Eligibility: The Sweepstakes is open to everyone eighteen (18) and over at the time of entry who are legal residents of the fifty (50) United States and District of Columbia (excluding Quebec, Puerto Rico and other U.S. territories and possessions), except employees (including their immediate family members and persons living in the same household), officers, directors, and agents of Sponsor, ASUS, Facebook, Twitter, and Instagram and their respective parent companies, affiliates, subsidiaries, advertising, promotion, and fulfillment agencies, who are not eligible to participate in the Sweepstakes. How to Enter: To enter and participate in the Sweepstakes during the Sweepstakes Period, you must follow @H1Z1 on Twitter and retweet the @H1Z1 account s tweet from March 8 th, 2018, which will feature #H1Z1 #sweeps and a special sweepstakes image ( Sweepstakes Tweet ). Each participant must retweet the original March 8 th Sweepstakes Tweet once during the Sweepstakes Period to be entered to win. Each participant may retweet the Sweepstakes Tweet once, for a maximum of one (1) entry. 3. Conditions of Entry: Sweepstakes is limited to one (1) entry per person. Subsequent entries will be void from official Sweepstakes entries, but may still be shared with the community. Sponsor reserves the right to disqualify any person that submits multiple entries. Submissions posted on any gamerelated website forum or not submitted as specified above will not be accepted for entry. By participating in the Sweepstakes, you agree to comply with Daybreak s Terms of Service, Privacy Policy, and all rules, regulations, and policies related to Daybreak. Determination of Winner: Sponsor will randomly determine one (1) Grand Prize winner. Winner will be randomly selected by Sponsor from eligible entries submitted during the Sweepstakes Period. To be considered, you must submit your entries to Sponsor as set forth herein no later than the time and date set forth in the Sweepstakes. Sweepstakes are limited to one (1) entry per person. Duplicate entries (more than specified number of entries per participant), any entries submitted by agencies, other third parties, or through other unapproved methods are void. Winners will be displayed (subject to Sponsor guidelines, standards, and practices, and in a manner and location determined by Sponsor in its discretion) on certain Daybreak-related websites as decided by Sponsor in its sole discretion. 6. General Limitations for all Prizes: Winner will be selected randomly from eligible entries. Odds of winning depend on the number of entries received. All prize details are at Sponsor s sole discretion. No
alternative prize, cash, or other substitution is permitted except by Sponsor, at its sole discretion. All prizes are non-transferable and non-tradable. All federal, state, and local taxes are the sole responsibility of the winner. Based upon the criteria listed above, up to one (1) prize will be awarded for the winner. The potential winner(s) will be notified electronically via Twitter Direct Message within three (3) days after the conclusion of the Sweepstakes Period and will have forty eight (48) hours from notification to accept the prize. In the event a potential winner does not accept the prize via Twitter Direct Message within the timeframe, they forfeit the claim to that prize and Sponsor may award the prize to a new potential winner or dispose of the prize, at Sponsor s discretion. Requirements of Winner: By agreeing to become a winner and/or accepting or using a prize, the selected entrant: (i) is required to sign and return an affidavits of release, release of liability, declaration of eligibility, an IRS W-9 form and/or where lawful, publicity consent agreements, within five (5) days of acknowledged notification; and (ii) agrees to the use of his or her name, voice and/or likeness, and submitted content, for the purpose of advertising, trade, marketing, or promotion by Sponsor without further compensation, unless prohibited by law. Entrant further agrees that in any cause of action, the Released Parties liability will be limited to US$50.00, and in no event shall the Released Parties be liable for attorney s fees. Disputes: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules shall be governed by, and construed in accordance with, the laws of the State of California, without giving effect to any choice of law or conflict of law rules (whether of the State of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of California. All disputes, controversies or differences which may arise between the parties out of or in relation to or in connection with this Sweepstakes shall be finally settled through arbitration administered by JAMS or the American Arbitration Association (AAA) in accordance with the AAA's Commercial Arbitration Rules. A judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. Any arbitration administered hereunder shall be conducted in English and take place in San Diego, California, USA. 11.
