WAIVER AND RELEASE P3 NAME OF PARTICIPANT: (Please print) Date OF BIRTH: Waiver and Release: In consideration for IMG Academy LLC (hereafter IMG ) accepting the enrollment of Participant in a program and/or permitting Participant access to or the use of the property, facilities, parking lot, buildings, fields, equipment, housing, dining areas, and/ or services of IMG Participant and his/her Parent/Guardian, on behalf of Participant(hereinafter Releasors ), hereby release IMG its affiliated companies and all of its, members, directors, officers, employees, volunteers, sponsors, independent contractors or agents, for any liability, claims, actions, damages, costs, expenses or lawsuit whatsoever, arising out of or in any way connected with Participant s enrollment and participation in the program or the use of any IMG service or facility by Participant and/or his/her guests, relatives or family members. The scope of this Waiver and Release shall include, but is not limited to, any damages, losses or injuries in connection with transportation, food, lodging, medical concerns (physical and emotion), entertainment, photographs, athletic activities and physical injury of any kind that arise from Participant s own acts, the acts of third persons/parties, the effect of the condition of any property, equipment, or premises, or any acts of IMG s own negligence, or the negligence of any IMG officer, employee, agent, or anyone else whose conduct may be attributed to IMG. The Releasors further agree that this Wavier and Release shall remain effective throughout Participant s enrollment in any IMG program or participation on its property or using its facilities at any time. ACKNOWLEDGMENT: The Releasors acknowledge that he/she/they received the opportunity to review this Waiver and Release. The Releasors further acknowledge to have carefully read and fully understand the contents of this Waiver and Release and have asked and received answers to all questions he/she/they may have and that the Releasors have duly executed this Waiver and Release freely and voluntarily, intending and agreeing to be fully bound by the terms. If any portion is held invalid, the remaining portion of the Waiver and Release will continue in full legal force and effect. ARBITRATION/DISPUTE RESOLUTION: All claims or disputes between the Participant and/or the Participant s Parent(s)/Guardian(s) and IMG Academy, its employees, agents, officers, members, or affiliates, including those arising out of or related to this Agreement or arising out of or related to the Participant s activities with IMG Academy such as, without limitation, any claim based on breach of contract, breach of duty, negligence, gross negligence, fraud, or misrepresentation (collectively the Disputes ) will be resolved through binding, confidential arbitration conducted in or near Bradenton, Florida in accordance with the then-current Consumer Arbitration Rules of the American Arbitration Association ( AAA ). No claims may be brought in any forum on behalf of any putative class. The costs of any arbitration brought by IMG Academy to enforce any provision of this Agreement, including but not limited to attorneys fees, shall be reimbursed by the Participant and/or the Participant s Parent(s)/Guardian(s) to the extent that IMG Academy is the prevailing party. Disputes in which more than $250,000 is at issue will be heard by a panel of three neutral arbitrators; others will be heard by a single neutral arbitrator. For purposes of confirming any award rendered pursuant to this arbitration agreement, Participant and Participant s Parent(s)/Guardian(s) consent to the jurisdiction of the courts of Manatee County, Florida and the United States District Court for the Middle District of Florida. NOTICE TO THE MINOR CHILD S NATURAL GUARDIAN READ THIS FORM COMPLETELY AND CAREFULLY. YOU ARE AGREEING TO LET YOUR MINOR CHILD ENGAGE IN A POTENTIALLY DANGEROUS ACTIVITY. YOU ARE AGREEING THAT, EVEN IF IMG USES REASONABLE CARE IN PROVIDING THIS ACTIVITY, THERE IS A CHANCE YOUR CHILD MAY BE SERIOUSLY INJURED OR KILLED BY PARTICIPATING IN THIS ACTIVITY BECAUSE THERE ARE CERTAIN DANGERS INHERENT IN THE ACTIVITY WHICH CANNOT BE AVOIDED OR ELIMINATED. BY SIGNING THIS FORM YOU ARE GIVING UP YOUR CHILD S RIGHT AND YOUR RIGHT TO RECOVER FROM IMG IN A LAWSUIT FOR ANY PERSONAL INJURY, INCLUDING DEATH, TO YOUR CHILD OR ANY PROPERTY DAMAGE THAT RESULTS FROM THE RISKS THAT ARE A NATURAL PART OF THE ACTIVITY. YOU HAVE THE RIGHT TO REFUSE TO SIGN THIS FORM, AND IMG HAS THE RIGHT TO REFUSE TO LET YOUR CHILD PARTICIPATE IF YOU DO NOT SIGN THIS FORM. AGREEMENT TO PARTICIPATE & Indemnification P4 PARTICIPANT NAME: (Please print) INDEMNIFICATION: In further consideration for IMG accepting the enrollment of Participant in a program, Participant and his/her Parent/Guardian, on behalf of Participant hereby agree to defend and indemnify IMG, its affiliated companies and all of its agents, members, directors, officers, employees, volunteers, sponsors, independent contractors, or agents, from any liability, claims, demands, lawsuits, or damages, including attorney fees, brought by any person (including Participant) or entity for personal injuries or property damage, arising out of, or in any way connected to Participant and/or his/her guests, relatives, or family members active or passive negligence, intentional conduct, and/or criminal conduct. This indemnification agreement is not limited to activities occurring on IMG premises, but encompasses all conduct by Participant and/or his/her guests, relatives, or family members for which a third party seeks to hold IMG, its affiliated companies, or any of their members, directors, officers, employees, volunteers, sponsors, independent contractors, or agents, liable, whether occurring on or off of an IMG property. ACKNOWLEDGMENT: Participant and his/her Parent/Guardian, on behalf of Participant personally, his/her Parent/Guardian personally, acknowledge that he/she/they received the opportunity to review this Indemnification. Participant and his/her Parent/Guardian, on behalf of Participant personally, his/ her Parent/Guardian personally, further acknowledge to have carefully read and fully understand the contents of this Indemnification and have asked, or had the opportunity to ask, and received answers to all questions he/she/they may have and that Participant and his/her Parent/Guardian, on behalf of Participant personally, his/her Parent/Guardian personally, have duly executed this Indemnification freely and voluntarily, intending and agreeing to be fully bound by the terms. If any portion is held invalid, the remaining portion of the Indemnification will continue in full legal force and effect. Assumption of Risks: Physical activity, by its very nature, carries with it certain dangers and risks that cannot be eliminated regardless of the care taken to prevent or minimize harm. IMG has facilities for various sport specific activities such as soccer, golf, tennis, baseball, football and basketball and related activities such as physical training, running, weight training, and swimming. Some of these activities involve endurance or strenuous exertions of strength using various muscle groups, some involve quick movements involving speed and change of direction, some involve contact with equipment, fixed objects (e.g. goal posts), other participants (including participants that are older or younger and who may be larger or smaller in terms of weight and height) and various surfaces types, and others involve sustained physical activity that places stress on the cardiovascular and nervous systems. The specific risks vary from one activity to another, but in each activity the risks range from (1) minor injuries such as cuts, bruises, muscle strains and sprains, to (2) major injuries such as broken or fractured bones, concussions, or lost teeth, to (3) catastrophic injuries, such as heart attacks or fractured skull or those that cause disfigurement, loss of mental capacity, loss of sight, speech or hearing, paralysis, or death. I also understand that the Participant may be exposed, or expose others, to contagious and potentially harmful or deadly disease such as influenza, common cold, chicken pox, meningitis, or measles. Participant will also be exposed to risks while traveling (such as in vans when traveling to and from competitions, social events, or the airport), exposure to large crowds (such as at a big competition or a theme park), and exposure to risks related to receipt of treatment for any physical or mental condition. Participant and Parent/Guardian have read the previous paragraphs and (1) understand the nature of the activities at IMG, (2) understand the demands of those activities relative to the physical condition and skill level of Participant, and (3) appreciate the types of injuries and illnesses and risks related to treatment for any physical or medical condition which may occur as a result of activities that I participate in at IMG. Participant and Parent/Guardian hereby assert that participation in a sport program at IMG and use of their facilities and services is voluntary and that Participant and Parent/Guardian knowingly assume all related risks. Publicity Release and Consent: Participant and Parent/Guardian consent to all recording, photographing and filming of Participant at the Academy or related to IMG activities (the Recordings ) and each agree that IMG can use these Recordings at any time and in any manner without payment to, or additional consent of, Participant or Parent/Guardian and release IMG and its licensees from all claims related to use of the Recordings. Academic RECORDS RELEASE: Participant and IMG Academy will not release report cards to parties other than the parents/guardians of an enrolled student without written permission from Parent/Guardian. The communication between the coaches, residential mentors, faculty, family and student is valuable to the success of the child. In order to fulfill this mission, your signature below is permission is needed to release academic reports to these individuals. Acknowledgement of Rules and Standards of Conduct: Participant and Parent/Guardian understand that IMG has rules and standards of conduct that are set forth in the IMG Academy Student Handbook, which is available on our website and in hard copy, and agree to abide by these rules and standards for the safety of all participants, guests and employees whether on or off campus, in session or on vacation for the duration of enrollment at Academy. In addition, all Participants must comply with any applicable city, state or federal laws and ordinances. Participant may be subject to disciplinary actions for failure to do so. There will be no refund or credit due for dismissal, suspension, or lost training days or school as a result of disciplinary action. Acknowledgment of Understanding: Participant and Parent/Guardian have read this agreement to participate and fully understand its terms. Participant and Parent/Guardian acknowledge, freely and voluntarily, signing the agreement to participate and intend the signatures to signify a complete assumption of the inherent risks of participating in or observing activities at IMG to the greatest extent allowed by law in the State of Florida. ACTIVITY PERMISSION and sign out FORM (ALL STUDENTS) P5 PARTICIPANT NAME: Sport: (Please print) ACTIVITY/PERMISSION I hereby give my child permission to participate in all athletic, social and educational activities offered at or through IMG Academy, on-campus and off-campus, such as, without limitation, the following: Permission to go to games and tournaments or competitions in the USA or outside the USA, the beach, theme parks, malls and other entertainment venues and other activities or outings not specifically listed above accompanied by IMG Academy s staff. Permission to attend local restaurants and other local venues (Wal-Mart, Best Buy, etc.) unaccompanied by IMG Academy staff. I understand the Academy will use reasonable efforts to notify restaurant management to ensure proper behavior (i.e., no purchase of alcoholic beverages, no smoking, no leaving restaurant until Academy picks up). Permission to play at local golf courses on weekends. I understand the IMG Academy staff will drop off and pick up my child, but will not supervise golf round or activities at the golf course. Permission to be transported by faculty and/or staff of the academic school he/she is attending while enrolled at IMG Academy. Permission to participate in sport product testing. Permission to participate in sports activities and play which are not supervised by IMG Academy or under its control (i.e., biking, pickup basketball games, ice skating, etc.) for which IMG Academy will have no responsibility. OFF-CAMPUS RELEASE - BOARDING STUDENTS ONLY I hereby give my child permission to go off-campus or on an overnight visit with adult individuals and/or families specified on the below sign out form. I understand that my child will not be given permission to go off campus with individual families or other persons unless specified by me in writing by fax (941)752-2528 or via e-mail to CampusLife@img.com. IMG Academy will not accept permissions other than those placed on attached form or submitted in writing to IMG. I further understand that IMG Academy does not monitor the individuals or families authorized by me and that once my child is released to the individuals authorized by me, I agree that IMG Academy will have no responsibility or liability for anything that happens with or to my child. THIS IS LIVING OPTIONS P6 Laundry package The 2017-2018 Laundry Package includes a twice weekly laundry service with pick-up and drop-off to students dorm rooms. Clean laundry is delivered to the students dorm rooms within 48 hours of pick-up. If you wish to sign up your child, please indicate your selection by checking one of the boxes provided. Laundry Package Cancellations: Participant that cancel their laundry service, in writing, on or before fourteen (14) days after their arrival at IMG Academy may be eligible for a 50% refund of the amount paid for the service. Any cancellations of the laundry service more than fourteen days after the Participant s arrival will result in no refund of the amount paid for the service. IMG ACADEMICS/ATHLETICS DRESS CODE & UNDER ARMOUR EQUIPMENT POLICY P7 ACADEMIC DRESS CODE Recognizing our student athletes share a strong sense of pride in being members of the IMG Academy community, we designed the following academic dress code to complement the uniform-based dress code student-athletes follow in their designated sport. Students must adhere to the following dress code during school hours in the Academic Center even if not attending class and while taking final exams. Students not in proper uniform are subject to consequence. Tops: School uniform shirt must be polo style with collar and one of four colors provided in the school uniform package. The uniform shirts will be worn Monday, Tuesday, Thursday and Friday. On Wednesday a student-athlete can wear any type of Under Armour Polo as long as it has the IMG logo visible. Sweatshirts or jackets are permitted in the school but must be taken off in the classroom. Bottoms: School uniform pants and shorts must be chino style, solid color, and in good repair (no holes or frayed edges). Shorts must be no shorter than fingertip length when arms are placed at one s side. Jeans, pajama bottoms, sweatpants, leggings, denim, skirts, camouflage, shorts/pants with prints and athletic shorts/pants/tights are not permitted. Hats: Hats are not permitted inside the Academic Center (including entry ways, hallways, and classrooms). Shoes: Shoes must be in good repair. Open toe shoes will be permitted. Closed toe shoes maybe required for academic labs and/or field trips. Headphones/Earbuds: Headphones and earbuds are not permitted in the school. Uniforms are now available for purchase in the IMG Bookstore or on ShopIMG.com (http://shopimg.com/collections/school-uniforms). You may also place your order over the phone by calling the IMG Bookstore at 941-749-8754. All uniform items will be available at the IMG Bookstore year-round. ATHLETICS DRESS CODE & UNDER ARMOUR EQUIPMENT POLICY All IMG Academy student-athletes are required to adhere to the IMG Academy Under Armour Equipment Policy. IMG Academy is proud of its relationship with Under Armour (hereafter UA ), the Official Outfitter of IMG Academy. Each sport is provided an allocation of Under Armour gear which will differ by sport. Under Armour provides IMG Academy student-athletes with a generous supply of practice and competition merchandise specifically produced for IMG Academy student-athletes Each student-athlete is expected to wear his or her official IMG Academy Under Armour gear when participating in an official team activity. An official team activity is defined as competition, practice, workouts, travel to/from competition, photo sessions, and IMG Academy public appearances. Any student-athlete not wearing his/her allocated Under Armour gear during an official team activity will not be allowed to participate in that day of activities, including competitions. Shoes: Running shoes, cross trainers, or sneakers that have been allotted to the student-athlete are to be worn to and from training, competition, and in the weight room at all times. If a student-athlete is not able to wear Under Armour footwear, he/she should follow the steps set forth in the Student-Athlete Handbook (provided at check-in). Clothing and Soft Goods: UA clothing/soft goods must be worn at all times while participating in an official team activity. This would include the sports practice and game venue as well as APD classes and the weight room. Use of any product by a competitive company is not allowed. If an IMG student-athlete is not in compliance, then they are not allowed to participate in that training or competition.
