BMHRC/Limited Tender/ES/Bio Medical Waste/2017-18/03 Director, BMHRC Bhopal, invites limited Tender (single bid) from the interested firms duly authorized from Madhya Pradesh Pollution Control Board (MPPCB) for collection, transport, treatment and disposal of Bio Medical Waste generated at BMHRC & its Health Centers at Bhopal. General Terms & Conditions BMHRC, Bhopal intends to out-source services related to the collection, transport, treatment and disposal of Bio-medical waste and thereby invites sealed tenders from firms having valid authorization from Madhya Pradesh Pollution Control Board (MPPCB) to operate in Bhopal district. This is for engaging eligible Bio Medical Waste Management Service Provider agency for a period of 2 years, from the date of Notification of award of work. SCOPE OF WORK. 1. The contractor should have valid authorization from Madhya Pradesh Pollution Control Board (MPPCB) authorities to carry out the handling, collection, storage, transport, treatment and disposal of Bio-medical waste in Bhopal, throughout the period of contract. 2. The selected firm (Contractor) shall be responsible for the handling, collection, transport and disposal of biomedical waste from BMHRC and its Health Centres located in city area Bhopal. It shall be the legal duty of the firm to ensure that biomedical waste is collected, transported and disposed in such a manner that they do not cause any adverse impact on human health or environment, as per the provisions of Bio-Medical Waste (Management & Handling) Rule 2016 (Rules). 3. All legal responsibility of Bio- Medical Waste shall be of the Contractor immediately after it being picked up from the storage rooms (Incinerator Department BMHRC) and Health Centres. 4. If any mishap happens during transportation all responsibility shall be that of the contractor. 5. Irrespective of shut down/ break down of the plant/ incinerator/ CTF of the Contractor, it will be the responsibility of the contractor to collect Bio-Medical Waste from all Bio- Medical Waste storage rooms (Incinerator department) of BMHRC and its Health Centres. 6. The contractor shall be responsible for any punitive legal action imposed by legal authorities arising out of non- lifting/ non- collection and non- disposal of Bio- Medical Waste form BMHRC Bhopal and its Health Centres located in city area of Bhopal. 7. In case of breakdown, if disposal is not done within 48 hrs (as per rules & regulations of Bio- Medical Waste Management & Handling) Rule 1998, all legal responsibility shall be that of the contractor. 8. Collection of Bio-Medical Waste will be undertaken daily. In case of default no payment shall be made for that particular day/ days. There would be an additional penalty amounting to 1% of the monthly payment if Bio- medical waste is not picked up from BMHRC and its Health Centres no. 1 to 8 of BMHRC Bhopal for duration of 48 hours and 2% of the monthly payment for every additional day of failure to pick up. 9. The firm shall transport the bio- medical waste in a dedicated covered vehicle to an authorized waste treatment facility centre as per Rules and time to time according to instructions issued from the MPPCB. 10. It would be the inescapable duty of the firm to ensure that the instrument and practices used for the treatment and disposal of the waste is duly comply with the standards prescribed in Bio- Medical Waste (Management & Handling) Rules, 2016. 11. The firm (Contractor) would be required to assist BMHRC Bhopal in filling annual reports and other reports/ records as mandated by the appropriate pollution control authorities from time to time. 12. The contact shall not be transferable to any one and the contractor shall be personally liable in respect of this arrangement. 13. The management of BMHRC shall have the right to withhold payment, terminate the contract or make the recovery from the agency in respect of any losses or damage caused or occasioned due to violation of statutory obligations or unsatisfactory performance. 14. It has been mutually agreed between the parties that all differences and disputes arising during the contract period regarding interpretation of the contract shall be solved by mutual discussion. In the event of difference or dispute remaining unsolved, the same shall be referred for arbitration to the Director of BMHRC and his decision shall be final and binding on all parties. 15. This contract shall be deemed to have been concluded at Bhopal for all purposes and therefore only courts of Bhopal shall be having jurisdiction for the purpose of any adjudication where some dispute/obligation remain unsolved despite arbitration. 16. Payment will be on monthly basis within one month from the date of submission of invoice by M/s agency after completion of work done during the calendar month duly certified by the certifying officer/authorized person of the BMHRC. 17. EMD : The agency willing to participate in tender may submit EMD of Rs.20,000/- in favor of Director BMHRC, issued from any Commercial Bank payble at Bhopal in the form of DD/FDR/ Bankers cheque and it is adjustable against performance guarantee. The EMD to be submitted alongwith the tender documents, tender would be rejected out rightly in case of non submission of EMD. 18. Performance Bank Guarantee : The selected agency have to submit performance bank guarantee of 10% of amount value in the form of DD/ FDR/ Bank Guarantee issued from any commercial bank valid for the period 90 days beyond the contract completion date. 19. FORCE MAJEURE: If at any time during the currency of the contract, either party is subject to force majeure, which can be termed as civil disturbance, riots, strikes, tempest, acts of God etc. which may prevent either party to discharge his obligation, the affected party shall promptly notify the other party about the happening of such an event. Neither party shall by reason of such event be entitled to terminate the contract in respect of such performance of their obligations. The obligations under the contract shall be resumed as soon as practicable after the event has come to an end or ceased to exist. If the performance of any obligation under the contract is prevented or delayed by reason of the event beyond a period mutually agreed to if any or seven days, whichever is more, either party may at its option terminate the contract. The interested firms are requested to submit the bids, furnishing the following information strictly in sequential order, by 19.05.2017 (till 2:00 PM) in the sealed envelope subscripting Limited Tender (single bid) for Providing Bio Medical Waste Management Services to BMHRC Bhopal. The Limited tender (single bid) envelop may be dropped in tender box kept at Admin. Block of BMHRC prior to closing time & date of tender submission.
