GENERAL AGREEMENT Between BUTTE CLERKS UNION and SILVER BOW EMPLOYERS ASSOCIATION Butte, Montana Effective from May 7th, 1934 Classification. 1. All persons em ployed by th m em bers of the Silver Bow E m ployers A ssociation in the follow ing w ork: D epartm ent m anagers, salespeople, w indow trim m ers, m ail order dep artm ents, floor w alkers, m illiners, cashiers, bundle w rappers, street' salesm en, collectors, advertising w riters, wafe,- housem en, carpet layers, receiving and 1 shipping clerks, order counter em- * ployees, retail deliverym en and all, store em ployees not under the ju risdiction of other unions, excepting bookkeepers and stenographers who do such w ork exclusively, shall be, m em bers of the B utte C lerks U nion 3

in good standing or shall becom e m em bers of said union w ithin thirty days after securing em ploym ent. Salesm en spending 60% or m ore of their w orking hours out of the city are not required to be m em bers of the B utte C lerks U nion. I t is specifically agreed th at this classification does not include any person engaged exclusively in m anufacturing. 2. N o person not eligible to m em - bershio in the C lerks U nion shall be em ployed at any tim e w ithout w ritten perm ission from the B utte C lerks U nion. 3. T he establishm ents shall be divided into tw o classes, viz: T extile stores and Foodstuff stores. 4. A Foodstuff store shall be one w hich is engaged in the sale of foodstuffs. S. All stores not classified as F oodstuff stores shall be considered T extile stores. Hours. 6. Six hours and forty m inutes of labor and one hour for lunch shall constitute a day s w ork in all T extile stores w ith the exception of executives, w ho m ay be em ployed eight hours per day, six days per w eek and under provisions of the R etailers P erm anent Code, A rticle 5, Section 5. 4

D aily w orking hours shall be from 9 a. m. to 4:40 p. m., or from 10:20 a. m. to 6 p. m. w ith one hour for lunch. If B eginning after July 4th and during,i I July and A ugust, T extile clerks shall I w ork five days of eight hours each per 1. week. E xecutives to be allow ed one *( day off every o th er w eek after Ju ly * ' 4th during the m onths of Ju ly and A ugust. T extile establishm ents shall open at 9 a. m. and close a t 6 p. m. 7. A ny clerk em ployed for less than a day shall receive a full day s pay. 8. E ight hours w ork and one hour.f Ifor lunch shall constitute a day s w ork for em ployees in F oodstuff stores. O n Sundays m ale em ployees in Foodstuffs stores shall receive $6.40 per day and on holidays they shall receive $6.40 per day in addition to the regular pay. 1 W om en em ployees in Foodstuff stores shall receive $4.80 per day on Sundays and on holidays they shall receive $4.80 per day in addition to the reg ular pay. In Foodstuff stores four hours or its equivalent shall be allowed to each em ployee each week after July 4th during the m onths of July and A ugust. 5

Holiday Closing Hours. 9. The closing hours before C hristm as shall be as follow s: F oodstuff stores m ay rem ain open until 9 p. m. on the third and second nights before C hristm as, but shall close the night before C hristm as at 6 p. m. W holesale houses no additional time. T extile houses m ay rem ain open until 9 p. m. on the fifth, fourth, third and second nights before C hristm as but shall close the night before C hristm as at 6 p. m. T he delivery dep artm ents on the nights before C hristm as shall continue until deliveries are com pleted w ithout overtim e charges. W o rk perform ed during this period to the tim e of closing shall not be construed to be overtim e. Holidays. 10. All establishm ents shall be closed all day as follow s: All Sundays, C hristm as day, N ew Y ear s day, W ashington s birthday, D ecoration day, F ourth of July, L abor day, T hanksgiving day, and provided th at w henever M iners Field day is observed, then the stores shall be closed all day. W hen any of the above holidays fall on Sunday, the follow ing M onday shall be observed. 6

11. M em bers shall be paid for the above m entioned holidays. 12. W holesale houses shall close at 1 p. m. every Saturday, but w ork m ay be distributed through the w eek as required, provided th at no m em ber shall w ork longer than eight hours in any one day and the total num ber of hours in each week shall com ply w ith the requirem ents of the Codes applying to each kind of business; provided, a shipping clerk and one floor m an be perm itted to w ork in case of an em er- \ gency on Saturday and receive the. overtim e rate. Produce houses m ay I rem ain open Saturday afternoon if the. N ational Code, w hen adopted, allow s longer than a forty-four hour week. Scales. 13. T he scale of w ages shall be as follow s: j T extile em ployees: Men, $28.75 per week or $124.60 per m onth. T extile em ployees: W om en, $20.00 per week, $86.65 per m onth. Jew elers, w atchm akers, engravers, opticians, $36.00 per week. L ady fitters in alteration dep artm ents, $25.00 per week. ft D eliverym en, $28.75 per week. II D eliverym en (three- quarter ton t f tru ck s), $16.45 per week, $71.30 per m onth. 7

Linoleum or carpet layers w ages will be $30.00 per w eek of forty hours. Linoleum or carpet w ork perform ed at other than store hours will be done at the regular overtim e rate. Foodstuff Employees: 14. Men, $30.20 per week or $130.85 per m onth. W om en, $21.00 per week or $91.00 per m onth.. D eliverym en, $30.20 per week or $130.85 per m onth. D eliverym en (three- q uarter ton trucks), $19.00 per week or $82.35 per m onth." Overtime. 15. All w ork in excess of the tim e specified as a day s w ork o r on Sundays or holidays as specified, shall be paid as overtim e at the rate of 80 cents per hour for m en and 60 cents for ^ women and apprentices, w hich shall J be paid to B usiness A gent of said U nion. O vertim e shall be discouraged by both organizations except under em ergency conditions. A t inventory tim es: T h e em ployees in F oodstuff stores and wholesale w arehouses, w henever inventory is on Sunday, to be given a full day off the follow ing week. 16. W atchm akers, jew elers, engravers and opticians, $1.00 per hour. 8

jjj 17. L ight truck drivers, 60 cents' per hour. 18. O ne m echanical apprentice shall be perm itted to each jew elry shop w ithout restrictions w hich apply to other apprentices. 19. O ne apprentice or junior em ployee shall be allow ed for each five ' m em bers of the U nion. A ny person 18 years of age startin g an apprenticeship shall be paid for the second y ear s apprentice scale. T hose 19 years, the th ird y ear s scale. Cash or errand boys or girls shall not be under the jurisdiction of the C lerks Union. 20. All apprentices shall file application w ith the C lerks U nion and secure a w orking card before com m encing em ploym ent, and after each y ear s em ploym ent shall be advanced to the next scale, if retained. 9

i Cigar and Fruit Stores. 22. T he closing hours shall not apply to the follow ing establishm ents which handle such com m odities exclusively, i. e., cigars, tobacco, confectioneries, fruits, bakery goods, milk, cream, ice cream and soft drinks, but the em ployees shall be under the ju risdiction of the said U nion and o th er rules apply. Window Trimmers. 23. W indow trim m ers shall be allowed to trim w indow s after w orking hours provided the trim m er is allowed the sam e tim e off earlier the sam e day. C lerks U nion office to be notified by the window trim m er desiring to w ork overtim e. Alteration Department. 24. N o piece w ork shall be allow ed in this departm ent or any w ork leased out. A ny seam stress tem porarily acting as a fitter, shall receive fitters w ages N o apprentice shall be allowed in this departm ent. Before com m encing w ork in this departm ent, new em ployees shall first secure a perm it from the C lerks U nion. General Rules. 25. T he Business A gent of the C lerks U nion shall be perm itted to

interview any em ployee during busi-, ness hours, provided such em ployee is not engaged in w aiting upon a custom er. 26. N o em ployee shall suffer a reduction in salary on account of the operation of this agreem ent. T his applies to all em ployees w ho are a l low ed and earn com m issions, bonuses or other rem uneration in addition to th eir salaries. 27. A ll m isunderstandings o r disagreem ents over the interpretation of this agreem ent shall be subm itted to a joint com m ittee for adjudication, the num ber of representatives on such com m ittee to be m utually agreeable. 28. T his agreem ent shall becom e effective on and after M onday, M ay 7, 1934, and continue in full force and effect until M ay 1, 1935. If neither p arty gives notice d u ring the m onth o f April, 1935, it shall then autom atically continue for the ensuing tw elve m onths. 12

Agreement Between Silver Bow Employers Association and the Butte Clerks Union Relative to Druggists, and the Membership of the Said Union Employed Therein. All persons em ployed in any store conducted by a m em ber of the Silver Bow E m ployers A ssociation, except stenographers and bookkeepers, who do such w ork exclusively, shall be or becom e m em bers of the B utte C lerks U nion w ithin thirty days from the com m encem ent of said em ploym ent. N ine hours w ork, the hours to run consecutively w ith only one m eal hour, where possible, shall constitute a day's w ork for all m ale employees. O n holidays specified by the agreem ent betw een the E m ployers A ssociation and the C lerks U nion, four and one-half hours shall constitute a day s work. E very other Sunday shall be allowed off and an additional two and one-half hours shall be allow ed off each week, provided the num ber of hours to be w orked during the first seven (7) days to be sixty and one-half (60J4) 13

hours, and the follow ing six (6) days fifty-one and one-half (5 1 ^ ) hours in conform ity w ith the Code for thirteen days in any tw o consecutive weeks. F orty-eight hours per week fo r girls em ployed as soda fountain dispensers, cigar clerks, cashiers, etc., shall be considered union hours. A ll w ork in excess of this shall be paid for a t the rate of 50 cents per hour, in the m anner prescribed by the general agreem ent w ith the E m ployers A ssociation. All w ork in excess of the prescribed w ork as above for m ale em ployees, shall be paid for at the rate of time and one-half in the m anner provided by the general agreem ent. T he m inim um w age for pharm acists registered in M ontana shall be $37.50 per w eek after six m onths service in th e State of M ontana. T he first assistan t for the first six m o n th s services, $25.50 per w eek; the second six m onths service, $27.80. A fter tw elve m onths service, said assistan t to receive $37.50 per w eek if registered in M ontana. T he m inim um wage for second assistan t to be $20.00 per week. A ny store m ay em ploy one additional clerk in addition to the first and second assistants under the term s of th e general agreem ent. 14

All girl em ployees engaged as cashiers, cigar clerks, soda dispensers, etc., to receive the m inim um wage of $21.00 per week. T he first assistant is any person w ho is registered in som e other state than M ontana or a registered assistant in th e State of M ontana. T he second assistant is any person not registered in any state, but w ho is engaged in the sale or dispensing of drugs or drug sundries. N ot m ore than one first assistant is allow ed to a store at one time. O nly one second assistant shall be allowed to a store. H ow ever, one first and one second assistant m ay be allowed in one store at the sam e time. T he shifts shall so rotate as to perm it each m em ber to enjoy the benefits of the early shift after having w orked on the late night shift. All conditions not specified by this agreem ent shall be governed by the general agreem ent betw een the C lerks U nion and the E m ployers A ssociation of w hich this agreem ent becom es a part. 15
