ARCELORMITTAL SOUTH AFRICA LIMITED [Registration Number 1989/002164/06] ( ArcelorMittal ) INTRODUCTION The Promotion of Access to Information Act, No 2 of 2000, ( the Act ) gives effect to the constitutional right of access to information held by a public or private body. ArcelorMittal is a private body and as such has to comply with the requirements of the Act. One of the requirements of the Act is the compilation of a manual that contains information on the records held by the relevant private body. This document serves as the manual of ArcelorMittal, all it operating divisions, its subsidiaries and related entities listed below in compliance with the requirements of the Act. COMPANY OVERVIEW ArcelorMittal South Africa Limited, which has been known as Iscor Limited since June 1989 and change its name to Ispat Iscor Ltd on 17 August 2004 and change its again name on 1 st March 2005 to Mittal Steel South Africa Limited and again to ArcelorMittal South Africa Limited on 3 October 2007, was established in 1928 to promote industrialisation in South Africa through the production of steel for the growing manufacturing industry. Requesters should note that no request will be processed if the prescribed form is not duly completed and if the right that the requester is seeking to exercise or protect has not been identified. If a request is made on behalf of a third party, the requester must submit proof of the capacity in which the requester is making the request to the satisfaction of the company secretary. The company secretary will advise the requester of the fees (if any) payable to obtain access to the relevant record/s. Requester should note that access to certain records may be denied on the grounds set out in the Act. PART VI [s51(3)] AVAILABILITY OF MANUAL As indicated, the manual is available for inspection, free of charge, at the office of ArcelorMittal in Vanderbijlpark and is also available on the company s website at wwww.mittalsteelsa.com. Copies may also be requested from the South African Human Rights Commission. PART VII PRESCRIBED FORM AND FEE STRUCTURE The form and fee structure prescribed under the Act are attached hereto as Annexures 1 and 2 and are also available on the company s website or on the website of the Department of Justice and Constitutional Development (www.doj.gov.za) under the Regulations section. Both a request fee and an access fee are payable. The request fee is a standard fee as prescribed by Regulation published in the Government Gazette and the access fee must be calculated by taking certain factors into consideration such as reproduction costs, search and preparation time and cost and postal costs. The company secretary may also require a requester to pay a deposit that will be equal to the prescribed portion of the access fee that would be payable if the request is granted. The company secretary shall withhold a record until a requester has paid the fees as required in full. ---------------------------------- Page 8 of 8
