What the amendment des The amendment prpses t: Rezne land as fllws: The majrity f the Queen Victria Market land and Queen Street extensin currently zned Capital City Zne (CCZ1) t be rezned t Public Use Zne (PUZ7); and The Queen Victria Market car park currently zned Capital City Zne (CCZ1) t be rezned t Public Park and Recreatin Zne (PPRZ). Apply a new Schedule t the Develpment Plan Overlay (DPO11), which incrprates a visin and design requirements fr develpment f land, including Cuncil wned land, adjacent t the Queen Victria Market. Delete existing schedule 14 t the Design and Develpment Overlay (DDO14) frm the Queen Victria Market and land t which DPO11 applies t cntract the area cvered by DDO14. Amend the existing schedule 14 t the Design and Develpment Overlay (DDO14) which will apply nly t the cntracted area, t intrduce revised built frm cntrls fr new develpment. Amend the Built Envirnment and Heritage within the Hddle Grid Plicy (Clause 21.12) t delete an existing plicy statement relating t the existing DDO14, and amend Figure 6: Hddle Grid t shw the Queen Victria Market and t extend the area f the Queen Victria Market Precinct (t which this amendment applies). Strategic assessment f the amendment Why is the amendment required? The City f Melburne has develped a masterplan fr the Queen Victria Market Precinct, t set a psitive agenda fr cnserving the heritage significance and character f the QVM, whilst meeting the cntemprary needs f traders, shppers and a grwing City. The amendment is required in rder t implement a revised framewrk f planning cntrls that facilitates the principles established in the masterplan, safeguards the future f the QVM and enhances its surrunds. The Queen Victria Market Precinct Renewal: Built Frm Review and Recmmendatins Reprt prepared by Jnes & Whitehead Pty Ltd (the Built Frm Review) identifies shrtcmings in the existing cntrls affecting the QVM and its envirns. It sets ut recmmendatins regarding the Queen Victria Market Precinct and changes t the existing planning cntrls, which the amendment seeks t implement. Required changes t the planning scheme: The QVM and the Queen Street extensin are t be rezned t the Public Use Zne in recgnitin f their lng standing use fr public purpses. The new zne will cntinue t facilitate the existing use and develpment f the land fr the Market and its attendant functins, differentiating it frm the land surrunding it which is in either a Mixed Use Zne (MUZ) r Capital City Zne (CCZ1). The land t the suth f main Market building, between Peel Street and Queen Street is prpsed t be rezned t a Public Park and Recreatin Zne. This is t implement the masterplan s prpsal t relcate the existing market car park t ther Cuncil wned site(s) in the precinct and use the land as a new public pen space. A new Develpment Plan Overlay (Schedule 11) is prpsed t be applied t the QVM car park, existing stre buildings t the suth and land ppsite the market in Therry Street, Queen Street and Franklin Street. The DPO11 is prpsed t apply new use and develpment requirements that will facilitate the recmmendatins f the masterplan and the Built Frm Review. The area t which the DPO11 applies is cnsidered the mst sensitive being directly ppsite the market. Any develpment prpsal will be subject t street frntage heights and setbacks, and wind and weather prtectin requirements. These requirements are t ensure a lively and cmfrtable pedestrian envirnment and the interface with the Market and t ensure develpment respnds apprpriately t its scale and heritage character. The existing Design and Develpment Overlay (Schedule 14) will be amended, t cntract its extent (t be in part replaced by a Develpment Plan Overlay, and t intrduce specific design requirements fr building scale, heights, setbacks, facades, active street frntages, public spaces and new pedestrian access links. A number f these requirements align with plicy directin in existing lcal plices and in rder t simplify the planning scheme, these prvisins have been subsumed int the new DDO. As Amendment C245 was prepared prir t the apprval f Amendment C262, it was cnsidered necessary that the revised area f DDO 14 remain and include built frm cntrls that are generally cmplementary t the DPO prvisins and cmplete the suite f planning scheme cntrls that will enhance whle QVM Precinct. A cnsequential change is als required t Clause 21.12 (Hddle Grid) t remve reference t a built frm transitin that is n lnger relevant r achievable in the cntext f the built frm review. In granting authrisatin the Minister fr Planning has required the inclusin f plicies t cnsider vershadwing f Flagstaff Gardens within DPO11 and t mdify clause 22.02 Sunlight t Public Places. Pursuant t sectin 12 f the Planning and Envirnment Act 1987 the amendment als cmplies with the Ministerial Directin N.9 (Metrplitan Strategy): Directin 1.4 Expanded central city: the amendment will facilitate the future expansin f the CBD int the City Nrth Precinct by encuraging a range f uses and quality built frm utcmes that reflect the intended linking f the CBD and City Nrth. Directin 2.2 Husing supply: the amendment will assist with unlcking the capacity f the nrthern edge f the Central City fr higher density mixed use develpment including husing and mre affrdable husing clse t public transprt and, emplyment and cmmunity services. Directin 4.2 Prtect Melburne and its suburbs frm inapprpriate develpment: the amendment will prtect a unique City s precinct in and arund the QVM and ensure that new develpment des nt cmprmise the values held by the cmmunity fr this area. Directin 4.6 Mre public spaces: the amendment will enable the creatin f a new public pen space at the suthern end f the market that cmplements highly valued existing public spaces in the area Directin 4.7 Respect ur heritage: the amendment will encurage new develpment that is designed and sited t respect the identified significance f heritage places, in particular the Queen Victria Market. Hw des the amendment supprt r implement the State Planning Plicy Framewrk? The amendment is cnsistent with State Planning Plicy by supprting the regeneratin f existing urban land, prviding gd use f infill develpment and use f existing
infrastructure, whilst managing change and impacts n the significant Queen Victria Market. Specifically, the amendment is cnsistent with: Clause 10 Operatin. By managing the use and develpment f land adjacent t the QVM, the amendment will help deliver a net cmmunity benefit. This will be achieved by allwing an increased urban density, activating a mixture f different and cmplementary land uses as well as bringing vitality t the these areas. Clause 11 Settlement. The amendment is cnsistent with the principles and bjectives f Plan Melburne and will manage develpment in a manner that will uphld the Metrplitan Strategy s plicy directives. Clause 15.01 Design and Built Frm. The amendment will facilitate the implementatin f urban design, built frm, and streetscape design principles t facilitate psitive changes t land adjacent t the QVM. The amendment will help incrprate planning prvisins that will encurage and supprt enhanced liveability, and amenity within the QVM envirns. Clause 16 Husing. The amendment will help deliver the strategic visin fr the QVM envirns by facilitating and cntributing t the enhancement and planning f a vibrant, functinal, safe and integrated part f the Central city which services the cmmercial, emplyment and husing needs f the municipality. The City f Melburne is an interface bdy under the Transprt Integratin Act 2010. It is required t have regard t transprt system bjectives and decisin-making principles when making decisins that have a significant impact n the transprt system. The Amendment will imprve the transprt system. It will: encurage walking; reduce reliance n cars; and imprve the pedestrian netwrk within, int and ut f the precinct. The Amendment will strngly integrate transprt and land use by prviding fr mre intensive land use near existing and prpsed public transprt ndes including the planned Melburne Metr statins at Parkville and City Nrth. The Amendment prvides fr mixed land uses near existing and prpsed statins which will increase the efficiency f the use f public transprt infrastructure by increasing cunter-peak and inter-peak use.
