Clarifies that Roadway fees shall be collected in the Westside industrial area only, Amends the City s consolidated fee schedule to reflect the changes to fees and clarification of fees for appeal. The Administration has confirmed that they will begin the process to re-open the Impact Fees Facility Plan shortly. The Administration indicates that they will include the following in the scope: establishing level of service, update service areas, creation/update of list of projects, modification of impact fees based on new service areas and projects, examination of program where developers can build public facilities in lieu of paying fee (would include discussion of long-term maintenance, liability, public usage, etc.), analysis of separation of roadway fees (to collect for roads in a separate area than for other modes of transportation) or collection citywide. SALT LAKE CITY ORDINANCE No. of 2014 (Amending impact fee service areas) AN ORDINANCE AMENDING SECTION 18.98.040, SALT LAKE CITY CODE, TO MODIFY THE ROADWAY FACILITIES IMPACT FEE SERVICE AREA. WHEREAS, it is proposed that Section 18.98.040, Service Areas, Salt Lake City Code, be amended to modify the roadway impact fee service area; and WHEREAS, the City Council finds adoption of this ordinance reasonably furthers the health, safety, and general welfare of the citizens of Salt Lake City. BUDGET IMPACT: The proposed ordinance would decrease the parks impact fee from the current amount to the Mayor's original proposed fee. This transmittal also clarifies the Administration's intent in collecting roadway impact fees pursuant to the existing ordinance. BACKGROUNDIDISCUSSION: On December 10,2013, an initial transmittal was submitted to the Council regarding impact fees. Since that submittal, additional infonnation has been received and included and this transmittal supplements and clarifies the original transmittal, and now stands as the most current transmittal from the Administration. In May 201 2 the City Cowlcil voted to approve the 10-Year Capital Facilities Plan and an increase to the City'S impact fees. Galena Consulting, the impact fee consultant, was hired by the City to research and compile the 10-Year Plan. They presented three recommendations to the Mayor and the City Council regarding the impact fees. The Mayor chose an option with lower impact fees and fewer items on the fiscally constrained project list. The G:ouncil approved a different option which included various increases or 451 SOUTH ST... decreases to the fees and a more expansive project list. The most significant changes in the new impact fee schedule inclnde a) a change to the park fee which was increased from the Mayor's recommendation of $1,752 to $3,999 and b) an intended change in the way that roadway fees are collected. In the previous plan, fees for roadways were paid for projects within three areas: infill development, west side, and northwest quadrant; however, the Council intended to enact an ordinance requiring collection of roadway impact fees City-wide. Although the 10-Year Capital Facilities Plan was approved in 2012, the impact fees were put into effect beginning January I, 2013. Throughout 2013, various divisions within Community and Economic Development received several complaints and comments from the development community regarding the changes to the fees. The feedback received is that due to the change in impact fees, particularly the roadway and parks fees, many developers have or are threatening to move to other cities, choosing not to build, or are considering legal action against the City, all of which are affecting the economic health of the City. There is also an intemal issue to the City with the impact fee increase. Impact fees are required to be spent within a six-year period or be repaid to the developers who were charged the fees. Based on growth, a percentage of impact fees may be used for eligible projects, which means that the remaining funding must come from another source, typically the general fund or Class C. Due to the significant increase of impact fees as a result of the higher fee schedule, the City will not only need to have eligible projects for the use of the fimds but will also need to have additional funding available to malce up the difference in cost, or match, before the six-year expiration. Eligible projects are those identified in the constrained 10-Year Capital Facilities Plan. During the yearlong process to adopt the 10-Y eai' Capital Facilities Plan, the Council reviewed and approved a list of projects submitted by the Administration, such as park, bicycle and pedestrian, and roadway improvement projects. (A complete list of these projects maybe found in the 10-Year Capital Facilities Plan.) The consultant then prepared a fiscally constrained Sources and Uses that outlined what the projects are and how they should be funded using impact fees or other sources. However, a reduced impact fee schedule would result in proj ects not being full y-funded as outlined in the current Capital Facilities Plan. One other consideration is that the fiscally constrained plan is also based on a 7% on-going General Fund contribution. Finally, while the City Council intended to enact an ordinance requiring City-wide collection of roadway impact fees, the currently enacted ordinance exempts all areas of the City except the Northwest Quadrant and the Westside Industrial Area from collection of roadway impact fees. As the ordinance is currently written, the City's collection of roadway impact fees should be limited to the Northwest Quadrant and the Westside Industrial Area. This discrepancy between the City Council's intent and the language of the enacted ordinance was recently discovered, and the City collected roadway impact fees City-wide throughout 2013. Staff Comparison

The Administration has created a comparison of the past and present fees. The following chart separates the comparison offees into three categories: Infill, Westside Industrial Area, and Northwest Quadrant to clarify the different fee increases or reductions in the two main commercial development areas of the City under the previous impact fee schedule. The results of that comparison indicate that the City's fees are consistent with or, in many instances, less than those of the municipalities outside ofthe state. Salt Lake City'S fees are slightly higher when compared to local municipalities. However, since the 2012 increase in impact fees is being perceived as extreme within the development community, the City might reconsider the method in which fees are collected and spent in accordance with the intent of the state Impact Fees Act. The Administration recommends the Council enact an ordinance which decreases the parks impact fee to the Mayor's original proposed amount of$1,752 and incrementally increases the fee armually over a five year period. The Administration recommends an automatic increase of $562 in the parks impact fee per year until it reaches the current amount of $3,999, The amounts per year would be as follows: in year 1 the fee would be $1752; in year 2, the fee would be $2314; in year 3 the fee would be $2876; in year 4, the fee would be $3438; and in year 5 the fee would be $3999. These increases would be written into the City's Consolidated Fee Schedule as automatic increases, so the City Council does not have to reconsider the fee on an annual basis.

The Administration recognizes that by decreasing the parks fee some projects in the Capital Facilities Plan may not be fully ftmded with impact fees and recommends that the City Council either fund these projects using other sources or open and amend the eligible projects in the 10-Year Capital Facilities Plan. In addition, because the parks fees will annually automatically increase, the City will, within five years, be close to the level of service and recommended parks impact fee under the 10-Year Capital Facilities Plan. Under state law, the Council has the right to enact an ordinance, Attachment B, decreasing the parks impact fees, and adding an automatic incremental increase, without revisiting the Capital Facilities Plan, so the Administration recommends that as the first step. Prior to reducing the parks impact fees, the City Council will be required to provide notice and hold a public hearing pursuant to Utah Code Ann. 11-36a-504. While it was the City Council's intent to assess roadway impact fees Citywide, the current impact fee ordinance exempts all development within the City from roadway impact fees unless the development is within the Westside Industrial Area or the Northwest Quadrant. Upon discovery of this discrepancy between the City Council's intent and the language of the ordinance, the Administration stopped collecting roadway impact fees for projects located outside the Northwest Quadrant and the Westside Industrial Area. The Administration is also preparing to refund roadway impact fees that were collected in 2013 from developments outside these two areas. The Administration recommends keeping the language ofthe ordinance as it is currently written, and collecting roadway impact fees only for development in the Northwest Quadrant and Westside Industrial Areas of Salt Lal<e City where there is the most significant growth, and where most of the roadway projects identified in the Capital Facilities Plan are located. In the alternative, if the City Council would prefer to collect Citywide roadway impact fees, the ordinance must be amended to remove the exemption for development outside the Northwest Quadrant and Westside Industrial Area. If the City Council revises the ordinance to make the roadway impact fees Citywide, it must provide notice and hold a public hearing pursuant to Utah Code Ann. ll-36a-504. The Administration also recommends that the City set aside the difference between the decreased park fees and the currently adopted fees that were collected during 2013 and not allocate the difference in fees to a specific project until the current plan is amended or a new plan is adopted. Finally, the Impact FeeOrdiiiiihce also a1lbwsf()tappeals anof6r oevel6persto perform an independent calculation for development activity. The appeals process requires a $50 fee and the independent calculation requires a $150 fee to be paid. Neither fee is currently shown in the Consolidated Fee Schedule. The attached update to the Consolidated Fee Schedule will include those fees as per ordinance.

As outlined in the 10-Year Capital Facilities Plan there is great need in the City for capital improvements and impact fees playa vital role in providing those for the community. However, based on the comments from the development community, the City's current impact fee assessment may actually be a detriment to achieving the goals outlined in the plan if developers are truly taking their projects to other municipalities because of the City's impact fees. SALT LAKE CITY ORDINANCE No. of2014 (Amending the Consolidated Fee Schedule by Adding, Eliminating, or Modifying Certain Fees) AN ORDINANCE AMENDING THE SALT LAKE CITY CONSOLIDATED FEE SCHEDULE BY ADDING, ELIMINATING, OR MODIFYING VARIOUS FEES. WHEREAS, on May 17,2011 the City Council adopted Ordinances 2011-23, 2011-24 and 2011-25 to authorize and create the Salt Lake City Consolidated Fee Schedule; and WHEREAS, the Salt Lake City Consolidated Fee Schedule has since been amended fro m time to time; and WHEREAS, it is now proposed that the Salt Lake City Consolidated Fee Schedule be amended to include, eliminate, or otherwise modify various fees as shown in the attached Exhibit "A"; and WHEREAS, the City Council finds (i) the fees set forth in Exhibit "A" are necessary, reasonable, and equitable in relation to regulatory and service costs incurred by the City; and (ii) adoption of this ordinance reasonably furthers the health, safety, and general welfare of the citizens of Salt Lake City. NOW, THEREFORE, be it ordained by the City Council of Salt Lake City, Utah: SECTION I. The Salt Lake City Consolidated Fee Schedule shall be, and hereby is, amended in pertinent part to reflect the fees set forth in the attached Exhibit "A". SECTION 2. The pertinent portions of the official copy of the Salt Lake City Consolidated Fee Schedule shall be revised to reflect the fees set forth in the attached Exhibit "A" and a copy of the entire Salt Lake City Consolidated Fee Schedule that incorporates such revisions shall be published on the official Salt Lake City website. SECTION 3. This ordinance shall become effective immediately upon publication.
