EY s 8 th Global Mobility Breakfast Food for thought EY is delighted to invite you to its 8 th Global Mobility Breakfast event to be held at Hotel Royal in Geneva on 6 October 2015. Expatriate tax concessions under threat! On 9 January 2015, the Swiss Federal authorities published a revised version of the Federal Ordinance on expatriate deductions. The revised Ordinance considerably reduces both the number of employees who can receive these deductions and the benefits that are deductible. According to our benchmark with international companies operating in Romandie, the new Ordinance is likely to increase the Swiss tax charge for many employees as well as the costs for employers. It confirms the more restrictive practice already followed by the German speaking cantons of Switzerland. As the new rules will apply as of January 2016, companies will need to determine before the end of this year whether expatriate status and deductions can still apply for incoming expatriates under prevailing contractual arrangements and implement any changes where necessary to continue benefiting from the deductions. Meanwhile, some cantonal authorities such as Geneva have started to communicate on the position they are likely to adopt and the transitional rules they intend to put in place. During today s breakfast our specialists will summarize the latest developments in this sensitive area and suggest next steps for Swiss-based employers with an international workforce. In particular, we will look at the following topics more closely: What are the current deductions expatriates in Switzerland can benefit from? What types of deductions are reduced or will no longer exist under the revised rules? Where is room for planning? How will existing employment contracts, assignment letters and global mobility policies need to be revised? How will the new rules affect cooperate agreements with international schools? Can existing rulings still apply and what are the transition rules for the new regulations? What are the topics subject to further discussion with the tax administration? How will the new rules impact the application for expatriate concessions, e.g. with respect to GEM (rulings) and administrative set up and reporting (payroll)?
The purpose of this session is to update you on the latest developments to allow you to proactively plan, manage costs and evaluate risks and opportunities once the new legislation comes into force. Restrictions on the private use of company cars: Latest update and first experiences! Another change with serious consequences for many Swiss companies and their employees relates to company cars offered to employees domiciled in the EU such as frontaliers working in Switzerland and living in neighboring EU countries (e.g. France). In fact, the more restrictive EU regulations entered into force as of 1 May this year, allowing the private use of the vehicle only for travel between the place of work and the place of residence of the employee. Customs duties, penalties and the confiscation of the car may apply in the EU in case of non-compliance with the new rules. When considering solutions for EU domiciled employees, Swiss employers will need to take into account the more stringent rules that apply in Switzerland.
