Ÿ All the transactions are on reserved price basis, SAMIL reserves its rights to withdraw any vehicle(s) or equipment, if SAMIL does not get the desired/expected reserve price. Ÿ All vehicles and equipments are sold on as is where is basis and it is the customer's responsibility to do the physical inspection before buying any vehicle or equipment. Shriram Automall India Limited takes no guarantee or warranties, expressed or implied, of any kind. Ÿ Sale price does not include any statutory tax pending and applicable RTA fees. All these costs are additionally payable by the successful customer. Ÿ The Customers are deemed to have physically inspected the vehicle(s) or equipment before buying, hence subsequent to sale, no disputes or deal cancellations shall be entertained. The inspection can be done by any person on giving his / her business card. Ÿ To participate in the Vehicle Mela, the participants are advised to register in advance. Ÿ All purchases made by the successful Customer are subject to applicable VAT or sales tax as may be levied by the seller of the vehicle / equipment Customer Registration Ÿ SAMIL shall be entitled to collect Rs.19,999/- (Rupees Nineteen thousand nine hundred and nineteen only) as refundable security deposit for the services rendered by it ( RSD ). The refundable security deposit shall be adjusted with the service charge paid by the buyer. Ÿ The customer will be entitled to bid up to 10 times of the RSD amount in favour of SAMIL. The customer can enhance his bidding limit by depositing additional RSD anytime during the event. Ÿ For registration the customer must present one of the following Photo ids - PAN Card or Passport or Driving License or Voter's ID or Adhaar Card. Ÿ Entry to the Vehicle Mela is strictly restricted to the registered Customer only. Ÿ In case a registered customer does not buy any vehicle or equipment, then the refund of RSD will be made immediately after the closure of the Vehicle Mela. Ÿ The successful customers will pay SAMIL Service Charge @ 1% of the Purchase Price per vehicle or Rs.1000/- per vehicle whichever is higher, plus applicable Service Tax @ 12.36% on the Service Charge for the services rendered by SAMIL. The Service Charge is not negotiable and is payable on all purchases. Payment Ÿ All purchases made by the Successful Customer are subject to applicable VAT or sales tax charge and any other statutory taxes and RTO charges applicable as per law in force, the same are payable by the Successful Customer exclusive of the Sale Amount. Ÿ Successful Customers (including Customers opting to pay Sale Amount by Cheque / DD) have to pay a minimum of 10% of the Sale Amount of the vehicle / equipment on the same day to Seller. The seller's details will be provided by SAMIL. Ÿ The balance sale amount should be paid by the Successful Customers (including Customers opting to pay Sale Amount to the Seller by Cheque / DD) within 7 (seven) calendar days from the date of Vehicle Mela. Ÿ A delayed interest @ 18% will be charged against any amount due and payable by the Successful Customer beyond 7 (seven) calendar days from the date of Vehicle Mela, subject to a maximum wait period of 15 (fifteen) calendar days from the date of Vehicle Mela. Ÿ Default beyond the stipulated 15 calendar days time limit will lead to deal cancellation and forfeiture of RSD paid and the vehicle/equipment/machinery will be re-sold without further information. Documentation services Valuation services Delivery Ÿ Successful Customers are fully responsible for taking delivery of all Vehicle(s) or Equipment from Automall after full payment is made. Ÿ No vehicle / equipment must be removed by the Successful Customer until all dues are paid in full and realized by the seller. Ÿ All purchased vehicles or equipment must be removed within 15 (fifteen) calendar days from the date of Vehicle Mela; else storage / parking fees @ Rs. 500/- (Rupees Five Hundred Only) plus applicable taxes per Vehicle or equipment per day will be applicable. P Secured stockyards and parking facility Spare parts and accessories General Insurance Refund Ÿ No Refundable Security Deposit (RSD) in excess of Rs 19,999/- is refunded in cash; any cash received more than Rs 19,999/- towards RSD will be refunded to unsuccessful customers in the form of cheque or DD or NEFT transfer within 3 working days at any given branch location subject to submission of Bank particulars by the customer. Ÿ For NEFT transfer the following details are required : IFSC code Account No., Bank Name, Bank Branch Name, Bank Branch Code, Beneficiary Name (Customer Name -MUST be same as per ID proof given) And the ID / address proof (given for registration ) and customer name in bank should be same. Ÿ RSD will be refunded to successful bidders after realization of sale proceeds by the seller and confirmed the same by the seller. Others Ÿ It is hereby informed to all Customers and participants that, videos and photographs of the Vehicle Mela and events shall be used for our promotional, marketing, publicity, record keeping and other such related purposes. Ÿ Shriram Automall India Limited reserves the right to hold any Vehicle. Ÿ Ÿ The Successful Customer hereby agrees that the decision of SAMIL is final in conducting auction.
