Office of the Commissioner Customs & Central Excise Commissionerate, OB-32, Rail Head Complex, Jammu TENDER NOTICE Customs & Central Excise Commissionerate, Jammu & Kashmir, requires the services of a Labour Contractor having valid licence under Section 12 of the Contract Labour (Regulation and Abolition) Act, 1970 for the specified services of housekeeping of its offices located at various locations in the state of Jammu & Kashmir. The details regarding nature of service, office location and area in square feet over which service is required may be had by the eligible Labour Contractor from the Superintendent (Hqrs) of this Commissionerate. The service is required for the period 01-04-2012 to 31-03-2013. Apart from the Commissionerate office, the service is required for subordinate offices located at Srinagar, Kathua, Samba, R.S.Pura,, Rajouri, Akhnoor, Nyoma and Leh. In addition to this one frash/sweeper full time or part time may be required for TFC, Chakan-da-Bagh, Poonch for which separate rate may be quoted. Details regarding general terms and conditions, prequalifications requirements for award of contract and proforma for quoting rates can be had from Supdt. (Hqrs.) during office hours on any working day. Quotations must reach the Commissionerate office on or before 22.03.2012 by 1730 hours and the same will be opened at 1100 hours on 23.03.2012 in the presence of the bidders, who wish to be present. Contract shall be from the first working day of a month to the last working day i.e. excluding Sundays & Gazetted holidays. While submitting quotations, bidders must submit the Proforma duly filled in and signed for having accepted the general terms and conditions (Annexure-I), special terms and conditions (Annexure-II), Schedule for quoting rates (Annexure-III), Certificate of non-participation of near relatives of Customs
Employee in the tender (Annexure-IV) in one envelope, financial bid (Annexure-V) in another envelope and area of each building in sq. feet (Annexure VI). Both the sealed envelopes be placed in another sealed cover super-scribing it Quotations / rates for rendering service on contract basis. It is, however, not necessary that a bidder has to bid for all the premises. Contractors, who do not fulfill the pre-qualifications requirements, will not be considered. Financial bids of only those contractors/ agencies, who fulfill the other terms and conditions, will be opened separately. The Customs & Central Excise Commissionerate reserves the right to accept or reject any or all the quotations without assigning any reason whatsoever. Annexure - I GENERAL TERMS AND CONDITIONS OF THE TENDER 1. Rates / Quotations, duly filled in, will be received upto the date and time mentioned in the letter. 2. The Commissionerate of Customs & Central Excise, Jammu reserves the right to postpone and / or extend the date of receipt / opening of Rates / Quotations or to withdraw the same, without assigning any reason thereof. 3. The Contractors are required to submit the complete Rates / Quotations only after satisfying each and every condition laid down in the Annexure enclosed. 4. All the rates must be written both in figures and in words. Corrections, if any, are to be made by crossing out, initialing, dating and rewriting. In case of discrepancy between the words and figures, the rates indicated in figures shall prevail. All overwriting / cutting, insertions shall be authenticated and attested. 5. Rates / Quotations should be submitted and signed/stamped by the firm with its current business address. 6. The rates shall be valid for a period for which contract is solicited. 7. The Contractors should satisfy themselves, before submission of the rates / quotations, that they meet the qualifying criteria and capability as laid down in the Annexure. 8. The Contractors must comply with the Rates / Quotations, specifications and all terms and conditions of contract. No deviation in the Terms & Conditions of the Contract shall be entertained unless specifically mentioned by the Contractor in the Rates / Quotations and accepted by the Commissionerate. 9. The contract will be awarded initially for six months subject to further extension from time to time. However, extension will be considered keeping in view the various factors such as prevailing market prices, satisfactory performance of the firm. 10. In case of default by the Contractor of any terms & conditions, the Commissionerate may, without prejudice to any other right /remedy, terminate the contract, in whole or part, by giving 15 days advance notice in writing to the Contractor.
11. Notwithstanding anything contained herein, the Commissionerate reserves the right to terminate the contract by giving 15 days notice in writing without assigning any reason and without incurring any financial liability whatsoever to the Contractor. 12. Insurance cover protecting the agency against all claims applicable under the Workmen s Compensation Act, 1948, shall he taken by the Contractor. The contractor shall arrange necessary insurance cover for any persons deployed by him even for short duration. The Commissionerate shall not entertain any claim arising out or mishap, if any, that may take place. In the event of any liability/claim failing on this Commissionerate, the same shall be reimbursed by the Contractor. 13. Contractor shall in no case lease/transfer/sublet/appoint care taker for services. 14. No other person, except Contractor s authorised representative, shall be allowed to enter the Commissionerate. The contract worker to be provided by the Contractor shall mark their daily attendance with the Inspector (Hqrs) of the Commissionerate or with the Inspector designated for this purpose with the subordinate offices. The housekeeping work such as cleaning shall start before 0900 hrs. The contractor shall provide identity Cards to his contract worker along with an uniform for identification. 15. Within the premises of the Commissionerate, the Contractor s personnel shall not do any private work other than their normal duties. 16. Contractor shall be directly responsible for any/all disputes arising between him and his personnel and keep the Commissionerate indemnified against all actions, losses, damages, expenses and claims whatsoever arising thereof. 17. Contractor shall be solely responsible for payment of wages/salaries, EPF, ESI and other benefits and allowances to his personnel that might become applicable under any Act or Order of the Govt. The Commissionerate shall have no liability whatsoever in this regard and the contractor shall indemnify this Commissionerate against any/all claims which may arise under the provisions of various Acts, Govt. Orders etc. 18. Contractor shall be fully responsible for theft, burglary, fire or any mischievous deeds by this staff.
19. All consumables and material used by the contractor shall be provided by this Commissionerate. 20. It is made clear that the engagement of the service provider does not in any way confer any right to the service provider or the persons that may be deployed by him in this office for claiming any regular or part time employment in this office or any other Govt. The rates quoted for providing contract labour/ sweeper should be inclusive of all levies like ESI and PF as per guidelines issued from time to time by the Govt. 3. Break- up of above components on wages shall be quoted separately in the bid forms in compliance of Minimum Wages Act/ DC rate. 4. Service charges for providing the services of contract labour/sweeper shall be quoted separately.

It is certified that to the best of my knowledge, none of my relatives is serving in Customs & Central Excise Department, in any capacity.
