TERMS AND CONDITIONS CIMB BANK Submit Your EPF Statement Campaign Campaign Period 1. The CIMB Bank Submit Your EPF Statement Campaign ( Campaign ) is organized by CIMB Bank Berhad (13491-P) ( CIMB Bank ) and shall run from 16 th October 2017 to 8 th December 2017, both dates inclusive (the Campaign Period ). 2. This Campaign is held in conjunction with Submit Your EPF Statement Campaign organized by CIMB Islamic Bank Berhad ( CIMB Islamic Bank ). In carrying out the Campaign in conjunction with CIMB Islamic Bank, the Prizes under this Campaign shall come from the same pool of Prizes intended for the Campaign organized by CIMB Islamic Bank. 3. CIMB Bank reserves the right upon giving prior notice of fourteen (14) days to change the duration and/or the commencement and/or expiry dates of the Campaign Period. Eligibility 4. This Campaign is open to all CIMB Bank s existing customers and new-to-bank customers* (the Eligible Participant(s) ); and the following categories of persons/entities shall NOT be eligible to participate in this Campaign:- (i) (ii) (iii) Permanent and/or temporary staffs or employees of CIMB Bank (including its subsidiaries and related companies) and their immediate family members (i.e. spouses, children, parents, brothers and sisters); and/or Representatives and/or agents (including advertising and campaign agents, third party vendors and service providers) of CIMB Bank (including its subsidiaries and related companies) and their permanent and/or contract staffs or employees and their immediate family members (i.e. spouses, children, parents, brothers and sisters); and/or Non-individual entities including but not limited to sole-proprietorships, partnerships, charitable/non-profit organisations/societies, corporate and commercial customers, public listed and private limited companies, clubs, associations and co-operatives. *A new-to-bank customer is defined as an individual who applies for a CIMB Bank s product and his/her application is approved during the Campaign Period. Qualifying Criteria 5. Each Eligible Participant shall be entitled to only one (1) entry ( Entry ) to stand a chance to win the Prize, if: 1

(i) The Participant prints out their EPF statement at CIMB Branch using designated EPF kiosk machine ( Designated Kiosks ); and (ii) The Eligible Participant signs and submits his/her EPF statement printed from the Designated Kiosk to a CIMB Bank branch officer to endorse original sighted on the EPF statement on the same day. CIMB Bank will keep a scanned copy of the Eligible Participant s EPF statement original sighted and the original copy of the EPF Statement will be returned to the Eligible Participant. 5A. The information contained in EPF statement of the Eligible Participant(s) will be used and processed by CIMB Bank in accordance with CIMB Group Privacy Notice available at https://www.cimbbank.com.my/en/personal/support/privacy.html and for the following purposes:- (a) To assess the eligibility, current and future needs of the Eligible Participant(s) for any of the products, services and/or offers of CIMB Group and/or any third party, and which CIMB Bank believes may be of interest or benefit to the Eligible Participant(s) ( Products ); and (b) To market, cross sell or provide information of the Products to the Eligible Participants through any communication channels that CIMB Bank deems fit. For the avoidance of doubt, in the event any Eligible Participant(s) have notified CIMB Bank that they do not wish to receive marketing, advertising and promotional communications from CIMB Group**, and/or CIMB Group s merchants and/or strategic alliance via the address/email address/telephone number set out below:- Address: Customer Resolution Unit, Level 19, Menara Bumiputra-Commerce, 11 Jalan Raja Laut, 50350 Kuala Lumpur Tel: 03 6204 7788 Fax: 603 2691 3248 Email : cru@cimb.com then, no such marketing, advertising and promotional communications will be sent by CIMB Bank to the said Eligible Participant(s). ** CIMB Group refers to CIMB Group Holdings Berhad and all its related companies, as defined in section 7 of the Companies Act 2016 and jointly controlled companies, providing financial and other regulated services, excluding companies, branches, offices and other forms of presence operating outside of Malaysia unless and to the extent otherwise stated. Winner Selection 6. At the end of every week, thirty seven (37) Eligible Participants who fulfill the Participating Criteria will be randomly selected by an automated selection system from the total entries to be named as the potential winner to receive the Prize(s) as mentioned in Clause 16 ( Shortlisted Participants ). 7. The Shortlisted Participants will be contacted by CIMB Bank within two (2) weeks of their EPF Statement submission to CIMB Bank, via Short Messaging Services ( SMS ) at the mobile number provided by the Eligible Participants to CIMB Bank. The Shortlisted Participants will be required to answer one (1) question. 8. The Shortlisted Participants must reply to the SMS with the correct answer within the prescribed date and time in the SMS. If the Shortlisted Participant is able to answer or respond or reply to the SMS successfully 2

in the manner as specified in the SMS, the Shortlisted Participant will be declared as a winner ( Winner ) entitled to win one Prize. 9. If the Shortlisted Participants are not able to answer or respond or reply to the SMS successfully in the manner as specified in the SMS for any reason whatsoever, the Shortlisted Participant will be disqualified and will not be entitled to win any Prize. There will be no additional selection to reward additional winners. 10. The first two Shortlisted Participants to reply the fastest with the correct answer within the prescribed date and time prescribed in the SMS will receive the Prize(s) of 2 x iphone 8 and the remaining Shortlisted Participant who reply with the correct answer will receive the RM300 Tesco Shopping Voucher or RM300 Parkson Shopping Voucher (depending on the date of submission of the EPF Statement by the Winner as set out in Clause 16). 11. CIMB Bank has the sole discretion to fix any date and time to send the SMS to the Shortlisted Participants. CIMB Bank shall not be held responsible for SMS sent to the Shortlisted Participants which are not completed or not replied or not responded by the Shortlisted Participants due to any reasons whatsoever. 12. For the avoidance of doubt, all charges for SMS sent by the Shortlisted Participants to respond to CIMB Bank s SMS will be subject to the charges as may be imposed by the Shortlisted Participant s telecommunication service providers which shall be borne by the Shortlisted Participant. 13. All SMS answer received from the Shortlisted Participants will be judged and decided by a panel of judges selected by CIMB Bank and the decision of the panel of judges shall be final, binding and conclusive. 14. It shall be the Shortlisted Participants responsibility to ensure their mobile numbers and mailing address provided ( Contact Particulars ) to CIMB Bank are current and updated. The notification and delivery of Prize(s) by CIMB Bank will be based on the Shortlisted Participant(s) phone number(s) and mailing address maintained in CIMB Bank s records. In the event there is a change to the Contact Particulars it shall be the responsibility of the Shortlisted Participant to update CIMB Bank of the same. CIMB Bank shall not be responsible to the Shortlisted Participant(s) for non-delivery of the Prize(s) or any loss (including loss of opportunity and consequential loss arising therefrom) suffered or incurred in the event the Contact Particulars maintained in CIMB Bank s record is not current or correct. 15. A Shortlisted Participant shall only be entitled to win and receive a maximum of one (1) Prize only under this Campaign. 3

All Prize(s) under this Campaign is provided on an as is basis and is neither transferable nor exchangeable for cash or credit of any kind. Where applicable, the Prize(s) shall be subject to the terms and conditions of the supplier, manufacturer and/or merchant of the relevant Prize(s) which terms and conditions are separate from CIMB Bank s terms and conditions governing this Campaign. 18. Subject to terms and conditions herein, the Weekly Prize(s) (RM 300 Shopping Voucher) will be delivered to the Winner(s) mailing address based on CIMB Bank s record via mail within 8 to 10 weeks from the end of the Campaign Period. The Grand Prize(s) (iphone 8) will be delivered to the Winner(s) mailing address based on CIMB Bank s record via mail within six (6) months from the Campaign Period. CIMB Bank will not entertain any request from any Winner(s) to deliver the Prize(s) to any third party address. 19. The Winner(s) agrees and authorises CIMB Bank to disclose their details (including but not limited to their names, NRIC numbers, phone numbers and mailing and electronic mailing addresses) to the distributor/agent appointed to deliver the Prize(s). All Prizes(s) under the Campaign may vary and subject to stock availability. CIMB Bank reserves the right to substitute any Prize(s) under this Campaign with another item of similar cost during the Campaign Period upon giving fourteen (14) calendar days prior notice to the Winner(s). 20. To the fullest extent permitted by law, CIMB Bank expressly excludes and disclaims any representations, warranties, or endorsements, express or implied, written or oral, in respect of the Prize(s) unless the same is due to the gross negligence or willful default of CIMB Bank. All risks, loss, damage and/or injury associated with the use of the Prize(s) shall be assumed by the Winner (s). General Terms and Conditions 21. By participating in this Campaign, the Eligible Participant(s) is deemed to have read, understood and agreed to be bound by the Terms and Conditions herein and agree that any or all decisions made by CIMB Bank shall be final and conclusive. The Eligible Participant(s) MUST NOT be in breach of any of the terms and conditions of the relevant product(s) that the Eligible Participant (s) has with CIMB Bank and/or CIMB Clicks Internet Banking Agreement and the product that the Eligible Participant (s) has with CIMB Bank MUST NOT be invalid, cancelled or terminated within CIMB Bank s definition at the point of delivering the Prize(s) otherwise the Eligible Participant(s) will be disqualified from receiving the Prize(s) and shall not be entitled to any compensation. 4

22. CIMB Bank reserves the right at its sole discretion to disqualify any Eligible Participant(s) that it determines to be tampering with the entry process or to be acting in breach or potential breach of these Terms and Conditions. 23. CIMB Bank will not assume any responsibility for the Prize(s) provided under this Campaign. The Prize(s) are offered and/or provided solely by the relevant vendors and providers, under such terms and conditions as determined by such vendors and providers, and CIMB Bank shall not be liable (including but not limited to, loss of income, profits or goodwill, direct or indirect, incidental, consequential, exemplary, punitive or special damages of any party) howsoever arising whether in contract, tort or otherwise in connection with the Campaign unless the same is due to the gross negligence or willful default of CIMB Bank. 24. CIMB Bank will not entertain any complaint whatsoever in connection with such Prize(s). The Prize(s) have not been certified by CIMB Bank and under no circumstances shall the inclusion of any Prize(s) in this Campaign be construed as an endorsement or recommendation of such Prize(s) by CIMB Bank. If any Eligible Participant(s) is dissatisfied with any of the Prize(s), such Eligible Participant(s) shall seek recourse with the relevant vendor/ provider directly. 25. By participating in this Campaign, the Eligible Participant(s) hereby irrevocably and unconditionally undertakes to fully absolve CIMB Bank of all liabilities and agrees to indemnify CIMB Bank (on full indemnity basis) and hold CIMB Bank harmless against any claim by third party, and against any loss, damage, cost and expense (including solicitor s fees and cost)that CIMB Bank may suffer or incur as a result of or in connection with this Campaign unless the same arise from and are caused directly by CIMB Bank s gross negligence or willful default. 26. CIMB Bank reserves the right to cancel, terminate or suspend this Campaign upon giving prior notice of fourteen (14) calendar days. For the avoidance of doubt, cancellation, termination or suspension by CIMB Bank of this Campaign shall not entitle the Eligible Participant(s) or any other person whosoever to any claim or compensation against CIMB Bank for any losses or damages suffered or incurred as a direct or indirect result of the act of cancellation, termination or suspension. 27. CIMB Bank reserves the right upon giving prior notice of twenty one (21) calendar days to vary (whether by addition, deletion, modification, amendment or otherwise howsoever) ( Amendment ) any of the Terms and Conditions herein. Notification to the Eligible Participant(s) in respect of the Amendment, cancellation, termination, suspension of this Campaign or any other notices to be given by CIMB Bank to the Eligible Participant(s) under this Campaign shall be effected at CIMB Bank s absolute discretion through any one of the following means of communication, namely, by posting a notice regarding the Amendment at each of CIMB Bank s branches or via CIMB Bank s website or by any other means of notification which CIMB Bank may select and the Amendment shall be deemed as binding on the Eligible Participant(s) as from the date of notification of the Amendment or from such other date as may be specified by CIMB Bank in the notification. Eligible Participant(s) acknowledges and agrees to access CIMB Bank s website at regular intervals to view these Terms and Conditions and to ensure that he/she is kept up-to-date with any changes or variations to the Terms and Conditions herein. 28. The Terms and Conditions (as the same may be amended from time to time pursuant to Clause 27 above) shall be read in conjunction with the prevailing terms and conditions in the terms and conditions of the product(s) that the Eligible Participant(s) has with CIMB Bank and/or CIMB Clicks Internet Banking Agreement and shall prevail over any inconsistent terms, conditions, provisions or representations contained in any other promotional materials of the Campaign. 29. CIMB Bank does not warrant that the Campaign shall be uninterruptible and/or error free. By participating in the Campaign, the Eligible Participant(s) hereby acknowledges and irrevocably agrees that CIMB Bank 5

shall not in any manner whatsoever be liable for any technical or system failures of any kind, whatsoever intervention, interruption and/or any electronic or human error arising from and under the Campaign. CIMB Bank shall not be liable or held responsible to the Eligible Participant(s) in any manner whatsoever if CIMB Bank is unable to perform any of its obligations stipulated herein where such inability is due directly or indirectly to any act of God, industrial dispute, war, strike, riot, technical or system failures or anything beyond CIMB Bank s reasonable control. 30. If there is any inconsistency(ies), conflict(s), ambiguity(ies) or discrepancy(ies) between the English and the Bahasa Malaysia versions or versions in any other languages of the Terms and Conditions herein, the English version of these Terms and Conditions shall prevail. Notwithstanding the aforementioned where request is made by the Eligible Participant(s) and noted and acknowledged by CIMB Bank in its records that the Bahasa Malaysia version of these Terms and Conditions shall govern the operation of the product(s) that the Eligible Participant(s) has with the CIMB Bank, then the Bahasa Malaysia version of these Terms and Conditions shall prevail. 31.
