GENERAL TERMS & CONDITIONS:- 1 If the Officers of the HSWC responsible for supervision of the performance of the maintenance contract, find at any time that the cleanliness is not upto desired level and that there is discrepancy in the use of material and labour for maintenance of work, such monthly penalty as may be deemed fit shall be imposed and deduction be made from the monthly bills of the contractor after giving due opportunity, provided that the monthly penalty if imposed shall not be less than 10% and more than 100% of the monthly bill payable by the Corporation. 2. The contractor will carry out the instructions given in site order book and his authorized agent shall sign the same in token of acceptance of instructions given to him. 3. The Corporation may, without prejudice to its right against the contractor for any interior workmanship or breach of any of the terms and conditions of the contract may terminate the contract by giving one month notice in writing and get the work done through another contractor or by itself for the left over period of the contract at the risk and cost of the defaulting contractor.2 4. All questions and disputes arising out of relations to the contract or otherwise concerning contract work, or execution of failure to execute the contract work, whether arising during the period of the contract or after the completion of abandonment thereof shall be referred to the Managing Director, HSWC, whose decision shall be final and binding in all respect. 5. The contractor shall indemnify the Corporation in regard to any encumbrances in relations to the person engaged by him for fulfilling his obligations under this contract. The contractor shall be further responsible for any loss caused to the Corporation due to negligence or otherwise on the part of this men and amount, if any, as determined by the Corporation, as loss, shall be recoverable from the contractor. The decision of the Managing Director, HSWC, shall be final and binding in all such cases. 6. Income Tax & service tax as applicable will be deducted at source from the bill as per the rules. 7. A proper contract agreement on stamp paper of Rs. 10.00 will be executed between the contractor ( whose tender is accepted ) and HSWC. The cost of stamp paper required for execution of the agreement shall be borne by the contractor. The allotment letter shall be issued after submission of bank guarantee and agreement on stamp paper 8. For all matters, the Managing Director, Haryana State Warehousing Corporation will be the final authority whose order will be binding in the contract. 9. The Corporation shall not be liable to pay any compensation on any account of the accident, injury or death sustain by any worker deployed by the contractor and any claim under Workmen Compensation Act the contractor shall indemnify the Corporation on account of above claims. 10. All the statutory deductions in force or coming into force while making the payment will be made from your bills. 11. All the disputes are subject to Panchkula jurisdiction.

12. The contract shall be awarded for a period of one year extendable by another six months at the consent of the contractor & the option of the Corporation. 13. Payment to the workers will be made by cheque/demand draft by the company/ Housekeeping agency and proof of payment will be furnished at the time of claiming of the bill of concerned month. 14. The workers shall be issued ESI cards by the House Keeping agency. 15. The contractor shall abide by the instruction/guidelines issued by the Govt. of Haryana, Finance Department vide letter dated 23-8-2012. 16. The work to the lowest bidder shall be allotted only on deposit of bank guarantee of rupees 5.00 lacs which shall be valid for 15 months i.e. from 1-01-2015 to 31-3-2016. The bank guarantee shall be returned within one month of termination of contract or shall be forfeited in case the work and conduct of the agency is not up to the mark. 17. The tender shall be opened in double envelop system. The envelope A shall contain technical bid and shall contain the following documents: 1) Completion certificates (in original) of having performed satisfactory service in at least five private hospitals or bank or other reputed agencies in the last three years. 2) Details of staff deployed and tools and plants in hand. 3) Photocopy of audited balance sheet of last three years. 4) Demand draft of earnest money for respective tender in original. 5) Self attested certificate to be given by the tenderer on its letter pad that the agency has not been blacklisted by any organisation from the date of inception of the agency till date of filling of tender. 6) Original cash receipt/demand draft of Rs.500/-(in case tender is downloaded) for tender fee. SERVICE TO BE RENDERED BY THE CONTRACTOR FOR CORPORATE OFFICE Sr.No1. Providing house keeping services at H.O. building Panchkula. DAILY: Scope of work:- i) Daily sweeping of Head Office building including basement, garage, open area with the boundary wall, toilets, terrace and collection of waste material to be disposed off by the contractor every day on the specific clearance of the Corporation. ii) Clearing of floor area with wet duster and by detergents, disinfectants etc. in the morning before 9.00AM and thereafter at 1.30PM. iii) Cleaning & washing of toilets using deodorants, detergents and disinfectants twice a day i.e. once in the morning & again in the afternoon or as the need may be. iv) Dusting/cleaning of windows and doors, Venetian blinds, curtains & partition glass using chemical to maintain cleanliness in every form in the area housing the office of the Corporation. v) Dusting & wet cleaning of partition glasses and panes with utmost care. vi) Acid cleaning of sanitary wares. vii) Cleaning of AC grills. viii) Dusting of ceiling fans/tube lights/exhaust fans/open record lying in all the floors. IX) Filling up the desert coolers twice a day in summer season i.e. from 1 st April to 30 th September. HORTICULTURE SERVICES: i) Regular watering & manuring of plants. ii) Regular mowing of grass. iii) Planting of seasonal plant regularly. iv) Cleaning of rivulet in the garden. TERMS & CONDITIONS 1. The contractor will not sublet the work. 2. The contractor shall be responsible for the attendance of the sweeper to engaged by him for day to day cleaning operation. He shall also maintain a wage register in respect of the workers employed by him. 3. For the execution of the maintenance contract the contractor shall employ a minimum work force of four sweepers and one gardener every day for a minimum wages prescribed under the minimum wages act by the concerned Administration i.e. Deputy Commissioner, Panchkula, the same shall be appropriately revised from the date of notification. 4. The sweepers shall do their job from 7.00AM to 3.00PM daily. 5. The contractor shall provide uniform and identity cards to the workers. A copy of their particulars shall be supplied by the contractor to the corporation.

6. All the waste papers collected during cleaning operation should be disposed off daily. 7. The payment of maintenance contract will be made to the contractor on the presentation of the bill every month. The bill shall be supported with a list of the persons employed on maintenance contract along with the wages paid to each employee with a certificate that the wages paid are according to the minimum wages. A representative of HSWC shall be present at the time of disbursement of wages to ensure that minimum wages as fixed by State Govt. are being paid to the workers. The representative of HSWC shall sign the wages register to ensure that the payment is given to the workers in his presence. Provident fund of the worker employed must be deposited & certificate in this regard shall be furnished by the employer. 8. The contractor shall ensure that all major cleanliness work is done before 9.00AM daily. All the waste papers collected during cleaning operation shall be placed by the Contractor at the place provided by the department daily which will be disposed off daily or weekly after checking by the official authorized by the HSWC. 9. All the workers should report to the officer/official authorised by the HSWC. The contractor will be personally responsible for the work & conduct of all the workers deployed by him in HSWC and HSWC shall not be responsible for any dispute by them. 10. The manpower of the contractor shall wear a specific uniform approved by the Corporation and the workers shall wear the uniform daily. 11. The contractor shall submit a daily routine of workers in hour to hour basis for the cleaning operations to be done by the sweepers every week which shall be followed on weekly basis.
