TERMS AND CONDITIONS: 1. a) The Contractor has to indemnify the Company against present & future liability towards P.F and ESI contributions that would arise in execution of this work. You have to remit the Provident Fund and ESI contributions for the Employees engaged by you and proof of remittance shall be submitted along with the bills. You have to submit acquittance register every month. You have also to submit the PF & ESI Code numbers for the employees engaged by you. In case you fail to submit the details of remittances towards PF & ESI contributions, the Company reserves the right to recover the PF & ESI contributions as per acquittance register submitted by you, from your running bills and remit the same to the respect authorities. b) Previous Experience if any to be submitted along with offer. c) Tenderer Shall deposit Rs.15,027/- (Rupees Fifteen thousand Twenty Seven only) by crossed Demand Draft in favour of the Andhra Pradesh Heavy Machinery & Engineering Limited payable at Vijayawada as Earnest Money. Any Tender which is not accompanied by the Earnest Money shall be rejected. This amount shall not bear any interest. Earnest money of unsuccessful Tenders shall be returned after finalization of order. EMD of successful Tenderer shall be returned after completion of work and acceptance as certified by the concerned. d) The Tenderer shall agree to deposit with the Company a sum of Rs.25,000/- (Rupees Twenty Five thousand only) as Security Deposit for due performance of the contract and the Security Deposit of Rs.25,000/- kept with the Company shall not earn any interest. This Security deposit shall be returned after guarantee period. e) Conditioned Tenders and Tenders without requisite Earnest Money deposit shall be rejected summarily. APHMEL reserves the right to accept or reject any or all the Tenders without assigning any reason whatsoever. f) Contractors must quote their rates both in words and figures. In case of any discrepancy between the words and figures the words shall prevail. No further correspondence in this regard will be entertained. 2. PRE-QUALIFICATION AND TENDERING PROCEDURE. i). Only those contractors/firms who have experience in execution of similar Magnitude works shall be eligible. Documentary evidence obtained from organizations (clients) clearly indicating financial year-wise turnover for having executed such works with full details shall be produced along with tender. ii) The Tenderers have shall have an experience at a Minimum Annual Turnover of Rs.5 lakh of civil works in any one financial year during the preceding three financial years (2012-2015). iii) The experience certificates issued by the Organizations (Clients) for whom the tenderers have executed the works, shall clearly indicate the financial year wise amount of works (yearly turn-over) executed by the tenderer. iv) Latest income tax clearance certificate. v) In Case of firms, they should submit the registered partnership deal and registration certificate issued by registrar of firms. In case of limited company the articles of association etc., are also to be submitted. vi) On award of the work, if the contractor fails to execute the work within the stipulated time, or fails to show substantial progress as per the programme submitted by contractor at the time of Agreement on various items of work given in schedule of quantities, the APHMEL is at liberty to order the contractor to discontinue the work forthwith and shall recover liquidated damages, difference in cost of the work left incomplete as per the prevailing rates, confiscate the Earnest Money Deposit & Further Security Deposits paid on the work. Such recoveries will be deducted from the bills payable to the contractor. If the amounts of pending bills are not sufficient to meet the recoveries. The APHMEL is at liberty to recover from any amounts either held by APHMEL or due for payment including pending bills of other works of this contractor with the APHMEL. vii) APHMEL reserves the right to accept any tender in full or in part or to reject any or all tenders assigning any reasons. without viii) Bidders are requested to submit their most competitive unit prices in sealed covers.
ix) Any dispute arised in execution of above work will be settled within the Jurisdiction of Vijayawada, Krishna Dt., A.P. only. x). Force Majeure: The force-majeure conditions are such as civil commotion, natural calamities, war etc., acts of god, strike or lockout in the factory of the contractor and their major suppliers. The force-majeure conditions also includes delays arising out of short supplies of power, delay in handing over the land which are beyond the control of the contractors and they shall submit documentary evidence in support of the above. 3. INJURIES DUE TO ACCIDENTS: The Contractor shall at all times indemnify the APHMEL against all claims which may be under the workmen compensation Act or any statutory modification thereof for the rules of the compensation payable in consequence of any accident or any injury sustained by any workmen and engaged in the performance of business relating to this contract. In all cases of personal injury to workmen employed by contractor on this work, the contractor is liable to pay compensation under Workmen s Compensation Act. 4) CLAIMS OF P.F & E.S.I CONTRIBUTIONS: The Contractor at all time indemnify the APHMEL against all claims which may be under Employee Provident Fund Act and Employee State Insurance Act or any other modification thereof for the rules of contributions payable in consiqusion of execution of said work. The bidders shall submit proof of PF & ESI Registration Certificate along with the tender. 5. PLAN OF PAYMENT: a) Based on progress of the work the Contractor has to produce a record bill in a measurement book as per the mutually agreed proforma and as per the item-wise rates and submit for payment to the department. b) The payment of bills will be made after due scrutiny by the departmental Engineers considering work programmed and purchase bills submitted. c) The Contractor should arrange for legible, neat and systematic recording of the bill as per the items of the work/specifications listed in the item-wise schedule. d) However, the payments to the contractor are subject to TDS of APVAT (WCT) at present applicable TDS. The TDS of WCT would be made by APHMEL irrespective of the fact whether the contractor is eligible for payment of APVAT (WCT) or not.
