3/500 Dealer 3/3000 Consumer Buyer L i m i t e d + P o w e r t r a i n W a r r a n t y CLAIMS PROCEDURES IMPORTANT NOTICE: You must contact the BUYER SHIELD CLAIMS ADMINISTRATOR at 877-435-7804 for authorization PRIOR TO ANY REPAIRS. BUYER SHIELD will determine the validity of any claim and only BUYER SHIELD may authorize the remedy of any claim. The vehicle owner/dealer may take the vehicle to a licensed repair facility of their choice. (The Administrator may recommend the vehicle be moved if the facility selected does not meet the level of service expected to ensure proper repair of the vehicle). The vehicle owner/dealer must give the repair facility the initial authorization to perform an inspection and diagnosis to determine the cause of failure and estimated cost of the repair. The repair facility will need to call the claims department to initiate a claim. They must provide the owner name, VIN, current mileage and a brief description of the complaint and failures. The claims department will document all information related to the failures and provide a claim number and instruction to the repair facility on how to proceed. The claims Administrator may offer to send an outside vendor part which can include used, like, kind & quality. Any part offered by the administrator will have a 12/12 parts & labor warranty. The claims department will communicate with the repair facility who will in turn update the vehicle owner/dealer of the claim status, details or requirements. Some vehicles may require an inspection to verify the failure: The inspection process under normal circumstances will take 24-48 hrs. Unexpected circumstances may require more time. Average time for a claim to be approved with an inspection is FOUR (4) business days. This does not include the initial diagnostic time performed by the repair facility outlined in 2 above or the time it takes to complete the repair. The actual time it takes to complete a repair will be determined by several factors... such as the availability of parts, work load of the repair facility and other circumstances that are beyond the administrator's control. TERMS & CONDITIONS 1. DEFINITIONS You should be aware of these important terms which appear in bold type throughout this Agreement. Actual Cash Value or ACV: shall be the average trade in value for the Vehicle, adjusted for mileage as shown in the thencurrent NADA Official Used Car Guide. Administrator: refers to CornerStone United, Inc., 1020 Main Ave. NW, Hickory, North Carolina 28601,1-877-435-7804 Breakdown: refers to any Covered Part that fails to perform the function for which it was intended by the manufacturer due to a defect in material or workmanship, or fails to perform within manufacturer s specifications. This does not include gradual reduction in operating performance due to wear & tear, or damage resulting from the failure of a non-covered part. Agreement: refers to this Limited Warranty Agreement. Covered Part(s): refers to parts listed as covered in Section 5 WHAT IS COVERED. Deductible: refers to the amount You must pay per repair visit in the event of a covered Breakdown. The Deductible for this Agreement is THREE HUNDRED (300) dollars. Named Component Coverage: refers to the coverage afforded by this Limited Warranty. Only the parts and/or components specifically listed are covered. Repair Facility: refers to the Repair Facility that is, has or will be performing repairs to the Vehicle. Such facility must be licensed and/or approved by the state to perform automotive repairs and must work within labor rates & times as approved by the Administrator. Such facility must have a tax identification number where required and be capable of performing the needed repairs to the Vehicle. Vehicle: refers to the Vehicle covered by this Limited Warranty as listed on the first page of this Agreement. We, Us, Our, Obligor: refers to the entity obligated to perform under this Agreement. Auto Byline Systems, 341 Corporate Terrace Corona, CA 92879 is the Obligor for this Agreement. You, Your, His/Her, or Agreement Holder: refers to the person named on this Agreement as the Purchasing Dealer. 2. LIMITED WARRANTY TERM This Agreement shall be in effect as of the date the Vehicle is purchased from the auction provided this Agreement is accepted by Administrator, and shall continue in effect until terminated, cancelled, voided, or until expiration of the time and mileage limitations identified on the first page of this Agreement. The Agreement term in mileage is measured from the Vehicle s odometer reading on the date of Vehicle wholesale purchase. We reserve the right to refuse or cancel any Agreement which does not meet Our underwriting guidelines, is submitted with insufficient payment or if You make a material misrepresentation in submitting a claim. 3. LIMITS OF LIABILTY The total dollar value of all benefits paid or payable under this Agreement shall not exceed the lesser of a) the wholesale Vehicle purchase price from auction, b) Actual Cash Value of the Vehicle at the time of a Breakdown, or c) the following aggregate limits: up to THREE THOUSAND FIVE HUNDRED DOLLARS ($3,500) for Engine & Cooling System Components; up to TWO THOUSAND FIVE HUNDRED DOLLARS ($2,500)) for Transmission & Transfer Case Components ; and/or up to ONE THOUSAND FIVE HUNDRED ($1,500) for Front & Rear Drive Axle Components. There is a total aggregate lim it of SIX THOUSAN D DOLLARS ($6,000). Once the lim its of liabilit y hav e been reached, this Agreeme nt, its trans fe r rights terminate and no further claims can be made against us. We shall not be responsible for lost time, wages, lost use or any other consequential or incidental damages. 4. OUR OBLIGATIONS If the Vehicle experiences a Breakdown during the term of this Agreement within the United States or Canada, the Administrator will pay or reimburse the Repair Facility for the repair or replacement of the Covered Part(s) as described in this Agreement, provided You have met Your obligations as stated in this Agreement (see Section 7 WHAT TO DO IN THE EVENT OF A BREAKDOWN and Section 8 AGREEMENT HOLDERS OBLIGATIONS) and if the repair is not excluded under WHAT IS NOT COVERED (Section 6 of this Agreement). Replacement parts will be of like kind and quality and may be new, remanufactured, rebuilt or serviceable used parts at Our sole discretion. Labor time for any repair shall be based on a nationally recognized labor guide of Our choice and We will pay up to ONE HUNDRED DOLLARS ($100) per hour labor rate. Additionally, the Administrator reserves the right to determine acceptable parts costs, in its sole discretion. 5. WHAT IS COVERED Coverage is limited to the parts listed below. Engine & Cooling System: All internally lubricated parts; pulleys and cover; oil pump; water pump; manifolds; harmonic balancer; turbocharger housing, internal parts and vanes. Note: case, housing, engine block and cylinder heads are also covered only if damaged by the failure of an internally-lubricated part. WHAT IS NOT COVERED THE FOLLOWING IS A LIST OF ITEMS NOT COVERED UNDER THIS AGREEMENT: Incidental or consequential damages or loss caused by Breakdown of Covered Part(s) (or otherwise) including property damage, personal injury, inconvenience, loss of Vehicle use, and commercial loss. Commercial use is excluded and will void coverage under this Limited Warranty Agreement. Repairs required because of collision, abuse, overheating, operation without proper lubrication or coolant, road conditions, misuse, negligence, alterations, racing, accidents, fires, floods, riots, acts of God, vandalism, upset, theft, lack of reasonable and proper maintenance, abuse through towing or improper load capacity, abuse through continued operation of an impaired Vehicle; any other losses normally covered by casualty insurance; excessive oil consumption; loss of compression; gradual reduction in operating performance (wear and tear); repairs beyond those required to correct a covered failure; repairs of components which have been modified or added to the Vehicle after purchase; repairs on Vehicles whose mileage has been altered or whose odometer has been tampered with; rental or towing expenses; or repairs covered by this Limited Warranty Agreement in excess of the limits of liability stated in Section 3 of this Agreement. All parts not listed as covered under Section 5 What is Covered, including but not limited to the following parts: Mechanical: service adjustments/cleaning; carburetor; throttle body assembly; seals and gaskets; contaminated fuel system; air conditioning recharge; refrigerant; coolant; battery cables; belts; hoses; brakes (front hubs, drums, shoes, lining, disc rotors and pads); exhaust system (including catalytic converter); filters; fluids; lights (bulbs, sealed beam and lenses); lubricants; manual clutch disc; strut inserts; shock absorbers; spark/glow plugs and wires; squeaks and rattles; tires; tune-ups; wheel balancing; wheel alignment; wheel studs; wiper blades; shop supplies and hazardous waste removal; and repairs, retro-fit, or replacement of any components caused by or due to compliance with any law or legislation (including but not limited to the 1990 Clean Air Act). Exterior: service adjustments/(glass and body parts); bright metal; bumpers; body panels; door handles; hinges; glass; moldings; outside ornamentation; convertible or vinyl tops; paint; rust; sheet metal; side view mirrors (glass and housing); air and water leaks; weather strip; wheel covers/ornaments; wind noise; and physical damage or alignment of body parts or bumpers. Interior: buttons; carpet; dash pad; door and window handles; knobs; rearview mirror (glass and housing); trim and upholstery; radios, tape players, compact disc players, graphic equalizers, speakers, cellular telephones, theft deterrent systems, and radar detectors. 7. WHAT TO DO IN THE EVENT OF A BREAKDOWN In the event of a failure You must protect the Vehicle from further damage. This may require You to stop the Vehicle, turn off the engine, and/or have the Vehicle towed. Damage resulting from continued operation of an impaired Vehicle will be considered negligence and will result in denial of claim coverage. You may take the Vehicle to any licensed repair facility, however, the Administrator has the right to select a different Repair Facility and/or move the Vehicle in the event that the Repair Facility selected by You charges for parts and labor in excess of amounts shown by a nationally accepted flat rate labor guide, or does not meet the level of service necessary to insure proper repair of the Vehicle. You may contact the Administrator for assistance in locating a Repair Facility. You are required to authorize the Repair Facility to inspect and/or tear down the Vehicle to determine the cause of the failure. You may be responsible for these charges if the failure is not covered under the terms of this Agreement. If it is determined that the failure is covered, We will pay for the reasonable and customary cost of such tear-down and/or diagnosis. We reserve the right to inspect the Vehicle and service records prior to approving any repairs. NO CLAIMS WILL BE PAID WITHOUT PRIOR AUTHORIZATION! You must ensure the Repair Facility calls the Administrator at 877-435-7804 prior to any work being performed on the Vehicle. Authorization must be obtained from the Administrator prior to any repair. If it is determined the failure is covered, the Administrator will confirm the cost of the repair and provide the Repair Facility with an authorization code. The repair cost that is approved by the Administrator is the maximum amount that will be paid for any Covered Repairs under the terms of this Agreement. Any additional amount must receive prior approval from the Administrator. Payment will be made via direct billing or credit card. Once authorization is obtained and the repair has been completed, all repair orders and documentation must be signed by You and submitted to the Administrator within THIRTY (30) days from the date the repair to the Vehicle was completed. All such documentation must show the Claim Authorization Number and be submitted to: CornerStone United Inc., 1020 Main Ave. NW Hickory, NC 28601. You are responsible for the payment of any applicable Deductible for each visit to the Repair Facility. If a Breakdown requires more than one visit to repair, only one Deductible applies to the original failure for which a claim was filed. Present a copy of this document to the Repair Facility prior to proceeding with repairs. Any claims made after the expiration date or after the expiration mileage of this Agreement will be denied without regard to the date of the failure. 8. AGREEMENT HOLDER S OBLIGATIONS To keep this Agreement in force, You are required to follow the Manufacturer s Recommended Maintenance Schedule for Your Vehicle. For example, some manufacturers require that the timing belt be changed or an oil change be performed at specific time and/or mileage intervals. You must follow the manufacturer s maintenance guidelines (including types and quality of products used in maintenance) to avoid denial of a claim and/or cancellation of this Agreement. You must also follow the procedures described within this Agreement under Section 7 WHAT TO DO IN THE EVENT OF A BREAKDOWN. 9. HOW BUYERSHIELD COVERAGE MAY BE ESTABLISHED FOR RETAIL CONSUMER If You sell the Vehicle during the term of this Agreement, this Agreement will terminate unless You activate a Buyer plan for the Retail Consumer purchasing the Vehicle at the time of sale. To activate coverage, You must visit the Buyer Administrator Internet portal at www.buyer-shield.com and follow the procedure provided. Upon activation of new coverage, You will be provided a printable electronic copy of the Retail Consumer Limited Warranty Agreement, which You must provide them. Failure to process the activation of the Retail Consumer Limited Warranty Agreement at time of Vehicle purchase will result in no coverage for the consumer, and may be a violation of Your legal obligations to the consumer. Once this Agreement has expired, activation of Buyer coverage for the retail consumer is no longer available. The Administrator has the sole discretion to approve or reject such activation.
