this Contest (regardless of the cause of such injury, damage or loss) and/or the delivery and/or subsequent use or misuse of any of the Grand Prize awarded, to the full extent permitted by law. No responsibility is assumed by the Contest Sponsors for cancelled, delayed, suspended or re-scheduled Consultations once arrangements are made for any reason whatsoever beyond its control including if the Consultation is delayed, postponed or cancelled for any reason and the Grand Prize winner will not be reimbursed for any portion of the Grand Prize that may become unavailable. In the event that the Grand
Prize winner does not use any portion of the Grand Prize, there will be no extension, transfer, substitution or any kind of compensation provided. The Grand Prize must be accepted as awarded without substitution, is not transferable, is not for resale and has no cash surrender value. Notwithstanding anything else in these Contest Rules, Contest Sponsors reserve the right in their sole and absolute discretion, if the Grand Prize or any component of the Grand Prize cannot be awarded as described for any reason, to substitute a similar prize or component of prize of equal or greater value (based on the ARV of the prize as stated in these Contest Rules), without liability. The Grand Prize winner is solely responsible for all costs not expressly described herein. 9. GENERAL RULES: Entries obtained through fraudulent means or through an abuse of the PC Optimum program or are in any way tampered with, forged, mutilated, illegible, incomplete or are photocopied or otherwise mechanically reproduced essays or essays not original to entrants may, at the sole and absolute discretion of Contest Sponsors, be judged void and disqualified. All Entries are subject to verification by Contest Sponsors and Contest Sponsors reserve the right in their sole and absolute discretion to cancel and revoke any Entries if they are found to be improper or if the entrant is subsequently found to be ineligible pursuant to the Contest Rules. The Contest Group is not responsible for Entries that are lost, late, misdirected, stolen, damaged, garbled, illegible, incomplete, contain inaccurate information, delayed for any reason or do not conform with or satisfy any or all of the conditions of these Contest Rules, as determined by Contest Sponsors, in their sole and absolute discretion. Mailed no-purchase Entries must bear sufficient postage, which is the sole responsibility of the entrant. The Contest Group is not responsible for any postal delays or strikes, or delivery failures. Proof of sending a no purchase Entry or purchasing a participating product is not proof of receipt by Contest Sponsors. The Contest Group shall not be liable to the confirmed Grand Prize winner or the Grand Prize for any guarantee, warranty, condition or representation, express or implied, relating to the prize, including without limitation, its quality, condition or fitness for a particular purpose. The Contest Group does not assume any responsibility or liability for, and each entrant and winner assumes liability for, and releases and holds harmless the Contest Group from and against any and all losses, damages, costs, actions, liabilities, claims, demands, or injuries caused or claimed to be caused by participation or attempted participation in the Contest, the administration of the Contest, the selection and confirmation of winner, the awarding of the prize, and/or the acceptance, possession, use or misuse of the prize awarded, including but not limited to claims/damages for personal injury, property damage or death. The Contest Group and its agents are not responsible for typographical or other errors in the Contest or administration of this Contest, including, but not limited to, errors in advertising, the Contest Rules, the
selection and announcement of winner, distribution of prize or technical malfunctions of telephone network lines, computer online systems or providers, software and hardware configurations, or failure of any entry to be received by Contest Sponsors for any reason. 10. For Quebec residents: Any litigation regarding the conduct or organization of this Contest may be submitted to the Régie des Alcools, des Courses et des Jeux ( Regie ) for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement. 11. Subject to the approval of the Régie with respect to the province of Quebec, Contest Sponsors may, in their sole discretion and without liability, terminate, modify or suspend the Contest or amend the Contest Rules, in whole or in part, without prior individual notice, at any time, including, but not limited to, if fraud, technical failures, including any network server or hardware failure, viruses, bugs, errors in programming, or communications or other errors or other causes beyond the control of Contest Sponsors corrupt the administration, integrity or security of the Contest or if any other factor interferes with the conduct of this Contest as contemplated by the Contest Rules. In no event will the number of prizes awarded exceed the available number of prizes as specified in these Contest Rules. 12. In the event of any discrepancy or inconsistency between the terms and conditions of these English Contest Rules and disclosures or other statements contained in any Contest-related materials, including, but not limited to: The French version of these Contest Rules, and/or point of sale, television, print or online advertising, the terms and conditions of these English Contest Rules shall prevail, govern and control. All issues and questions concerning the construction, validity, interpretation, and enforceability of the Contest Rules, or the rights and obligations of entrants and the Contest Sponsors in connection with the Promotion, shall be governed by, and construed in accordance with (i) the laws of the Province of Québec and the laws of Canada applicable therein in respect of residents of the Province of Québec, and (ii) the laws of the Province of Ontario and the laws of Canada applicable therein in respect of residents of the other Canadian provinces/territories, without regard to conflicts of law principles. Any attempt by an entrant or any other individual to deliberately damage any website or undermine the legitimate operation of the Promotion could be a violation of criminal and civil laws and should such an attempt be made; the Contest Sponsors reserve the right to seek damages from any such person to the fullest extent permitted by law. This Promotion is subject to all federal, provincial/territorial, and municipal laws. 13. PRIVACY AND PUBLICITY RELEASE: By entering the Contest and/or accepting the Grand Prize, the winner consents to the use of his/her name, city of residence, voice, photograph and/or other likeness in any publicity or advertisement carried out by Contest Sponsors and publication of the name of the winner without further compensation. Contest Sponsors respect your right to privacy. Personal information collected from entrants using their PC Optimum Card is subject to the privacy information terms and conditions of the PC Optimum Card Program and the Shoppers Drug Mart privacy policy and will also be used by Contest Sponsors to administer the Contest. By entering the Contest and using your PC Optimum Card to provide your information, you consent and agree to Contest Sponsors collection and use of the entry information to administer this Contest.
