The lwest respnsible bidder fr this prject is FTR Internatinal, Inc., lcated at Irvine, Califrnia. The cntract amunt, plus 10% cntingency, is $47,005,062.00, and the cntract duratin is 1,090 calendar days. RECOMMENDATIONS: It is recmmended that the Bard f Harbr Cmmissiners: 1. Award the abve mentined cntract fr Item Ns. 1 thrugh 15 f the prpsal schedule t FTR Internatinal, Inc., in the amunt f $42,731,875.00; that a 10% cntingency nt included in the riginal cntract amunt be applied fr a ttal authrized amunt f $47,005,062.00; and that payment be authrized frm the Cnstructin Accunt. The cntract time fr perfrmance f the wrk will be 1,090 calendar days frm the Ntice t Prceed. 2. Authrize the Executive Directr t execute and the Bard Secretary t attest t this cntract fr and n behalf f the Bard. 3. In accrdance with the City Charter 655(g), delegate and authrize the Executive Directr t accept the cnstructin cntract upn its cmpletin. DISCUSSION: 1. Due t the grwth f the Prt and the need fr additinal security, the Prt Plice staff is expanding, and its physical and technlgical capabilities are being increased. Prt Plice staff has been authrized t expand its current FY 07108 level f 142 swrn and 84 civilian (including security fficers) persnnel t a FY 08/09 level f 212 swrn and 161 civilian persnnel. Additinal expansin beynd these levels is being cnsidered. The current 4,000 square feet f Prt Plice space in the Harbr Administratin Building was riginally designed fr 30 fficers and is cnsiderably vercrwded and can nt supprt any additinal staff. The new headquarters will prvide additinal space alng with imprvements in technlgies, including an updated dispatch center and surveillance center, that will enable the Prt Plice t enhance its capacity t prtect the prt.

The prject cnsists f the demlitin f an existing 2-level parking structure, cnstructin f a 3-stry plice building with 1-level subterranean parking, cnstructin f assciated utilities, cmmunicatins and security systems, hardscape, landscape, and site wrk. 3. The prject will achieve a LEED Gld rating and certificatin frm the U.S. Green Building Cuncil, and will incrprate sustainable design and cnstructin elements including, but nt limited t, the fllwing: 3.8 kw Phtvltaic slar panels Recycle, by diversin frm landfills, 75% f inert cnstructin debris Energy saving features such as high perfrmance HVAC and ptimized interir lighting levels Water efficient landscaping and use f water efficient plumbing Cnstructin materials t use 10% recycled cntent, and 50% f materials extracted reginally On-site strm-water management system that reduces run-ff and treats strm water befre it leaves the site Use f lw-emitting cnstructin materials 4. In accrdance with Reslutin N. 6468 apprved by the Bard f Harbr Cmmissiners n January 4,2007, pre-qualified prime cntractrs were requested t submit bids fr this prject, and nly pre-qualified Specialty Wrk subcntractrs will perfrm electrical, mechanical, pile installatin, and security systems wrk frthis prject. 5. In rder t facilitate subcntractr pprtunities, the Ntice Inviting Bids was advertised n the Prt f Ls Angeles Website and in the L.A. Times, L.A. Watts Time, Ddge Cnstructin "Green Sheets", Hy, and Metrplitan News Cmpany.

DATE: JANUARY 31, 2008 PAGE 3 OF 5 6. As authrized by the Executive Directr n Nvember 20, 2007, the Chief Harbr Engineer received bids fr the subject prject n January 23, 2008. Six bids were received frm S.J. Amrs Cnstructin C.; Mallcraft, Inc.; Pinner Cnstructin Cmpany; Sinanian Develpment, Inc.; Bernards; and FTR Internatinal in the amunts shwn n the attached Analysis f Bids. The bids received n that date were pened and declared. FTR Internatinal, Inc. was determined t be the apparent lw bidder at $42,731,875.00. 7. FTR Internatinal, Inc. has prvided the required dcumentatin regarding the Small Business Develpment Prgram. Their Small Business Enterprise participatin is 28.0%. The Department had set a minimum SBE participatin level f 25% fr this prject. 8. This cntract includes a lcal hire prvisin that requires the cntractr t make a gd faith effrt t hire wrkers frm lcal areas. A gal f 30% lcal hire and 5% atrisk wrkers has been established fr this prject. The cntract requires the cntractr t submit mnthly status reprts indicating their lcal hire and at-risk wrker percentages achieved that mnth. Achievement will be mnitred via certified payrll recrds submitted t the City f Ls Angeles Office f Cntract Cmpliance. The cntractr will be required t take apprpriate measures t achieve the specified gals. At-risk wrkers are defined as meeting tw r mre f the fllwing criteria: 1) Husehld incme belw 50% f the median fr Ls Angeles Cunty; 2) Hmeless; 3) Welfare recipient; 4) Histry f invlvement with the justice system; 5) Unemplyed; r 6) Single parent. 9. Cnstructin staff has verified FTR Internatinal, Inc.'s state license and prject references. In cnfrmance with Sectin 10.8.4 f Ordinance N. 143429, certificatin is hereby made that FTR Internatinal, Inc. has executed and filed an Affirmative Actin Plan with their bid. A ntificatin letter has been sent t the Office f Cntract Cmpliance as required in the rdinance. 10. This cntract is cnsistent with State f Califrnia Prevailing Wage prvisins. 11. A Castal Develpment Permit is nt required fr this prject.

DATE: JANUARY 31, 2008 PAGE40F5 ENVIRONMENTAL ASSESSMENT: The prpsed actin invlves award f a cntract t cnstruct a three-stry Prt f Ls Angeles Plice Headquarters building in San Pedr cnsistent with the prject analyzed in the Prt Plice Headquarters, Califrnia Maritime Center, and Charter High Schl Envirnmental Impact Reprt (ADP N. 030212-032), which was adpted by the Bard f Harbr Cmmissiners in September 2005. As such, the Directr f Envirnmental Management has determined that the prpsed activities were previusly assessed under the Califrnia Envirnmental Quality Act (CEQA), in accrdance with Article II Sectin 2(i) f the Ls Angeles City CEQA Guidelines. FINANCIAL IMPACT: Funds fr this cntract have been budgeted in the current 2007/2008 Fiscal Year in Accunt N. 54510 (Capital Cnstructin Services), Wrk Order N. 24583, Center N. 1181 and Prgram N. 624. It is anticipated that funds will be expended as fllws: FY 2007-2008 $ 1,141,044 FY 2008-2009 $20,117,194 FY 2009-2010 $20,075,410 FY 2010-2011 $ 1,398,227 Ttal $42,731,875 Althugh the Cntractr is nt bligated t perfrm any wrk under the cntract in any fiscal year in which n apprpriatin fr the cntract has been made, the Cntractr agrees t resume perfrmance f the wrk required by the cntract n the same terms and cnditins fr a perid f 60 days after the end f the fiscal year if an apprpriatin therefre is apprved within that 60-day perid. The Cntractr is respnsible fr maintaining all insurance and bnds during this 60-day perid. The time fr perfrmance will be extended during this perid until the apprpriatin is made; hwever, such extensin f time is nt cmpensable. If in any subsequent fiscal year funds are nt apprpriated fr wrk required by the cntract, the cntract shall be terminated. Hwever, such terminatin shall nt relieve the parties f liability fr any bligatin previusly incurred.
