Tom Carter Tom Carter Call: 2012 Email: tomcarter@ropewalk.co.uk Tom became a member of Chambers in October 2013 following completion of his pupillage. He studied law at the University of Nottingham, was awarded a Scholarship by Inner Temple and undertook the BPTC at Nottingham Law School. He is registered with the Bar Council to undertake Public Access work and is able to receive instructions directly from lay clients, as well as those on the traditional professional client basis. Outside of work, Tom plays music and enjoys reading and walking. Property & Real Estate Tom has a busy practice dealing with claims involving nuisance to land, including subsidence due to tree roots and Japanese Knotweed. He also has experience of dealing with other kinds of nuisance, including flooding. In respect of Japanese Knotweed, Tom successfully represented one of the Claimants in the case of Stephen Williams & Robin Waistell v Network Rail Infrastructure Ltd. Tom also has experience of dealing with claims involving Japanese Knotweed against residential landowners, farmers, building developers and local authorities. m.html Tom has also acted in cases against sellers for misrepresentation when Japanese Knotweed has not been disclosed and against surveyors for professional negligence where it has not been identified. In respect of claims involving tree roots, Tom has experience of injunctions (interim and final), claims for damages and dealing with TPO s and various issues that arise such as claims for compensation against local authorities for refusal to consent to felling. As a pupil, Tom assisted Jonathan Mitchell in the case of Dennis Rye Ltd v Bolsover DC [2013] EWHC 101 (Admin) involving nuisance in breach of an abatement notice. Tom has experience of dealing with a wide range of property cases generally including boundary disputes, claims for adverse possession, trusts of land and cases involving personal property such as claims for delivery up of goods, conversion and damage to property. He also has experience of both commercial and residential landlord and tenant disputes. Within the context of residential tenancies, he has experience of bringing and defending claims under the ECHR and the Equality Act 2010. Professional Negligence Tom has experience of dealing with professional negligence claims against solicitors, accountants and surveyors. Commercial Dispute Resolution Tom has experience of acting for Claimants and Defendants in a wide range of commercial disputes. As well as advising clients and representing them at trial, Tom has dealt with applications for security for costs, third party debt orders and a range of other issues. Costs & Litigation Funding Tom has experience of dealing with all manner of costs issues at detailed assessments and on challenging provisional assessments. He deals with inter partes costs as well as solicitor-own client assessments involving allegations of misconduct and overcharging. Tom is due to appear in the Court of Appeal in December 2017 in a case involving the scope of the court s power to limit a claimant to fixed costs under CPR 5.2 and its interaction with misconduct under CPR.11. 2

Insurance Tom has experience of acting for insurers and insured parties in disputes involving avoidance of insurance policies. A large amount of his work, including claims involving property damage, inevitably affects insurers and Tom is aware of insurance-related issues that may arise. Housing Tom has experience of acting for landlords and tenants in the full range of private and public tenancies. He has experience of dealing with possession hearings, injunctions and committal applications. He has experience of bringing and defending claims under the ECHR and the Equality Act 2010 as well as ordinary housing grounds. Insolvency Tom has acted in a range of insolvency disputes, from contested petitions by creditors to remove liquidators in the Companies Court to personal bankruptcy proceedings. Wills, Probate & Inheritance Tom has acted for clients in a range of disputes involving claims for breach of trust against trustees under wills and disputes between beneficiaries. Clinical Negligence Tom has appeared in a range of clinical negligence cases, involving a three day trial before Langstaff J. He has experience of dealing with experts in conference and at trial. As well as cases involving negligent surgery and failure to diagnose, Tom has been involved in a range of cases involving interesting issues such as ICU psychosis. He also acted for the applicant before Keehan J in the High Court in a case involving an application under the Human Tissue Act 200 for a private post-mortem to be carried out on the applicant s late father to investigate a possible link between his death and infection following surgery. 3

Disease Tom has a wide range of experience in cases involving NIHL, HAVs, COSHH and asbestos. He regularly drafts pleadings in the full range of disease cases. He also advises on the full range of issues including breach of duty, causation and limitation. Tom has appeared at numerous NIHL trials, on limitation and on all issues, and acts for both Claimants and Defendants. He has experience of cross-examining expert witnesses and dealing with all forms of argument. Public Sector & Not for Profit Tom recently acted for the successful Claimant in an unlawful detention case in Abdul Haq Miyanji v Secretary of State for the Home Department [2017] EWHC 1939 (QB). He has acted for the Government Legal Department resisting a number of judicial reviews from the beginning of his practice despite not being a member of the Attorney General s Panel. Employment Tom has acted in a range of employment cases, including acting for both claimants and respondents in claims for unfair dismissal, automatically unfair dismissal and discrimination. He also has experience of appearing in the EAT. He is shortly due to appear in an a case involving a dispute over whether an alleged threat made by a respondent to a claimant via ACAS falls within the unambiguous impropriety exception to without prejudice communications and whether it can be relied on by the claimant to ground a claim for victimisation. Personal Injury Tom acts for Claimants and Defendants in all types of cases including employers liability and public liability claims. Credit Hire Tom acts for Claimants and Defendants in a range of credit hire claims dealing with all issues of enforceability, need, impecuniosity, period and rate.
