RESOLUTION NO. ------ RESOLUTION OF THE CITY OF GLENDALE SETTING FORTH RATES AND CHARGES FOR GLENDALE WATER AND POWER ELECTRIC SERVICE WHEREAS, the City of Glendale, through the Glendale Water & Power Division ("GWP"), operates a municipal utility for the distribution of electrical energy to the citizens of the City of Glendale; and WHEREAS, GWP electric rates have not been increased since 2008; and WHEREAS, an electric rate increase is essential to maintain and restore the financial stability of the utility; and WHEREAS, the City of Glendale employed a rate consultant who performed a cost of service analysis and an electric rate design for GWP; and WHEREAS, through the cost of service analysis, the consultant concluded that the shares of total revenue collected from the various customer classes must be adjusted in order to accurately reflect the costs of providing electric service to each customer class; and WHEREAS, the rate consultant recommends a rate plan that would allocate the cost of providing electric service proportionately among all classes of electric customers; and WHEREAS, on August 6, 2013, the City of Glendale conducted a noticed public meeting regarding the proposed electric rates and charges and considered the reports and testimony of staff and the comments of the public regarding the same; and WHEREAS, the cost of service analysis and proposed rate plan reflect previously approved law and legislative direction of the present and former city councils including: (i) the requirements of Article XI, Section 22 of the Glendale City Charter, which was approved by the voters in 1949 and has remained in the City Charter since that date; (ii) the Public Benefits Charge set forth in Section 13.44.425 of the Glendale Municipal Code, which was first approved in 1997 as required by state law and subsequently amended in 1998, 1999, 2001, 2006 and 2008 and has remained in the Glendale Municipal Code, 1995 ("GMC") without change since 2008 (iii) the direction of city councils to fund street lighting expenses and traffic signal lighting with GWP revenue for each of fiscal years 2001-2002 through 2012-2013 and (iv) the direction of the current city council to fund street lighting expenses and traffic signal lighting through general fund revenue effective with FY 2013-2014, and as approved in the FY 2013-2014 budget; and 1 c 1 F/fllenetcopy/Electric Rate Resolutlon.docx
WHEREAS, the proposed electric service rates and charges have been calculated on the basis of the actual and proportionate costs to provide electric service to GWP's customers; and WHEREAS, the proposed electric rates and charges constitute charges imposed for one or more of the following reasons: ( 1) a specific City benefit conferred or privilege granted (California Constitution, Article XlllC, 1(e)(1)) and/or (2) a City service or product (California Constitution, Article XlllC, 1 (e)(2)). NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF GLENDALE: Section 1. Notice of the public meeting at which this Resolution was considered was properly given, and all oral and written presentations made to and heard by the City Council were properly considered. Section 2. There is a reasonable relationship between the rates to be charged for the provision of various City services and the City's costs in providing those services. Section 3. The Electric Rates attached hereto as Exhibit A: a) do not exceed the actual or estimated reasonable costs to the City of providing the services to which the fees relate; b) are reasonable and necessary to enable the City to provide the benefit or privilege, service or product to which they relate; and c) have been allocated in a manner such that the costs to the payor bear a fair and reasonable relationship to the payer's burden on, or benefits received, from the City. Section 4. Compliance with California Environmental Quality Act. The City Council finds and determines that this Ordinance is not subject to the California Environmental Quality Act ("CEQA") and, therefore, an environmental review is not required pursuant to Section 21080(b )(8) of the California Public Resources Code and Sections 15273(a) and 15061 (b )(3) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3 because CEQA does not apply to the establishment, modification, restructuring, or approval of rates and other charges by public agencies for purposes such as those set forth herein. BE IT FURTHER RESOLVED that the electrical rates and charges set forth in Exhibit A shall take effect upon the effective date of the 2013 ordinance entitled: "AN ORDINANCE OF THE CITY OF GLENDALE AMENDING SECTIONS 13.44.010 THROUGH 13.44.530 OF THE GLENDALE MUNICIPAL CODE, 1995, RELATING TO GLENDALE WATER AND POWER ELECTRIC RATES AND CHARGES." Section 6. Severability. If any Section, subsection, clause, phrase, sentence or word of this Resolution or the application thereof to any person or circumstance is for any reason held invalid, the validity of the remainder of the Resolution or the application of such provision to other persons or circumstances shall not be affected thereby and shall not affect any other Section, subsection, clause, phrase, sentence or word of the Ordinance that can be given effect without the invalid Section, subsection, clause, phrase, sentence or word of this Resolution. The City Council hereby declares that it would have passed this Resolution and each Section, subsection, clause, phrase, sentence and word hereof, irrespective of the fact that one or more Sections, subsections, clauses, phrases, sentences or words or the application hereof to any person or circumstance is held invalid.
