Applicant: Date: Landowner: Date: General Municipal Law #125, Chapter 439 Adds new requirements that a building permit shall not be issued unless the applicant provides either proof of Workers Compensation and Disability coverage, or documentation of exemption from same.

BUILDING PERMIT INSTRUCTIONS Applying for a Permit What to bring: 1. A detailed site plan with the following: o Survey map or scaled drawing of the property location of project on the site o Show distances from project to boundary lines o Show dimensions of project o Three (3) sets of drawings are required at the time a building permit is issued, two (2) sets will be returned upon issuance of the building permit; one for the Onsite Inspector (this will be left behind at project close for Property Owner), the other for the Builder/Contractor. o If the building is 1,500 square feet or more, wet-stamped plans by a Professional Engineer or Architect are required. The licensed professional must also submit a signed statement of Energy Compliance, e.g. Reschek or ComChek. 2. Structural drawings: o Cross-section or elevation sketch with dimensions o Sizes of structural lumber o Show spans of structural lumber 3. Completed Building Permit Application 4. Proof of Insurances: Workers Compensation, Liability, and Disability (See the attached exemption options if applicable) 5. Payment: o Payment is required prior to the issuance of a building permit. Timeline: We are required by NYS Law to review all plans prior to Building Permit issuance. Depending on the size of your project, anticipate issuance of building permit to be available within 7 days. Larger projects will take longer to review and process.

Inspections Inspections are required to ensure that projects are built following all applicable building and codes laws and standards. There are several inspections required throughout a construction project. When your project is ready for an inspection, please call 24 hours in advance. When you call for an inspection, have the type of permit, the address of the project, and the floor of the structure or business name information available. Types of Inspections: o Pre-site inspections o Excavation inspections o Footer and foundation inspections o Concrete before pouring o Structural o Plumbing o Electrical o Insulation o Fire safety o HVAC o Final inspections for Certificate of Occupancy Your project may require any of these inspections throughout the building process. If you are unsure of which inspections you need, contact the Building Inspector at (607)535-7367. Inspections may be conducted in full or in part.

WC/DB Exemptions (/content/ebiz/wc_db_exemptions/requestexemptionoverview.jsp) Request for WC/DB Exemption (Form CE-200) Overview This application is for a Certificate of Attestation of Exemption, Form CE-200, from Workers' Compensation and/or Disability Benefits insurance coverage. It may only be completed by entities with no employees and/or out-of-state entities obtaining a contract or license in which all the work is being performed outside of New York State. The application can be completed by using either the "Web-based Application" or the "Paper Application". By accessing the application on-line you will be able to complete the application and print the certificate immediately. The paper application must be submitted to the Workers' Compensation Board for processing and the certificate will be mailed to the applicant. This process may take up to 4 weeks for completion. Certificates can only be used to attest to a government entity that the applicant requesting a permit, license, or contract is not required to carry workers' compensation and/or disability benefits coverage. Certificates are only valid for the specific license, permit or contract and the period for which it is issued. Certificates for building permits are job-specific and a separate certificate will be required for each building permit. Certificates are assigned a unique certificate number that can be validated by the government official issuing the license, permit, or contract. Select to access web-based Exemption Application

Affidavit of Exemption to Show Specific Proof of Workers Compensation Insurance Coverage for a 1, 2, 3 or 4 Family, Owner-occupied Residence **This form cannot be used to waive the workers compensation rights or obligations of any party.** Under penalty of perjury, I certify that I am the owner of the 1, 2, 3 or 4 family, owner-occupied residence (including condominiums) listed on the building permit that I am applying for, and I am not required to show specific proof of workers compensation insurance coverage for such residence because (please check the appropriate box): I am performing all the work for which the building permit was issued. I am not hiring, paying or compensating in any way, the individual(s) that is(are) performing all the work for which the building permit was issued or helping me perform such work. I have a homeowners insurance policy that is currently in effect and covers the property listed on the attached building permit AND am hiring or paying individuals a total of less than 40 hours per week (aggregate hours for all paid individuals on the jobsite) for which the building permit was issued. I also agree to either: acquire appropriate workers compensation coverage and provide appropriate proof of that coverage on forms approved by the Chair of the NYS Workers Compensation Board to the government entity issuing the building permit if I need to hire or pay individuals a total of 40 hours or more per week (aggregate hours for all paid individuals on the jobsite) for work indicated on the building permit, or if appropriate, file a CE- 200 exemption form; OR have the general contractor, performing the work on the 1, 2, 3 or 4 family, owner-occupied residence (including condominiums) listed on the building permit that I am applying for, provide appropriate proof of workers compensation coverage or proof of exemption from that coverage on forms approved by the Chair of the NYS Workers Compensation Board to the government entity issuing the building permit if the project takes a total of 40 hours or more per week (aggregate hours for all paid individuals on the jobsite) for work indicated on the building permit. _ (Signature of Homeowner) _ (Homeowner s Name Printed) (Date Signed) Home Telephone Number Property Address that requires the building permit: Once notarized, this BP-1 form serves as an exemption for both workers compensation and disability benefits insurance coverage. LAWS OF NEW YORK, 1998 CHAPTER 439 The general municipal law is amended by adding a new section 125 to read as follows: 125. ISSUANCE OF BUILDING PERMITS. NO CITY, TOWN OR VILLAGE SHALL ISSUE A BUILDING PERMIT WITHOUT OBTAINING FROM THE PERMIT APPLICANT EITHER: 1. PROOF DULY SUBSCRIBED THAT WORKERS COMPENSATION INSURANCE AND DISABILITY BENEFITS COVERAGE ISSUED BY AN INSURANCE CARRIER IN A FORM SATISFACTORY TO THE CHAIR OF THE WORKERS COMPENSATION BOARD AS PROVIDED FOR IN SECTION FIFTY-SEVEN OF THE WORKERS COMPENSATION LAW IS EFFECTIVE; OR 2. AN AFFIDAVIT THAT SUCH PERMIT APPLICANT HAS NOT ENGAGED AN EMPLOYER OR ANY EMPLOYEES AS THOSE TERMS ARE DEFINED IN SECTION TWO OF THE WORKERS COMPENSATION LAW TO PERFORM WORK RELATING TO SUCH BUILDING PERMIT. Implementing Section 125 of the General Municipal Law 1. General Contractors -- Business Owners and Certain Homeowners For businesses and certain homeowners listed as the general contractors on building permits, proof that they are in compliance with Section 57 of the Workers Compensation Law (WCL) is ONE of the following forms that indicate that they are: insured (C-105.2 or U-26.3), self-insured (SI-12), or are exempt (CE-200), under the mandatory coverage provisions of the WCL. Any residence that is not a 1, 2, 3 or 4 Family, Owner-occupied Residence is considered a business (income or potential income property) and must prove compliance by filing one of the above forms. 2. Owner-occupied Residences For homeowners of a 1, 2, 3 or 4 Family, Owner-occupied Residence, proof of their exemption from the mandatory coverage provisions of the Workers Compensation Law when applying for a building permit is to file form BP-1 (12/08). Form BP-1shall be filed if the homeowner of a 1, 2, 3 or 4 Family, Owner-occupied Residence is listed as the general contractor on the building permit, and the homeowner: is performing all the work for which the building permit was issued him/herself, is not hiring, paying or compensating in any way, the individual(s) that is(are) performing all the work for which the building permit was issued or helping the homeowner perform such work, or has a homeowner s insurance policy that is currently in effect and covers the property for which the building permit was issued AND the homeowner is hiring or paying individuals a total of less than 40 hours per week (aggregate hours for all paid individuals on the jobsite) for the work for which the building permit was issued. If the homeowner of a 1, 2, 3 or 4 Family, Owner-occupied Residence is hiring or paying individuals a total of 40 hours or MORE in any week (aggregate hours for all paid individuals on the jobsite) for the work for which the building permit was issued, then the homeowner may not file the Affidavit of Exemption form, BP-1(12/08), but shall either: BP-1 (12/08) Reverse acquire appropriate workers compensation coverage and provide appropriate proof of that coverage on forms approved by the Chair of the NYS Workers Compensation Board to the government entity issuing the building permit (the C-105.2 or U-26.3 form), OR have the general contractor, (performing the work on the 1, 2, 3 or 4 family, owner-occupied residence (including condominiums) listed on the building permit) provide appropriate proof of workers compensation coverage, or proof of exemption from that coverage on forms approved by the Chair of the NYS Workers Compensation Board to the government entity issuing the building permit. www.wcb.ny.gov
