What is Ocean Cargo Insurance? Goods in transit need to be insured from an inland point of origin to a final inland destination and all points along the way. Most of the time, this is accomplished with one policy so there is no question as to which policy is in force at any given time. The coverage can be provided on an individual basis as each shipment is made or under a Marine Open Cargo policy. Insurance can be purchased by the buyer, seller, consignee or freight forwarder. Transit insurance is from warehouse to warehouse, or as required by the terms of sale, or by a specific country s insurance requirements. Conditions of Coverage Through our Open Cargo policy, we provide a comprehensive policy that automatically covers a wide range of exposures beyond basic coverages for international traders. Extensions Coverage can be extended for domestic and overseas inland transit, warehouse storage, exhibition and installations. We also provide shippers interest and legal liability coverage for freight forwarders, logistics providers and Non-Vessel Operating Common Carriers (NVOCC). Companion War policies are offered for all CNA Marine clients. Strikes, riots and civil commotions, as well as Terrorism Risk Insurance Act (TRIA) coverages, are also available. Geographic Scope Our policy provides coverage for all legal shipments traveling around the world. We prefer to have knowledge of the assured s primary areas of trade and rates are generally based on those trade areas. Furthermore, U.S. laws or restrictive insurance legislation of another country may affect whether or not coverage can be provided. Valuation The Valuation Clause in the Cargo policy gives a formula for determining the insured value for each shipment. In the event of loss, it is very important that the value insured is properly calculated. The formula is simple and most often will be Invoice Cost + Freight + 10%. The extra 10 percent is called an advance or percentage load and provides additional coverage for incidental expenses and fluctuations in value. Other valuations based on market conditions and commodities can be negotiated. Limits of Liability The limits of liability for a Cargo policy are determined on a per conveyance basis; for example, $500,000 per vessel or per aircraft and connecting conveyances. Because of the increased risk of shipping goods directly on deck of a vessel, a sub-limit may apply to cargo shipped on deck and may be subject to an on-deck bill of lading. Containerized shipments are considered under deck because they are shipped subject to an under deck or optional bill of lading that requires more responsibility by the carrier and permits more subrogation by the insurance company. Premium is not usually based on the limit but rather on the actual values shipped. Exclusions The policy s exclusions include, but are not limited to, improper packing, abandonment of cargo, rejection by customs or other governmental authorities, inherent vice, loss caused by delay, and loss of use or market. The Free of Capture and Seizure Warranty (FC & S) of the Ocean Cargo policy specifically excludes coverage for losses due to war. War Coverage Because losses due to war are excluded under the Cargo policy, a separate War Risk Only policy is issued in conjunction with the Marine coverage. War coverage is provided only while the cargo is waterborne or airborne and has a different cancellation clause, usually 48 hours of notice. Premium is most often separate and rates can differ by country based on the warlike activity in that country. 3

Ocean Cargo Certificates and Reports Most exports require a Certificate of Insurance, providing proof of insurance for a specific shipment. A certificate is a negotiable document and is considered a complete policy unto itself. A certificate will have all the pertinent information about a shipment, as well as the policy terms and conditions, claim contacts and bank-required wording for a letter of credit. If certificates are not required, such as for imports, reporting of shipments can still be done online via CNACargo.com. The system provides automatic premium rating of shipments based on the negotiated Open Cargo policy rates, allowing for faster billing of Cargo premium. Rates and Premiums Premium in Cargo insurance is most often based on a negotiated rate per $100 of insured value. The rate is determined based on the best judgment of the underwriter, which includes contributing factors such as commodity, geographic scope, conveyance, volume, loss experience and market conditions. A rate schedule is then agreed upon for each assured and made part of the policy. 4

Your Errors & Omissions exposure is reduced. Common Misconceptions About Cargo Insurance Placement can only be handled by marine specialists. Although you have marine underwriting specialists at CNA to rely on, Cargo is not as complicated as many perceive. With just some basic information on the shipping practices of your clients, they can have their own policy in force. My client uses a freight forwarder so they re already covered. The freight forwarder s policy is geared to many different commodities and many different customers, providing non-tailored coverage usually at a much higher cost. Nothing could ever happen to my client s goods. Your client s goods may be less susceptible to loss than others but they still have the risk of catastrophic loss and loss due to General Average, which is a sharing of a loss that occurs to the hull or other s cargo. If a General Average is declared and your client does not have insurance, your client will be required to post a cash bond before receiving their goods. My client isn t big enough. CNA has reasonable minimum premiums for Open Cargo policies and the availability of insuring just the occasional shipment. Settling claims takes too much time. A claim occurrence is the most important time to have access to the experts.
