It is the responsibility of each bidder to be familiar with the laws and regulations regarding public school bids, including those within the Uniform Grant Guidelines (2CFR 200), and to read and be aware of the conditions for bidding. These specifications outline the general conditions for bidding. Some items may not be applicable to a specific bid. If you are uncertain whether an item applies, please contact Mr. William M. Bowling for clarification. 1. Advertisement: The Gettysburg Area School District will accept bids for General Supplies, Art Supplies, Science Supplies, Physical Education Supplies, Consumer Science Supplies (Home Economics), Tech Ed Supplies (Industrial Arts), Music Supplies, Athletic Supplies, and Vocational Education Supplies (Police Science, Culinary, Allied Health and Diesel Mechanics). Bids will be accepted electronically until 1:59 P.M., Wednesday, March 22, 2017. Information can be obtained by contacting William M. Bowling, Jr., Coordinator of Transportation, 900 Biglerville Road, Gettysburg, PA 17325 or call 717-334-6254 ext. 1263. 2 Bid Identification: All bids will be submitted electronically, and will be appropriately identified through the software provided. 3. Bidder s Response: All bid responses must be submitted electronically through District provided software and must be clearly identified with any changes, alternates or conditions noted. 4. Signature: A Completed Bid Proposal Special Conditions/Certification form must be filled out for each Bid, signed in ink by an authorized company representative giving his/her title and date and also a signed and notarized Non-Collusion Affidavit must be completed and mailed back to the District at: Gettysburg Area School District, Attention: Bill Bowling, 900 Biglerville Road, Gettysburg, PA 17325 (these forms are found under the District instructions tab in the Vendor Portal). These documents are due by April 7, 2017. 5. Bid Bond: The District reserves the right to require a bid bond or certified check in favor of GASD in the amount of 10% of the total purchase price to be enclosed with the bid. A bid bond is not required with this bid.
6. Bid Opening: Bids will be electronically opened and recorded at the GASD Administrative Offices, 900 Biglerville Road, Gettysburg, PA 17325, Telephone (717) 334-6254, 2:00 P.M., Wednesday, March 22, 2017. Any bid received after the time and date specified above shall not be considered. 7. Reservation: The District reserves the right to reject any or all bids or parts of the bids and may waive any informalities, technicalities, or irregularities, and to negotiate any corresponding escalation or de-escalation of items and/or price. Bids will only be accepted from qualified vendors as determined solely by the District, i.e., bidder must be normally engaged full-time in the business of supplying merchandise included in the bid. 8. Discrimination: The bidder shall agree to abide by the nondiscrimination provisions as set forth in Section 755 of the Public School Code of Pennsylvania as amended. 9. Human Relations Act: The provisions of the Pennsylvania Human Relations Act, Act 222 of October 27, 1955, the Commonwealth of Pennsylvania, prohibits discrimination because of race, color, religious creed, ancestry, sex, national origin, handicap or disability, by employers, employment agencies, labor organization, contractors, and others. The contractor shall agree to comply with the provisions of the Act as amended that are made part of this specification. Your attention is directed to the Commonwealth s nondiscrimination clause in 16 PA. 10. Quality Standards: The bidder is responsible to provide brand specified or equal unless stated otherwise on the bid document. Name brands are shown as a standard of quality and unless marked NO SUBSTITUTIONS, alternate of equal quality, features, etc. may be presented for consideration and must be clearly identified by catalog number on the bid response. Bidders are encouraged to provide a brochure; catalog cut and/or samples to assist in the evaluation of their bid. GASD representatives shall be the sole judge in making determinations as to the quality. 11. No Cash Allowances: No cash allowance for any purpose is included in the specifications of this project. 12. Time(s) of Completion of the Project: Delivery or installation of items or beginning services awarded may not commence before July 1, 2017. Delivery must be made no later than August 11, 2017, unless otherwise noted. Successful bidder must give GASD 48 hours notice prior to delivery. All prices quoted shall include the costs of inside delivery to the location specified with each bid. Training of GASD personnel in the operation and maintenance of the equipment must be provided by the successful bidder, if applicable, at the time of delivery. 13. Owners Compliance in Retaining Payments: If the District intends to retain percentage of the payment to the contractors throughout the duration of the project as outlined in Act 317 of 1978, the amount and length of time will be noted on the bid document. 14. Sub-contracts: The bidder shall not assign, transfer, or sublet bids without written approval by GASD. 15. Payment: Payment shall be approved upon receipt of the invoice and all unit(s) and service in a condition acceptable to GASD at its sole discretion where said payment has been approved by the Board of School Directors at its next regularly scheduled monthly action meeting.
16. Political Subdivision Procurement Interest Payment Act: Bidders that meet the criteria for certain qualified small businesses as defined in Act 138 of 1994 must provide written confirmation with their bid. 17. Law/Permits: The successful bidder shall be responsible for all cost and compliance with all laws, regulations, and permits of all local, state, and federal governments such as but not limited to Right to Know, AHERA, etc. The District is exempt from payment of Pennsylvania sales tax and Federal Taxes and said taxes shall not be included in the bid. All applicable laws shall be deemed to part of these specifications and the contract shall be enforced as though they were included. 18. Liability: Contractor will be responsible for any damage to property caused by contractor or his/her agents. Contractor further covenants and agrees to assume and does hereby assume all liability for, and shall and does agree to, indemnify and save harmless the District against any and all loss, costs, suits, claims, charges, or damages arising from injuries sustained by mechanics, laborers, workman, or by any person or persons, whatsoever, to their persons or property, whether employed in and about the said work or other side, by reason of any accidents, damages, or injuries, torts, or trespasses of the performance of this contract and the performance of said work and labor, including costs, counsel fees and all expenses of defense, and agrees to carry the usual property damage and liability insurance and to furnish certificates therefore, when required by the District. 19. Bid/Price Dates: No Bidder may withdraw his bid for a period of 90 days after the date set for the opening thereof. 20. Samples: The District reserves the right to require the bidder to ship sample amount(s) at the bidder s expense and to reject sample as not meeting specifications at its sole discretion and to require the bidder to remove sample unit at bidder s expense. 21. Alternates: Alternates must be clearly indicated on the bid response. 22. Non-Collusion Affidavit: The enclosed Non-Collusion Affidavit must be executed and mailed to Gettysburg Area School District, Attention: Bill Bowling, 900 Biglerville Road, Gettysburg, PA 17325. This is due by April 7, 2017. 23. Default: Nonconformance to the bid conditions or contract documents or purchase order shall result in the bidder being required to remove said item and redo or replace at no cost to the GASD. If bidder does not correct nonconformance within a specified time by GASD. GASD has the right to remove and/or replace with items or services from the open market and any cost shall be the responsibility of the bidder. 24. Bid Tabulations: Bid tabulations will be available after July 1, 2017. INSTRUCTIONS FOR NON-COLLUSION AFFIDAVIT 1. The Non-Collusion Affidavit must be completed, notarized and returned with all bids. 2. The member, officer or employee of the bidder who makes the final decision of prices, and the amount quoted in the bid must execute this Non-Collusion Affidavit. 3. Bid rigging and other efforts to restrain competition and the making of false sworn statements in connection with the submission of bids are unlawful and may be subject to criminal prosecution. The person who signs the affidavit should examine it carefully before signing to assure himself or herself that each statement is true and accurate making diligent inquiry, as necessary, of all other persons employed by or associated with the bidder with responsibilities for the preparation, approval or submission of this bid. 4.
