In this Schedule any word or expression to which a meaning has been assigned in the Act shall have that meaning and unless the context otherwise indicates - "contract ginning" means seed cotton ginned by a ginner on behalf of another party without the ownership of the cotton passing over to the ginner; "cotton" means cotton lint and seed cotton derived from the ball of the cotton plant (Gossypium hirsutum); "cotton lint" means the fibre derived from the seed cotton after the seed cotton has been ginned; "Cotton South Africa" means Cotton SA NPC a non-profit company registered in terms of the Companies Act, which operates under the name Cotton South Africa; "ginner" means any person who gins seed cotton; "gin" in relation to seed cotton, means to separate the seed and fibre in seed cotton and ginning has a corresponding meaning; "seed cotton" means the lint and seed derived from the ball of the cotton plant (Gossypium hirsutum), before it has been ginned; "the Act" means the Marketing of Agricultural Products Act, 1996 (Act No. 47 of 1996). Purpose and aims of statutory measure and the relation thereof to objectives of the Act 2. The purpose and aims of this statutory measure are to compel the following parties to keep records and furnish returns to Cotton South Africa: Persons who are parties to the purchase of seed cotton from producers; those persons who process seed cotton; persons who import or export cotton; and those persons who are parties to the purchase of cotton lint from producers or ginners. This is deemed necessary to ensure that continuous, timeous and accurate market information relating to cotton is made available for all role-players. Information gathered by Cotton South Africa from the records and returns will be freely distributed to the market place. Market information is deemed essential for all role-players in a deregulated market, in order for them to be able to make informed decisions. By the compulsory furnishing of monthly returns on an individual basis, market information for the whole of the country can be processed and disseminated to the market place. The established of this statutory measure will not only enhance market access for all market participants but should also promote the efficiency of the marketing of cotton. Furthermore, proper market information will enhance the viability of the cotton industry and the agricultural sector at large. The measure will not be detrimental to the number of employment opportunities within the economy or fair labour practice. This statutory measure will be administered by Cotton South Africa, a company incorporated under section 21 of the Companies Act, 1973 (Act No.61 of 1973). Cotton South Africa is appointed to implement, administer and enforce the intervention set out in the Schedule. It is envisaged that Cotton South Africa will make available macro generic market information to the cotton industry and other interested parties on a monthly basis. This information will be obtained from the returns rendered to Cotton South Africa and will be supplied on a national basis. The information will furthermore be made available in a manner suitable to reach the majority of the role-players in the cotton industry.

This statutory measure shall apply within the geographical area of the Republic of South Africa. Records and returns to be kept and submitted by exporters, importers, processors, and purchasers of cotton 5. (1) The following parties shall keep records and furnish returns with regard to cotton in his or her possession or under his or her control: a) Persons who are parties to the purchase of seed cotton from producers; b) those persons who process seed cotton; c) persons who import or export cotton; and d) those persons who are parties to the purchase of cotton lint from producers or ginners. (2) Cotton South Africa shall make forms available to facilitate the process of submitting returns. (3) a) The return shall be submitted monthly, when forwarded by post to - Cotton South Africa P.O. (4) The return shall be submitted before or on the twentieth day of the month, following the month to which the records and returns relate, with the exception of the monthly crop return which have to reach Cotton South Africa not later than the end of the month to which the crop return relates. (5) The records and returns shall in the case of the ginners, contain information with regard to the following: a) The month concerned: b) The marketing year applicable; c) The name and address of the ginnery concerned; d) with regard to seed cotton purchased from RSA producers, the following information: (i) Cultivars; (ii) opening stock in kg; (iii) plus purchased stock during the month in kg; (iv) less ginned stock during the month in kg; (v) closing stock for the month in kg; and e) with regard to seed cotton received from RSA producers for contract ginning, the following information: (i) Cultivars;

STAATSKOERANT, 28 MAART 2014 No. 37461 9 (ii) opening stock in kg; (iii) plus stock received during the month in kg; (iv) less ginned stock during the month in kg; (v) closing stock for the month in kg; and f) with regard to seed cotton purchased from other persons or countries, the following information for the month concerned; (i) Person or country; (ii) opening stock in kg; (iii) plus purchased stock in kg; (iv) less ginned stock in kg; (v) closing stock in kg; and g) with regard to seed cotton received for contract ginning from other countries or persons other than RSA producers, the following information for the month concerned; (i) Person or country; (ii) opening stock in kg; (iii) plus received stock in kg; (iv) less ginned stock in kg; (v) closing stock in kg; and h) with regard to cotton lint produced from seed cotton purchased by the gin, the following information for the month concerned: (i) Opening stock in kg; (ii) plus stock produced; (iii) less sales in kg; (iv) closing stock in kg; i) with regard to cotton lint produced from seed cotton received for contract ginning, the following information for the month concerned: (i) Opening stock in kg; (ii) plus stock produced; (iii) less stock delivered in kg; (iv) closing stock in kg. (6) A monthly crop return shall be submitted by the ginners which reflect the following information per production area and country, in respect of seed cotton that the gin expects to purchase and/or expects to contract gin: a) the month concerned; b) production year concerned; c) name and address of the ginnery concerned; d) date on which report is submitted; e) area under which crop is planted; f) hectares under irrigation or dryland; g) estimated yield in kg seed cotton per hectare with regard to areas under irrigation or dryland; h) estimated crop in 200 kg lint bales; i) percentage handpicked; and j) percentage of crop ginned up to date. (7) A monthly return shall be submitted by spinners which reflect the following information: a) the month concerned; b) the marketing year concerned c) name and address of spinner concerned; d) with regard to cotton lint purchased, the following information for the month concerned: 400898 B

Commencement and period of validity 6. This statutory measure shall come into operation on 1 April 2014 and shall lapse on 31 March 2018.

(2)An application for registration in terms of subclause (1) shall be made within 30 days from the date of commencement of this statutory measure and, in case of a person becoming a party in terms of subclause (1) after such date of commencement, within 30 days of becoming a party in terms of subclause (1). (3)The parties in terms of subclause (1) shall within 30 days of ceasing to be a party in terms of subclause (1) notifies Cotton South Africa in writing thereof whereupon his or her registration shall be cancelled. The purpose and aims of this statutory measure are to provide financial support for the following functions that the cotton industry has identified as essential and in the interest of the industry as a whole: (a) Rendering of information services to all role-players; (b) the promotion of cotton production and the demand; (c) the co-ordination of research; (d) the maintenance of quality standards and norms and the provision of training; and (e) the facilitation of the development of the emerging cotton production sector. The maintenance of macro industry information is regarded as critical for strategic planning by the cotton industry. Proper and accurate market information that is available on a continuous and timeous manner, will not only increase market access for all market participants, but will also promote the efficiency of the marketing of cotton. The promotion of the production of cotton can make a significant contribution towards the level of household food security in South Africa, particularly in the more arid regions of the country where other summer crops have regularly failed. It is furthermore important that perceptions be changed in terms of crops more suited to those areas to feature more strongly. Research is essential for the furtherance of the primary cotton industry's competitive position, taking into account the extremely competitive marketing environment in which cotton compete and the steady decline in the cotton fibre market over the past few years. Research is also important for cotton cultivation by commercial and small-scale farmers. Studies in connection with cultivar characteristics such as yield tendencies, adaptability and yield stability, make it possible for the cotton producer to make meaningful cultivar choices for specific conditions. Quality standards, grading and classification as well as independent arbitration services for quality disputes have to be maintained in order to promote the efficiency of cotton marketing per se. This function is deemed a basic precondition for the orderly marketing of cotton. Therefore,

A portion of the funds collected by means of this levy will also be focused on small-scale farmers and the developing cotton industry. The established of this statutory measure will not only assist in enhancing market access for all market participants but will also enhance the viability of the cotton industry. The establishment of this measure will in fact further all the objectives of the Act as stipulated in Section 2 thereof. This statutory measure shall be administered by Cotton South Africa. Product to which statutory measure applies 3. This statutory measure shall apply to cotton lint. Area in which statutory measure applies 4. This statutory measure shall apply within the geographical area of the Republic of South Africa. Imposition of levy 5. A levy is hereby imposed on all cotton lint, ginned by ginners from seed cotton. Amount of levy 6. The levy shall be as follows (VAT excluded): From 1 April 2014 to 31 March 2015: 22c/kg on cotton lint, From 1 April 2015 to 31 March 2016: 23.5c/kg on cotton lint, From 1 April 2016 to 31 March 2017: 25c/kg on cotton lint, and From 1 April 2017 to 31 March 2018: 26.5c/kg on cotton lint, Persons by whom and to whom levy is payable 7. The levy imposed in terms of clause 5 and 6 shall - (a) be payable by ginners; and (b) be payable to Cotton South Africa. Payment of levy 8. (1) Payment shall be made not later than the 20th day that follows the month during which the cotton lint on which the levy is payable, was produced. (2) Payment shall be made by means of an electronic funds transfer, cheque, postal order or money order made out in favour of Cotton South Africa. Part 2: General Application 1. This Notice shall apply to all temporary asphalt plants which are operating anywhere in the country. Implementation 2. Emission measurements 5. The concentration or mass of pollutant for which emissions standards have been set in this Notice shall be reported as the average of at least three (3) measurements; measured over a minimum sample period of 60 minutes, under normal operating conditions to obtain a representative sample. The manner in which measurements shall be carried out must be in accordance with the standard sampling and analysis methods listed in Annexure A to this Notice. 7. Methods other than those contained in Annexure A to this Notice may be used with the written consent of the National Air Quality Officer. 8. in seeking the written consent referred to paragraph 7 above, an applicant must provide the National Air Quality Officer with any information that supports the equivalence of the method other than those listed in Annexure A to this Notice. Reporting requirements 9. The operator of a temporary asphalt plant must- (1) submit at least one (1) emission report every six months to the relevant air quality officer in the format set out in Annexure A to this Notice; (2) provide any additional emission reports as requested by an air quality officer; and (3) produce the record of the measurement results for inspection if requested to do so by an air quality officer. 10. For reporting requirements, emissions shall be measured by stack emission measurement and may be supplemented by means of mass balances or engineering calculations.

DEFINITIONS OF TERMS 'Adult education and training centre' means a centre, either public or private, providing adult education and training as contemplated in the Adult Education and Training Act, 2000 (Act 52 of 2000) 'DHET entities' refers to those public entities listed in Part A (National Public Entities) of Schedule 3 for the Public Finance Management Act (PFMA) that report to the Minister of Higher Education and Training. These are Sector Education and Training Authorities (SETAs), Quality Councils (QCs), the South African Qualifications Authority (SAQA) and the National Student Financial Aid Scheme (NSFAS) 'Further education and training' means all learning and training programmes leading to qualifications above the general education but below higher education level as contemplated by the National Qualifications Framework, 2008 'HETIS' is the higher education and training information system including all processes, rules, standards, and responsibilities for information collection and management in the post-school sector 'HETIS officer' means an official charged with certain responsibilities regarding post-school education and training information in terms of this standard 'National data and statistics' means data and statistics used in the public domain that are sustainable but have not been designated as official by the Statistician-General as contemplated by the Statistics Act, 1999 (Act 6 of 1999) 'Post-school' refers to all education for people who have left school, as well as for those adults who have never been to school but require education opportunities

PREAMBLE 3.1 The Department of Higher Education and Training (DHET), in specifying the rules for the publication of post-school education and training statistics, aims to establish standards to ensure that the statistical reports produced provide relevant, timeous and accurate information that will assist in planning, decision-making, monitoring and evaluation at all levels. 4. PURPOSE 4.1 The purpose of this standard is to specify the rules for the publication of statistical reports on the post-school education and training sector in order to ensure the quality of such publications. This standard is supplementing Higher Education and Training Information Policy published in terms of government gazette no 36973 of November 2013. 5. SCOPE AND APPLICABILITY 5.1 This standard is applicable to statistical reports published by the DHET. 6. APPROVAL OF POST-SCHOOL EDUCATION AND TRAINING STATISTICS AND PUBLICATIONS 6.1 All post-school education and training statistical reports produced by the Department of Higher Education and Training should be approved by the Director- General. 7. COVER PAGE 7.1 The cover page of a statistical publication should display the DHET branding colours, namely green and gold and should include the logo of the relevant organisation. 7.2 The title of the report should reflect the year or the period over which the statistics are applicable. 7.3 The Copyright section should include: 7.3.1 Name of the department in full - Department of Higher Education and Training; 7.3.2 Contact details of the department -123 Francis Baard Street, Pretoria SA. The title should describe content information. 8.2 If a table or data in a table was obtained from a reference source, a source line that identifies the reference should be written below the table. 8.3 The units of measurement should be included in the table title. 8.4 If data is not available for a particular cell, a dash (-) should be used. 8.5 If information is not applicable for a particular cell, (n.a) should be used. 9. FIGURES 9.1 Figures should have informative titles that summarise the figure. All figures should be numbered. 9.2 Figure legends can be used to provide further explanation. 10. EXPLANATORY NOTES 10.1 This section contains information that supplements, clarifies and supports the content of the report and includes 10.1.1 scope of the surveys used to collect data; 10.1.2 statistical methods and techniques; 10.1.3 response rate; 10.1.4 target audience and anticipated users; 10.1.5 status of the statistics as being either preliminary or final; and 10.1.6 biases in the data. 11. GLOSSARY 11.1 Glossary entries should be in alphabetical order and aligned with the left margin. 12. LIST OF CONTACT DETAILS 12.1 The list indicates the complete mailing addresses of individuals responsible for education and training systems in the DHET.

ARCHIVING 15.1 The post-school education and training statistics publications should have an International Standard Book Number (ISBN) before publication. 15.2 All post-school education and training publications with ISBNs should be lodged with the relevant legal deposit libraries as prescribed by the Legal Deposit Act 54 of 1997. 15.3 An electronic version of all approved post-school education and training publications, and where applicable, hard copies should be lodged with the Information Resource Centre for the department's archives. 16. DISSEMINATION 16.1 Each publication of post-school education and training should have a dissemination plan, specifying: 16.1.1 the number of copies to be printed (if any) 16.1.2 the distribution channels to be used for the publication 16.1.3 the standard list of recipients who are required to receive copies of the publication; and 16.1.4 publications with ISBNs should be published on the internal and external websites of the DHET, public Universities, public Technical and Vocational Education and Training (WET) Colleges, Sector Education and Training Authority (SETA), and Provincial Education Departments. 17. RELEASE OF POST-SCHOOL EDUCATION AND TRAINING STATISTICS 17.1 All post-school education and training statistics should be published as soon as the data is audited and finalised. The Higher Education and Training Information System (HETIS) Officer will publish schedule of publication dates and times. 18. REVISION OF PUBLISHED POST-SCHOOL EDUCATION AND TRAINING STATISTICS 18.1 Revisions of published education and training statistics should follow a regular, well established and transparent schedule. 18.2 Changes in published education and training statistics should be brought about and publicised at the earliest possible date. 18.3 Adequate documentation of statistical revision, including the reasons for revision, should be included in the publication of the statistics.

The applicant for the proposed statutory measures is AMIE, an association founded in 1996, which was established due to a need by meat and poultry importers and exporters, for a mouthpiece to speak on their behalf and to look after the interests of its members. AMIE proposed a statutory levy of 2c/kg (excluding VAT) on imported chicken products. The proposed statutory levies will finance the following functions, namely - > Quality control & Consumer assurance; > Liaison, including consumer education; > Transformation in the industry; > Research and development; and > Administration

The maximum of 5% must be based on a guideline price calculated as the average price at the first point of sale over a period not exceeding three years. For the proposed statutory levies, the guideline price is determined as follows: Chicken products vary significantly in price, depending on the cut. The table below contains average prices per cut, at the first point of sale for the last three years. AMIE considers appointing Red Meat Levy Administrator (Pty) Ltd, the administrator of the red meat and pork statutory levies, to administer the proposed statutory levies. The compulsory registration of these importers will ensure that accurate information is obtained and will also assist in the collection of the proposed statutory levies on imported chicken products. The purpose of the statutory measure relating to records & returns is to compel importers of chicken products to render records and returns to the levy administrator. This is necessary to ensure that continuous, timeous and accurate information relating to imported chicken products is available to all role-players. Market information is deemed essential for all roleplayers in order for them to make informed decisions. The National Agricultural Marketing Council (NAMC) took cognisance that the proposed implementation of statutory measures relating to levies, registration, the keeping of records and the rendering of returns in the poultry industry as requested by AMIE, is consistent with

The application was lodged by the Graf Tech South Africa Pty Ltd, the only manufacturer of the subject product in the SACU. The Applicant alleged that the subject product was being dumped into the SACU market, causing material injury to the SACU industry. The investigation was initiated after the Commission considered that there was prima facie evidence to show that the subject product was imported at dumped prices, causing material injury and that there was a causal link between dumped imports and material injury. (2) Section 102(3) requires a manager, upon the winding up of a portfolio and under the control and supervision of the trustee or custodian, to realise all the assets of the portfolio (3) The exemption facilitates the process of the conversion of a scheme into a REIT by exempting a manager from the requirement to realise and distribute the assets of the scheme as required by section 102(3) of the Act. (4) The exemption is only applicable to a scheme which is to be converted into a REIT in accordance with the JSE Listings Requirements. (5) The registrar is satisfied that this Exemption is in the public interest. 3. The extent of the exemption (1) A manager of a scheme which is to be converted into a REIT is exempted from the provisions of section 102(3), (4) and (5) of the Act to the extent that the manager will not be required to realise the assets of the scheme by way of a conversion of the assets into cash. (2) Despite the provisions of section 102(3), a manager of a scheme will be permitted under the control and supervision of the trustee or custodian to dispose of the assets in another manner other than through the conversion of the assets to cash, having regard to the interests of investors. 4. Conditions of the exemption The following conditions apply to the exemption- (a) the manager must hold a meeting of all investors on giving 21 days
