COPY REGULATION OF THE MINISTER OF FINANCE THE REPUBLIC OF INDONESIA NUMBER 12 / PMK.010 / 2015 ON THE IMPOSITION OF SAFEGUARD ON IMPORTED PRODUCTS I AND H SECTION OF OTHER ALLOY STEEL BY THE GRACE OF GOD ALMIGHTY THE MINISTER OF FINANCE, Considering : a. that under the provisions of Article 70 of Government Regulation No. 34 Year 2011 on Antidumping Measures, Compensation Measures and Trade Security Measures on imported goods, in addition to the import duty, it may be imposed on Protection Measures including the imposition of Safeguard; b. that based on the final results of investigation of the Indonesian Trade Security Committee, serious losses suffered by domestic industry is caused by the surge in the number of imported products I and H section of other alloy steel; c. that corresponding to the results of investigation in question, Indonesian Trade Security Committee has submitted recommendations to the Minister of Trade on the imposition of Trade Security Measures, namely the imposition of Safeguard on imported products I and H section of other alloy steel; d. that in order to follow up the results of investigation on letter c, by letter No. 1091 / M-DAG / SD / 4/2014 dated October 17, 2014 and No. 1151 / M-DAG / SD / 11/2014 dated 17 November 2014 the Minister of Trade submit the proposed imposition of Safeguard on imported of products I and H section of other alloy steel with Harmonized System (HS) No.7228.70.10.00 and 7228.70.90.00; e. that based on the considerations set forth in letter a, b, c, and d, as well as in implementing the provisions of Article 23D paragraph (2) of - 1 -
Law No. 10 of 1995 on Customs, as amended by Law No. 17 of 2006, it is necessary to stipulate the Minister of Finance Regulation on the Imposition of Safeguard on Imported Products I and H Section Of Other Alloy Steel; that based on the considerations set forth in letter a, b, c, and d, as well as in implementing the provisions of Article 23D paragraph (2) of Law No. 10 of 1995 on Customs, as amended by Law No. 17 of 2006, it is necessary to stipulate the Minister of Finance Regulation on the Imposition of Safeguard on Imported Products I and H Section Of Other Alloy Steel; Given : 1. Law No. 10 of 1995 on Customs (State Gazette of the Republic of Indonesia Year 1995 Number 75, Supplement to State Gazette of the Republic of Indonesia Number 3612) as amended by Law No. 17 of 2006 (State Gazette of the Republic of Indonesia Year 2006 Number 93, Gazette of the Republic of Indonesia Number 4661); 3. 2014 on Decision Over Final Results of Investigation on Trade Security Measures Against Products "I and H Section Of Other Alloy Steel" with the HS No. 7228.70.90.00 and 7228.70.10.00; 3. Final Disclosure of Investigation Results of Indonesian Trade Security Committee on Importation I and H Section of Other Iron or Steel Alloy with HS No. 7228.70.90.00 and 7228.70.10.00; HAS DECIDED: Stipulate : THE MINISTER OF FINANCE REGULATION ON THE IMPOSITION OF SAFEGUARD ON IMPORTED PRODUCTS I AND H SECTION OF OTHER ALLOY STEEL. Article 1 (1) It is imposed the Safeguard on imported products I and H sections of other alloy steel. (2) The imported products in the form of I and H section of other alloy steel as referred to in paragraph (1) are; a. I Section with height or width of 100 mm up to 600 mm, and H section with a height of 100 mm to 350 mm, of Other Alloy Steel, which is not further processed than hot-rolled, hotdrawn or extruded, and which is included in the tariff code ex. 7228.70.10.00; b. I Section with height or width of 100 mm up to 600 mm and H section with a height of 100 mm to 350 mm, of Other Alloy steel, which is further processed with hot-rolled, hot-drawn or extruded, which is included in the tariff code ex. 7228.70.90.00. Article 2 The Safeguard as referred to in Article 1 is charged for 3 (three) years with the following conditions: No. - 3 - Period Amount of Safeguard
1 First Year, with 1 (one) year Period from the date of this Ministerial Regulation promulgated. 2 Second Year, with 1 (one) year Period from the termination of the First Year. 3 Third Year, with 1 (one) year Period from the termination of the Second Year. over Imports Value 26% 22% 18% Article 3 The Safeguard as referred to in Article 1 shall be imposed on the importation of all countries, except for products I and H section of other alloy steel produced from the countries listed in the Appendix which is an integral part of this Ministerial Regulation. Article 4 (1) The imposition of Safeguard as referred to in Article 1 are: a. Most Favored Nation); or b. Additional import duty preferences based on the schemes of international goods trade agreements in force, in the case of import from countries that are included in the schemes of international goods trade agreements in question and the provisions in the schemes of international goods trade agreements. (2) In terms of the provisions in the schemes of international goods trade agreement are not met, the imposition of Safeguard on the importation of the countries that included in the schemes of international goods trade agreement as referred to in paragraph (1) letter b is the Most Favored Nation. Article 5 On the import of products I and H section of other alloy steel originating from countries exempted from the imposition of Safeguard as referred to in Article 3 and the countries that have trade cooperation with - 4 -
Indonesia as referred to in Article 4 paragraph (1) letter b, the importer shall submit the Certificate of Origin. Article 6 The provisions on the imposition of Safeguard as referred to in Article 2 shall fully apply to the importation of goods which it relevant import customs notification has received registration number from the Customs Office of port of entry from the effective date of this regulation. Article 7 (1) This Ministerial Regulation shall be valid for 3 (three) years from the effective date of this regulation. (2) This Ministerial Regulation comes into force on the date of it promulgation. For public cognizance, this Ministerial Regulation shall be promulgated and published in the State Gazette of the Republic Of Indonesia.
