The minutes of the Regular Meeting of the Village of Haverstraw Board of Trustees on Monday, November 21 st, 2016, beginning at 7:00 PM. PLEDGE OF ALLEGIANCE ROLL CALL Trustee Batista - Present Trustee Bueno - Present Trustee Watson - Present Trustee Dominguez - Present Mayor Kohut - Present The Mayor opened the meeting with the first Public Participation inviting the public to ask questions or make comments. Marion Breland, Director of Haverstraw Center & Vanessa Lopez, Administrative Ass t. at Haverstraw Center: Ms. Breland expressed her admiration and respect for all the hard work and effort that retiring Deputy Mayor Francisco Batista has done for the children of this community and also for the Community as a whole. She also thanked him for his friendship and support over the years and for bringing all his knowledge and heartfelt dedication into everything he has done for the betterment of our Village, to assist the Mayor and the Village Board, the staff of the Haverstraw Center, all the different departments of the Village and especially for all the residents who call our village home. She finished by saying it has always been an honor and a privilege to work with Deputy Mayor Batista and to stand alongside him as a friend. Vanessa Lopez: Ms. Lopez shared the same thoughts as Ms. Breland, but wanted to pay tribute to Deputy Mayor Batista herself for being such an avid supporter of the Haverstraw Center and for the respect he always had for everyone there. Marion Breland: Ms. Breland then informed the Board that they had another very successful Thanksgiving Dinner at the Center, which was attended by incumbent Trustee Joel Santana. She is very pleased that Mr. Santana will be joining the Village Board of Trustees and hopes he will visit the Center whenever possible. She then went on to inform the Board that the children at the Center look at Mr. Batista as a Rock Star because he has helped so many of the kids in so many ways. She again thanked Deputy Mayor Batista for everything he has done to support our Village. Fire Chief Robert Drexler, Jr.: Fire Chief Drexler, along with the Assistant Chiefs, presented Deputy Mayor Batista with a plaque thanking him for everything he has done for the Haverstraw Fire Department and to wish him well in all his future endeavors. Mayor Michael Kohut: The Mayor then made a presentation of a plaque, on behalf of the entire Village Board, thanking him for his 16 years of wisdom and insight, compassion and devotion to the people of the Village, and most importantly for his friendship throughout the years. The Mayor read the plaque which he then presented to retiring Deputy Mayor Batista. Francisco Batista: Deputy Mayor Batista thanked the Mayor and the Board, and was without words to express his deep appreciation to everyone for everything, including all the ups and downs, which are always a part of Village government, but always lead to resolving so many issues and problems to make life better for the people of the Village of Haverstraw and

to help the Village move forward and prosper. He stated that he now leaves the Village knowing that the Board is united for one cause and that is for the Village and the people to live and prosper united together as one. He also thanked the Haverstraw Fire Department for always being there when needed. With no further input from the public, the Mayor continued with the agenda for that night s meeting announcing a Public Hearing with regard to amending Sections 165-3 and 165-15 and adding 165-8.1 to the Peddling & Soliciting (No-Knock) Law. Mayor Kohut entertained a motion to open the Public Hearing as stated above. RESOLUTION #245-2016 The Mayor then invited Jay Hood, Jr., Esq., Village Counsel to present the amendments to the public for comment or questions. Jay Hood, Jr., Esq.: Counselor Hood mentioned that there is already a Peddling and Solicitation Law on the Village books, however, the Board wished to strengthen this law. He explained that a property owner will now be able to obtain a Do Not Solicit sticker from the Village Hall to be placed in the front window of their home to prevent anyone, except those listed as exceptions, from entering their property. He also explained that there will be violations and penalties for any hawker or peddler who violates any of the provisions of this law. He read the penalties as follows: 1) First time offense - a fine of not less than $500.00 and not more than $1,500.00. 2) Second offense If within a 24 month period, measured from occurrence to occurrence, a fine of not less than $1,500.00 and not more than $3,500.00. 3) Third offense If within a 24 month period, a fine of not less than $3,500.00 and not more than $10,000.00, or imprisonment not to exceed 30 days, or both. Counselor Hood mentioned that there are exemptions to who can approach residential properties, which are listed in Section 165-3. Terence Watson, Jr.: Trustee Watson inquired what a resident could do if someone keeps approaching them. Jay Hood, Jr., Esq.: Counselor Hood informed both the Board and the public that the Building Department Code Enforcer could be called to handle the situation or the Police can be called in with either one able to issue violations. With no input from the public, Mayor Kohut entertained a motion to close the Public Hearing.

RESOLUTION #246-2016 Mayor Kohut then entertained a motion to approve the amendment to Section 165 of the Peddling & Soliciting Law. RESOLUTION #247-2016 Seconded by: Francisco Batista REPORTS OF VILLAGE OFFICIALS VILLAGE ATTORNEY, Jay Hood, Jr.: Counselor Hood spoke on the pet day care facility application which will encompass Route 9W. He is requesting the Board adopt and accept the SEQR Reports 1, 2 & 3 and the negative declaration of environmental impacts. Mayor Kohut entertained a motion to adopt and accept the SEQR Reports and the negative declaration of environmental impacts. RESOLUTION #248-2016 Seconded by: Terence Watson, Jr. Counselor Hood then mentioned that Rockland County has to review this and has up to 30 days to make a statement, then the Board will hold a Public Hearing scheduled for December 19 th, after which the Board is free to vote on the matter. Counselor Hood then reported that the Village is considering hiring the firm of Zarin & Steinmetz of White Plains to review and revamp the Village Zoning laws, as well as consider a possible new Comprehensive Plan pending grant funding. He received an engagement letter from them setting forth the terms and conditions of their representation, which Counselor Hood is requesting the Board to approve. Mayor Kohut entertained a motion to approve hiring the firm of Zarin & Steinmetz as stated above. RESOLUTION #249-2016 Motion by: Terence Watson, Jr. Seconded by: Emily Dominguez Counselor Hood had nothing further to report. VILLAGE TREASURER, Judith Curcio: Ms. Curcio had nothing to report.

MAYOR S REPORT, The Mayor received a request from the North Rockland Rotary to hold a carnival in the parking lot adjacent to the Knights of Columbus on May 4 th thru May 7 th, 2017, which is being used as a fundraiser to support various projects and provide scholarships for the youth of our community. Mayor Kohut entertained a motion to approve the Rotary Club s request to hold a carnival as stated above. RESOLUTION #250-2016 The Mayor reported that the Village is looking to apply for a grant under the Hudson River Greenway Grant Program to be used to help the Village plan for development on the Chair Factory property. He advised the public that there is funding available through this program to start the process. He requested approval of the Board to submit an application for the project entitled The Haverstraw Riverside Redevelopment Concept Plan. Mayor Kohut entertained a motion to approve the Village s application to the Hudson River Valley Greenway Grant Program as stated above. RESOLUTION #251-2016 Seconded by: Terence Watson, Jr. The Mayor reported that the Village has received a contract from the County of Rockland for the Celebrating Families Program, which is held at the Haverstraw Center. Mayor Kohut entertained a motion to approve the Mayor to sign the Contractor Agreement with the County as stated above. RESOLUTION #252-2016 Motion by: Francisco Batista Seconded by: Emily Dominguez The Mayor received a proposal from Mello Engineering, PC, for engineering services pertaining to current and future applications from Ginsburg Development for the 2017 fiscal year. Mayor Kohut entertained a motion to accept the proposal of Mello Engineering PC and for approval to sign said proposal. RESOLUTION #253-2016

The Mayor received a Letter of Resignation from Sandra Castro from her position in the Building Department, effective November 1 st, 2016. Mayor Kohut entertained a motion to accept the resignation of Sandra Castro as stated above. RESOLUTION #254-2016 The Mayor received a Letter of Resignation from Joel Santana from the Village of Haverstraw Planning Board, effective November 30 th. Mayor Kohut entertained a motion to accept the resignation of Joel Santana as stated above. RESOLUTION #255-2016 Motion by: Francisco Batista Seconded by: Emily Dominguez The Mayor received a Letter of Resignation from Behar Krasniqi who is resigning from his position as Parking Enforcement Officer, effective November 14, 2016. Mayor Kohut entertained a motion to accept the resignation of Behar Krasniqi as stated above. RESOLUTION #256-2016 The Mayor received a Letter of Resignation from Victor Ortiz from his position as Parking Enforcement Officer, effective November 24 th, 2016 and his position as Crossing Guard, effective December 31 st, 2016. Mayor Kohut entertained a motion to accept the resignation of Victor Ortiz as stated above. REPORTS OF STANDING COMMITTEES FIRE & ORDINANCES Trustee Rafael Bueno: nothing to report. Trustee Bueno had PUBLIC WORKS, BUILDINGS & GROUNDS Trustee Terence Watson: Trustee Watson read the following report submitted by Robert Drexler, Superintendent of Public Works, as of December 5 th, 2016: 1) Mounted all Christmas decorations throughout the Village, including Village Hall. 2) Repaired and painted all doors and the porch at the Brick Museum. 3) Blacktopped numerous streets, potholes and alleyways. 4) Cleaned sewer at 42 West Broad Street. 5) Catch basins were cleaned and repaired on Dowd Street. 6) Installed speed humps at the Harbors. Trustee Watson had nothing further to report. The Mayor informed everyone that the DPW has a new sweeper, which has now been utilized for approximately 2 weeks. He also mentioned that with the new sweeper, the DPW will also be able to clean out catch basins, which will now be a part of the regular maintenance routine of the DPW a couple of days of week. YOUTH & FAMILY SERVICES - Trustee Francisco Batista: Trustee Batista read the following report of activities at the Community Center for the period of November 7 th through November 21 st, 2016: 1) THANKSGIVING: The Haverstraw Center hosted their annual Thanksgiving Luncheon on November 21 st, with a total of 76 youth participants and their families. 2) HOLIDAY PARTY: The Annual Holiday Party is scheduled for December 19 th, 4:00 PM at the Haverstraw Center. The party is by invitation only and is expressly geared toward participants of the youth programs at the Center and their families. The Toys for Tots U.S. Marine Corps. Program has donated approximately 250 toys to be used for this party. Any extra toys will be donated to the Quisqueya Club for their Annual Village Holiday Party.

3) HAVERSTRAW COLLABORATIVE: The Collaborative continues to meet monthly at the Center to plan and promote activities for the betterment of the Community. 4) CELEBRATING FAMILIES: The Center s staff, in conjunction with the Department of Social Services, started this program on Wednesday, November 16. This is a 16 week program, where the staff works with every member of the family, from ages 3 through adult, to strengthen recovery from alcohol and/or other drugs, break the cycle of addiction and increase successful family reunification. Babysitting service is provided by staff members. 5) Tim Sanders was honored by Keep Rockland Beautiful for all his hard work and dedication to the program. 6) JUMP PROGRAM: This program began on October 11 th, however, it is still in dire need of Spanish speaking mentors to assist with this program. Volunteers can contact Peter Fata at the Center. Trustee Batista had nothing further to report. BUILDINGS & CODE ENFORCEMENT - Trustee Emily Dominguez: Trustee Dominguez read the following report submitted by the Building Inspector, Ruben Berrios, for the period of November 7 th through November 18 th, 2016: Miscellaneous inspections - 55 Complaints - 7 Searches - 2 Construction inspections - 3 Building Permits & C.O. s - 4 Violations/Tickets - 12 Fines collected at court: $3,750.00 Trustee Dominguez reminded everyone that overnight parking rules are now in effect and 470 parking permits have been sold to date. Trustee Dominguez had nothing further to report. OLD BUSINESS None. NEW BUSINESS None. 2 nd PUBLIC PARTICIPATION Mel Post, 1422 Round Pointe Drive: Mr. Post congratulated the Mayor on his 50 th birthday, then congratulated Deputy Mayor Francisco Batista on his retirement and finally congratulated Joel Santana on becoming the newest Trustee on the Village Board.
