BUSINESS PROTECTOR (BP) INTRODUCTION North Star Mutual s Business Protector Policy provides both property and liability coverage for eligible small to medium size businesses. The policy may be written for: Apartments; Eligible Mercantile Risks; Restaurants; and Condominiums; Eligible Service Risks; Self-Storage Facilities Convenience Stores; Offices; Two policy forms, Businessowners Coverage Form NS-0003 (Special Perils) and the Named Perils Form BP 10 09 are available. Each form provides both mandatory and optional coverages. Liability coverage is mandatory and is provided by Businessowners Coverage Form NS-0003 for both Special Perils Coverage and Named Perils Coverage. The package rate includes all the mandatory coverages; optional coverages may be added for additional charges. Use our simplified rating program, found on our Website at www.northstarmutual.com, to provide accurate quotes for your customers. UNDERWRITING GUIDELINES Because of broad coverages and competitive premiums, the policy must be limited to risks that are superior in their class. In addition, they should be well managed and the applicant should be of proven moral and financial standing. Insurable risks that do not meet the eligibility requirements of the BP may still be written on our Multiline plan with a competitive premium. INSURANCE TO VALUE All buildings, including garages and storage buildings, business personal property and fixtures, machinery and equipment constituting a permanent part of the building and pertaining to the service of the building, should be insured at 100% of insurable value, whether coverage is written subject to replacement cost valuation or actual cash value (ACV). The limit of insurance for all insured property must be the replacement cost of the property. However, there is an option to write building coverage on an ACV basis. Loss payment provisions require the limit of insurance to equal 80% (or more) of the full replacement cost of the property immediately before the loss, in order for replacement cost loss settlement to apply. To determine insurable value of buildings, use a reliable cost guide, professional appraisal or actual construction figures. Building coverage includes: completed additions; fixtures, including outdoor fixtures; exterior/interior glass; permanently installed machinery and equipment; insureds personal property in apartments furnished by him/her as landlord; and fire extinguishing equipment, outdoor furniture, floor coverings and appliances used for refrigerating, ventilating, cooking, dishwashing or laundering if owned by the insured and used to maintain or service the building. Each building insured must be listed on the Declarations with a coverage amount - this includes garages, storage buildings and other appurtenant structures on the premises. Business Personal Property values should be based on actual invoice or inventory figures. Business Personal Property includes: computers, furniture, machinery and equipment not permanently installed; property of others in the insureds care, custody or control (amount insured legally liable for) (on an ACV basis only); tenant s improvements and betterments; leased personal property for which the insured has a contractual responsibility to insure; and exterior building glass for glass in the tenant s care, custody or control. APPLICATIONS North Star Mutual uses its own Business Protector (BP) application. Applications must be completed in their entirety. Backdating of an application is not permissible. Recent photos are required with application. QUOTATIONS - ONLINE RATING PROGRAM North Star Mutual uses an online rating program so the agent can quote risks under the Business Protector Program. The program is located on the North Star Mutual Website at www.northstarmutual.com. If the agent has a question, does not have access to the Internet or wants us to provide a quote, he/she may call our Commercial Department. We have excellent turnaround time on our quotes and, if necessary, can normally call the agent back with a quote within 24 hours. Online quotes are subject to underwriting approval. LINE LIMITS Refer to COMMERCIAL PROPERTY FIRE LINE GUIDE AND PROHIBITED LIST of the Commercial Lines General Information Section of this manual for line limits as they apply to different types of businesses. ELIGIBILITY 1. Specific Underwriting Guidelines are as follows: a. Building must be of superior construction and maintenance must be excellent. Exceptions may be made for buildings over 40 years old that have been extensively updated, subject to Company approval. The wiring, heating, plumbing and roof must have been completely updated and in good working condition. b. Only the occupancies listed on our ELIGIBLE CLASSIFICATIONS page may be covered. c. Unoccupied buildings, vacant buildings, property under construction or buildings not in good repair are not eligible. d. Apartment buildings must not be converted dwellings. e. Commercial buildings are not eligible for coverage if they have wood burning equipment. f. It is not permissible to split a risk between two businessowner type forms. Either the Businessowners Coverage Form NS-0003 (Special Perils) or the Named Perils BP 10 09 attached to NS-0003 must apply. g. When under one ownership, building and business personal property must be included in the same policy. h. A fully completed and signed Business Protector application must be submitted, together with a recent photo of the business. Include previous carrier information and past loss history. Backdating of an application is not permissible. 2. Requirements that apply to each of the following general classifications eligible for the Business Protector policy are: a. Apartments and Residential Condominium Associations 1) Building may not exceed 4 stories in height, nor contain more than 16 dwelling units. 2) The following incidental occupancies are permitted: a) Offices; b) Eligible mercantile, service or processing occupancies which in total do not exceed 25,000 square feet. b. Offices (Including Office And Commercial Condominium Associations) 1) Office buildings may not exceed 6 stories in height or 25,000 square feet in total area. 2) The following incidental occupancies are permitted: a) Apartments; b) Eligible mercantile, service or processing occupancies which in total do not exceed 25,000 square feet. c. Mercantile 1) Mercantile buildings may not exceed 25,000 square feet in total floor area. 2) Second hand stores, auction houses, antique stores or wholesale stores are not eligible. 3) Risks in which more than 25% of the total gross income is derived from any of the following activities are not eligible: Manufacturing Installation Repair Contracting Minnesota New Business 06-01-14 North Star Mutual Ins. ELIGIBILITY (Continued) d. Motels Motels must be under 40 years old and not have any bar, cocktail lounge or swimming pool exposure. At least a $500 deductible is required. e. Service and Processing Risks 1) Certain Service and Processing Risks are eligible for the Business Protector Policy. Refer to the ELIGIBLE CLASSIFICATIONS. 2) Service and Processing buildings may not exceed 25,000 square feet in total floor area. 3) Risks in which more than 25% of the total gross sales are derived from off-premises operations are not eligible. f. Convenience Food Stores, Grocery Stores and Supermarkets (With or without gasoline sales) 1) A minimum of 3,000 square feet in total floor area, when the convenience store, grocery store or supermarket provides for the sale of gasoline. 2) No automobile service or repair operations. 3) No 24-hour operations. g. Restaurants (Limited Cooking, Fast Food, Casual Dining, Fine Dining) 1) No more than 7,500 square feet in total floor area. 2) Seating capacity no greater than 75 for Limited Cooking Restaurants and 150 for all others. 3) No seasonal operations (risks that are closed for more than 30 consecutive days). 4) Restaurants with grills or fryers must have installation and maintenance of an automatic extinguishing system for cooking equipment equivalent to that which is recommended by NFPA Standard #96. h. Buildings Under Construction or Renovation Buildings under construction or renovation that will meet eligibility requirements for the Business Protector Program, when complete, may be written. (Must meet eligibility as to type of risk and line guide limits.) Coverage must be written at 100% of what the replacement cost is estimated to be when the building is completed. Construction or renovation must be continuous and timely to assure completion. Losses occurring during construction or renovation will be adjusted on the same proportion that the degree of completion bears to the total amount of insurance on the building. A flat charge is applied to cover the builders risk exposure. Theft of materials, supplies, equipment and temporary structures used for new construction or for making additions, alterations or repairs to the building can be covered if a premium and coverage limit are indicated on the appropriate endorsement or on the Declarations. i. Directors & Officers Liability (Residential Associations) This coverage is subject to the following underwriting guidelines: 1) No losses in the past three years. 2) No restrictions regarding the sale of a unit by a unit owner. 3) The developer(s) or contractor(s) cannot be a director or officer. 4) The developer(s) or contractor(s) may not own any units, except for an individual unit where he/she resides. 5) All directors and officers must be unit owners. 6) Commercial operations are not permitted in units. 7) No more than 10% of the units may be rented or available under a time share program. 8) Management must be successful and experienced. 9) Retroactive date will be the same as the original coverage inception date unless there is an interruption in coverage. j. Liquor Liability Liquor Liability Coverage may be available for the following classes of business: (Restaurants with alcohol sales >40% will be ineligible for coverage) 1) Restaurants 2) Fine Dining 3) Grocery Stores 4) Liquor Stores 5) Convenience Stores 6) Distributors Please contact the Commercial Underwriting Department for complete underwriting guidelines. INELIGIBLE RISKS Following is a list of ineligible risks: 1. Automobile repair or service stations; automobile, motor home, mobile home and motorcycle dealers; parking lots or garages, unless incidental to an otherwise eligible class. 2. Bars, pubs. 3. Contractors. 4. Buildings occupied in whole or in part for manufacturing or processing (except those processing risks shown under ELIGIBLE CLASSIFICATIONS). 5. Insureds whose business operation involves one or more locations which are used for manufacturing, processing or servicing (except those service risks shown under ELIGIBLE CLASSIFICATIONS). 6. Banks, building and loan associations, savings and loan associations, credit unions, stock brokers and similar financial institutions. 7. Accounts dealing in used, second hand or antique merchandise. 8. Architect and/or engineering firms, or land surveyors. 9. Places of amusement. 10. Wholesalers. 11. One or two family dwellings. 12. Condominium associations other than office, commercial or residential condominiums. 13. Tobacco products stores. BILLING PROCEDURES See the Billing Information section of this Agent s Manual. POLICY TERM The Business Protector (BP) is written for a term of 1 year. The policy will be automatically renewed each year with an updated Declarations page. Policyholders will initially receive copies of all policy forms. Upon renewal they will receive only an updated Declarations and forms that are new or revised. Policyholders may receive all policy forms upon request. The policy will be subject to the premiums, rules and forms in effect at the time of renewal. EQUIPMENT BREAKDOWN Coverage is provided by Businessowners Coverage Form NS-0003 (Special Perils Only) for breakdown to covered equipment. Covered equipment includes: equipment designed and built to operate under internal pressure or vacuum other than weight of contents; communication and computer equipment; fiber optic cable; and any other electrical or mechanical equipment used in the generation, transmission or utilization of energy. ACTUAL CASH VALUE - BUILDINGS In those situations where the risk is eligible for the Business Protector (BP) but does not meet the replacement cost provisions, actual cash value may be used for an additional premium. Actual cash value may be used for buildings only. MINIMUM PREMIUMS 1. The minimum premium for all coverages, except Employment Practices Liability, Cyber Liability and Liquor Liability applies per policy as follows: SPECIAL PERILS FORM $400 NAMED PERILS FORM $375 2. The minimum premium per policy for Employment Practices Liability coverage is $50. 3. The minimum premium per policy for Cyber Liability coverage is $20. 4. The minimum premium per policy for basic Liquor Liability coverage applies as follows: On-premises Liquor Exposure $400 for Non-VFW/Eagles risks; or $750 for VFW/Eagles risks The minimum premium for Liquor Liability is subject to modification by the Liquor Liability Limits factor. Credits cannot reduce minimum premiums. INDIVIDUAL RISK PREMIUM MODIFICATION (IRPM) Premium credits or debits of up to 25% may be applied at the discretion of the Home Office. Standard Deductible A $500 base property deductible is contemplated for all causes of loss. The deductible applies to all Building and Business Personal Property Coverages, both mandatory and optional, including Glass Coverage and Employee Dishonesty. The deductible does not apply to Business Income, Extra Expense, Civil Authority, Fire Extinguisher System Recharge Expense and Fire Department Service Charge. Deductibles apply per location. 2. Optional Flat Dollar Deductibles a. All Causes Of Loss Deductible amounts of $1,000, $2,500, $5,000, $10,000, $25,000 and $50,000 are available and must be indicated on the Declarations. These optional deductibles do not apply to the following coverages (a $500 Deductible applies to these coverages): 1) Burglary and Robbery (this coverage in Named Perils Form only) 2) Employee Dishonesty (Optional Coverage) 3) Outdoor Signs (Optional Coverage) 4) Money and Securities (this coverage in Special Perils Form only) 5) Forgery and Alteration b. Windstorm Or Hail When the deductible for all causes of loss is $1,000 or greater, an option to provide a separate higher deductible for Windstorm or Hail causes of loss is available in the amounts of $2,500, $5,000, $10,000, $25,000 and $50,000. c. RATING RULES 1. Rates and premiums are for an annual period. 2. The amount of insurance must be equal to the full Replacement Cost Value of the property to be insured, unless the Actual Cash Value - Buildings Option applies. Actual Cash Value may be used for buildings only and must show on the Declarations. 3. Combined office and apartment properties with 15% or less of the total floor area used for office occupancy will be rated as apartments; if more than 15% of the total floor area is occupied as an office, the risk will be rated as an office. 4. If apartment or office buildings contain eligible restaurant occupancies, rate property as a restaurant. If apartment or office buildings contain eligible occupancies other than restaurants, the rate of the occupancy (other than the apartment or office) with the largest total floor area applies. (If no single occupancy has the largest floor area, use the highest rates.) 5. If buildings (other than apartment or office) contain multiple eligible occupancies, the rate of the occupancy with the largest total floor area applies. (If no such occupancy has the largest total floor area, use the highest rate). 6. Occupant vs. Lessor a. A Lessor is not a building tenant. A Lessor is a building owner who leases the building to tenants and: 1) Does not occupy the building; or 2) Occupies 10% or less of the building. b. An Occupant is: 1) The building owner that occupies all of the building; or 2) The building owner that occupies more than 10% of the building; or 3) A tenant of the building. 7. When coverage is written for retail drug stores, an additional charge for Limited Pharmacists Liability must be made. RISK CLASSIFICATIONS 1. Select amount of insurance - policy is on a replacement cost basis. If building coverage is written on Actual Cash Value basis, it must be shown on the Declarations. Contents are on a Replacement Cost basis only. 2. The Class Lookup on the Occupancy tab of the online rating program provides a list of all eligible classifications with descriptions and rating codes. 3. Select the construction of the building according to the following types: a. Frame or Brick Veneer. Exterior walls are constructed primarily of wood or other combustible materials including construction where combustible materials are combined with other materials (such as brick veneer, stone veneer, wood ironclad, stucco on wood). If mixed construction and more than 1/3 of the total wall area is of combustible materials, classify as frame. b. Joisted Masonry. Exterior walls are constructed of masonry materials such as adobe, brick, concrete, gypsum block, hollow concrete block, stone, tile or similar materials where the floors and roof are combustible (disregarding floors resting directly on the ground). If mixed construction and 2/3 or more of the total wall area is of masonry or fire resistive material and more than 1/3 of total floor and roof area is of combustible materials, classify as joisted masonry. c. Non-Combustible. Exterior walls, floors and roof are constructed of and supported by metal, asbestos, gypsum or other non-combustible materials. If mixed construction and 2/3 or more of the total wall area and 2/3 or more of the floor and roof area are of non-combustible materials, classify as non-combustible. d. Masonry Non-Combustible, Modified Fire Resistive or Fire Resistive or if in doubt about the construction classification, call the Home Office. 4.
