To : All DATAIR Retirement Plan Document System Clients From : DATAIR Document Services Date : November 24, 2003 Re : Annual Prototype Document Sponsor Reporting To maintain our status as a Sponsor of prototype retirement documents, and for plans adopted under DATAIR s name as the Document Sponsor to continue to rely upon Opinion Letters issued on those documents, DATAIR must abide by the annual reporting requirements of IRS Revenue Procedure 2000-20. Among other provisions, 2000-20 requires that the Sponsor of a prototype plan: Maintain, and be prepared to provide to the IRS, a listing of the name, current business address, and Federal Employer Identification Number of each employer that has adopted the Sponsor s plan; and Notify adopting employers of changes to the prototype during the preceding 12 months; of any intent to abandon a prototype document; or of necessary steps that are required to be taken to continue to rely on the prototype opinion letter. All adopters of DATAIR-sponsored Version 1 and Version 2 (pre-gust) prototypes must restate to a GUST-compliant document, such as our Version 3 (GUST) prototypes, by the end of DATAIR s Remedial Amendment Period, which is December 31, 2003. Each pre-gust document you report to us as Active will receive a letter from us indicating this requirement, and advise them to contact you for details. In order for us to complete this process, the DATAIR Document System Version 1.08 includes a Sponsor Reporting utility to gather the necessary information and prepare a diskette to be returned to us. Enclosed you will find a blank diskette, a Waiver Form, instructions for using the utility, and an envelope to return your reporting to us. Any plans adopted under DATAIR s name that you fail to report to us by Friday January 9, 2004 will not be included in our records of active plans for this reporting cycle. This could result in the IRS classifying those plans as Individually Designed, without reliance on the Prototype Opinion Letters issued by the IRS. An annual reporting fee applies to all active prototypes under DATAIR s name, based on the when DATAIR receives your firm s reporting diskette and waiver form as follows Package Received on or before Reporting Fee per Active Plan Friday December 26, 2003 $10 Friday January 2, 2004 $15 Friday January 9, 2004 $20 Obviously, it is to your advantage for us to receive your reply by December 26, 2003. Packages received after January 9, 2004 will not be included in this reporting cycle. There is no fee for inactive, terminated, or draft plans. Nor is there a fee for volume submitter plans and prototype plans adopted under your name as a word-for-word adopter/regional sponsor.

We would like to emphasize that providing current & accurate addresses for adopting employers is absolutely imperative. Due to the excessive number of letters returned as undeliverable due to incorrect address information during previous years, we are imposing a $20 special handling fee per undeliverable letter sent to adopting employers. This is in addition to the standard per-plan fee. There is a $50 per-plan special handling fee for plans reported to us manually rather than on the reporting diskette. This manual processing fee is in addition to the standard per-plan fee. You will receive a faxed or emailed confirmation of the receipt of your Sponsor Reporting package from DATAIR within 3 business days of its receipt. If you do not receive a confirmation within a reasonable time period after it is mailed to us, please contact Suzanne Martineck at DATAIR. All fees associated with sponsor reporting will be included in your January or February 2004 billing statement as a separate line item. Please do not include payment when you return your reporting package to us. If you are a word-for-word adopter/regional sponsor of one or more DATAIR prototypes, please remember that you are responsible for meeting the reporting requirements of Rev. Proc. 2000-20 for plans prepared under your name. Through the Sponsor Reporting Utility, you can generate the necessary lists and letters for plans which you are the Sponsor. Keep in mind that if you only sponsor some of the prototypes, you will still need to report any plans adopted under DATAIR s name to us for reporting. Section I Instructions for those Who Are Not Word for Word Adopters of Prototype Documents 1.1 Introduction Word for word adopter is the new term under Revenue Procedure 2000-20 for what was called a Regional Sponsor under Revenue Procedure 89-13. Revenue Procedure 2000-20, requires DATAIR, as a Prototype Document Sponsor, to maintain a current list of all employers who have adopted and maintain documents sponsored by DATAIR. Additionally, we are required to notify each employer who has adopted a plan of changes made to the prototype document, or of required amendments. The Sponsor reporting process allows DATAIR to comply with the above requirements. 1.2 Who Should Report If you have ANY plans in either the DATAIR Windows Document System, OR the DATAIR DOS Retirement Document System for which DATAIR is the Document Sponsor, then you must report them to DATAIR. Even if you are a Regional Sponsor for some of your documents, any documents not covered by your Word for Word Adopter status must be reported to DATAIR. (Note: If your firm was a regional sponsor of our Pre- GUST Documents, but is NOT a Word for Word Adopter of our GUST documents, you must also follow the instructions in Section II, Instructions for those who are Word for Word Adopters.) 1.3 What Plans are Reported to DATAIR To comply with its reporting requirements under Rev. Proc 2000-20, DATAIR is concerned with documents that meet the following criteria: Documents that show DATAIR as the Document sponsor AND ARE ALSO coded as a Prototype Document AND ARE ALSO coded as Active AND ALSO has an effective date prior to 01/01/2004 DATAIR s reporting requirements do NOT include the following: Documents where the Document Sponsor is other than DATAIR. Documents coded as Proposals or Defaults. Volume Submitter Documents and Individually Designed Documents. 1.4 What You Should Have Received In this package you should have received the following: These Instructions. A CD supplied by DATAIR containing Version 1.08 of the DATAIR Document system, which includes the current Sponsor Reporting Utility, that must be installed. A diskette supplied by DATAIR. This Diskette contains information needed by the Sponsor Reporting Utility and should not be discarded. It must be returned to DATAIR unless you have no plans to report. A waiver form. This waiver form must be completed and returned to DATAIR. A pre-addressed mailer envelope. Use this mailer to return the diskette and waiver form. Page 1

If you did not receive all of the above, please contact DATAIR Customer Support so that we may send replacements. 1.5 Before You Start Make sure that the information in your plan files is up to date. In particular, please make sure the following is correct. Plan type information (Plan Type, Sub Type, Document Type) These selections can be found on the Plan information screen, at the Plan info, and Document info tabs. In RDS, it may be found on the Plan Definition Screen. The Plans current status (Proposal, Active, or Inactive) Documents that are not adopted by the employer at this time should be coded as Proposal in WinDS or D for draft in RDS. Documents coded as Proposal are not subject to Sponsor Reporting. In WinDS, it is found on the Plan info screen on the Plan Info Tab. In RDS, it is found on the Plan Definition Screen. Documents that are currently adopted and in force by the adopting Employer should be coded Active. Documents coded as active, are subject to Sponsor Reporting The Adopting Employer s name and address The name and address information entered here is what is used to mail the notification letters. If the Adopting employer has moved, changed names, etc., this information must be brought up to date in order for the notification letter to reach them. In WinDS, it is found on the Plan info screen on the Sponsor Tab. In RDS, it is found in Screen Group 1, names and addresses. The Tax ID number The IRS requires a Tax ID number. This must be an EIN, not a Social Security number. In WinDS, its found on the Plan Info Screen, Sponsor Tab. In RDS, it is found in Screen Group 1, names and addresses. Document Plan Sponsor The document sponsor must be selected to indicate who is the document sponsor. In Win DS it is found on the Plan Info Screen, Document Info Tab. In RDS, it is found in Screen Group 1, names and addresses. Effective Date The effective date must be filled in. In WinDS it is found in the Plan info screen, Documents tab. In RDS, it is found in Screen Group 1, names and addresses. Effective dates later than 01/01/2004 are excluded from this reporting cycle. Making sure this information is filled out and up to date on all active plans to be reported to DATAIR will ensure that the sponsor reporting process goes smoothly. Page 2

1.6 Installation of the Sponsor Reporting Utility Sponsor Reporting is installed as part of the Installation of the DATAIR Document System V1.08. You must have Win DS 1.08 installed to run the current Sponsor Reporting. Once DS 1.08 is installed, the Sponsor Reporting Utility can be started from the Activities List Bar. 1.7 Starting The Sponsor Reporting Utility You will find the Sponsor Reporting Utility listed in the Document System Activities list bar, similar to that shown below. 1.8 Sponsor Information After starting the Sponsor Reporting Utility, and clicking <Next> to pass the opening screen, the next screen will display your Sponsor Information. Please confirm your company name, address, phone, and contact information. Any fields with missing required information will be highlighted in red. The information on this screen will appear on any notification letters EXACTLY as shown here. In addition, we have provided space for an E-Mail address or FAX number. While not appearing on notification letters, we can use this E-Mail or FAX number to communicate with you regarding Sponsor Reporting. Your E-Mail address will NOT be used or distributed for any other purpose. Click <Next> to continue on to the next section. Page 4

1.9 RDS Location Information The Sponsor Reporting Utility will attempt to find your Retirement Document System (RDS) Plan files. Only if it is not successful will the following screen be displayed. If the Sponsor Reporting Utility is unable to find your RDS plans on its own, you may use the <Browse> button to point to the location of your RD1 files. When completed, click <Next> to continue. If you do not have the DOS RDS system installed, then you may skip the next section. 1.10 Plans Being Reported The data will be gathered from both systems. The Sponsor Reporting utility will then sort the plans to decide which are reportable. The resulting list will be displayed. The sorting criteria is as follows: 1) only active prototype plans are shown. 2) Plans migrated from the RDS system to the Windows Document system will be shown only once. 3) Plans are matched based in EIN Page 5

number and three digit plan number and 4) plans effective prior to 01/01/2004. Plans from the old RDS system that have not been restated for GUST, will have a status of Pre-Gust. Plans from the Windows Document System will have a status of Gust. You may exclude a plan from the list if you believe it does not meet the criteria by removing the check mark in the leftmost column. Missing required data will be highlighted in red. A selection button for Exceptions Report will appear to provide a list of plans requiring corrections. To correct missing data, you may return to the Document System and open the plan in question, then enter the missing data. You may then return to Sponsor Reporting and select the Refresh selection to re-load and re-verify the data. You may work in both the Document system and Sponsor Reporting simultaneously. Once you are satisfied with the list, click <Next> to continue to the last section. Note: If the system has determined you have no reportable plans you have no need to continue the process. You may click <Finish> to exit the program and skip to Step 1.12 How To Complete the Waiver Form. 1.11 Reports You may make a hard copy report of the reportable plans using the Print Summary Report button. Margins are adjustable. A print option is also available to preview the report before printing it. At this time you can complete the Sponsor Reporting process by creating the reporting file. Insert the DATAIR supplied diskette (or a blank, formatted floppy if it s not available), and click Create Reporting File. You will be notified when the system is done writing files to the diskette. If your system does not have a Floppy Disk drive, or you wish to E-Mail the results to us, the output location for the reporting file may be changed in the Advanced Options screen. The file created is called TRANSMIT.TXT. You may now Click <Finish> to exit the Sponsor Reporting Utility. Page 6

1.12 How To Complete The Waiver Form The waiver form is your certification to DATAIR of what you are reporting to us, as well as instructions regarding disposition of any return materials. The options are as follows: 1. We hereby notify DATAIR, via the enclosed diskette, of those Prototype documents which have been prepared and adopted under DATAIR s name and for which DATAIR is responsible under Rev. Proc 2000-20. Your firm has active prototype plans sponsored by DATAIR to report and/or plans discontinued since the last reporting cycle. You are reporting these plans to DATAIR. There are then two sub options to specify how you want the notification letters handled. DATAIR will directly mail all notification letters directly to your firms adopting employers. You will receive courtesy copies of those mailings. 2. We have no Prototype documents prepared under DATAIR s name to report. Either we have no active Prototype plans, or all plans which are currently adopted are under our name as a regional sponsor of the plans, and we are responsible for reporting of those plans under Rev. Proc. 2000-20. Further, we understand any active plans adopted under DATAIR s name not reported to DATAIR may be considered as individually designed plans by the IRS and may not rely upon Prototype Notification or Determination Letters issued by the IRS. Your firm has no prototype plans to report. Applicable if your firm is a regional Sponsor for all plans your firm handles. Once you have completed the waiver form, add your firms name, sign and date the last page. 1.13 What Gets Returned To DATAIR Using the enclosed mailer, the following should be returned to DATAIR: The Reporting Diskette The completed waiver form. 1.14 What Does DATAIR Return To My Firm When our processing of the information you provided us is completed, you will receive the following: Copies of all appropriate adopting employer letters. A summary listing of all plans for which we have information. After our January reporting to the IRS is completed, you will be billed for all active plans reported by your firm. Page 7

Revenue Procedure 2000-20, requires that Word for Word Adopters maintain a current list of all employers who have adopted and maintain plans they sponsor and be able to produce it upon demand by the IRS. Additionally, they are required to notify each employer who has adopted a plan of changes made to the prototype document, or of amendments required. The Sponsor reporting process allows you, as a Word for Word Adopter, to comply with the above requirements. 2.2 Reporting To DATAIR If you have ANY plans in your system for which DATAIR is the Document Sponsor, then you must report those to DATAIR following the instructions in Section I (Instructions for those who are not Word for Word Adopters). If you are a Word for Word Adopter for all document types your firm deals with, then you need only return the completed waiver form. See section 2.11 Completing The Waiver Form. 2.3 What You Should Have Received In this package you should have received the following: These Instructions. First Select the Document Sponsor you are reporting for. Then confirm your company name, address, phone, and contact information. While not appearing on notification letters, we can use this E-Mail or FAX number to communicate with you regarding Sponsor Reporting. Click <Next> to continue on to the next section. 2.8 RDS Location Information The Sponsor Reporting Utility will attempt to find your Retirement Document System (RDS) Plan files. Only if it is not successful will the following screen be displayed. Page 10

If the Sponsor Reporting Utility is unable to find your RDS plans on its own, you may use the <Browse> button to point to the location of your RD1 files. When completed, click <Next> to continue. If you do not have the DOS RDS system installed, then you may skip the next section. 2.9 Plans Being Reported The data will be gathered from both systems. The Sponsor Reporting utility will then sort the plans to decide which are reportable. The resulting list will be displayed. The sorting criteria is as follows: 1) only active prototype plans are shown. 2) Plans migrated from the RDS system to the Windows Document system will be shown only once. And 3) Plans are matched based in EIN number and three digit plan number. Plans from the old RDS system that have not been restated for GUST, will have a status of Pre-Gust. Plans from the Windows Document System will have a status of Gust. You may exclude a plan from the list if you believe it does not meet the criteria by removing the check mark in the leftmost column. Missing required data will be highlighted in red. A selection button for Exceptions Report will appear to provide a list of plans requiring corrections. To correct missing data, you may return to the Document System and open the plan in question, then enter the missing data. You may then return to Sponsor Reporting and select the Refresh selection to re-load and re-verify the data. You may work in both the Document system and Sponsor Reporting simultaneously. Once you are satisfied with the list, click <Next> to continue to the last section. Note: If the system has determined you have no reportable plans you have no need to continue the process. You may click <Finish> to exit the program and skip to Step 2.11 How To Complete the Waiver Form. 2.10 Reports/Letters You have several reports available to you. You may: 1) Make a hard copy report of the reportable plans using the Print Summary Report button. 2) Create a hard copy list suitable for the IRS of active plans sorted by plan type. 3) Generate required notification letters. Note: At this time, only Pre-GUST plans prototypes are required to receive notification letters. Employers who have adopted GUST documents are not required to receive notification letters during this reporting cycle. Margins are adjustable. A print option is also available to preview the report before printing it. When you are finished with reports, select finished to Quit Sponsor Reporting. 2.11 How To Complete The Waiver Form The waiver form is your certification to DATAIR of what you are reporting to us as well as instructions regarding disposition of any return materials. The options are as follows: Page 12

1. We hereby notify DATAIR, via the enclosed diskette, of those Prototype documents which have been prepared and adopted under DATAIR s name and for which DATAIR is responsible under Rev. Proc. 2000-20. Your firm has active prototype plans sponsored by DATAIR to report and/or plans discontinued since the last reporting cycle. You are reporting these plans to DATAIR. There are then two sub options to specify how you want the notification letters handled. DATAIR will directly mail all notification letters directly to your firms adopting employers. You will receive courtesy copies of those mailings. 2. We have no Prototype documents prepared under DATAIR s name to report. Either we have no active Prototype plans, or all plans which are currently adopted are under our name as a word-for-word adopter of the plans, and we are responsible for reporting of those plans under Rev. Proc. 2000-20. Further, we understand any active plans adopted under DATAIR s name not reported to DATAIR may be considered as individually designed plans by the IRS and may not rely upon Prototype Notification or Determination Letters issued by the IRS. Your firm has no prototype plans to report. Applicable if your firm is a word-for-word adopter for all plans you prepare. Once you have completed the waiver form, add your firms name, sign and date the last page. 2.12 What Gets Returned To DATAIR Using the enclosed mailer, the following should be returned to DATAIR: The Reporting Diskette (only if you have plans to report to DATAIR) The completed waiver form. 2.13 What Does DATAIR Return To My Firm If you have plans to report to DATAIR, when our processing of your received information is completed, you will receive the following: Copies of all appropriate adopting employer letters. A summary listing of all plans we have information for, and their status. After our January reporting to the IRS is completed, you will be billed for all active plans reported for your firm. If you do not have plans to report to DATAIR, then we will acknowledge the receipt of your waiver form. Page 13

Appendix A Frequently Asked Questions About Sponsor Reporting 1) I have plans on multiple computers. How does the Sponsor Reporting Utility handle this? The Sponsor Reporting Utility can handle multiple sets of plan files. The procedure is as follows: 1) Run the Sponsor Reporting Utility on the first machine with plans. Complete the reporting file. 2) Go to the next machine with plans. Run the Sponsor Reporting Utility on that machine. Use the same diskette for the reporting file. When making the report on the second machine, you will see the message Data on drive A:\ already exists. Do you wish to Append?. Select Yes. This will add the data to the previous data. 3) Continue as in step 2 for however many machines have plan files. 2) Can I send my information in via the internet? Yes. Create the reporting file on diskette as per the sponsor reporting instructions, or send the reporting file to an alternate location defined in Advanced Options. The file name created is TRANSMIT.TXT. E- mail that file as an attachment to RD.Support@datair.com. Fax the waiver form to us at (630) 325-2660. 3) I ve lost the diskette that came with the Sponsor Reporting Package. Do I need a new one from DATAIR? No. Any blank formatted floppy disk will do. 4) I have received my information back from DATAIR. On several of the plans the mailing address on the adopting employers letters is wrong. What do I do? The address on the letter is based on the information contained in the plan file. If the client has moved, then it is up to you to make sure the information remains current in the plan file. If the address is wrong, please correct it in your plan file for next year, and report it to us. We will issue a corrected letter. Be advised a manual handling fee may apply in cases like this. 5) To make corrections, do I have to leave sponsor reporting? No. You can have the Windows Document System, RDS DOS, and Sponsor Reporting running all at the same time. You can switch between them to make corrections, and use the refresh selection in sponsor reporting to re-load the corrected data. Page 14
