2 THE SENIOR CITIZENS GRANT (AMENDMENT) BILL, 2010 Explanatory Note (These notes form no part of the Bill but are intended only to indicate its general purport) The Bill seeks to amend the Senior Citizens Grant Act, Chap. 32:02 to change the name of the Act to the Senior Citizens Pension Act and to make the necessary changes from senior citizens grant to senior citizens pension within the Act. This Act would also increase the ceiling for monthly pensions to three thousand dollars and set out the various income ranges as the eligibility criteria for receipt of the monthly pension. Clause 1 provides for the short title. Clause 2 seeks to amend the Senior Citizens Grant Act by, inter alia, repealing the long title and section 1, which provides for the short title of the Bill, to effectively change the name of the Act to the Senior Citizens Pension Act. Clause 2 also seeks to delete the definition of Grant and include a definition for pension and subsequently to replace the words Senior Citizens Grant and grant with the words Senior Citizens Pension and pension respectively. Further, this clause would repeal subsections (1) to (5) of section 3 thereby removing certain criteria associated with the entitlement to the monthly pension and substitute a new subsection (1) that would establish a scale in which the monthly income of an entitled person would determine the amount of his monthly pension. Clause 3 would validate the increase in senior citizens grant given to eligible persons in May, 2010.

3 BILL AN ACT to amend the Senior Citizens Grant Act, Chap. 32:02 [, 2010] ENACTED by the Parliament of Trinidad and Tobago as follows: Enactment

4 Short title Chap. 32:02 amended 1. This Act may be cited as the Senior Citizens Grant (Amendment) Bill, 2010. 2. The Senior Citizens Grant Act is amended (a) by repealing the long title and substituting the following long title: An Act to provide for the Senior Citizens Pension ; (b) by repealing section 1 and substituting the following section: Short title 1. This Act may be cited as the Senior Citizens Pension Act. ; (c) in section 2 (i) by inserting after the definition of Minister the following definition: pension means the Senior Citizens Pension payable under this Act; ; and (ii) by deleting the definition of Grant ; (d) in section 3 (i) by repealing subsections (1) to (5) and substituting the following subsection: (1) With effect from September 1, 2010 a person who satisfies the conditions specified in section 4 and receives a monthly income in the sum specified in the first column is entitled to a monthly Senior Citizens Pension in the sum specified in the second column as follows: First Column Second Column INCOME PENSION not exceeding $500 $3,000 exceeding $500 but not exceeding $1,450 $2,550

5 First Column INCOME Second Column PENSION exceeding $1,450 but not exceeding $1,650 $2,350 exceeding $1,650 but not exceeding $1,800 $2,200 exceeding $1,800 but not exceeding $2,000 $2,000 exceeding $2,000 but not exceeding $2,200 $1,800 exceeding $2,200 but not exceeding $2,400 $1,600 exceeding $2,400 but not exceeding $2,600 $1,400 exceeding $2,600 but not exceeding $2,800 $1,200 (ii) by renumbering subsections (6) and (7) as subsections (2) and (3) respectively; (iii) by deleting the words Senior Citizens Grant wherever they occur and substituting in each place the words Senior Citizens Pension ; and (iv) by deleting the word grant wherever it occurs and substituting in each place the word pension. 3. Any increased payment made by the Board, on or after 1st May, 2010, to a person eligible to receive a Senior Citizens Pension is validated.
