TERMS AND CONDITIONS Debit Card RM 5 Dining Cash Back Campaign Campaign Period 1. The Debit Card RM 5 Dining Cash Back Campaign ( Campaign ) is organized by CIMB Bank Berhad (13491-P) ( CIMB Bank ) and shall run from 1 July 2017 to 30 September 2017, both dates inclusive ( Campaign Period ) or until the cash back capping is used up, whichever earlier. 2. This Campaign is held in conjunction with Debit Card RM5 Dining Cash Back Campaign organized by CIMB Islamic Bank Berhad ( CIMB Islamic Bank ). In carrying out the Campaign in conjunction with CIMB Islamic Bank, the Cash Back under this Campaign shall come from the same pool of Cash Back intended for the Campaign organized by CIMB Islamic Bank. 3. CIMB Bank reserves the right to change the duration and/or the commencement and/or expiry dates of the Campaign Period by giving fourteen (14) calendar days prior notice. Eligibility 4. Subject to the terms and conditions herein, this Campaign is open to all existing and new CIMB Debit Mastercard Cardholders [ Debit Cardholders (including CIMB Tesco Debit Mastercard and CIMB PETRONAS Debit Mastercard cardholders)] issued by CIMB Bank in Malaysia and whose mobile numbers are registered with Maxis, Celcom, Digi, U-Mobile or XOX telecommunication service providers and maintained in CIMB Bank s record ( Eligible Participant(s) ). Eligible Participant(s) who sent SMS(s) from a mobile number that is not maintained in CIMB Bank s records shall not be entitled to participate in this Campaign. 5. The following persons / entities shall NOT be eligible to participate in this Campaign: a) Representative and/or agents (including advertising and promotion agents) of CIMB Bank, Mastercard Worldwide Pte. Limited, a company organized in the State of Delaware, having its office and principal place of business at 2000 Purchase Street, Purchase, New York, NY 10577-2509, United States of America ( Mastercard ) (including their representative subsidiaries and related companies); and/or b) Small medium enterprise/enterprise Banking/Commercial and Corporate customers asdeterminedby the Bank which include but not limited to sole proprietorships, partnerships, private limited companies, charitable/non-profit organization, societies and professional partnerships; and/or c) Individuals below the age of eighteen (18) years. 6. It shall be the Eligible Participant(s) responsibility to ensure their mobile phone numbers or e-mail addresses provided are current and updated with CIMB Bank in the event of any changes being made to the same by them. CIMB Bank shall not be responsible to the Eligible Participant(s) for any loss (including loss of opportunity and consequential loss flowing there from) suffered in the event the Eligible Participant(s) mobile phone numbers or e-mail addresses in CIMB Bank s record is not current or correct. 1

7. To participate in this Campaign, Eligible Participants must first register their participation in the Campaign either:- a) by responding to CIMB Bank s short message service( SMS ) sent to their mobile number maintained in CIMB Bank s records by typing DINE1 and sending the same to 62666 during the Campaign Period; or b) by sending an SMS by typing DINE 2 or DINE 3<space> last 6 digits of the Eligible Participant s NRIC number and sending the same to 62666 during the Campaign Period using the mobile number maintained in CIMB Bank s records; or c) by enrolling online at www.cimbbank.com.my/rm5dine; or d) by auto-enrolment via an SMS sent by CIMB Bank to their mobile numbers maintained in CIMB Bank s records stating that they have been auto-enrolled to participate in the Campaign. 8. Eligible Participants shall bear the standard telecommunications charges imposed for each SMS sent to CIMB Bank. 9. Upon successful registration of the participation of Eligible Participants in accordance with Clause 7 above, Eligible Participants shall receive a confirmation SMS from CIMB Bank. 10. In the event an SMS registration is incomplete, an SMS will be sent to the Eligible Participant s mobile number maintained in CIMB Bank s records at no cost notifying him/her to re-register via SMS. The Eligible Participant must ensure that he/she has keyed in the correct last 6 digits of his/her NRIC number in the SMS. Qualifying Spend Criteria 11. Upon successful registration as per Clause 7 above, Eligible Participant(s) shall spend using 6-Digit PIN on their PIN & PAY CIMB Debit Mastercard for Dining transactions (as defined in Clause 17 herein) within the Campaign Period and shall be entitled to receive Ringgit Malaysia Five (RM5) cash back for every spending transaction ( Eligible Transaction(s) ). 12. Minimum spend per Eligible Transaction is RM 50. 13. For easy reference, please refer to the customers scenarios Table 1 below: Table 1: Customer Scenarios Customer A had registered for this campaign on 1 July 2017. Customer Spend Period Spending transactions A 1 July 2017 30 1 st swipe: RM80 September 2017 2 nd Swipe: RM50 Customer A is entitled to RM10 cash back (Subject to Customer Capping of RM20 and Campaign Capping of RM1,000,000 throughout the Campaign Period) Customer B had registered for this campaign on 7 August 2017. Customer Spend Period Spending transactions B 7 August 2017 1 st swipe: RM50 30September 2017 2 nd Swipe: RM10 (Not entitled for cash back as minimum spend is RM50) 3 rd Swipe: RM60 4 th Swipe: RM100 Customer B is entitled to RM15 cash back (Subject to Customer Capping of RM20 and Campaign Capping of RM1,000,000 throughout the Campaign Period) 2

Customer C had registered for this campaign on 18 September 2017. Customer Spend Period Spending transactions C 18 September 2017 1 st swipe: RM70 30September2017 2 nd Swipe: RM50 3 rd Swipe: RM60 4 th Swipe: RM100 5 th Swipe: RM100 (Not entitled for cash back as customer capping is RM20 throughout the campaign period) Customer C is entitled to RM20 cash back (Subject to Customer Capping of RM20 and Campaign Capping of RM1,000,000 throughout the Campaign Period) 14. Subject to the Terms and Conditions herein, an Eligible Participant shall accumulate transactions from the date in which he/she successfully registered for the Campaign provided that the registration is made within the Campaign Period. Please refer to the example below. Example: Eligible Participant D has made multiple Eligible Transactions with his CIMB Debit Mastercard since 1 July 2017. However, Eligible Participant D only successfully registered for the Campaign on 16 July 2017. As a result,all of Eligible Participant D s Eligible Transactions from 1 July 15 July 2017 will not be accumulated to calculate the cash back even though the transactions meet the Eligible Transactions requirement. Only Eligible Participant D s Eligible Transactions from 16 July 30 September 2017 will be accumulated to calculate the cash back. 15. If an Eligible Participant(s) holds more than one CIMB Debit Mastercard, Eligible Transaction(s) made using each CIMB Debit Mastercard will be combined to meet the Spend Criteria. Eligible Transaction(s) made by joint accountholders, will be combined with Eligible Transaction(s) of the first named account holder i.e. the primary account holder. For the purpose of this Campaign, the secondary joint accountholder(s) is not eligible to participate in this Campaign. 16. Transaction must be posted to the Eligible Participant(s) CIMB Debit Mastercard within the dates (Malaysia GMT) shown in Table 2 below to be included towards meeting the Eligible Transaction(s). Please note that transactions may be posted by the merchant as late as 30 days after the transaction date. The Bank will not be held responsible for late posting. 18. Any unposted, cancelled, void, disputed, refunded, fraudulent or unauthorised transactions will be excluded from the Eligible Transaction(s). Any determination by CIMB Bank as to what constitutes Dining Category shall be conclusive and shall not be challenged in any manner whatsoever. 19. The Eligible Participant(s) CIMB Bank Current or Savings Account(s) and CIMB Debit Mastercard must not be dormant or closed at the point the cash back is credited into the Eligible Participant s CIMB Bank Current Account or Savings Account. Cash Back 20. Cash Back is capped at RM 20 per Eligible Participant throughout Campaign Period. 21. The total Cash Back made available for this Campaign and the Debit Card RM5 Dining Cash Back Campaign organized by CIMB Islamic Bank is capped at RM1,000,000 and shall be awarded on a first come first serve basis which is based on earliest transaction date and time. Once the capping of RM1,000,000 is fully used up, the Eligible Participants will not be awarded with the Cash Back. 22. CIMB Bank will notify the Eligible Participants entitled to cash back via electronic communication display at CIMB Bank s website or www.cimbclicks.com.my or via electronic mail or via SMS to theirmobile numbers or by any other means of notification which CIMB Bank may select if they have won the Cash Back. 23. Cash back will be credited into the Eligible Participants CIMB Bank Current or Savings Account linked to the CIMB Debit Mastercard used for the first Eligible Transaction during the Campaign Period within 8 to 10 weeks after each of the Campaign Months. CIMB Bank will not entertain any request from the Eligible Participants entitled to cash back to credit the cash back to their other CIMB Bank accounts or other accounts maintained with other banks or any third party s accounts. General Terms and Conditions 24. By participating in this Campaign, the Eligible Participant(s) are deemed to have read, understood and agree to be bound by the Terms and Conditions herein and agree all decisions fairly and reasonably made by of CIMB Bank in relation to every aspect of this Campaign, including the cash backto be given away and the determination of Eligible Participants entitled to cash backshall be final, binding and conclusive. 25. The Eligible Participant(s) participating Debit Mastercards (i) MUST not be in breach of material terms and conditions of CIMB Debit Mastercard agreement or CIMB Bank account agreement or CIMB Clicks Internet Banking Agreement or CIMB Clicks Mobile Banking Agreement, AND (ii) MUST not be terminated or closed or made subject to any terminated or closed or be made subject to any attachment, adverse orders made by the Court or any authorities sanctioned by laws, AND (iii) MUST not be in delinquent, and/ or be invalid or cancelled within CIMB Bank s definition, otherwise the Eligible Participant(s) will be disqualified from participating in this Campaign and shall not be entitled to receive the cash back. 26. CIMB Bank reserves the right to suspend, cancel, terminate or withdraw this Campaign in whole or part, by giving the Eligible Participant(s) prior notice of fourteen (14) calendar days. For the avoidance of doubt, suspension, cancellation, termination or withdrawal of this Campaign shall not entitle the Eligible Participant(s) to any claim or compensation against CIMB Bank for any losses or damages suffered by the Eligible Participant(s) or any party as a direct or indirect result of the act of suspension, cancellation, termination or withdrawal unless the same is to CIMB Bank s willful default or gross neglect. 4

27. CIMB Bank reserves the right upon giving prior notice of twenty one (21) calendar days to vary (whether by addition, deletion, modification, amendment, or otherwise howsoever) ( Amendment ) any of the terms and conditions herein. Notification to the Eligible Participant(s) in respect of the Amendment shall be effected at CIMB Bank s absolute discretion through any one of the following means of communication, namely, by ordinary mail to the Eligible Participant(s) last known address or by posting a notice regarding the Amendment at each of CIMB Bank s branches or by effecting an advertisement regarding the Amendment in one newspaper of CIMB Bank s choice, or via CIMB Bank s website or by any other means of notification which CIMB Bank may select and the Amendment shall be deemed as binding as from the date of notification of the Amendment or from such date as may be specified by CIMB Bank in the notification. Eligible Participants acknowledge and agree to access CIMB Bank s website at regular intervals to view the Terms and Conditions and to ensure that they are kept up-to-date with any changes or variations to these Terms and Conditions. 28. These Terms and Conditions (as may be amended from time to time pursuant to Clause 27) shall prevail over any provisions or representations contained in any other promotional materials advertising this Campaign. These Terms and Conditions are to be read in conjunction with the prevailing terms and conditions of the CIMB Debit Mastercard agreement or CIMB Bank account agreement or CIMB Clicks Internet Banking Agreement or CIMB Clicks Mobile Banking Agreement and terms and conditions in CIMB Bank Current or Savings account agreement and/or CIMB card or account agreement which shall apply in addition to the Terms and Conditions herein. 29. By participating in this Campaign, the Eligible Participant(s) hereby agrees that shall not hold CIMB Bank liable in the event that CIMB Bank is unable to perform in whole or in part of any of its obligation herein, attributable directly or indirectly to the failure or error of any mechanical or electronic device, data processing system, transmission line, electrical failure, industrial dispute, war, strike, riot, any act of God beyond CIMB Bank's control or due to any factor in a nature of a force majeure which is beyond CIMB Bank s reasonable control. 30. By acceptance or receipt of cash back, the Eligible Participants agrees not to hold harmless CIMB Bank and its affiliates and their respective directors, officers, employees and agents from and against any claim, action, proceeding, judgment, damage, loss, expense or liability suffered by CIMB Bank and its affiliates and their respective directors, officers, employees and agents in connection with such Eligible Participants participation in the Campaign or receipt, redemption or use of the cash back. 31. CIMB Bank shall not be liable to any party, including the Eligible Participant(s), for any loss or damage of whatsoever nature suffered by the Eligible Participant(s) or any party (including but not limited to any injury or death, loss of income, profits or goodwill, direct or indirect, incidental, consequential, exemplary, punitive or special damages of any party) howsoever arising, in relation to the Eligible Participant s participation or non-participation in the Campaign including arising from the Eligible Participant s receipt, non-receipt and/or delayed receipt of the phone call or Short Message Service (SMS) or e-mail by the selected Eligible Participant unless the same is due to CIMB Bank s willful default or gross neglect. 32. By participating in the Campaign, the Eligible Participant(s) hereby consent to and agree that CIMB Bank shall be entitled to publish and/or display at no costs to the Eligible Participant(s), materials and/or information, including but not limited to the names, identification number, city of residence and photographs of Eligible Participants(s) for advertising and publicity purposes in any manner it deems appropriate. Non-compliance may result in an alternative Eligible Participants entitled to cash back being chosen. 33. In the event of any inconsistency(ies), conflict(s), ambiguity(ies) or discrepancy(ies) between the Bahasa Malaysia and English version or versions in other languages of these terms and conditions, the English version of these terms and conditions shall prevail. Notwithstanding the aforementioned where request had been made by the Eligible Participant(s) and noted and acknowledged by CIMB Bank in its records that the Bahasa Malaysia version of the terms and conditions shall govern the 5

operation of the CIMB Bank Current or Savings Account(s) linked to the Debit Mastercard, then the Bahasa Malaysia version of the terms and conditions herein shall prevail. 34.
