Hong Kong Science and Technology Parks Corporation Adoptive Survey and Consultancy for an Industrial Building at Wang Lee Street Yuen Long Industrial Estate, New Territories (Agreement No. IEBU/CA/015) Expression of Interest ( EOI ) Ref: EOI/2018/OMU/002 1. Invitation for EOI The Hong Kong Science and Technology Parks Corporation ( HKSTP ) is inviting professional firms with experience in adoptive survey and consultancy services to express their interest in undertaking the captioned service. 2. Description of the Property The Property is a partially completed structure with a target total floor area of 39,597m² on a 15,838m 2 site in Yuen Long Industrial Estate. Under the Revised Industrial Estates Programme, HKSTP is desirous of completing the Property into a specialized multi-storey industrial building for rent to multi-users. The target tenants are pharmaceutical manufacturers with need to locate their production to premises with sufficient provisions for Pharmaceutical Inspection Co-operation Scheme (PIC/S) Good Manufacturing Practice (GMP) standards. 3. Scope of Works The consultant will be engaged to provide consultancy service ( the Service ) involving the followings :- (a) (b) Adoptive Survey To Provide professional services in undertaking a comprehensive check on the constructed portion of the building and its building services, and collect all the required/outstanding information from the consultants originally hired for the suspended project. The survey report shall be completed with recommendation for the possible utilization of the constructed structure and the concept/way forward of the new building design. Consultancy - To provide professional services in respect of design and management of all necessary construction works to complete the new building 1
into a multi-storey industrial building for rent to multi-users in pharmaceutical industry and with sufficient provisions to meet PIC/S GMP standards. 4. Tentative Commencement Date The Service is tentatively scheduled to commence in July 2018. 5. Submission for EOI The consultant is required to submit the following information:- (a) (b) (c) the duly completed Proforma for Pre-Qualification as shown in Annex B based on the notes in Annex A; the duly completed Proforma for EOI Submission as shown in Annex C; and a statement or a copy of ISO 9000 Certification in accordance with the requirements in Annex D. The consultant shall identify his proposed sub-consultants (if required) in the above submission. The sub-consultant is not allowed to be changed in the subsequent detailed technical and fee proposal submission without acceptable justification. The consultant is also required to declare any involvement or interest if it is considered by the consultant to be in real or apparent conflict with the duties to be performed for the Service. Any involvement or interest declared would be carefully considered but would not automatically bar the consultant from being further considered in the selection process. Late submissions or submissions that do not conform to the requirements will not be considered. At this stage, the submission is not intended to be comprehensive, please limit the submission to the requested items. 6. Selection Criteria Consultants that fulfill the qualifying criterion as mentioned in Annex A will be assessed based on the following selection criteria for shortlisting. (a) Appreciation of the key requirements and constraints/ risks (15%) (b) Approach and strategy in architectural design and project administration to meet the requirements of the assignment (30%) (c) Previous relevant experience in Hong Kong (15%) (d) Knowledge, experience and capability of core personnel (40%) 2
The shortlisted consultants will then be invited to further submit the detailed technical and fee proposals. HKSTP is not bound to invite any consultant to make further submission. It should be noted that HKSTP will not be responsible for the reimbursement of any cost incurred for the preparation of the submission. 7. Submission Consultant should submit the EOI proposal and one copy of Non-Collusive Tendering Certificate, duly signed with company chop (in the form set out at Annex E to this EOI) via our HKSTP TENDER Website https://tender.hkstp.org/ on or before 12:00 noon, 31 May 2018. No late submission will be accepted. Remark: Because this is an EOI which shortlists the consultants for tendering, in your submission, consultant should input 0 under the Total Contract Sum (HK$) section of HKSTP TENDER Website. 8. The project should be completed within the last eight (8) years counting from the submission deadline and had a final cost not less than HK$500 million. (2) The consultant is required to complete the declaration proforma attached in Annex B. (3) The attention of the consultant is drawn to the following notes for the minimum experience requirements:- (a) (b) (c) (d) (e) (f) (g) (h) Only the experience of the consultant in Hong Kong will be considered. For projects completed within the past 8 years, irrespective of its commencement date, the full costs of the project would be taken into account. The experience of a parent, subsidiary or affiliated company will not be considered. Sectional completion, not being the last section completed excluding establishment works, if any, will not be considered. Projects which are still on-going, irrespective of the date of the commencement of the project, will not be considered. Completion here means certified substantially or practically completed by the Architect, Engineer, Surveyor, Project Manager, or equivalent, and applies to the contract as whole (exclude Defects Liability Periods or Maintenance Periods). The last 8 years shall be the period taken from the original date set for the submission deadline (i.e. 31 May 2018) and not be affected by extension. For novated contracts, only those contracts novated before the date on which this Notice is first published will be considered. The full project cost will be considered to be accountable to the new consultant (the novatee) but not the old consultant (the novator). Annex A - 1

Hong Kong Science and Technology Parks Corporation Adoptive Survey and Consultancy for an Industrial Building at Wang Lee Street, Yuen Long Industrial Estate, New Territories Agreement No. IEBU/CA/015 Annex D Requirements of ISO 9000 Certification (1) The consultant shall submit, together with its expression of interest, a copy of its ISO9001:2008 certificate acceptable to the Employer showing the scope of certification and a statement either: (A) confirming that no area/aspect in the consultancy agreement which its quality system specifically excludes; or (B) disclosing the areas/aspects in the consultancy agreement which its quality system specifically excludes. (2) Subject to the following paragraphs, submissions from consultants who have not obtained ISO 9001:2008 certification on or before the date of this invitation may not be considered. (3) If the consultants, due to circumstances beyond its control, has not obtained ISO 9001:2008 certification but a full review of the Quality Manual of its Hong Kong office has been carried out in Hong Kong by a certification body acceptable to the Employer and such Quality Manual has been confirmed by the certification body as being in conformity with the requirements of ISO 9001:2008 standard on or before the date of this invitation, the submission by the consultant will still be considered provided that the consultant shall undertake in writing if it is awarded the consultancy agreement, to book within three months of the award of the consultancy agreement, the date of audit for the ISO 9001:2008 certification with the certification body; with detailed documented quality system procedures ready at the time of booking. The booking of the audit shall be a condition precedent to the consultant s entitlement to any payment or any further payment of fees under the consultancy agreement. (4) If the consultant whose scope of certificate excludes site activities service which is required to be provided by the consultant under the consultancy agreement, its submission will be considered to be non-conforming in respect of the certification requirements. If the consultant can prove to satisfaction of the Employer that such exclusion is due to circumstances beyond its control, the proposal may still be considered to be conforming in respect of the certification requirements provided that the consultant shall undertake in writing that if the consultant is awarded the consultancy agreement, it shall apply within three months of the award of the consultancy agreement to the certification body for revision of its current scope to cover site activities service; with detailed documented quality system procedures ready at the time of applying for revision. The submission of an application for revision of the scope of its ISO 9001:2008 certification to cover site activities service shall be a condition precedent to the consultant s entitlement to any payment or any further payment of fees under the consultancy agreement. (5) If the consultant is a joint venture, the consultant shall submit, together with its expression of interest, a statement declaring that it shall implement the quality system of one of its participants or shareholders, and specifying which one. The reference to ISO 9001:2008 certification referred to in (1) to (4) above shall refer to that of the specified participant or shareholder. The consultant shall also submit a copy of the written notification to the certification body of the specified participant or shareholder that the joint venture shall implement the quality system by the specified participant or shareholder and the written agreement of all participants, or as the case may be, shareholders of the joint venture that the activities of the joint venture shall be subject to the surveillance of the certification body

Paragraph 2(b) of this certificate shall not apply to agreements, arrangements, communications, understandings, promises or undertakings with: (a) HKSTP; (b) a joint venture partner, where joint venture arrangements relevant to the bid exist and which are notified to HKSTP;
(c) consultants or sub-contractors, provided that the communications are held in strict confidence and limited to the information required to facilitate that particular consultancy arrangement or sub-contract; (d) professional advisers, provided that the communications are held in strict confidence and limited to the information required for the adviser to render their professional advice in relation to the Tender; (e) insurers or brokers for the purpose of obtaining an insurance quote, provided that the communications are held in strict confidence and limited to the information required to facilitate that particular insurance arrangement; and (f) banks for the purpose of obtaining financing for the Contract, provided that the communications are held in strict confidence and limited to the information required to facilitate that financing. Disclosure of subcontracting 4. We understand that we are required to disclose all intended sub-contracting arrangements relating to the Tender to HKSTP, including those which are entered into after the Contract is awarded. We warrant that we have duly disclosed and will continue to disclose such arrangements to HKSTP. Consequences of breach or non-compliance 5. We understand that in the event of any breach or non-compliance with any warranties or undertakings in this certificate, HKSTP may, at its discretion, invalidate our bid, exclude us in future tenders, pursue damages or other forms of redress from us (including but not limited to damages for delay, costs and expenses of re-tendering and other costs incurred), and/or (in the event that we are awarded the Contract) terminate the Contract. 6. Under the Competition Ordinance, bid-rigging is serious anti-competitive conduct. We understand that HKSTP may, at its discretion, report all suspected instances of bid-rigging to the Competition Commission (the Commission ) and provide the Commission with any relevant information, including but not limited to information on our bid and our personal information.
