Infinite Peripherals, Inc. IPC Care Plan Proposal and Agreement Offer Date Customer Covered Product (Part No.) Term (Years) Price Infinite Peripherals, Inc. ( IPC ) provides a standard warranty on all of its products (the Standard Warranty ). A copy of the Standard Warranty is attached hereto as Exhibit A. This IPC Care Plan Proposal and Agreement (this Agreement ) offers to the above identified customer (the Customer ) a care plan with broader coverage than the Standard Warranty (the IPC Care Plan ). A copy of the terms of the IPC Care Plan is attached hereto as Exhibit B. A summary and comparison of the coverages of the Standard Warranty and the IPC Care Plan are included in this Agreement. Customer has the option of extending the above Standard Warranty to the IPC Care Plan for a period of two (2) or three (3) years, beginning on the date that is the later of the date of execution of this Agreement or the date the Covered Product(s) and specific part number(s) identified above (the Covered Product ) are shipped. The IPC Care Plan will cover only the Covered Product on the terms described in this Agreement and Exhibits. The offer contained in this Agreement is valid for a period of up to 30 days following purchase of a Covered Product. In order to be valid, the IPC Care Plan must be purchased at the same time as the Covered Product. Once purchased, the IPC Care Plan coverage may not be canceled. Damaged scan engine window EXHIBIT A Standard Warranty For one (1) year after shipment of the product to Buyer, IPC warrants the Covered Product against defects in materials and workmanship provided the product has been operated and maintained in accordance with manufacturer's operating and maintenance specifications. This warranty specifically excludes any third party accessories and any ribbons, paper, and other consumable items. THIS WARRANTY IS IN LIEU OF ANY AND ALL OTHER WARRANTIES- EXPRESSED OR IMPLIED. IPC MAKES NO OTHER WARRANTY AND BUYER SPECIFICALLY WAIVES ANY OTHER WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. THERE ARE NO WARRANTIES THAT EXTEND BEYOND THOSE DESCRIBED HEREIN. IPC's liability hereunder is limited to the repair or replacement of defective parts. This liability does not extend to normal wear and tear. IPC will, solely at its options, remedy all valid warranty claims either by: (a) Repairing or replacing the defective unit at IPC's facility; or (b) Repairing or replacing the defective subassembly at IPC's facility. If so directed by IPC, Buyer shall return the defective unit or subassembly, transportation prepaid by Buyer, to IPC's facility. After repair or replacements has been accomplished, IPC will return the unit or subassembly, transportation prepaid, by IPC, to Buyer. As a precondition to any warranty service, prior to return of any units or subassemblies to IPC by Buyer, Buyer must contact IPC's Order Administration Services and receive authorization in the form of a Return Material Authorization (RMA) number. IPC reserves the right to refuse any goods it has not previously authorized for return, or any goods shipped without transportation prepaid. NO WARRANTY SHALL APPLY TO ANY DAMAGE RESULTING FROM OR CAUSED BY BUYER, IF BUYER SHALL MAKE ANY CHANGES, MODIFICATIONS, ADDITIONS OR DELETIONS OF HARDWARE, SOFTWARE, OR FIRMWARE IN THE PRINTER PRODUCTS SOLD HEREUNDER WITHOUT IPC'S ADVANCE WRITTEN CONSENT. EXHIBIT B IPC Care Plan Terms and Conditions For a period of two (2) or three (3) years beginning on the date of shipment of the Covered Products, as defined in this Agreement, IPC warrants the Covered Products against defects in materials and workmanship provided the product has been operated and maintained in accordance with manufacturer s operating and maintenance specifications. This IPC Care Plan includes: Out of box failure/doa (Dead on Arrival); Damaged components and/or parts; Scan engine or defect; Magnetic stripe reader or defect; Charging or battery or defect; Battery status LED or defect; Main PCB or defect; Cosmetic to outer cover/enclosure; Damaged removable top cover; Damaged USB port; Damaged Lightning connector; Damaged scan engine window; and The IPC Care Plan does not include: Accessories including lightweight/rugged cases, pistol grips, dome handles and straps, etc; Missing components; Any Damage/failure due to customer abuse/misuse such as severe impact, immersion in water, total destruction of device, etc.; Installation, removal or disposal of the Covered Product, or installation, removal, repair, or maintenance of non-covered Product (including accessories, attachments, or other devices); Damage to the Covered Product caused by accident, abuse, neglect, misuse (including faulty installation, repair or maintenance by anyone other than IPC or an IPC Authorized Service Provider), unauthorized modification, extreme environment (including extreme temperature or humidity), extreme physical or electrical stress or interference, fluctuation or surges of electrical power, lightning, static electricity, fire, or other external causes; Covered Product with a serial number that has been altered, defaced or removed; Problems caused by a device that is not the Covered Product, including equipment that is not IPC-branded, whether or not purchased at the same time as the Covered Product; Service necessary to comply with the regulations of any government body or agency arising after the date of this Plan; Problems caused by the function of a network or cellular service or viruses or other software problems introduced into the Covered Product; INFINITE 4 IPC Care Plan
Covered Product that has been lost or stolen. This IPC Care Plan only covers Covered Product that is returned to IPC in its entirety; Cosmetic to the Covered Product including but not limited to scratches, dents and broken plastic on ports; Preventative maintenance on the Covered Product; The provision of replacement equipment during the period when the Covered Product is being serviced; Defects caused by normal wear and tear or otherwise due to normal aging of the Covered Product; Protective coatings designed to diminish over time unless failure has occurred due to a defect in materials or workmanship, and/or; Except as specifically provided herein, any other s that do not arise from defects in materials and workmanship or ordinary and customary usage of the Covered Product.
