VALUATIONS Valuations to be done within 2 years i.e not later than 30 September 2003 if taxpayer elected to use market value on valuation date Where market value exceed R10m certain other conditions apply

OTHER ISSUES Foreign Currency transactions Capital gains and losses dealt with by way of regulations Disposal to and from deceased estate Deceased estate liable for Estate Duty & CGT R1m rebate available only for estate duty Capital gain or loss realised through death CGT paid by estate - not beneficiaries Annual deduction increased to R50000 CGT qualify as deduction in estates above R1m

OTHER ISSUES(cont.) Company distribution Only company capital distributions subject to CGT if the distribution: Does not constitute a dividend Constitute a dividend which is exempt from STC Trusts and beneficiaries where trust asset is vested in beneficiary who is a resident capital gain disregarded in trust taken into account in determining beneficiary s aggregate capital gain or loss

OTHER ISSUES(cont.) Insolvent Estate Disposal of an asset by insolvent estate treated as if it was a disposal of the asset by the insolvent Compliance Retention of records Retain records to determine capital gain or loss for 4 years Lump sum benefit on retirement CGT will not affect average rate

PROBLEM AREAS Problem areas will have to be clarified by a further act of parliament, a practice note from the Receiver or a court decision. Losses carried forward It is not clear if the aggregate capital loss will be reduced each year by R10000 if there is no capital gain to set it off against.

Share valuations Taxpayers who are forced to adopt market value in last 5 trading days might loose if shares drop dramatically before 1 October 2001 Example: Cost price of shares in 1998 R10 per share Market value 1 October 2001 R5 per share Sells on 1 October 2002 for R7 per share CGT payable R2 per share - actual loss R3 per share

PROBLEM AREAS(cont.) Foreign Currency Will be dealt with by way of regulations What happens when offshore bank account in pounds is moved into a dollar account? Personal motor vehicles used for business purposes Employee receives car allowance Register car in own name Capital gain taxed if used for business purposes When used mainly for business purposes?

CONCLUSION To rephrase the title of Clint Eastwood s film Every which way you loose One should guard against valuing immovable property too high if you intend to sell the property later.
