HONG LEONG MSIG TAKAFUL BERHAD (HLM Takaful) PERSONAL ACCIDENT TAKAFUL- MATTA HAJI DATE: 01/01/2015 1. What is this product about? This certificate provides compensation in the event of accidental bodily injuries being sustained by a Participant during the Period of Takaful coverage, caused solely and directly by violent, accidental, external and visible events, which shall result in death or disablement while travelling. Please refer to the Master Certificate for full details. 2. What are the Shariah concepts applicable? Takaful is a concept of mutual guarantee which is in compliance with Shariah principles. Contributions collected from participants are pooled together to provide for the benefits in the event of losses suffered by any of its members or participants. Hong Leong MSIG Takaful Berhad (HLM Takaful) as a Takaful operator is entrusted to properly invest and manage this mutual fund. Iltizam Bi Al Tabarru Shall mean the commitment to make Tabarru. Tabarru Shall mean a certain portion of the contribution that the participant agrees to donate upon occurrence of events approved by Shariah Committee of HLM Takaful, thus enabling him to fulfil his obligation of mutual help and joint guarantee should any of his fellow participants suffer a defined loss where his donation is meant to help others and others donations are meant to help him. Wakalah Shall mean an arrangement appointing HLM Takaful to manage the overall services provided under the Certificate. HLM Takaful will take a portion of the contribution as Wakalah Fee in return of the services rendered. Wakalah Fee Shall mean an upfront fee payable to HLM Takaful in return of the services rendered. Ju alah Shall mean a contract in which the Participant agrees to reward HLM Takaful for its achievement or good performance in managing the Risk Fund. Risk Fund Shall mean a pool of funds for the purposes of mutual assistance, solidarity, brotherhood and for the mutual benefits of all Participants. 100% of gross contribution paid by the Participant, net of Wakalah Fee shall be allocated to the relevant Risk Fund under Iltizam Bi Al Tabarru' Page 1 of 6
concept. Within the Risk Fund, the Participant s tabarru' shall be deemed to have occurred upon any claim payment made in respect of fellow participants and incurrence of reserves, Retakaful cost as well as other costs as approved by the Shariah Committee of HLM Takaful with the remaining balance to be managed according to the terms and conditions of this Certificate. Note: Distribution of Surplus Any surplus exceeding reserves from Risk Fund may be distributed to HLM Takaful and Participants with ratio of 50:50. 3. What are the covers / benefits provided? The relevant benefits for both Overseas Trips and Domestic Trips are listed in the Table of Benefits and are subject to the relevant terms and conditions described hereunder. Importance of disclosure Statement Pursuant to Schedule 9 of the Islamic Financial Services Act 2013 You are required by Law to tell us all facts that you know or are expected to know about the risk that we are accepting from you. These facts can influence our decision whether to accept your application for insurance or what terms we imposed on you. You must tell us immediately if at any time any of the information on which this Takaful coverage is based is incorrect, inaccurate or changes. You must take reasonable care to provide us with all the answers and not to make misrepresentation. If you mispresented any facts to us before the certificate was entered into, we may:- - Declare your certificate void from inception (which means treating it as invalid), we may not make any return of contribution and also recover any unpaid contribution; - Cancel this certificate and return any contribution less our cancellation charge or recover any unpaid contribution; - Recover any shortfall in contribution; - Not pay any claim that has been or will be made under the certificate; - Be entitled to recover from you the total amount of any claim already paid under the certificate or any claim we have to pay under any relevant legislation, plus any recovery Free-look period You may cancel Your Coverage simply by notifying us within fifteen (15) days after you receive Your Coverage. However, there is no refund of contribution upon cancellation of Your Coverage. 7. Procedure for making a claim On the happening of any occurrence which will likely give rise to a claim under the Master Certificate, You or Your legal representative must give us written notice as soon as possible and, in any event, within 15 days after the date of occurrence. 8. What are the major exclusions under this certificate? This certificate does not cover; Self-inflicted injury and suicide Driving while intoxicated Page 4 of 6
Professional/motor sports War (whether declared or not), invasion, civil war, riot, civil commotion Engaging in aviation other than as a fare-paying Illness and diseases Venereal disease, congenital conditions Pregnancy, birth, miscarriage or abortion Acupuncture treatment Carrying out high risk and hazardous occupations or trade Note: This list is non-exhaustive. Please refer to the Master Certificate for the full list of exclusions. 9. Can I cancel my certificate? You can cancel Your Coverage by giving us a written notice at least one month s prior notice. However, there is no refund of Contribution upon cancellation of Your Coverage. 10. What do I need to do if there are changes to contact / personal details/ trip? It is important that you inform us of any changes in your contact or details of your which would affect the acceptance of the risk. 11. Where can I get further information?
