Andhra Pradesh Industrial Infrastructure Corporation Ltd, a Government of Andhra Pradesh Undertaking, invites tenders from reputed licensed contractor/manpower supply Consultancies/Agencies, under the provisions of Contract Labour (Regulation & Abolition) Act, 1970 for carrying out its civil/electrical/environment works through PROJECT ENGINEERS (CIVIL), PROJECT ENGINEERS (ELECTRICAL) AND ENVIRONMENT ENGINEERS on outsourcing basis, for its ongoing works all over the state of Andhra Pradesh 2. Tender document is to be submitted in two parts comprising Cover-I: Technical Bid & Conver-II: Price Bid. The Cover-I (Technical Bid) should contain the EMD and statement showing compliance with the criteria /. The Cover-II (Price Bid) should contain the price offered. Both the covers should be properly marked and enclosed in separate sealed envelopes for their proper identification. Contractor may submit their tender in sealed cover superscribed with Tender for outsourcing of Manpower addressed to the Executive Director-S, APIIC Ltd., 5 th floor, Parisramabhavanam, Basheerbagh, Hyderabad 500004, along with EMD of Rs. 40,000/- (Rs. Forty Thousand Only) in the form of Demand Draft drawn in favour of APIIC Ltd., payable at Hyderabad, on or before 2.30 PM on 31.5.2013, which will be opened on the same day at 1500 hrs. in the presence of the contractor or their authorized representative, if any. 6. Tenders received after due date/time and without EMD shall be rejected. 7. APIIC Ltd reserves the right to accept or reject any or all the offers without assigning any reason. 8. Canvassing in any form is prohibited and the tenders submitted by the contractor who resort to canvassing is liable for rejection. 9. The tenderer shall not be permitted to tender for works in APIIC, if his relatives are working in APIIC Ltd.. On checking if there are difference between the rates quoted by the tenderer in words and in figures or in the amount worked out by him, the following procedure shall be followed : 11. i) When there is difference between the rates in figures and in words, the rates, which correspond to the amount worked out by the tenderer, shall be taken as correct. ii) When the amount of an item is not worked out by the tenderer or it does not correspond with the rate written either in figure or in words the rate quoted by the tenderer in words shall be taken as correct. iii) When the rate quoted by the tenderer in figures and in words tallies but the amount is not worked out correctly the rate quoted by the tenderer shall be taken as correct and not the amount. 12. The tenderer should quote the rates after assessing the work requirement. 13. Earnest Money will be forfeited if the contractor fails to commence the work as per the award letter for the work. 14. Except writing rates and amount, the tenderer should not write any conditions or make any changes, additions, alterations and modifications in the printed form of tenders. Tenderers who are desirous to offer rebate, should mention it separately in the covering letter submitted along with the tender.

DUTIES OF PROJECT ENGINEER (ELECTRICAL): The Project Engineers shall assistant the Managers (Electrical) f of APIIC in discharging the following duties: 1. Preparation of estimates 2. Supervision of all electrical works assigned to him 3. Recording of measurements of all electrical works assigned to him 4. Bill preparation 5. Liaison with the APTRANSCO/Power Distribution Corporation concerned with regard to execution of work 6. Any other work assigned by the Competent Authority DUTIES OF ENVIRONMENTAL ENGINEER: To undertake environmental activities as assigned in the Zonal Offices, under the guidance of the Zonal Manager of APIIC, including coordination of activities with IALAs and industries. Identify environmental problems, issues, improvement needs, infrastructure needs etc. In IPs/SEZs/IALAs and report to DGM/GM (EMP) through ZM. Take all necessary actions, under the guidance of the ZM, for achieving the milestones/targets/ results. Develop environmental database for all the industrial parks of the assigned APIIC Zone. Assist in periodic review of the progress of activities and achievement of milestones/targets/ results in various IPs. Regularly communicate with the Managers (EMP) at APIIC HQs, for achieving the set milestones/targets/results. Undertake documentation work, including preparing progress reports, providing inputs for publications and information brochures. Coordination and follow-ups with the assigned consultants for EIA activities for new industrial parks. Assist in identification of requirements for the development of environmental infrastructure and taking necessary action for their planning and development, including appointment of consultants etc.
Coordination of activities with IALAs, under the guidance of ZM of the assigned for developing GIS based database for all the industrial estates in the respective APIIC zone. Proper upkeep of environment in the Industrial Parks, including control of illegal discharges of wastes, waste waters etc. Strengthening of environmental infrastructure in the industrial estates. Reporting of illegal discharges of waste waters, wastes and emissions. Spreading environmental awareness among IALAs and industries. Taking any other relevant action as may be necessary. Regular site visits. CONTRACTOR S OBLIGATIONS: 1. The contractor/manpower Supplying Consultancy/agency, shall provide the required number of Project Engineers (Civil), Project Engineers (Electrical) and Environment Engineers, as indicated by the APIIC Ltd., from time to time. 2. The Project Engineers (Civil), Project Engineers (Electrical) and Environment Engineers, engaged by the Consultancy/Agency/Contractor are responsible for carrying out the work in accordance with the specifications prescribed in the approved Estimates/Agreements/Drawings.. They should assist the APIIC Officers in recording the measurements as per procedures stipulated. Wherever they sign, they should affix the stamp of the Supervising Agency. 3. The Manpower Supplying Consultancy/Agency/Contractor is responsible for the work done by the Project Engineers engaged by it, including quality of work and measurements. 4. The contractor/manpower Supplying Consultancy/Agency shall submit details of the names, parentage, residential address, age, etc. of the persons deployed by him in the premises of the APIIC Ltd for the purpose of proper identification of the employees of contractor deployed at various points/sections/divisions. He shall issue identity cards bearing their photographs/ identification, etc. and such employees shall display their identity cards at the time of duty. 5. That the performing the assigned work, the contractor/manpower Supplying Consultancy/Agency, shall deploy medically and physically fit persons. The contractor shall ensure that the persons are punctual and disciplined and remain vigilant in performance of their duty. 6. That the persons so deployed shall be exclusively for duties in APIIC Ltd.
7. That the contractor/manpower Supplying Consultancy/Agency shall comply with the statutory provisions of Contract Labour (Regulation & Abolition) Act, Payment of Wages Act, 1936. The Employees Provident Fund (and miscellaneous Provisions) Act, 1952, Payment of Bonus Act, 1965, the Minimum Wages Act, 1948, Employer Liability Act, 1923, Employment of Children Act, 1938 and/ or any other Rules/Regulations and/or statues that may be applicable to them and shall further keep the APIIC Ltd indemnified from all acts of omission, fault breaches and /or any claim, demand; loss; injury and expense arising out from the non-compliance of the aforesaid statutory provision. Contractor s failure to fulfill any of the obligations hereunder and/or under the said Act s rules/regulations and/or any bye-laws or rules framed under or any of these the APIIC Ltd shall be entitled to recover any of the such losses of expenses which it may have to suffer or incur on account of such claims, demands, loss or injury from the contractor s monthly payments. 8. That the contractor/manpower Supplying Consultancy/Agency, shall submit every month the proof of having deposited the amount of contribution claimed by him on account of ESI & EPF towards the persons deployed in APIIC Ltd in their respective names before submitting the bill for the subsequent month. In case the contractor fails to do so, the amount claimed towards ESI & EPF contribution shall be withheld till submission of required documents. 9. That the contractor/manpower Supplying Consultancy/Agency shall be required to maintain permanent attendance register and muster roll at the APIIC Ltd premises which shall be open for inspection and checking by the authorized officers of APIIC Ltd. 10. That the contractor/manpower Supplying Consultancy/Agency shall make the payment of wages, etc. to persons so deployed and shall on demand furnish copies of wage register/muster roll, etc. to APIIC or persons/agencies authorized by it and/or any other Statutory Authority. 11. The contractor/manpower Supplying Consultancy/Agency shall take all reasonable precautions to prevent any unlawful, riotous or disorderly conduct or acts of his employees so deployed. 12. The contractor/manpower Supplying Consultancy / Agency, shall in all dealings with the persons in his employment have due regard to all recognized festivals, days of rest and religious or other customs. In the event of the contractor committing a default or beach of any of provisions of the Labour Laws including the provisions of Contractor Labour (Regulation Abolition) Act, 1970 as amended from time to time or furnishing any information, or submitting or filing any statement under the provisions of the said regulations and rules which is materially incorrect, he shall without prejudice to any other liability pay to the Vice Chairman & Managing Director, APIIC Ltd a sum as may be claimed by APIIC Ltd.
13. The contractor/manpower Supplying Consultancy/Agency, shall deploy his persons in such a way that they get weekly rest. The working hours/leave for which the work is taken from them, do not violate relevant provisions of shops and Establishment Act. The contractor shall in all dealings with the persons in his employment have due regard to all recognized festivals, days of rest and religious or other customs. In the event of the contractor committing a default or breach of any of the provisions of the Labour Laws including the provisions of Contract Labour 14. In case of any deficiency in quality of the work either during execution or subsequently, the contractor/manpower supplying Consultancy/Agency, shall be responsible. C. APIIC Ltd OBLIGATIONS: 1. In consideration of the service rendered by the contractor, he shall be paid wages as prescribed by APIIC Ltd, EPF, ESI, Service charges and Service Tax each month. Payment shall be made by the 7 th day of the month on the basis of the bills raised by the contractor and duly certified by the officer designated by Vice Chairman & Managing Director, APIIC Ltd in this regard. 2. That payment of account of enhancement/escalation charges on account of revision in wages or statutory payments by the appropriate Authority from time to time shall be payable by the APIIC Ltd to the contractor. 3. That the Vice Chairman & Managing Director, APIIC Ltd shall reimburse the amount of service tax, if any, paid by the contractor to the authorities on account of the service rendered by him. This reimbursement shall be admissible on production of proof of deposit of the same by contractor. 4. The security deposit will be refunded, to the Contractor within one month of the expiry of the contract only on the satisfactory performance of the contract. SCOPE OF WORK: Tender for Project Engineers (Civil), Project Engineers (Electrical) and Environment Engineers is invited from contractors holding valid license under Contract Labour (Regulation & Abolition) Act, 1970, registered with EPF, ESIC authorities, having Service Tax registration and successfully carried out at least three similar works for supply of manpower of 50 or more persons under a single contract during the last 5 years in Govt./Semi-Govt./Central/State Autonomous bodies/institutes, on contract basis.
TERMS AND CONDITIONS: 1) Period of Contract: The contract will be initially for a period of two years which may be extended further with mutual consent. 2) Selection of candidates: Selection of the candidates from out of the individuals proposed by the Contracting Agency shall rest with APIIC and shall be through a screening procedure so as to enable APIIC to engage candidates with desired caliber. 3) The total required number indicated is not static throughout the contract period. They will be engaged based on the volume of works being executed by APIIC. The number of required candidates from time to time will be indicated 3 months in advance. Similarly, reduction in number of candidates already engaged under this contract will also be indicated 3 months in advance. 4) Notwithstanding the above, engagement of services of any individual found to attract clause (4) of general conditions shall be withdrawn immediately. 5) Earnest Money Deposit (EMD) : The EMD of Rs. 40,000/- in the form of Demand Draft from any scheduled bank drawn in favour of APIIC Ltd., payable at Hyderabad. The EMD shall be refunded to unsuccessful tenderer, after finalization of the tender. The EMD shall be forfeited if any tenderer withdraws his offer before finalization of the tender or fails to submit the acceptance within 15 days from the date of award of contract. 6) Bank Guarantee: A bank guarantee of 10% of the total order value should be furnished by the successful bidder from any scheduled bank. The bank Guarantee shall be kept with APIIC Ltd., Hyderabad, for a period of two years and shall be released after the successful completion of the contract. 7) The number of Project Engineers (Civil), Project Engineers (Electrical) and Environment Engineers is purely need based. Therefore, the number of Contractor s workers may increase or decrease as per requirement. The APIIC Ltd. will be under no obligation to engage any specific number of contractor s worker during the period of contract. 8) The APIIC Ltd. reserves the right to cancel the tender without assigning any reason at any stage of the tender process. 9) The APIIC Ltd. reserves the right to alter/ modify any or all conditions of this tender notice.

GENERAL CONDITIONS: 1. The persons deployed by the contractor/manpower Supplying Consultancy/Agency, for the services mentioned above shall be the employees of the contractor for all intents and purposes and that the persons so deployed shall remain under the control and supervision of the contractor and in no case, shall a relationship of employer and employee between the said persons and the APIIC Ltd shall accrue/arise implicitly or explicitly. 2. That on taking over the responsibility of providing Project Engineers, the contractor/manpower Supplying Consultancy/Agency, shall formulate the mechanism and duty assignment in consultation with Vice Chairman & Managing Director, APIIC Ltd or his nominee. Subsequently, the contractor/manpower Supplying Consultancy/Agency, shall review work arrangement from time to time and advise the Vice Chairman & Managing Director, APIIC Ltd for further streamlining the system. The contractor/manpower Supplying Consultancy/Agency, shall further be bound by and carry out the directions/instructions given to him by the Vice Chairman & Managing Director, APIIC Ltd or the officer designated by the Vice Chairman & Managing Director, APIIC Ltd in this respect from time to time. 3. That the Vice Chairman & Managing Director, APIIC Ltd or any other person authorized by him shall be at liberty to carry out surprise check on the persons so deployed by the contractor/manpower Supplying Consultancy/Agency, in order to ensure that persons deployed by him are doing their duties. 4. That in case of the persons so deployed by the contractor/manpower Supplying Consultancy/Agency, does not come up to the mark or does not perform his/her duties properly or indulges in any unlawful activities or riots or disorderly conduct, the contractor shall immediately withdraw and take suitable action against such persons on the report of the Vice Chairman & Managing Director, APIIC Ltd. or Officer authorized by him. Further, the contractor shall immediately replace the particular person so deployed on the demand of the Vice Chairman & Managing Director, APIIC Ltd, or his authorized Officer, in case of any of the aforesaid acts on the part of the said person. 5. The number of Project Engineers (Civil), Project Engineers (Electrical) and Environment Engineers will be purely need based. Therefore, the Number of Contractor s worker may increase or decrease as per requirement. Vice Chairman & Managing Director, APIIC Ltd will be under no obligation to engage any specific number of contractor s worker during the period of contract.
INDEMNIFICATION 1. The contractor/manpower Supplying Consultancy/Agency, shall keep the APIIC Ltd indemnified against all claims whatsoever in respect of the employees deployed by him/it. In case any employee of the contractor/manpower Supplying Consultancy/Agency, so deployed enters in dispute of any nature whatsoever, it will be the primary responsibility of the contractor to contest the same. In case APIIC Ltd is made party and is supposed to contest the case, APIIC Ltd will be reimbursed for the actual expenses incurred towards Counsel Fee and other expenses which shall be paid in advance by the contractor to APIIC Ltd on demand. Further, the contractor shall ensure that no financial or any other liability comes on APIIC Ltd in this respect of any nature whatsoever and shall keep APIIC Ltd indemnified in this respect. 2. The contractor/manpower Supplying Consultancy/Agency shall further keep the APIIC Ltd indemnified against any loss to the APIIC Ltd property and assets. The APIIC Ltd shall have further right to adjust and/or deduct any of the amounts as aforesaid from the payments due to the contractor under this contract. PENALTIES / LIABILITIES 1. The contractor/manpower Supplying Consultancy/Agency, shall be responsible for faithful compliance of the terms and conditions of agreement that has to be entered upon on finalization of contract. In the event of any breach of the agreement, the same may be terminated and the security deposit will be forfeited and further work may be got done from another Supervising Agency at the risk and cost of the Contractor. 2. If the contractor/manpower Supplying Consultancy/Agency violates any of the terms and conditions of the agreement or commits any fault or the service is not to the entire satisfaction of officer authorized by the Vice Chairman & Managing Director, APIIC Ltd, a penalty leading to a deduction up to a maximum of 10% of the total amount of bill for a particular month will be imposed. 3. The security money shall be liable to be forfeited or appropriated in the event of unsatisfactory performance of the contractor/manpower Supplying Consultancy/Agency, and/or loss/damage, if any, sustained by the APIIC Ltd on account of failure or negligence of the workers deployed by him or in the event of breach of the agreement by the contractor/manpower Supplying Consultancy/Agency.
