This document supplements rules, requirements or conditions contained in the rental agreement form. I. GENERAL A. Portions of the premises known as the Chesapeake City Park are available for use by municipal, school, commercial and private organizations or groups or individuals, providing that certain criteria are met and specified conditions are observed. B. The Chesapeake City Park is primarily a park intended for passive recreation purposes. Portions of the park may be set aside for a variety of public entertainment activities, both for resident and non-resident. When a group wishes to set aside portions of the Chesapeake City Park for their use, such reservations will require that a rental agreement between the user and the City be executed. II. POLICIES A. The City Council retains authority to approve the operating hours and the fee schedule for the Chesapeake City Park and delegates operating authority as set forth herein. B. The City Manager, or his designee, is empowered by City Council to develop and administer such procedures and policies as are necessary to insure safe and efficient operation of the Chesapeake City Park, and the City Manager is authorized to conclude rental agreements pertaining to temporary use of this facility. C. The Chesapeake City Park can be rented to an individual or a private group or organization incorporated with elected or appointed officers and who have authority to enter a rental agreement. Such individuals, corporations, associations, firms or similar entities eligible to rent the City Park site are hereinafter referred to as the Group(s). D. Use of the City Park site by groups is contingent upon observance of established regulations and conditions. A copy of the appropriate appendices will be provided along with the application and rental forms to those wishing to use the site.

PRIORITIES FOR USE OF THE CHESAPEAKE CITY PARK A. Programs or activities under the direct control of the City of Chesapeake will have first priority for use of all or portions the Chesapeake City Park. B. Organizations conducting activities which are co-sponsored by the City of Chesapeake are accorded second priority. C. All other eligible users may apply to reserve the Chesapeake City Park on a first come basis. D. Once a rental agreement has been executed, a using group may not be pre-empted by a higher priority request without the written consent of the rental group. IV. APPLICATION CONSIDERATIONS A. The City Manager has appointed the Department of Parks and Recreation to administer and schedule applications received in accordance with provisions of this document. The Park Ranger Office at Chesapeake City Park will be the point of contact within the department for processing applications. B. Users may apply to reserve the Chesapeake City Park on a first come basis at the beginning of the New Year. City agencies or City sponsored groups may apply up to one year in advance of the desired use date. C. Applications to use the Chesapeake City Park shall be submitted to the Chesapeake City Park Ranger office. 1. The name, address and title (if applicable) of the person completing the application. 2. The name and address of the group for whom the application is submitted. 3. The day(s) and hours of desired use. 4. The portion(s) of the site desired for use. The specific area to be used will be determined in discussions with the Park Ranger office and a description of that area will be included in the rental agreement.

An estimate of the anticipated attendance. 6. Any other information deemed reasonably necessary to a fair determination as to whether the application should be approved. D. Applications must be submitted to the Park Ranger Office no later than 30 days prior to the desired date of use. The certificate of insurance, if required, must be submitted within ten (10) working days of the desired date of use. E. Applicants must obtain all appropriate permits and licenses which may be required by the City of Chesapeake, the Alcohol Beverage Control Board, or other governing agencies. The user will be bound by all applicable ordinances, to include amusement tax and food tax where an admission fee is charged or edible refreshment sales are made to the public. See Appendix 3 if alcohol sale or use is intended. F. The Director may prescribe such insurance requirements as deemed necessary and appropriate by the Risk Manager. G. The Director may require the user to provide such materials, equipment, supplies or facilities which Director considers essential to the health, safety and welfare of any person. V. FEES AND DEPOSITS A. Activities sponsored or co-sponsored by the City of Chesapeake are exempt from fees. Requests for fee exemptions will be determined by the City Manager or designee. B. Payments for the required rental fee and the damages deposit must be submitted with the application. C. Profit groups may be subject to additional fees under Section 6-30 of the Chesapeake City Code dealing with Outdoor Concerts. D. Rain dates, if desired, are considered separate rentals and the standard fee Schedule for each twelve (12) hour period will apply. E. Refunds are given for weather related cancellations only.

Rental fees, for an event that has been cancelled due to weather, may be applied to a new rental date, provided the facility is available for rental. G. Violations of any portions of this policy or application may result in cancellation/ termination of this rental and forfeiture of any of all payments and fees. VI. GENERAL RULES AND REQUIREMENTS General rules for users of the Chesapeake City Park along with the fee and charges schedule are found in Appendix 1. The application for use of Chesapeake City Park is found in Appendix 2. Requirements applicable when alcoholic beverages are to be sold or consumed are found in Appendix 3. Robert A. APPENDIX 1 TO PARKS AND RECREATION POLICY NO. 6026 TITLE: GENERAL RULES - CHESAPEAKE CITY PARK PURPOSE: To provide regulatory information for the use of Chesapeake City Park by groups entering into a Rental Agreement with the City of Chesapeake. GENERAL: Groups using the Chesapeake City Park shall abide by all conditions, rules, and requirements stated herein, and/or in Appendix 3 when applicable, and in the Rental Agreement. 1. Admission. Advance approval must be obtained to charge admission to an activity or program or for vending food or beverages at the site, and shall be open to all persons regardless of race, sex, religion, color, national origin, or handicap. 2. Vehicle Parking and Use. No vehicle shall be driven or parked on any portion of the grounds other than designated roadways and parking areas, except for service vehicles delivering or removing foods or beverages or equipment, without the prior written approval of the City. For large activities, approval may be granted for the user group to use their rented sections for turf parking, contingent upon existing or forecast conditions. 3. Portable Toilets. The using group shall contract for provision of two portable chemical toilets, one of which shall be accessible to and equipped for the handicapped. When the anticipated attendance exceeds 100, then the user shall provide one toilet for each additional block of 100 persons. 4. Fireworks. Any use of firecrackers, torpedo rockets, or other fireworks is prohibited without written approval of the Fire Department. 5. Signs. Information signs will be allowed on the site during the period of use. However, all signs must be removed from the site at the end of the rental period. In addition, any holes made when erecting signs shall be filled with dirt after removal of the sign. 6. Police Protection and Traffic Control. The user must make all necessary arrangements for sheriff and/or police protection and traffic control. The City will require confirmation that such coordination has been completed. 7. Trash Disposal. The user must make adequate provision for the disposal of all trash and garbage generated as a result of the activity. The nature of such provision shall be coordinated with the City during the application review. The necessary action to be taken by the user may range from providing garbage bags for use in cans supplied by the City to the user contracting for dumpster service. 8. Insurance. Certain activities may require that the applicant obtain and submit such Certificate of Insurance and special events riders as deemed appropriate by the Insurance

Division of the Finance Department. The applicant shall promptly furnish such policy or policies for property damage or bodily injury showing out of any one accident or other cause in a sum of not less than $1,000,000 combined single limit or in an amount specified by the Insurance Division of the Finance Department to protect the City against damages. In addition, the applicant shall provide, as necessary, host liquor liability insurance coverage for those events in which the giving or serving of alcoholic beverages is a planned and/or anticipated activity. 9. Damage Liability. It is the responsibility of a user group to inspect for and to report finds of damaged property or facilities before the rental period begins in order to avoid possible liability for correction of damages discovered by the City at the conclusion of the rental period. 10. Electricity and Water. Arrangements for use of electricity or water shall be coordinated with the City by the user group prior to the date of use. 11. Approval of Intended Use. The Director of Parks and Recreation Department retains the right to allow or to disallow use of any requested section based on the specifics of the intended use. Violation of the intended use can result in the termination of the rental. 12. Three-Day Limit. Events or activities not sponsored or co-sponsored by the City shall be limited to a three (3) day use period. The three day limit includes the time to set up prior to the opening of the event or activity. With prior coordination and approval, the disassembly phase may extend beyond the three day period. 13. Serial-Style Events. Serial-style events (i.e., held once a week, once a month, etc.) are prohibited without approval by the City Manager or his designee. 14. Permits, Licenses, Taxes, and Ordinances. Applicant groups must obtain all appropriate permits and licenses which may be required by the City of Chesapeake, the Alcohol Beverage Control Board, or other governing agencies. The Group will be bound by all applicable ordinances, to include amusement tax and food tax where an admission fee is charged or edible refreshment sales are made to the public. 15. Fun Forest Playground, Basketball Courts, and Horseshoe Courts. These areas are for use by the general public and reservations for these areas cannot be accepted. 16. Skateboard Facility. The skateboard facility will be open to the public when on-site staff is on duty. Rental reservations for this area will not be accepted. For information, call 312-0243.

List: *Alcoholic beverage serving and consumption area must be restricted to a specific area, using orange fencing or some other means of demarcation. No one may wander into other areas of the park with alcoholic beverages. A copy of the application must be presented to the Alcoholic Beverage Commission when applying for a permit. Your ABC Permit must be on premises during use and available for inspection, if requested. Alcohol use must be approved by the City Manger prior to obtaining the ABC permit. **Copies of valid equipment inspection records may be submitted in lieu of department inspections. Inspection department permit still is required. City Code Section 50-27. Merchandising, advertising, signs, etc. -Parks (a) No person shall expose or offer for sale any article or thing, nor shall he station or place any stand, cart or vehicle for the transportation, sale or display of any such article or thing unless approval is granted by the Director of Parks and Recreation. Exception is made as to any regularly licensed concessionaire acting by and under the authority and regulation of the city council. (b) No person shall announce, advertise or call the public attention in any way to any article or service for sale or hire. (c) No person shall paste, glue, tack or otherwise post any sign, placard, advertisement or inscription whatever, nor shall any person erect or cause to be erected any sign whatever on any public lands such as parks, beaches, athletic fields, trees or roads adjacent to a park. (10-12-76). City Code Section 50-52. Standards for Issuance. Permits may be issued by the director; provided, that the permittee complies with the following standards: 1. The director may require the permittee to provide or construct any facilities, furnish such materials, equipment or supplies which the director considers essential to the health, safety and welfare of any person. 2. The proposed activity or use of the park will not unreasonably interfere with or detract form the general public s enjoyment of the park. 3. The proposed activity and use will not unreasonably interfere with or detract from the promotion of public health, welfare, safety and recreation. 4. The proposed activity or use is not reasonably anticipated to incite violence, crime or disorderly conduct. 5. The proposed activity will not entail unusual, extraordinary or burdensome expense or police operation by the city, as determined by chief of police or designated representative. 6. If proof of insurance is required, the organization/group shall at its own cost and expense furnish a policy or policies for property damage or bodily injury showing out of any one accident or other cause in a sum of not less than $1,000,000 combined single limit or in the amount specified by the Risk Management Division. Also, the City of Chesapeake should be named as additional insured. 8. Provide proof of liability insurance coverage for an event in which giving or serving of alcoholic beverages is a planned and/or anticipated activity. 9. It is the applicant s responsibility to obtain the required certificate of insurance when it is required from a third party. 10. Any special or unique circumstances and or risks for the event(s) planned may require the endorsement of a special events rider to the insurance policy. 11. Certificate(s) from the insurance carrier or carriers showing the above insurances to be in force must be submitted and approved by the Risk Manager prior to the event. 12. Comply with all laws, rules, and regulations of the federal, state, and city governments governing operations and conduct on City property. 13. The premises will be available to all citizens without discrimination, provided the applicant complies with the standards set forth in Section 50-52 of the Chesapeake City Code. 14. This agreement may be terminated by the City of Chesapeake Parks & Recreation Department at any time upon a finding of a violation of any rule, ordinance, and condition of the permit or upon good cause shown. 15. Minor structural alterations may be made to the premises but upon surrender or termination shall be restored to its previous condition. All such alterations must be approved in advance by the Parks & Recreation Department. 16. By acceptance of this agreement, the organization/applicant and its participants agree to see that all necessary safety precautions are followed and will indemnify the Department of Parks and Recreation, City of Chesapeake, Virginia, it s employees and agents, and save them harmless from and against any and all claims, damages, liability, costs and expenses in connection with loss of life, personal injury, and/or damage to property arising from or out of any occurrence arising from the exercise of the privileges granted in this agreement except as may result from the sole negligence of willful misconduct of the City. 17. APPENDIX 3 TO PARKS AND RECREATION POLICY NO. 6026 TITLE: CHESAPEAKE CITY PARK ALCOHOLIC BEVERAGES PURPOSE: To provide policy guidance, information, and procedures relating to the sale or consumption of alcohol at Chesapeake City Park. I. City Council has delegated to the City Manager, or designee, authority to issue a permit to any eligible group for the use of Chesapeake City Park where the sale or consumption of alcoholic beverages is intended. An eligible group is defined in this context as a private group or organization which is incorporated under the laws of Virginia, or which has officers which have been elected or appointed and who have authority to enter into a rental agreement. Such groups, corporations, associations, firms, or similar entities eligible for an alcohol permit at the Chesapeake City Park are hereinafter referred to as "Group(s)". II. III. Basic responsibilities for carrying out the provisions of this policy rest with the Director of Parks and Recreation Department or his designated representative. However, ultimate authority to issue a permit for alcoholic beverages at the park site rests with the City Manager or designee. The process listed below shall be followed to gain permission for the sale or use of alcoholic beverages in the City Park. A. The prospective user group obtains an application form for use of the park site from the Parks and Recreation Department and indicates in the appropriate space that alcohol sale or use is intended. By signing and returning the application, the Group acknowledges receipt, understanding, and acceptance of the rules governing alcohol use at the park site. Application and Permit Fee payment must be submitted no later than one month prior to the desired date of use. The application package will be forwarded to the City Manager for approval. The Group will be notified of the manager s decision on the approval/ disapproval for alcohol use. B. After the Group has received alcohol use approval from the City Manager, the Group must apply for a special ABC permit from the Alcohol Beverage Control Board, (Phone: 424-6700). The group is advised at time of application the process will take from five (5) days to two (2) weeks, and the required ABC Permit fee must be paid by check or money order and not by cash. IV. RULES Certain rules which pertain specifically to alcohol are presented in this paragraph. Other rules pertaining to use of the site are contained in Parks and Recreation Policy 6026, Appendix 1. A. The application submitted by the Group(s) must specify the area(s) in which alcoholic beverages may be consumed and then, upon approval of the application, the Group(s) is bound to ensure that alcohol consumption is confined to the specified area only. The Director of the Parks and Recreation Department may require the Group(s) to provide security guard(s) or law enforcement personnel to enforce this rule, dependent upon other planned or likely activities at the park during the proposed use time may require documentation verifying the services will be provided for the event, if required. B. All general rules specified in Parks and Recreation Policy 6026, Appendix 1 apply to applicant Group(s). C. Sec. 46-182. Consuming or tendering to another in a public place. (a) If any person takes a drink of alcoholic beverages or offers a drink thereof to another, whether accepted or not, at or in any public place, except as provided in subsections (b) and (c) of this section, he or she shall be guilty of a class 4 misdemeanor. Except as provided in subsections (b) and (c) of this section, if any person shall be in the possession of an opened alcoholic beverage container in or on any city park, playground, or public street, he or she shall be guilty of a class 4 misdemeanor. (b) This section shall not prevent any person from drinking alcoholic beverages or offering a drink thereof to another in any rooms or areas approved by the Virginia Alcoholic Beverage Control Board in a licensed establishment, provided such establishment or the person who operates the same is licensed to sell alcoholic beverages at retail for on-premises consumption and the alcoholic beverages drunk or offered were purchased therein. (c) The city manager is authorized to issue a permit to any person or organization for the use of a public recreation or community center where alcoholic beverages are to be consumed, upon the deposit of $200.00 with the city manager and compliance with the other requirements set forth in this subsection. A deposit shall not be required of any city department, agency, committee or board applying for such use. Such deposit shall be for the purpose of protecting the city from any damage to the facilities used by the applicant and the deposit shall be refunded after the proposed activity has been completed with no such damage having occurred. No meeting or other activity shall be held at the center other than that stated in the application. Any person desiring to obtain a permit shall make application to the city manager or designated representative 30 days prior to the day when the building is to be used, setting forth the following information: (1) Name of person or organization responsible for activity, the place of such building and the duration of the desired use. (2) Provisions for crowd control, traffic control and parking. (3) The person or organization serving or permitting alcoholic beverages at the premises shall comply in all respects with regulations of the alcoholic beverage control board. (d) The city manager is authorized to make such rules and regulations as may be necessary to govern the use of the premises where alcoholic beverages may be used or served. (e) Upon determination that the requirements of subsection (c) of this section have been met, the city manager shall issue the permit for the designated date and use. (a) It shall be (un)lawful to sell wine and beer on Sundays within the city between the hours of 6:00 a.m. and 1:00 p.m. This section has the sole purpose of controlling the sale of wine and beer at the time specified herein and does not alter, amend or affect regulations covering the sale of beer or wine within the city at any other time. (b) Any person violating this section shall be guilty of a misdemeanor.
