(FEES PERTAINING TO TARIFF STANDARDS AND PROCEDURE) REGULATIONS, 2002 NOTIFICATION Islamabad, the 17 th June, 2002 S.R.O. 385(I)/2002. ln exercise of the powers conferred by section 47 of the Regulation of Generation, Transmission and Distribution of Electric Power Act, 1997 (XL of 1997), read with Rule 3(1) of the Tariff Standards and Procedures Rules, 1998, National Electric Power Regulatory Authority hereby notifies the following regulations, namely: 1. Title and Commencement. (1) These regulations may be called the National Electric Power Regulatory Authority (Fees pertaining to Tariff Standards and Procedure) Regulations, 2002. (2) They shall come into force at once. (1) Definitions. In these regulations, unless there is anything repugnant in the subject or context, (i) (ii) (iii) "Act" means the Regulation of Generation, Transmission and Distribution of Electric Power Act, 1997 (XL of 1997); "financial year" means consecutive period of twelve calendar months commencing on the first day of July of any year and ending on the thirtieth day of June of the following year; and "Schedule" means the schedule to these regulations. 3. Payment of Fees. (1) A licensee or any person other than the licensee, as the case may be, shall pay to the Authority the fees calculated in the amount, manner and the purpose specified in the schedule from time to time. (2) The fees payable by the licensee or any person other than the licensee, as the case may be, shall be paid in one or more accounts of the Authority designated for the purpose. (3) The fees shall be considered paid to the Authority only when the amount is credited to the account of the Authority. (4) The Authority may from time to time, by notification in the official gazette, alter or modify the manner or time of payment, calculation or the amount of fees specified in the

schedule, provided further that, any increase in the fees shall be effective only in respect of the following financial year in which the increase is notified. [(5) The Authority may allow refund of tariff petition filing fee, on an application by licensee or any person other than licensee, in the following circumstances; (a) In case of withdrawal of tariff petition by licensee or any person other than licensee at pre-admission stage; and (b) In case of dismissal of tariff petition by the Authority at pre-admission stage.] 1 MAHJOOB AHMAD MIRZA, Registrar. 1 Sub-regulation (5) inserted vide S.R.O. 305(I)/2012 dated 28 th March, 2012.

Through SRO 1199(I)/2008 the ibid schedule was modified by superseding S.R.O. 887(I)/2006 dated 28 th August 2006. Through S.R.O. 887(I)/2006 the following schedule of fees, which was earlier published along with these regulations was deleted and replaced in its entirety: Schedule Part I 1. PART II INDEXATION OF FEES 1. Any and all fees payable pursuant to these regulations, shall be indexed to the Consumer Price Index ("CPI") published from time to time by the Federal Bureau of Statistics. 2. The indexation shall be done on the basis of the most recent CPI prevailing on the date of payment of the fee and shall be increased or decreased, as the case may be, in accordance with the following formula: Fpd = Ft [ CPIpd/CPIrd] Where Fpd = The actual fee payable on the date of payment. Ft = The respective fee set out in Part I of this Schedule. CPIpd = The most recent CPI prevalent on the last day of the month immediately preceding the month in which the payment is due. CPIrd = [The reference or base CPI as on September, 2008.] 3 3 The words The reference or base CPI, prevalent on the last day of the month in which these regulations are notified in the official gazette substituted with the words the reference or base CPI as on July 1, 2006 vide S.R.O. 887(I)/2006 dated 28 th August 2006. Thereafter vide S.R.O. 1199(I)/2008 dated 14 th November 2008 the words the reference or base CPI as on July 1, 2006 has been substituted with the words the reference or base CPI as on September, 2008.

Statutory Notifications (S.R.O.) GOVERNMENT OF PAKISTAN NOTIFICATION Islamabad, the 1 st June, 2006 S.R.O. 519(I)/2006. In exercise of power conferred by Section 47 of the Regulation of Generation, Transmission and Distribution of Electric Power Act, 1997 (XL of 1997), read with Rule 3(1) of the Tariff Standards and Procedure Rules 1998, the National Electric Power Regulatory Authority is pleased to approve the addition of the follwiong at Schedule Part-I under sub para (1) Tariff Petition of the National Electric Power Regulatory Authority Licensing (Fees Pertaining to the Tariff Standards and Procedure) Regulations 2002, notified vide S.R.O No. 385(I)/2002 dated 17-06-2002: (J) Generation Company opting for an upfront-tariff 0.50 Other contents of the S.R.O. 385(I)/2002 will remain un-changed. In exercise of power conferred by Section 47 of the Regulation of Generation, Transmission and Distribution of Electric Power Act, 1997 (XL of 1997), read with Rule 3(1) of the Tariff Standards and Procedure Rules 1998, the National Electric Power Regulatory Authority is pleased to approve the modification detailed at Annex-A in Schedule (Part-I & II) of National Electric Power Regulatory Authority Licensing (Fees Pertaining to the Tariff Standards and Procedure) Regulations 2002, notified vide S.R.O No. 385(I)/2002 dated 17-06-2002 and SRO 519(I)/2006 dated 1 st June, 2006. This SRO supersedes SRO 519(I)/2006 fortwith. Other contents of the S.R.O. 385(I)/2002 will remain un-changed. CORRIGENDUM/ADDENDUM NOTIFICATION Islamabad, the 15 th September, 2006 S.R.O. 981(I)/2006. In exercise of power conferred by Section 47 of the Regulation of Generation, Transmission and Distribution of Electric Power Act, 1997 (XL of 1997), read with Rule 3(1) of the Tariff Standards and Procedure Rules 1998, the National Electric Power Regulatory Authority is pleased to approve the following corrigendum/addendum in Annex-A i.e. Schedule Part 1 Section 1 notifivde vide SRO No. 887(I)/2006 dated 28-08-2006. Under Category (C) Distribution Licensees *(2): In 1 st row of 2 nd column against category of Upto 1 MW the figure of 100,000 may be inserted; In 2 nd row of 1 st column the word upto between 1 MW and 2 MW may be inserted;a and In 3 rd row of 2 nd column against category of More than 2 MW upto 5 MW the figure of 200,000 may be replaced with 300,000. Statutory Notifications (S.R.O.) GOVERNMENT OF PAKISTAN NOTIFICATION Islamabad, the 28 th March, 2012 S.R.O. 305 (I)/2012. In exercise of power conferred by Section 47 of the Regulation of Generation, Transmission and Distribution of Electric Power Act, 1997 (XL of 1997), the National Electric Power Regulatory Authority is pleased to made the following amendments in the National Electric Power Regulatory Authority (Fees Pertaining to Tariff Standards and Procedure) Regulations 2002, earlier notified vide S.R.O No. 385(I)/2002 dated 17.06.2002, namely: In the aforesaid Regulations, After sub-regulation (4) of regulation 3, following new sub-regulation shall be inserted: (5) The Authority may allow refund of tariff petition filing fee, on an application by licensee or any person other than licensee, in the following circumstances; (a) (b) In case of withdrawal of tariff petition by licensee or any person other than licensee at pre-admission stage; and In case of dismissal of tariff petition by the Authority at pre-admission stage.
