Kongsi Kemeriahan Raya: Groceries & Dining Cash Back Programme Terms and Conditions The terms and conditions herein ( Terms and Conditions ) are in addition to and are to be read together with the AmBank (M) Berhad ( AmBank ) / AmBank Islamic Berhad ( AmBank Islamic ) / MBF Cards (M sia) Sdn Bhd ( MBF Cards ) (collectively referred to as The Bank ) relevant credit card agreement(s) ( Cardmember Agreement ) which govern the use of the credit card issued by AmBank / AmBank Islamic/ MBF Cards ( Card ). In the event of any discrepancy or inconsistency between these Terms and Conditions and the Cardmember Agreement, the Terms and Conditions shall prevail in so far as it relates to the Programme Definition Except where the context otherwise requires, or unless these Terms and Conditions otherwise provide, all words, names and expressions defined in the Cardmember Agreement when used or referred to in these Terms and Conditions shall have the same meaning as that provided in the Cardmember Agreement. Eligible Cardmembers means the Customers of The Bank who has applied and has been issued a Principal Card and/or Supplementary Card during the Programme Period as herein described. The Programme means Kongsi Kemeriahan Raya: Groceries & Dining Cash Back programme organized by The Bank in accordance with the Terms and Conditions as herein stipulated. Words denoting person shall include living persons and, if and where applicable, body or persons incorporated or unincorporated. Words importing the singular shall also include the plural and vice-versa. Words importing the masculine gender shall include the feminine and neuter gender. The Programme 1. The Kongsi Kemeriahan Raya: Groceries & Dining Cash Back programme ( Programme ) commences on 15 June 2015 and ends on 14 September 2015 ( Programme Period ), both dates inclusive or such other period(s) as may be determined at the sole and absolute discretion of the Bank with at least 21 days prior notice. 2. Both Principal and Supplementary Cardmembers are entitled to participate on an independent basis with the exception of: a. Cardmembers of Debit Card(s), PrePaid Card(s), Corporate Card(s), Commercial Card(s), and Insurance Card(s) issued by The Bank; b. Cardmembers whose Card accounts have been suspended, cancelled or terminated for whatsoever reasons during the Programme Period or during the fulfilment of Cash Back. Registration Criteria 3. To participate in this Programme, Eligible Cardmember must register via a one-time SMS during the Programme Period as follows: CASH<space>New 12-digit IC Number to 66399. Example: CASH 771129105033 (SMS submission is not upper or lower case sensitive) Page 1 of 5

4. Eligible telcos for SMS registration: Maxis, Celcom, DiGi, and UMobile only. Standard telco charges will apply for each registration SMS sent. Registration in any other format will be automatically disqualified. 5. Upon registration, there will be an acknowledgement SMS sent from the Bank to the Eligible Cardmember to the mobile number used for the registration. Proof of SMS sent by a Cardmember does not denote proof that the SMS is received by the Bank. Eligible Cardmembers are responsible to ensure that the details of their registration are complete and accurate. 6. To the extent permitted by law and the Bank not being in breach of this Programme or is negligent, the Bank will not be held responsible and reserves the absolute discretion to disqualify any registration where the SMS is incomplete/ inaccurate, late entries, error message, unsuccessful registration due to network failure and/or interruption experienced by Telco Operators or for any reason whatsoever as the Bank may in its absolute discretion deemed fit. 7. In the event the Cardmember does not receive the SMS confirmation due to the invalidity, inaccessibility or system failure of the registered mobile phone (including but not limited to the Bank s or third party system, any electronic, mechanical, system failure or corruption, computer viruses, bugs or related problems, operating system malfunction, telecommunication network or internet failure, power breakdown or other delivery breakdown, the Cardmember should call the Customer Service number set out in Clause 29 for assistance. 8. To the extent permitted by law and the Bank not being in breach of this Programme or is negligent, the Bank will not be liable to the Cardmember if the Cardmember is unable to participate in this Programme caused by the unforeseeable and unavoidable circumstances herein mentioned. Selection and Spending Criteria 9. Cardmembers must use their Card to perform a cumulative monthly retail transaction of RM500 within the prescribed Merchant Category Code (MCC) as per clause 12 below ( Eligible Transaction ). Retail transaction shall mean purchase transactions for goods and services incurred for personal consumption and not for business purposes and shall not include betting or gaming transactions. 10. Once the Eligible Cardmember meets the participation criteria above in any Programme Month as per clause 17 below, the Eligible Cardmember stands a chance to receive the RM150 Cash Back subject to availability of the monthly cash pool for that Programme Month as outlined in clause 17 on a first-come, first-served basis. 11. The tracking of Cash Back by the Eligible Cardmember shall commence from the month the SMS registration is acknowledged by the Bank until the end of the Programme Period. Eligible Transactions include all local and overseas retail transactions based on the following Merchant Category Code (MCC) as recorded in the Bank s system: Retail Transaction Categories Examples of Merchants MCC Codes (*not applicable to AmBank Islamic Cardmembers) Dining Eating places/ restaurants/ fast food 5811, 5812, 5814 Groceries restaurants Includes hypermarkets e.g. Tesco, Giant, Cold Storage, AEON, Mydin, 99 Speedmart 5813* 5411, 5422, 5441, 5451, 5462, 5499, 9751, 9752 5921* 13. The assignment of MCC for each merchant is subject to classification by the respective merchants acquiring banks ( Merchant Acquiring Bank ) and it is the responsibility of the relevant Merchant Acquiring Bank to assign the correct MCC. The Bank is not responsible for nor does the Bank have any control whatsoever on any incorrect and/ or inconsistent assignment of MCC by the relevant Merchant Acquiring Bank that may result in the Eligible Cardmember being omitted from the Cash Back entitlement. 14. Transactions excluded are all online transactions, all Mail Order, Telephone Order, AmFlexi- Pay, standing instructions, trade financing transactions, qualifying retail transactions which are subsequently cancelled or refunded, disputed, unauthorised or fraudulent transactions, transactions which are under special corporate arrangement where rebate is applicable and on-going instalment payments. 15. Transactions made at a merchant that is not processed under the prescribed MCC codes in clause 12 will not qualify as Eligible Transactions. 16. All qualifying transactions must be posted to the Eligible Cardmember s Card account to be eligible for the Cash Back. The Bank will allow five (5) calendar days for the qualifying transactions made to be posted into the Eligible Cardmember s Card account. The Bank is not responsible in any manner whatsoever for any late posting to Eligible Cardmember s account by merchants and/or third party. Page 3 of 5

Cash Back Pool 17. The Programme Cash Back winner selection is by the Bank s system and shall be awarded based on a first-come-first-served basis from a pool of RM240,000 per month ( Monthly Cash Pool ) throughout the Programme Period. The allocation of the Monthly Cash Pool is based on the table below: Programme Month Programme Period Monthly Cash Pool 1 15 June to 14 July 2015 RM240,000 2 15 July to 14 August 2015 RM240,000 3 15 August to 14 September 2015 RM240,000 Total Cash Pool RM720,000 18. The balance from the Cash Pool allocated in the respective month that is not utilized (if any) will be brought forward to the next month. Cash Back Entitlement 19. Eligible Cardmember is only entitled to a maximum pay-out of RM150 per Programme Month as outlined in clause 10 above. Cash Back Winner Notification 20. The Bank will notify all Cash Back winners via SMS of their winning transactions for which the contact number shall be the number used by the Eligible Cardmember for registration. Notwithstanding the aforegoing, the Bank reserves the right to use any other method or medium the Bank deems fit at its sole and absolute discretion for the purpose of announcing the Cash Back winners. The Cash Back will be credited to the Eligible Cardmember s Card account and will be reflected in the following month s Card statement. Disqualification 21. The Bank reserves the absolute right to disqualify any of the Eligible Transactions for the purpose of this Programme without having to notify or alert the Cardmember based on the following:- a) All entries received before and after the stipulated Programme Period. b) Inaccurate or incomplete registration details. c) The Eligible Cardmember s Card account shall not be in default of facilities granted at any time during the Programme Period, subject to the Bank s discretion; and/or holder(s) of the Bank s credit card(s) whose accounts have been closed before the notification of the winnings. 22. By participating in the Programme and only for the purpose of this Programme, Cardmembers consent for the Bank to disclose their particulars only to the extent necessary to the Bank s service providers for purposes of running this Programme. Liability 23. To the extent permitted by law and the Bank not being in breach of this Programme or is negligent, the selection of all Cash Back winners by the Bank is final and no correspondence disputing the Bank s decision shall be entertained. 24. To the extent permitted by law and the Bank not being in breach of this Programme or is negligent, the Cardmember will indemnify the Bank for any loss or damage, costs and expenses, fees and charges which the Bank may incur due to breach by the Cardmember of any terms and conditions of this Programme (including out of the enforcement of such terms and conditions against the Cardmember) Language 25. In the event of any discrepancy or conflict in the interpretation of these Terms and Conditions, the English and Bahasa Malaysia versions of each of these Terms and Conditions shall be construed as equivalent and each of the Terms and Conditions stipulated shall carry the same meaning. Adherence to the Programme Terms & Conditions 26. All Cardmembers shall be required to adhere to the Programme Terms and Conditions. The Bank reserves the right to forfeit the Cash Back in the event any of the Terms and Conditions are not adhered to. 27. All Terms and Conditions stipulated herein are governed by and construed in accordance to the laws of Malaysia and any legal disputes shall be commenced and heard in courts in Kuala Lumpur. 28. The Cardmember has read and understood all the Terms and Conditions specified herein and the Bank may change, amend and/or modify any of Terms and Conditions stipulated herein from time to time and any changes will be announced with at least 21 calendar days on the Bank s website at www.ambank.com.my 29.
