CHESTER COUNTY RULES AND REGULATIONS FOR RENTAL OF CHESTER COUNTY WAR MEMORIAL BUILDING 1. Chester County reserves the right to refuse any request. 2. Rental Group Definitions and Fees: a. Non-Profit Organization including but not limited to Civic; Religious; Political Party Organization (must provide IRS Determination Letter or FEIN) Meetings on similar closed non-commercial or fund-raising activity or other public function of not for profit organizations. FEE: $500.00 PER DAY plus a refundable $300.00 deposit b. Commercial Events Meetings or open functions including but not limited to the actual sale of goods and/or services on the property held by For Profit organizations and Businesses duly registered with the South Carolina Secretary Of State or other State registration entity. FEE: $900.00 PER DAY plus a refundable $300.00 deposit c. Parties, receptions, banquets and similar functions for any individual or group that is not organized under the corporation laws of South Carolina or other State registration entity. FEE: $500.00 PER DAY plus a refundable $300.00 deposit. 3. Balance of rental fee must be paid within 14 business days prior to event. 4. There will be a $35.00 charge on any returned checks for any reason. 5. A $50.00 fee will be charged for cancellation of an event. Deposits are non-refundable if the rental event is cancelled within fourteen (14) days of the scheduled event date. If the reservation of an event is made within (14) days of the event, the deposit is automatically non-refundable if cancelled. 6. The Hold Harmless Wavier must be signed or proof of insurance will be required with the balance of rental fee (typically a rider on renters or homeowner s insurance or event insurance if an organization). The individual signing the Application and Rental Agreement is responsible for damages to the property and person or person s occurring during the time of use.
7. Security is required for every event. You must have a minimum of two (2) off duty commissioned officers in attendance for the duration of the event. You should contact the Chester County Sheriff s Office. 8. Doors to the War Memorial Building must remain locked at all times. 9. The person and/or persons using the facilities shall adhere strictly to the rules, regulations and ordinances of the City of Chester and South Carolina Fire Department. A copy of the occupancy statement by the Chester Fire Department is attached for reference and must be complied with at all times. 10. Any damage by act, default or negligence of the person/persons using the building or his agents, employees, patrons, guests or any person using the building will result in a forfeit of deposit. If damage exceeds deposit amount, lessee shall be required to pay the actual damage amount and all costs incurred by Chester County in the collection of this amount. 11. Chester County is not responsible for any personal possessions belonging to the lessee or guests of the lessee. It is the sole responsibility of each person entering the facility to be responsible for all their belongings. 12. Principal contact for this event assumes full responsibility for the character, acts and conduct of all persons admitted to the premises or any portion of the building. Children under the age of 18 may be present only in the direct care of responsible adults. 13. In the event that it becomes the recommendation of the security officer is to end the event, the individuals occupying the facility will immediately vacate the premises including the grounds. 14. Chester County retains the right and authority to cancel this Agreement or discontinue this Agreement or admission of other people to the building at such time that is in the best judgement of the County or its duly authorized representative, the conduct of the persons using the building appears to be a clear and present danger to the safety of other people or the premises. 15. Chester County retains the right to refuse to rent the facility to an individual, group or business where prior rentals have resulted in the premature end of an event because of disorderly conduct or intervention by law enforcement. 16. This Agreement shall not be assigned or sublet in any manner whatsoever. 17. Chester County employees may rent the facility at a reduced rate but must in attendance at the event. Abuse of this benefit may result in loss of same. 18. All food must be removed at the end of the event. All trash shall be bagged and placed outside the back door by the elevator. 19. Only the tables and chairs located in the building shall be used at any function. 20. SMOKING ANYWHERE IN THE BUILDING IS PROHIBITED AT ALL TIMES.
21. Freestanding candles, devices that might overload electrical circuits, or anything that may be deemed a fire hazard are prohibited. 22. Nothing may be attached to walls, ceilings or floors that might damage same. The use of staples, tacks or tape on the furniture or the walls, ceilings or floors is prohibited. All decorations, including but not limited to flowers, must be removed. 23. Rental time begins at 7:00 a.m. and ends at 2:00 a.m. Events may not extend beyond this time. 24. At the conclusion of each event, upon leaving the building, you must make certain that: a. All the lights and appliances are off. b. All doors are locked. c. Garbage and trash is disposed of properly in trash bins as outlined herein. d. The room is returned to its condition before the event. e. The floor is swept. f. If the kitchen is used: All eating and preparation surfaces are washed clean Coffee grounds are disposed of in the trash, not in sink All dishes or other kitchen items are removed No food items are left on the premises g. Failure to comply with any of these provisions will void the rental agreement and result in possible cleaning fee. 25. DOORS MUST BE LOCKED AND KEYS RETURNED TO THE COUNTY SUPERVISOR S OFFICE NO LATER THAN 12:00 NOON THE NEXT BUSSINESS DAY OR $100 OF THE DEPOST WILL BE FORFEITED. 26. The provider of this Agreement shall be servable so that the unenforceability or wavier of the provisions shall not affect the remaining provisions. 27. You are responsible for the use of the facility. You assume all risks inherent to the use of the facility. You assume all risks inherent to the use of the facility and agree to assume the entire responsibility for the defense of, and to pay, indemnity and hold Chester County, Chester County Council, its employees and agents, from all claims for damage to property or bodily injury (including death) resulting from use, operation or attendance at an event, whether or not it to be claimed or found that such damage or injury resulted in whole or part from the County s negligence, from the defective condition of its facility or any other cause. You agree that no warranties expressed or implied, including merchantability or fitness for a particular purpose have been made in connection with the facility. 28. It is implied by your signature on the Application and this Agreement that you have read and fully understand the terms and conditions of this agreement. By signing the Application and Rental
IN ORDER TO RECEIVE A FULL REFUND FROM YOUR DEPOSIT: ALL CHAIRS AND TABLES MUST BE RETURNED TO SRORAGE AND PLACED IN PROPER POSITIONS. SEE ATTATCHED LAYOUT FOR PROPER STORAGE. THIS LAYOUT IS NECESSARY TO MEET FIRE SAFETY CODES: ALL ITEMS ON CHECKLIST BELOW MUST ALSO BE COMPLETED: 1. ALL FOOD MUST BE TAKEN OUT OF BUILDING AT END OF EVENT. 2. TRASH WILL BE PICKED UP, BAGGED AND PLACED IN CANS LOCATED OUTSIDE AT REAR ELEVATOR ENTRANCE. 3. FLOORS SWEPT AND ANY NECESSARY MOPPING FOR WET OR STICKY SPOTS WILL BE COMPLETED. 4. ALL LIGHTS TURNED OFF. 5. ALL DOORS LOCKED. KEYS MUST BE RETURNED TO COUNTY MANAGER S OFFICE BEFORE NOON OF THE FIRST WORKING DAY AFTER THE EVENT.
