Terms and Conditions CIMB-Pay with Points & Win Campaign The Campaign Period 1. The CIMB-Pay with Points & Win Campaign ( this campaign ) is organised by CIMB Bank Berhad (13491-P) ( CIMB Bank or the Bank ) and shall run from 15 July, 2017 to 31 October, 2017, both dates inclusive ( the Campaign Period ). 2. CIMB Bank reserves the right to change the duration and/or commencement and/or the expiry dates of the Campaign Period by giving fourteen (14) calendar days prior notice. Eligibility 3. This Campaign is open to all new and existing CIMB Bank principal credit cardholder with bonus points feature issued by CIMB Bank Malaysia only ( Principal Credit Cardholder(s) ) and whose mobile numbers are registered with Maxis, Celcom, Digi or U-Mobile telecommunication service providers and maintained in CIMB Bank s records ( the Eligible Participant ). 4. The following categories of persons/entities shall NOT be eligible to participate in this Campaign:- i) Sole-proprietorships, Partnerships, Charitable/Non-profit Organizations/Societies, Corporate and Commercial Customers; ii) Permanent, contract and/or temporary staff or employees of CIMB (including its subsidiaries and related companies) and their immediate family members (i.e. spouses, children, parents, brothers and sisters); and iii) Representative and/or agents (including advertising and promotion agents) of CIMB, VISA Worldwide Pte. Limited, a company registered in Singapore, having its office at 30, Raffles Place, #10-00, Chevron House, Singapore 048622 ( VISA ) and MasterCard Worldwide, a company organized under the State of Delaware, having its office and principal place of business at 2000 Purchase Street, Purchase, New York, NY 10577-2509, United States of America ( MasterCard ) (including their respective subsidiaries and related companies); iv) Representative and/or agents (including advertising and campaign agents, 3 rd party vendors and service providers) of CIMB Bank, (including their respective subsidiaries and related companies) and their permanent and/or contract employees and their immediate family members (i.e. spouses, children, parents, brothers and sisters); and v) Individuals below the age of 18 years. 5. For the avoidance of doubt, supplementary cardholders are not entitled to win the Prize(s)(as hereinafter defined) under this Campaign. Prize(s) won by a supplementary cardholder, if any, will be given to the principal credit cardholder(s). 6. It shall be the Eligible Participant(s) responsibility to ensure their mobile phone number(s) or email address(es) provided is current and updated with CIMB Bank in the event of any changes being made to the same by them, CIMB Bank shall not be responsible to the Eligible Participant(s) for any loss (including loss of opportunity and consequential loss flowing there from) suffered in the event the Eligible Participant(s) 1

mobile phone number(s) or e-mail address(es) in CIMB Bank s records is not current or incorrect. Prizes and Participating Criteria 7. The following prizes shall be made available to the selected winners of this Campaign ( Prize(s) ):- Winner 2x Grand Prizes 2x 2 nd Prizes 2x 3 rd Prizes 100x Consolation Prizes Prize 3,000,000 CIMB Bonus Points each which is equivalent to RM7,500 1,500,000 CIMB Bonus Points each which is equivalent to RM3,750 500,000 CIMB Bonus Points each which is equivalent to RM1,250 100,000 CIMB Bonus Points each which is equivalent to RM250 Campaign Mechanics 8. Subject to terms and conditions herein, to participate in this Campaign, the Eligible Participant(s) may earn an entry or entries (as the case may be) and stand a chance to win the Prize(s) referred to in Clause 7 above in the following manner:- i) The Eligible Participant(s) must redeem bonus points in full or partial but subject to a minimum redemption stated in Clause 8 (iii) below in a single receipt with the Eligible Participant(s) credit card account during the Campaign Period at all Pay with Points participating outlets. The list of Pay with Points participating outlets can be viewed at the Bank s website at www.cimbbank.com.my/pwp ii) No registration is required to participate in this Campaign. Eligible Participant(s) will earn one (1) entry for each successful bonus points redemption ( Entry(ies) ). iii) The conversion rate is 400 bonus points equal to Ringgit Malaysia One (RM1) only and the conversion rate may change from time to time by the Bank upon giving the cardholders fourteen (14) calendar days prior notice. Winner Selection Process 9. Subject to the terms and conditions herein, the Eligible Participant(s) shall only earn and accumulate Entry(ies) starting from the first day of this Campaign until the end of the Campaign Period. 10. The Eligible Participant(s) who have earned the Entry/Entries referred to in Clause 8 shall be randomly short-listed by an automated system from the pool of qualifying Entries earned within the Campaign Period ( Shortlisted Participant(s) ). 11. Each Entry earned during the Campaign Period shall enable the Eligible Participant(s) to stand a chance to be shortlisted for the Prize(s). 12. The Shortlisted Participant(s) shall be contacted by CIMB Bank via a short messaging service (SMS) on their mobile numbers registered with Maxis, Celcom, U Mobile or Digi 2

Communication Service Providers maintained in CIMB Bank s records to answer one (1) question correctly within the date and time specified in the SMS before being declared as the winner of this Campaign ( Winner(s) ). 13. An SMS notification will be sent by CIMB Bank to Shortlisted Participant(s) only ONCE and only to those who replied to the said SMS with the correct answer within the specified date and time shall be confirmed as the Winner(s) via another SMS notification. The first six Shortlisted Participant(s) who answered the question correctly shall be declared the Winner(s) for the Grand Prize, Second Prize and Third Prize respectively (as per Clause 7). The remaining Shortlisted Participant(s) who answered the question correctly shall be declared the Winner(s) of the Consolation Prizes. 14. In the event any of the Shortlisted Participant(s) is unable to answer or reply or respond to the SMS by the specified date and time or where the answer given is incorrect, the Shortlisted Participant(s)will be regarded as unsuccessful in the participation to win the Prize(s). A SMS notification will be sent to the disqualified Shortlisted Participant(s). A new Shortlisted Participant(s)will be selected from the pool of the Shortlisted Participant(s) and then be contacted via SMS and shall be required to answer the SMS accordingly in the manner as specified therein. This process will be repeated until all 106 Winner(s) of this Campaign have been successfully identified. 15. CIMB Bank shall not be liable or be held responsible in any manner whatsoever in the event any Shortlisted Participant(s) cannot be contacted by way of SMS for whatever reasons. 16. For avoidance of doubt, standard telecommunications charges imposed by the telecommunication service providers will apply for the SMS response sent by the Shortlisted Participants. 17. All questions and answers will be determined, judged and decided by a panel of judges selected by CIMB Bank and the decisions of the panel judges in declaring the Winner(s) shall be final, conclusive and binding provided always that the decision must appear to be fair and reasonable. 18. At the time of selecting the Shortlisted Participant(s) and/or Winner(s), (i) the CIMB Bank credit card account of the Eligible Participant(s)and/or Shortlisted Participant(s) and/or Winner(s)MUST be in good standing, (ii) MUST NOT be in breach of any of the terms and conditions in CIMB Bank Cardholder Terms and Conditions and/or(iii) MUST NOT be terminated and/or be made subject to any attachment, adverse orders made by the Court or any authorities sanctioned by laws and/or delinquent, and/or be invalid and/or cancelled within CIMB Bank s definition, otherwise they will be disqualified from participating in this Campaign or being the Eligible Participant(s) and/or Shortlisted Participant(s) and/or Winner(s). 19. An Eligible Participant(s) is eligible to win only one (1) Prize under this Campaign. The Prize(s) are not transferable to another person or exchangeable for cash and does not include other related costs and expenses. 20. The Winners list will be posted on CIMB Bank s website at www.cimbbank.com.my within 12 weeks after the end of the Campaign Period. The Prize will be credited to the 3

Winner s CIMB Credit Card account within 90 days from the end of the Campaign Period. 21. The Bank reserves the right to forfeit any Prize(s) won and disqualify the Eligible Participant(s)and/or Shortlisted Participant(s) and/or Winner(s) in the event of a reversal of transactions and/or Qualified Bonus Points Redemption or cancellation or termination of the transactions and/or Credit Card during the Campaign Period and/or failure to comply with any terms and conditions herein. General Terms and Conditions 22. The Winner(s) of this Campaign agree and authorise CIMB Bank to disclose the Winner(s) details (including but not limited to name, NRIC number, telephone number and address) to the distributor/agent who would then contact the Winner(s) regarding the delivery or redemption of the Prize(s). The Winner(s) are responsible to make the necessary arrangements with CIMB Bank and/or /distributor/agent to collect or redeem their Prize(s). CIMB Bank will not bear any accommodation and/or transportation and/or any other cost that the Winner(s) may incur or have to incur in the course of redeeming or using the Prize(s). 23. By participating in this Campaign, the Eligible Participant(s) are deemed to have read, understood and agreed to be bound by these Terms and Conditions and the decisions of CIMB Bank and agree all decisions fairly and reasonably made by CIMB Bank in relation to every aspect of this Campaign including the Prize(s) to be given away and the determination of the Winner(s) shall be final, binding and conclusive. 24. It shall be the Eligible Participant(s) responsibility to ensure that the correspondence address and mobile telephone number provided and maintained in CIMB Bank s records are current and updated. CIMB Bank reserves the right to forfeit the Prizes in the event the Eligible Participant(s) and/or Winner(s) mobile number maintained in the CIMB Bank s records is invalid and/or not updated. 25. CIMB Bank shall not be responsible or held liable in any manner whatsoever in respect of technical failures or any kind, whatsoever intervention, interruptions, and/ or electronic or human error in the administration and/ or processing of the Retail Spending Transaction and/or Qualified Retail Spending Transaction performed by the Eligible Participant(s) via CIMB Credit Card unless the same is due to CIMB Bank s willful default or gross neglect. 26. CIMB Bank shall be entitled at its absolute discretion to vary, modify, delete, add to or alter any of the Terms and Conditions herein or any part thereof ( the Amendment ). The Amendment shall be binding on the Eligible Participant(s) and be deemed to be brought to the attention of the Eligible Participant(s) through any prior notice of at least twenty one (21) days sent by CIMB Bank to the Eligible Participant(s) by electronic communication including via electronic direct mail ( EDM ) and/or short messaging service ( SMS ) to the Eligible Participant(s) last known email address or mobile telephone number and/or via display at CIMB Bank s website at www.cimbbank.com.my and/or via any mode of communication which CIMB Bank in its absolute discretion deems fit and the Amendment shall be deemed as binding as from the date of notification of the Amendment or from such date as may be specified by 4

CIMB bank in the notification. Eligible Participant(s) acknowledges and agrees to access CIMB Bank s website at regular intervals to view the Terms and Conditions and to ensure that they are kept up-to-date with any changes or variations to these Terms and Conditions. 27. CIMB Bank reserves the rights to substitute the Prize(s) with prizes of similar cost or value and/or extend, shorten, suspend, cancel and/or discontinue this Campaign upon giving prior notice of (14) calendar days to the Eligible Participants. No compensation in cash or any kind whatsoever shall be given to the Eligible Participant(s) and/or any party arising from such substitution of Prize(s), extension, shortening, suspension, cancellation and/or discontinuation of this Campaign and/or variation, modification, deletion, addition or alteration of these Terms and Conditions herein. 28. By participating in this Campaign, the Eligible Participant(s) agrees that CIMB Bank shall not be held liable or responsible in the event CIMB Bank is unable to perform in whole or in part of any of its obligation herein, attributable directly or indirectly to the failure of any mechanical or electronic device, data processing system, transmission line, electrical failure, industrial dispute, war, strike, riot, any act of God beyond CIMB Bank's control or due to any factor in a nature of a force majeure which is beyond CIMB Bank s reasonable control. 29. The Terms and Conditions herein (as the same may be amended from time to time pursuant to Clause 26) shall be read in conjunction with the prevailing CIMB Bank s Cardholder Terms and Conditions and shall prevail over any inconsistent terms, conditions, provisions or representations contained in any other promotional materials and advertising in relation to this Campaign. 30. Decision of CIMB Bank and/or CIMB Bank s judges in relation to this Campaign shall, save for manifest error, be final, binding and conclusive. CIMB Bank reserves it absolute rights and discretion to disqualify and/or reject any Eligible Participant(s) and/or Shortlisted Participant(s) and/or Winner(s) that it determines or reasonably suspects to be tampering with the process or the operation of this Campaign, or to be acting in breach of the Terms and Conditions herein. 31. CIMB Bank shall not be liable to any Eligible Participant(s) or any party for any loss or damage of whatsoever nature suffered by the Eligible Participant(s) or any party save for any loss or damage caused directly by the omission or negligence of CIMB Bank. For the avoidance of doubt, CIMB Bank shall in no event be liable for any loss of income, profits or goodwill, indirect, incidental, consequential, exemplary, punitive or special damages of any party including third party) howsoever arising whether in contract, tort, negligence or otherwise in connection with this Campaign. 32. By acceptance or receipt of the Prize(s), the Winner(s) agrees to hold harmless CIMB Bank and its affiliates and their respective directors, officers, employees and agents from and against any claim, action, proceeding, judgment, damage, loss, expense or liability suffered by CIMB Bank and its affiliates and their respective directors, officers, employees and agents in connection with such Winner(s) participation in this Campaign or receipt, redemption or use of the Prize(s), save for any claim, action, proceeding, judgment, damage, loss, expense or liability caused by the negligence or omission of CIMB Bank. 5

33. If there any inconsistency (ies), conflict(s), ambiguity (ies) or discrepancy (ies) between the Bahasa Malaysia and English version or other language version of these Terms and Conditions herein, the English version of these Terms and Conditions shall prevail. Notwithstanding the aforementioned where request is made by the Eligible Participant(s) and noted and acknowledged by CIMB Bank in its records that the Bahasa Malaysia version of the terms and conditions shall govern the operation of the CIMB Credit Card, then the Bahasa Malaysia version of the Terms and Conditions herein shall prevail. 34.
