Sir/Madam, Sealed bids are invited for deputing manpower in Railway Board for manning the servers, related hardware and managing the oracle database & application server. 1. SCOPE OF WORK 1.1. Manning the Server Room in Vigilance Directorate, Railway Board having one unit each of the following infrastructure: IBM - POWER 7 PS720 (with AIX Operating System) along with HMC Console IBM - XEON SERVER x3650 M3 (having Enterprise Read hat Linux Operating System) IBM - SYSTEM STORAGE DS3400 EXPRESS IBM KVM SWITCH CISCO 3560 Layer 3 switch CISCO 2911 Router CYBEROAM CR200i IBM SYSTEM STORAGE 7214-1 U2, LTO ULTRIUM 4 TAPE DRIVE 6KVA UPS ORACLE Database 11g installed on POWER 7 PS720 Server JBOSS application server installed on XEON SERVER x3650 M3 All the Hardware, Operating systems, Oracle database and JBOSS application server is under 3 years warranty. 1.2. Responsibilities of the deputed person(s) : Operate the said Hardware and manage the System Software, Oracle Database and Application Server. In case of a failure in hardware/ system software liaise with respective OEM for speedy rectification of the fault. Page 2 of 8
Should maintain regular backup of Operating System, System Software, Application Software and Oracle Database The person(s) deputed must have minimum 3 years of experience in handling similar works. The detailed bio-data of the person(s) deputed along with experience certificates for similar work must be submitted along with the bid. Bids without the bio-data and relevant experience certificate will be rejected. 1.3. Initially the manpower requirement is for a period of 6 months. It can be further extended for another 6 months provided the performance of the person(s) deputed remains satisfactory. 1.4. The working hours will be 9:00 A.M to 6:30 P.M, Monday to Saturday. 2. PAYMENT TERMS 2.1 No advance payments are permitted. 2.2 Payment will be made on quarterly basis, at the end of each quarter of service completed to the satisfaction of Railway Board. RITES will make payment to the vendor on receipt of the same from Railway Board i.e Back to Back basis. At the end of each quarter of the services completed the vendor will raise the bill to RITES, which will be submitted to EDVA, Ministry of Railways, Railway Board for approval. On receipt of payment from Railway Board against the said bill the same will be paid to the vendor. 3. PENALTY 3.1 Vendor must make an alternate arrangement to depute a person in case the nominated manpower is unable to report for duty on a specific day otherwise penalty @ 0.5% per day will be deducted from the bill for each day of absence of vendor s person from the duties subject to maximum 3% of monthly billing for that month beyond which RITES reserves the right to terminate the contract and make an alternate arrangement for providing the services to Railway Board at the risk & cost of the existing vendor along with action stated vide clause no. 4.7(d)(3)(ii). 4. OTHER TERMS AND CONDITIONS 4.1 Price Quotation Page 3 of 8
(a) (b) All prices should be clearly written both in figures and words. Failure to write rates both in words and figures shall render the tender liable for rejection. Tenderers in their own interest should avoid alterations/corrections in the rates, submitted by them. However, if alterations or corrections in rates are inescapable each such alteration, correction should be indicated both in figures and words and also duly attested under the full signature of the Tenderer. The prices quoted shall be firm throughout the period of the validity of the offer and subsequently during the currency of the contract and shall not be subject to any variation. (c) The format for quoting the offered Rates under this contract is at para 6 of this tender. Tenderer can depute one person or more than one person for the job. However the charges quoted per month for the manpower deputed should be the consolidated value, irrespective of number of persons deputed. The Tenderers shall use this format only for the purpose without any deviation. In case they wish to give any additional information on their offered rates they may give it on additional sheets. M/S RITES reserves the right to summarily reject the offers of the Tenderers which are not submitted in the prescribed format. 4.2 The Tenderer shall submit their bids in a single sealed cover super scribed with Tender No. and Due Date. The cover thus prepared should also indicate clearly the name and address of the Tenderer to enable the Bid to be returned unopened in case it is declared Late. 4.3 The bids shall be typed and shall be signed by the Tenderer or a person or persons duly authorized to bind the Tenderer to the contract. All pages of the bid shall be initialed by the person or persons signing the bid. 4.4 If the outer cover of the bid is not sealed and marked, M/s RITES will assume no responsibility for the bid s misplacement or premature opening. 4.5 Amendment of Bid Documents (a) At any time prior to the last date for receipt of bids, M/s RITES may, for any reason, whether at his own initiative or in response to a clarification requested by a prospective tenderer, modify the tender documents by amendment. (b) The amendment will be notified in writing or by e-mail to all prospective tenderers and will be binding on them. Page 4 of 8
(c) In order to afford prospective tenderer reasonable time, in which to take the amendment into account in preparing their bid, M/s RITES may, at its discretion, extend the last date for the submission. 4.6 Language of Bids - The bids prepared by the tenderers and all correspondence and documents relating to the bids exchanged by the Tenderer and M/s RITES, shall be written in the English language. 4.7 Earnest Money Deposit (EMD) (a) (b) (c) (d) All bids must be accompanied by an Earnest Money Deposit (EMD) for an amount of Rs. 11,000/- (Rupees Eleven Thousand only). The EMD should be in the form of Demand Draft favoring RITES Ltd. Payable at Gurgaon for a like amount and valid for at least 30 days beyond the validity of the bid; Unsuccessful Tenderer's EMD will be discharged/returned as promptly as possible, but not later than 30 days after the expiration of the period of bid validity prescribed. The successful Tenderer's EMD will be discharged after the Tenderer had successfully completed the services for six months. The EMD will be forfeited: 1. If a Tenderer withdraws his bid during the period of bid validity specified by the Tenderer on the Bid Form; or 2. If at any stage, any of the information/declarations made by the Tenderer are found incorrect; or 3. In case of a successful Tenderer, if the Tenderer fails: (i) to sign the Contract (ii) to provide the services successfully for six months from the date of the acceptance of the purchase order 4.8 Revelation of Prices - Prices in any form before opening of bid should not be revealed, failing which the offer shall be liable to be rejected. If price change is envisaged due to any clarification, revised Commercial Bid in a separate sealed cover shall be accepted with prior written permission of M/s RITES. Such sealed covers should be super scribed REVISED COMMERCIAL BID. 4.9 Last date for receipt of Bids and Opening of Bids by RITES Ltd (a) The sealed bids must be delivered to the following address on/or before 1430 hrs. (IST) on 11/09/2012. The Bids will be opened at 1500 hrs. (IST) on the same day i.e 11/09/2012 at the address given below, in the presence of the tenderers or their authorized representatives who choose to attend the same: Page 5 of 8

In the event of the specified date for the submission of bids, being declared a holiday for M/s RITES, the bids will be received upto and opened on the appointed time on the next working day. Multiple bids from the same Tenderer will not be entertained. Each Tenderer can make only one bid and in case it is observed that a Tenderer has made multiple bids from the same company or firm, the Tenderer will be disqualified and none of the bids submitted by him will be considered. 4.10 Clarifications - When deemed necessary, M/s RITES may seek clarifications on any aspect from the Tenderer. However, that would not entitle the Tenderer to change or cause any change in the substance of the tender submitted or price quoted. 4.11 A Bid determined as not substantially responsive will be rejected by M/s RITES and cannot subsequently be made responsive by the Tenderer by correction of the non-conformity. M/s RITES may waive any minor informality or non-conformity or irregularity in a bid which does not constitute a material deviation, provided such waiver does not prejudice or affect the relative ranking of any Tenderer. 4.12 Preliminary Examination and Evaluation of Bids. (a) M/s RITES will examine the bids to determine that they are complete, all the documents have been properly signed, the detailed bio-data along with experience certificates of the person(s) proposed is attached and that the person(s) has minimum 3 years of experience in handling similar works and no computation errors have been made in the bid. (b) Arithmetical errors will be rectified on the following basis. If there is a discrepancy between the unit price and the total price that is obtained by multiplying the unit price and quantity, the unit price shall prevail and the total price shall be corrected. If the Tenderer does not accept the correction of errors, his bid will be rejected. If there is a discrepancy between words and figures, the amount in words will prevail. 4.13 Award Criteria Bids will be evaluated based on the total charges quoted per month for the manpower proposed, irrespective of number of persons being deputed (column [D] para 5). Subject to Para 4.12 above, M/s RITES Page 6 of 8
reserves the right to interview the person(s) proposed by L1 bidder to satisfy itself about the credibility of the person(s) proposed for the job and may reject the proposed person(s) if not found suitable, without giving any further reasons for rejection. M/s RITES will then award the Contract to the successful Tenderer whose bid has been determined to be lowest. M/s RITES shall however not bind itself to accept the lowest or any bid and reserves the right to accept any bid. 4.14 M/s RITES right to vary quantities at time of award - M/s RITES reserves the right at time of contract award to increase or decrease the time period of services 4.15 M/s RITES right to accept any bid and to reject any or all bids - M/s RITES reserves the right to accept any bid, and to annul the Tender process and reject all bids at any time prior to the Award of Contract, without thereby incurring any liability to the affected Tenderer or Tenderers or any obligation to inform affected Tenderer or Tenderers of the grounds for M/s RITES action. 4.16 Notification of Award and Signing of the Contract. (a) Prior to the expiration of the period of bid validity, M/s RITES will notify the successful Tenderer in writing by registered letter/e-mail that its bid has been accepted. (b) The Notification of Award will constitute the formation of the Contract. (c) Within 7 days of receipt of the Purchase Order (in duplicate), the successful Tenderer shall sign and date it and return the original signed & stamped copy to M/s RITES, that will form a binding contract between the two parties. Simultaneously the vendor will post the nominated person(s) in the Railway Board within 7 working days from the date of the Purchase order. Failure to comply with the above conditions may result in cancellation of the said purchase order. 4.17 Validity of the offer - The vendor should indicate the period for which their offer is valid. In any case the validity of offer cannot be less than 90 days from the date of opening the tender. Page 7 of 8
