DESCRIPTION: The Las Vegas Motor Speedway Chase to Vegas Sweepstakes sweepstakes (the Sweepstakes ) is sponsored by Nevada Speedway, LLC d/b/a Las Vegas Motor Speedway, a Delaware limited liability company with its principal place of business located at 7000 Las Vegas Boulevard North, Las Vegas, Nevada 89115 ( Sponsor ). SWEEPSTAKES PERIOD: The Sweepstakes begins on Thursday, October 29, 2015 at 8:00 a.m., Pacific Time (PT) and ends on Thursday, November 12, 2015 at 5:00 p.m. PT (the Sweepstakes Period ). All entries must be received by Thursday, November 12, 2015 at 5:00 p.m. PT. ELIGIBILITY: Sweepstakes is open only to legal residents of the 50 United States (including the District of Columbia) and Canada (excluding Québec) ( Territory ) who are twenty-one (21) years of age or older at time of entry, and have a valid driver s license except that residents of New York, Rhode Island and Florida are not eligible. WINNER SELECTION AND NOTIFICATION: Decisions of Sponsor with respect to the Sweepstakes are final. One (1) potential grand prize winner will be selected in a random drawing conducted by Sponsor, or a judge ( Judge ) it selects in its sole discretion on or about Thursday, November 12, 2015 from among all eligible entries received during the Sweepstakes Period. The potential grand prize winner is subject to verification, including without limitation, verification of eligibility, age, compliance with these Official Rules and completion of release forms (described below). If a potential grand prize winner is found not to be eligible or not in compliance with these Official Rules, the potential grand prize winner will be disqualified. All prizes will be awarded as-is with no warranty or guarantee either expressed or implied. The terms and conditions of the tickets awarded as part of the prize will govern in the event an event is not conducted due to weather conditions, an act of God, and an act of terrorism, civil disturbance or any other reason. Winner and his/her guest agree to comply with all applicable Speedway, Hotel and Venue regulations in connection with the prize. Sponsor reserves the right to remove or to deny entry to the Winner and/or his/her guest who engage in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person at the event. Released Parties (defined above) will not be responsible for weather conditions, Acts of God, acts of terrorism, civil disturbances, work stoppage or any other natural disaster outside their control that may cause the cancellation or postponement of any event. Event tickets and passes awarded as prizes may not be resold or offered for resale. Any such
resale may result in disqualification and prize forfeiture, and may invalidate the license granted by the event tickets. WINNER RESPONSIBILITIES: Sweepstakes winner will be solely responsible for all taxes on Sweepstakes prize(s) and will receive an IRS Form 1099 for the retail value of the prize(s). Winner will be required to sign a Statement of Eligibility, Liability Release and Publicity Release (collectively Releases ) (except where prohibited by law) and, in addition present a valid driver s license and insurance at the time of returning the executed Releases as directed by Sponsor. In addition, Winner s Guest will be required to sign a Liability and Publicity Release (except were prohibited by law). Failure to provide such will result in forfeiture of the Grand Prize. RELEASE: By participating, entrants agree, and by accepting prize, winner(s) agrees, to release and hold harmless the Released Parties from any and all liability, injury, loss or damage incurred by participating in the Sweepstakes and/or the awarding, receipt, acceptance, possession or use/misuse of the prize(s). By accepting the prize(s) the winner agrees to allow Sponsor the use of his/her name and address (city & state), photograph, videotape or likeness for advertising or publicity purposes and to the use of statements made by or attributed to the winner relating to Sweepstakes or Sponsor, and grants to Sponsor any and all rights to said use, without further compensation or notice, unless prohibited by law. PUBLICITY/USE OF PERSONAL INFORMATION: Except where prohibited, participation in the Sweepstakes constitutes entrant s consent for the Sponsor and the Sponsor s affiliates to use entrant s name, likeness and state of residence for promotional purposes in any media without further consideration. MODIFICATION: Sponsor reserves the right, at its sole discretion, to modify, cancel, postpone, delay, suspend and/or terminate this Sweepstakes in whole or in part in the event that the Sweepstakes is not capable of running as planned or as intended by these Official Rules by reason of any technical or other disabling causes that, in the sole discretion of the Sponsor, impair, corrupt or interrupt the administration, fairness, security or integrity or proper play of the Sweepstakes, including without limitation, hurricane, fire, flood, epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, war, terrorist threat or activity or insurrection. In the event of cancellation, Sponsor shall award the Sweepstakes Prize (or prizes of equal or greater value) in a random drawing from all eligible, non-suspect entries received as of the time of Sweepstakes cancellation. Sweepstakes are initially provided by Sponsor to entrant under the name Las Vegas Motor Speedway Chase to Vegas Sweepstakes but the name of the Sweepstakes is subject to change at the discretion of the Sponsor and any such name change shall be posted along with the rules at www.lvms.com/chasetovegas. Additional companies or organizations may join in sponsoring the Sweepstakes and such additions shall likewise be posted at www.lvms.com/chasetovegas
DISPUTE RESOLUTION: All entrants agree that: (i) any and all disputes, claims and causes of action arising out of or connected with the Contest or any Prizes awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for Nevada or the appropriate Nevada State Court located in Clark County, Nevada; and (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Contest, but in no event attorneys' fees. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of Nevada, without giving effect to any choice of law or conflict of law rules (whether of the State of Nevada or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Nevada.
