EXPLANATORY MEMORANDUM AMENDMENTS TO THE STAFF REGULATIONS AND OTHER REGULATIONS CONCERNED IN ORDER TO INTRODUCE THE EURO IN ADVANCE ON 1 JANUARY 1999 FOR THE PURPOSES OF REMUNERATION, PENSIONS AND OTHER FINANCIAL ENTITLEMENTS IN THE PARTICIPATING MEMBER STATES 1. PRESENT SITUATION WITH RESPECT TO THE STAFF REGULATIONS (1) The Staff Regulations, the Conditions of Employment of Other Servants and Regulation No 260/68 laying down the conditions and procedure for applying the tax for the benefit of the European Communities are the basis for Community legislation on the establishment and payment of the remuneration, pensions and other financial entitlements of officials and other servants. (2) The components of remuneration and pensions (basic salary, allowances) and the deductions effected in accordance with the Staff Regulations or implementing regulations (contributions, taxes, etc.) are currently expressed in Belgian francs. (3) The net amount is converted to national currency using a fixed exchange rate subject to a weighting. The product of this combination is the economic parity, which offsets the difference in cost of living compared with Brussels. 2. IMPLICATIONS OF THE INTRODUCTION OF THE EURO (4) On 17 June 1997 the Council adopted Regulation (EC) No 1103/97 on certain provisions relating to the introduction of the euro. 1 In 1998, once the list of participating Member States has been decided, the Council will proceed to adopt Regulation No... /98 on the introduction of the euro in accordance with the third sentence of Article 1091(4) of the Treaty. The content of the Regulation has already been agreed. 2 (5) As from 1 January 1999 the euro will be the currency of the participating Member States. During the transitional period it will exist in several forms. First, there will be the euro unit itself and the cent, its decimal subdivision; and second, there will be the national currency units, which will be non-decimal subdivisions of the euro. References to amounts in euros without specifying the unit (euro unit or national currency unit) must therefore as a general rule be understood as being references to euro units. (6) As of 1 January 1999, in accordance with Article 8(3) of Council Regulation.../98 on the introduction of the euro, any amount denominated either in the euro unit or in the national currency unit of a given participating Member State and payable within that Member State by crediting an account of the creditor, can be paid by the debtor either in the 1 2 OJL 162, 09.06.1997, p. 1. euro unit or in that national currency unit. If the amount to be credited is denominated in a currency other than that of the account of the creditor, it must be converted to that currency at the conversion rate. (7) At the end of the transitional period (from 1 January 2002) the components of remuneration and the related exchange rates and weightings (currently expressed in Belgian francs) must be read as amounts in euros by applying the conversion rate applicable to the Belgian franc under Article 14 of Regulation /98 on the introduction of the euro. 3. PROPOSED AMENDMENTS (8) In view of the political significance and symbolic value of paying remuneration and pensions in euros, the Commission is planning to do so in advance as from 1 January 1999. (9) To this end it is proposing that from 1 January 1999 all references to the Belgian franc and all amounts expressed in Belgian francs in the Staff Regulations, the Conditions of Employment of Other Servants and any other regulations applicable to them be replaced by references to the euro and by amounts expressed in euros. (10) Amounts on salary statements (basic salary, allowances, contributions, taxes, etc.) will be expressed in euros and the euro will become the pivot currency for the calculation of remuneration and pensions. Since the conversion rate for the Belgian franc and the euro will be fixed, the net amount of remuneration or pensions will not be affected. The Commission will be responsible for calculating and publishing the results of the conversion in the Official Journal. (11) As from 1 January 1999 remuneration and pensions will be established in euros in the participating countries (this conforms to the Staff Regulations since the euro will be the national currency of these countries). In countries which have not adopted the euro on 1 January 1999 remuneration and pensions will continue to be paid in national'currency. (12) This will have no impact on the net amount of remuneration or pensions received by officials and other servants regardless of place of employment (or residence in the case of pensioners). It simply entails a formal amendment of the Staff Regulations compatible with the salary adjustment method. (13) Lastly, the solution will have the effect of bringing forward the date on which financial entitlements are expressed in euros to 1 January 1999. 4. RELATED ASPECTS (14) Remuneration outside the European Union is subject to the weighting for Belgium and paid in Belgian francs; it will therefore be paid in euros. Officials may request that part or all of their remuneration is converted to

the currency of their place of employment subject to the weighting and corresponding exchange rate. (15) Mission allowances expressed in Belgian francs will be converted to euros at the fixed conversion rate from 1 January 1999. Calculations will continue to be based on the exchange rates used for implementing the general budget of the European Union (1 for "ins"). (16) Other allowances established in Belgian francs will also be converted to euros at the fixed conversion rate asfrom1 January 1999. 5. PROPOSED AMENDMENTS TO THE STAFF REGULATIONS In the Staff Regulations and other Regulations concerned the term "Belgian francs" will be replaced by the term "euros" and amounts in Belgian francs by their equivalent in euros at the fixed conversion rate with effect from 1 January 1999. Article 1 In the Staff Regulations of Officials and the Conditions of Employment of Other Servants of the European Communities 7 and the other Regulations applicable to them the term "Belgian francs" is replaced by the term "euros" and amounts expressed in Belgian francs are replaced by their equivalent in euro units at the conversion rate. The rules relating to the rounding of amounts laid down in Regulation (EC) No 1103/97 shall apply. Article 2 In Article 16(1) of Annex VII to the Staff Regulations "Belgian franc" is replaced by "cent". Article 3 For conversion of the basic monthly salaries set out in Article 66 of the Staff Regulations and Article 63 of the Conditions of Employment of Other Servants, the first step and the difference between the first and second steps of each grade shall be calculated by straight application of the conversion rate. The other steps shall be obtained by adding this difference to the preceding step. Article 4 With effect from 1 January 1999, the date referred to in the second paragraph of Article 63 of the Staff Regulations shall be replaced by "1 January 1999". The new weightings shall consequently be fixed on the basis of the ratio between the economic parities in force and the new exchange rates as referred to in Article 63 of the Staff Regulations, both expressed in euros. At the time of the annual review of remuneration to take effect on 1 July 1999, the date specified in the second paragraph of Article 63 of the Staff Regulations shall be replaced by 1 July 1999. Article 5 As from 1 January 1999, the weightings in force in non-community countries shall also be recalculated on the basis of the ratio between the economic parities in force and the corresponding new exchange rates in force on 1 January 1999 expressed in euros. When weightings taking effect after 1 January 1999 are adjusted, the corresponding exchange rate shall be that for the month preceding the date of application. Article 7 On 1 January 1999, pursuant to this Regulation, the Commission shall effect the conversion into euros of the amounts of the different financial entitlements referred to in the Staff Regulations and the Conditions of Employment of Other Servants and the adjustment of the weightings to correct the effect of the change in exchange rates; these values shall be published in the Official Journal in January 1999. The rules relating to the rounding of amounts laid down in Regulation (EC) No 1103/97 shall apply. Article 2 Article 8 is amended to read: "Tax shall be collected by means of deduction at source. The amount shall be rounded down to one hundredth of a euro." Article 3 On 1 January 1999, pursuant to this Regulation, the Commission shall effect the conversion into euros of the amounts in Belgian francs in Council Regulation No 260/68; these values shall be published in the Official Journal in January 1999. Article 1 In the Staff Regulations the term "Belgian francs" is replaced by the term "euros" and amounts expressed in Belgian francs are replaced by their equivalent in euro units at the conversion rate. The rules relating to the rounding of amounts laid down in Regulation (EC) No 1103/97 shall apply. Article 2 On 1 January 1999, pursuant to this Regulation, the Commission shall effect the conversion to the euro of the amounts in Belgian francs in Regulation No 122/66/EEC of the Councils; these values shall be published in the Official Journal in January 1999.
