Amended HSBC Bank/HSBC Amanah Telegraphic Transfer Love Campaign 2015 ( Promotion ) Terms and Conditions This Amended Terms and Conditions for HSBC Bank/HSBC Amanah Telegraphic Transfer Love Campaign 2015 ( This Terms and Conditions ) will supersede the existing, pre-amended Terms and Conditions ( Terms & Conditions for HSBC Bank/HSBC Amanah Telegraphic Transfer Love Campaign 2015 ) with effect from 17 August 2015 until the end of the Promotion Period. Clause 3 and 19 of this Terms and Conditions will be amended as in bold and underlined to include India as a beneficiary country and Indian Rupee as a Participating Currency with effect from the date mentioned above. Every mention of HSBC Bank refers to HSBC Bank Malaysia Berhad (Company No. 127776-V), HSBC Amanah to HSBC Amanah Malaysia Berhad (Company No. 807705-X). This Promotion shall be extended until 31 August 2015 and Clause 1 has been amended to reflect the extended promotion period. 1. This Promotion is valid from 4 June 2015 to 31 August 2015 ( Promotion Period ), both dates inclusive. 2. This Promotion is open to all customers of HSBC Bank and HSBC Amanah who: (i) have an MYR deposit 1 account/-i with HSBC Bank or HSBC Amanah; and (ii) perform an outward telegraphic transfer ( TT ) of a minimum amount of MYR 5,000 via HSBC Bank/ HSBC Amanah Personal Internet Banking ( PIB ) or at any HSBC Bank/HSBC Amanah branch ( Branch ), where the TT transaction involves a conversion of MYR to a Participating Currency (as defined below), EXCEPT for the following categories of persons:- i) permanent and/or contract employees of HSBC Bank, HSBC Amanah and HSBC Amanah Takaful (Malaysia) Sdn Bhd (Company No. 731530-M) (including their subsidiaries and related companies) and their immediate family members (spouse, children, parents, brothers and sisters); ii) non-individuals or HSBC Bank / HSBC Amanah corporate customers; iii) HSBC Bank / HSBC Amanah Business Internet Banking customers, hereinafter collectively referred to as Eligible Participant(s). 3. The following Foreign Currency(ies) are included in this Promotion ( Participating Currency ): (i) Offered by HSBC Bank Participating Currency: Australian Dollar (AUD), US Dollars (USD), Pound Sterling (GBP), Euro (EUR), Singapore Dollar (SGD), New Zealand Dollar (NZD), Brunei Dollar (BND), Canadian Dollar (CAD), Swiss Franc (CHF), Japanese Yen (JPY), Hong Kong Dollar (HKD), Danish Kroner (DKK), Norwegian Krone (NOK), Saudi Riyal (SAR), Swedish Krona (SEK), Thai Baht (THB), South African Rand (ZAR), Indian Rupee (INR); and (ii) Offered by HSBC Amanah Participating Currency: Australian Dollar (AUD), US Dollars (USD), Pound Sterling (GBP), Euro (EUR), Singapore Dollar (SGD), New Zealand Dollar (NZD) and Indian Rupee (INR). 4. For avoidance of doubt, if the source of funds for the TT transaction is already in the same currency being remitted, such TT transaction shall not be considered or taken into account for this 1 HSBC Bank/HSBC Amanah MYR Deposit Account/-i(s) are: HSBC Premier Account, HSBC Amanah Premier Account-i, HSBC Premier Junior Savings Account, HSBC Advance Account, HSBC Amanah Advance Account-i, HSBC Statement Savings Account, HSBC Passbook Savings, HSBC Basic Savings Account, HSBC Amanah Basic Savings Account-i, Current Account, HSBC Basic Current Account and HSBC Amanah Basic Current-i.
5. This Promotion specifically excludes TT transactions performed through Global View and Global Transfer. 6. The conversion of funds for any TT transaction is subject to the inherent risk of currency fluctuations. 7. The Eligible Participant will be charged a transaction fee for every successful TT transaction performed:- a) Via Branch MYR 47.70 b) Via PIB MYR 26.50 Winner Selection Process 8. To participate in this Promotion within the Promotion Period, the Eligible Participant must perform a successful TT transaction of a minimum of MYR 5,000.00. Each successful TT transaction will entitle the Eligible Participant to one (1) entry. 9. The following is the selection process adopted to determine the potential winners for this Promotion ( Potential Winners ): a) At the end of the Promotion Period, the pool of Eligible Participants who have performed the TT transactions will be listed in chronological order and assigned a running serial number. b) Twenty (20) Potential Winners will be determined by dividing the total serial numbers by 20 and rounded to the closest lower whole number. For example, the total serial numbers which amount to 38,888 will be divided by 20 and rounded to the closest lower whole number, i.e. 1,944. The Potential Winners would therefore be those with the serial number of 1,944 and multiples of 1,944. HSBC Bank/HSBC Amanah's decision on the selection of the Potential Winner will be final. c) Potential Winners will be contacted six (6) weeks after the Promotion Period by HSBC Bank/HSBC Amanah or its appointed representatives via telephone. The telephone call to the Potential Winner will be to their telephone numbers maintained in HSBC Bank/HSBC Amanah s records. The Potential Winner is required to answer 2 questions related to HSBC Bank/HSBC Amanah. If the first attempt to call the Potential Winners fails, i.e. no reply, telephone number not in service, no connection, etc., another 2 attempts will be made within the next 2 hours of the first phone call to the Potential Winners. Where such further attempts are unsuccessful or the Potential Winners withdraw from the Promotion on being contacted, The Potential Winners will be disqualified from the d) HSBC Bank/HSBC Amanah reserve the right to select the next Eligible Participant with the subsequent serial number as the next Potential Winner if: the initially-selected Potential Winner cannot be contacted or does not answer the 2 questions correctly. For example, if the Potential Winner with serial number 1,944 cannot be contacted or answers the 2 questions wrongly, the Eligible Participant with serial number 1,945 will then be selected as the next Potential Winner and contacted by HSBC Bank / HSBC Amanah; or the Potential Winner had already been selected as a Winner for this Thus, the next Eligible Participant with the subsequent serial number will be selected as the next Potential Winner. e) Potential Winners must answer the 2 questions correctly to be a winner ( Winner ) to receive one Travel Voucher worth MYR 10,000 ( Prize ). f) The process under Clauses 9c, 9d and 9e will be repeated until the twenty (20) Winners for the Promotion are determined.
10. The Winners of the Promotion will be notified either in writing or by telephone by HSBC Bank/HSBC Amanah no later than two (2) weeks after the Winners have been determined. Prize Terms & Conditions 11. Only the Winners are entitled to receive the Prizes for this 12. The Prize will be sent by courier to the Winner within 60 days after the end of the Promotion Period at the Winner s risk. 13. HSBC Bank / HSBC Amanah reserve the right to substitute the Prize with any other item of equivalent value at any time with 3 days prior notice. Telegraphic Transfer Fee Rebate 19. Every successful TT Transaction performed per Clause 8 above by the Eligible Participant(s) where the beneficiary country is United Kingdom (UK) and India will receive a rebate ("Rebate") of the TT Transaction Fee (as shown in Table A below). HSBC Bank/HSBC Amanah will not entertain any request(s) from any Eligible Participant(s) or any other party to credit the Rebate into any other HSBC Bank/HSBC Amanah MYR deposit account/-i. The Eligible Participant(s) who is(are) entitled to receive the Rebate will be able to view the Rebate amount in their next banking statement.
General Terms and Conditions 22. HSBC Bank / HSBC Amanah reserve the right at their absolute discretion to amend, delete or add to these Terms and Conditions from time to time with 3 days prior notice and such amended terms and conditions shall prevail over any provisions or representations contained in any other promotional materials advertising this 23. HSBC Bank / HSBC Amanah reserve the right to cancel, terminate or suspend this Promotion with 3 days prior notice. For the avoidance of doubt, cancellation, termination or suspension of this Promotion shall not entitle the Eligible Participant(s) to any claim or compensation against HSBC Bank and HSBC Amanah for any and all losses or damage suffered or incurred by the Eligible Participant(s) as a direct or indirect result of the act of cancellation, termination or suspension. 24. HSBC Bank / HSBC Amanah shall only be liable for any loss or damage suffered or incurred as a direct result of HSBC Bank s or HSBC Amanah s gross negligence and shall not be liable for any other loss or damage of any kind such as loss of income, profit, goodwill or indirect, incidental, exemplary, punitive, consequential or special loss or damage howsoever arising, whether or not HSBC Bank or HSBC Amanah have been advised of the possibility of such loss or damage. 25. To the fullest extent permitted by law, HSBC Bank / HSBC Amanah expressly excludes and disclaims any representations, warranties, or endorsements, express or implied, written or oral, including but not limited to, any warranty of quality, merchantability or fitness for a particular purpose in respect of this 26. HSBC Bank / HSBC Amanah may use any of the following modes to communicate notices in relation to this Promotion to the Eligible Participant(s): I. individual notice to the Eligible Participant(s) (whether by written notice or via electronic means) sent to the Eligible Participant(s) s latest address/email address as maintained in HSBC Bank s and HSBC Amanah s records; II. press advertisements; III. notice in the Eligible Participant(s) s composite statement(s); IV. display at its business premises; or V. notice on HSBC s internet website(s); where such notices shall be deemed to be effective on and from the 4th day after its delivery/ publication/display as per the manner described herein. Save and except for notices sent via ordinary mail which will be deemed delivered on the 3rd day after posting, notices sent via other modes as described herein are deemed delivered immediately after posting/ publication/display. 27. HSBC Bank s and HSBC Amanah s decision on all matters relating to this Promotion and in case of any dispute will be final and binding on all Eligible Participant(s) of this Promotion and no correspondence will be entertained. 31. By participating in this Promotion, the Eligible Participant(s) agrees to be bound by these Terms and Conditions and the decisions of HSBC Bank and HSBC Amanah.
